County Courthouse, Smithfield, NorthCarolina, with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, Freddie Adams, HowardBenton and Larry CastleberryMembers Absent NoneThe following business was transacted1 Approval of MinutesThe Board of Commissioners reviewed the minutes of the September 7, 14 and 21 boardmeetingsCommissioner Howard Benton moved that the minutes of the September 7, 14, and 21 boardmeetings be approved as recordedCommissioner Freddie Adams seconded the motion which was carried unanimously2 Deferred CompensationMr Frank Cranor, Account Executive, Deferred Compensation Corporation of North Carolina,met with the Board to explain the Deferred Compensation Plan Mr Cranor advised the Board thatapproximately 4,000 State employees are taking advantage of this plan and the corporation is nowallowed to offer it to the counties forconsideration Mr Cranor explained the Deferred Compensa-tion Plan would enable county employees to defer any portion of their salary up to 100 after socialsecurity and retirement deductions The employees money is deferred from current taxation until sutime as the money is taken out of the program It was emphasized that this is a savings plan for themployee that avoids immediate taxationAfter discussion the Board agreed to allow Deferred Compensation Corporation of NorthCarolina to draw up a plan for county employees to be further considered by the Board of Commissioner 3 Johnston County Wildlife Club - Wild Dogs - ResolutionAttorney Jim Levinson, representing the Johnston County Wildlife Club met with the Boardand presented the following resolutionFROM JOHNSTON COUNTY WILDLIFE CLUBTO JOHNSTON COUNTY COUNTY COMMISSIONERSWHEREAS, thi`Johrstan,-CQuntyWildlife Club is concerned over the loss to both domesticma °1 s`and wildlife by dogs, outs i d t1ie municipal limits of the various towns in Johnston County;a nd_WHEREAS, said damage is caused not only by mad, stray, or wild dogs, but also by dogswhich are allowed to roam at large at night by their owners; andWHEREAS, said Wildlife Club believes that the present laws in North Carolina General Sta-tute Chapter 67 are sufficient to remedy this situation, if adequately enforced; andWHEREAS, GS 67 -12 forbids any person from allowing his dog over six months old to run atlarge at nighttime unaccompanied by the owner or some other person; andWHEREAS, said laws made the owner of a dog liable for any livestock or fowls which it hasinjured; andWHEREAS, the County Dog Warden is limited in his duties due to the necessity of the largearea which he must cover and the limited budget available;BE IT HEREBY RESOLVED, that the Johnston County Wildlife Club urges and petitions theJohnston County Commissioners to render all assistance possible to the control and apprehension ofstray, mad, wild and unleashed unaccompanied dogs outside of the municipal limits of the varioustowns in Johnston County, particularly dogs running at large in the nighttime unaccompanied by anypersonIT IS FURTHER RESOLVED that the County Commissioners strengthen the enforcement ability othe County Dog Warden by providing him with sufficient funds with which to hire an assistant who migmake the rounds of the various communities during the daytime so as to free the County Dog Warden fopartial nighttime duties, including answering complaints and apprehension of dogs running loose inthe nighttime outside said municipal limitsThis 17th day of June 1976Clyde L GriggPresidentrrecognizing the acceptance and compliance of a plan hinges upon citizen involvement, we respectfullyrequest that representatives of the community with the participation of the WSSD commissioners, havea voice in the development and implementation of the planThe Board indicated they are ready to work with the West Smithfield area as a testingground for zoning and land use planning as the people in this area will be hurt without it After much discussion, Commissioner Frank B Holding moved that Ken Windley, County Plannerbe instructed to prepare a proposed land use plan and zoning ordinance for consideration by the WestSmithfield Sanitary District residents and that public hearings be held on the proposed land use andZoning OrdinanceCommissioner Freddie Adams seconded the motion which was carried unanimously9 West Smithfield Development Organization Recreation Grant RequestMr Harvey Evans, representing the West Smithfield Development Organization met with theBoard requesting a recreation grant in the amount of 1,680 for the development of a Community parkAfter discussion, Commissioner Freddie Adams moved that the West Smithfield DevelopmentOrganization request for a recreation grant in the amount of 1,680 be approvedCommissioner Howard Benton seconded the motion which was carried unanimously10 Automobiles for Sheriffs DepartmentKramer Jackson, County Administrator, advised the Board that the suggested purchasing ofState used cars is not at all satisfactory and recommended the purchase of five 1977 automobileswith an engine size of approximately 350 cubic inches, and to discontinue the use of State used carsThe Board authorized Kramer Jackson, County Administrator, and Commissioner Freddie Adamsto work out whatever they can in getting the Sheriffs Department some cars11 Flood Plain InsuranceKramer Jackson, County Administrator, advised the Board that EPA is prohibited by law frommaking any grant for acquisition or construction