September 2, 1975The Johnston County Board of Commissioners met in regular session in the Commissioners Roomof the Johnston County Courthouse, Smithfield, North Carolina, Tuesday, September 2, 1975, at 10oclock am, with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, Freddie Adams, Howard Bentonand Hoyt CastleberryMembers Absent NoneCommissioner Hoyt Castleberry opened the meeting with prayerThe following business was transacted1 Mobile Home Ordinance - Complaint - Jimmy HortonMr Jimmy Horton, Route #_1, Zebulon, N C, appeared before the Board with a complaintregarding the Mobile Home Ordinance and the Code Enforcement Officer Mr Horton advised the Boardthat he was visited by the Code Enforcement Officer at night around 8 oclock pm, this visit theonly one to his knowledge, and told what he would have to do in order for his Mobile Home to meet therequirements of the Johnston County Mobile Home and Mobile Home Park OrdinanceMr Horton told the Board that he did not like this ordinance, however, would have to abideif it was law, nor did he like the attitude of the Code Enforcement Officer, Mr Strickland MrHorton stated that at this time, he is not financially able to anchor his trailer or make any otheradjustments that would be of any expense to him, since he is recuperating from surgery and will beout of work for several weeksThe Board talked with Mr Strickland and he advised that he had been by Mr Hortons before,but was unable to find anyone at home, and further that he tried to explain this ordinance to MrHorton as best he could He advised him of what he needed to do to his mobile home in order to complywith the ordinance regulations and what period of time he had in which to get it doneThe Board discussed this matter at length with Mr Horton and Mr Strickland, after which MrHorton requested an extension of time to get his trailer in order to meet the requirements of theMobile Home OrdinanceThe Board granted Mr Horton an extension of sixty days, and further advised him that if thisshould work any hardship to come back to the Board2 ReportsThe following reports were filed with the BoardKramer JacksonL P CreechBobby CorbettHarper GodwinC W TarltonRubert C BarbourExpendituresVeterans OfficeElectrical InspectorTax CollectorExtension ChairmanDog Warden112September 2, 1975 ContThe Board, at this time, talked with Mr Tarlton, County Extension Chairman, regardinganother tree program and asked him to get more trees such as fruit pear, apple, pecan and fig3 T E Ricks - Secondary Road Councilman Secondary Road Program for 1975 - 1976Mr T E Ricks, Secondary Road Councilman, North Carolina State Highway Commission, FourthDistrict, met with the Board and explained the 1975 -1976 Secondary