purposes in a flood hazard area unless the communityor county in which the project is located is participating in the Federal Flood Insurance Programand flood insurance is- purchased by the grantee Mr Jackson further explained that in the SmithfielSelma 201 area, two lift stations, one near the Neuse and one near Holt Lake, would be involvedThe potential loss in grant money is approximately 150,000 and Johnston County may be forcedintoenforcing the State Building Code, designating a building inspector, and issuing building permitsTim Broome, Ragsdale Engineers, is checking with EPA to determine if we might purchase flood insurancon our own for the lift station sites involvedThe Board of Commissioners discussed this brieflyCommissioner Frank B Holding absent for afternoon session12 County Purchases Neuse Production Credit BuildinAfter negotiations and discussions regarding the purchase of the Neuse Production Creditbuilding, Commissioner Howard Benton moved that the County of Johnston purchase this building onJohnson Street adjacent to the Johnston County Tax Collectors Office fora price of 85,000Commissioner Benton further moved that 35,000 be transferred from unencumbered cash to supplementthe amount of 50,000 already budgeted for the purchase of this buildingCommissioner Freddie Adams seconded the motion which was carried unanimously13 Employment Security Commission Request Additional Office SpaceKramer Jackson, County Administrator, advised the Board that the Employment Security Commission has asked the County for additional space in the Employment Security Office Building which waspreviously occupied by the Department of Social Services, Food Stamp Program Mr Jackson told theBoard that this office badly needs more space and he had asked the Town of Smithfield to pay 7500of the 20000 a month increase for the Employment Security CommissionAfter discussion, Commissioner Freddie Adams moved that the County agree to rent the addi-tional space for the Employment Security Commission at 20000 a month, provided that the Town ofSmithfield shared in the cost by paying 7500 a monthCommissioner Larry Castleberry seconded the motion which was carried unanimously14 Resolution - 201 FacilityUpon a motion by Commissioner Howard Benton, duly seconded by Commissioner Larry Castleberrand carried unanimously, the following resolution was adoptedWhereas, the North Carolina Clean Water Bond Act of 1971 has authorized the making of grantto aid eligible units of government in financing the cost of construction of wastewater treatment wor ,wastewater collection systems, and water Account of the Clean WaterFund for step grants for wastewater treatment works projects, andWhereas, Title II of the Federal Water Pollution Control Act Amendments of 1972 PL92 -500 USC 1251 et seg authorized the award of step Federal Construction Grants for waste treat-ment works, andWhereas, the County of Johnston intends to request State and Federal grant assistance to idin Step III for the first phase facilities as set forth in the Smithfield -Selma Area Section 201Faci 1 i,ti es Plan;NOW THEREFORE, BE IT RESOLVED, BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF JOHNSTONThat the County of Johnston will arrange financing for all remaining costs of theproject if approved for State and Federal grant awardsThat the County of Johnston will adopt and place into effect on or before completionof the project a schedule of fees and charges which will provide adequate funds forproper operation, maintenance and administration of the systemThat the County of Johnston will provide for efficient operation and maintenance ofthe project on completion of construction thereofThat Mr M Kramer Jackson, County Administrator, and successors so titled, ishereby authorized to execute and file a Step III application on behalf of theCounty of Johnston with the Environmental Protection Agency and the State ofNorth Carolina for grants to aid in the construction of the project describedaboveThat Mr M Kramer Jackson, County Administrator, and successors so titled, ishereby authorized and directed to furnish such information as the appropriateFederal or State agencies may request in connection with such applications or theproject; to make the assurances as contained above, and to execute such otherdocuments as may be required in connection with the applications15 Revaluation RecommendationsKramer Jackson, County Administrator, presented recommendations for the county revalua-tionto the Board for study and consideration16 Princeton Community Building - Recreation Grant Request ApprovedCommissioner Freddie Adams moved that the recreation request from Princeton CommunityBuilding for 1976 -77 in the amount of 3,00000 be approvedCommissioner Howard Benton seconded the motion which was carried unanimously17 Benson Rescue Squad - AmbulanceAfter several meetings and discussions with county Rescue Squad members regarding thepriority of rescue squads needing ambulances and a letter from the county association president recom-mending an ambulance for the Benson Rescue Squad, as it is in greater need than Clayton or Princeton,Commissioner Howard Benton moved that the county appropriate 12,500 to assist the Benson Rescue Squadin purchasing a new ambulance this yearThe Board has previously appropriated funds for Clayton and PrincetonCommissioner Freddie Adams seconded the motion which was carried unanimously18 Road Petition - Secondary Road # 1146The Board received a road petition from property owners on Secondary Road # 1146, IngramsTownship, requesting that this road be pavedCommissioner Howard Benton moved that this petition be forwarded to the North CarolinaDepartment of Transportation, Division of Highways, Wilson, North Carolina, with the Boards recommen-dation for considerationCommissioner Freddie Adams seconded the motion which was carried unanimously19 Paving - Parking Lot —Department of Social ServicesMr Jackson advised the Board that he had recently learned there is a possibility ofgetting a 100 grant to pave the parking lot at the Department of Social ServicesCommissioner, Howard Benton moved that Kramer Jackson, County Administrator, be authorizedto find out more about this grant to pave the parking lot at the Department of Social ServicesCommissioner Freddie Adams seconded the motion which was carried unanimously97620 Christmas HolidaysCommissioner Larry Castleberry moved that the Christmas Holidays be designated as Thursday,December 23rd and Friday, December 24th for all county employeesCommissioner Howard Benton seconded the motion which was carried unanimously21 Bids on Pick -up TruckKramer Jackson, County Administrator, advised the board he had received only two bids forthe pick -up truck for the Maintenance DepartmentTheBoard instructed Mr Jackson to readvertise22 Johnston County 4 -H Request for Recreation GrantWilliam Clayton, 4 -H Extension Agent, met with the Board and renewed the Johnston County4 -H Club recreation grant request for a 48 passenger activity bus Mr Clayton explained therecreation program in detail, stating how the 4 -H program can grow in many areas with the properinvolvement and leadership and proper emphasis on 4 -H Recreation Leisure EducationThe Board discussed this request at length and thanked Mr Clayton for the fine job he isdoing with the County 4 -H ProgramThe Board deferred action on this request at this time23 Recreation Grant Request - The Home That CaresMr R G Gurley met with the Board of Commissioners representing The Home That Cares ofSelma, N C, in regards to its recreation grant request The Board inquired as to the owner ofthe property where The Home That Cares is located Mr Gurley explained this property is owned byGurley, Inc and leased indefinitely to The Home That Cares Mr Gurley also explained that withthis facility he is trying to establish environmental changes for the neighborhood youthThe Board deferred action on this request at this time24 Supplement - Secondary Road Program 1976 -1977Mr Paul Anderson, District Engineer, with the Division of Highways, North Carolina StateDepartment of Transportation and Highway Safety, appeared before the Board of County Commissionersand presented a supplement to the Secondary Road Program for 1976 -1977, Johnston County, for StageConstruction of Secondary Road # 2529After reviewing with Mr Anderson the stage construction of Secondary Road # 2529 WO6312208 for clearing, grubbing, drainage partial grading, Commissioner Freddie Adams movedthat this work order in the amount of 60,20000 be approved as presentedCommissioner Howard Benton seconded the motion which was carried by the following voteaye, Commissioners Freddie Adams, Howard Benton and Larry Castleberry,Nay None25 Coastal Plains Grant - ReportKramer Jackson, County Administrator, advised the Board that he had received informationfrom John Booth, Department of Administration, that his office is not recommending funding of theKenly Waterline with a Coastal Plains Regional Commission grant The reason for not recommendingthe grant is 1 the amount of Coastal Plains funds have been reduced and 2 Johnston TechnicalInstitute has received a 250,000 Coastal Plains GrantMr Jackson further advised the Board that the State has 784,000 EPA 304 discretionarymoney to be matched with 196,000 State appropriated money for a total of 980,000, and the Depart-ment of Administration is recommending to the Governor that 387,000 of this amount be granted toJohnston County for the Kenly waterline26 Hospital Request for ComputerKramer Jackson, County Administrator, advised the Board that the hospital would like topurchase a 130,000 computer but does not have the money The hospital wants to know if thecounty is willing to advance the 130,000 and allow the hospital to reimburse the county monthlyMr Jackson recommended that the Board might like to discuss this with Mr Lloyd Gilbert,Administrator, Johnston Memorial Hospital27 , Dog VaccineKramer Jackson, County Administrator, advised the Board that Dr Swearingen had earlierrequested permission to order dog vaccine during the month of September in order to take advantageof a 12 discount and Dr Swearingen had assured him that the firm is a well established firm withan excellent reputation Mr Jackson informed the Board that he had recommended that Dr Swearingenorder the vaccine with the understanding that should the Board object, the county could cancel theorder232be28, Summons - Suit Against CountyKramer Jackson, County Administrator, advised the Board of Commissioners that the counhas been served with a summons from Federal Court to be answered within 20 days in reference to theautomobile accident involving a deputy sheriffThe Board turned this summons over to the County AttorneyUpon a motion by Commissioner Freddie Adams, duly seconded by Commissioner Larry
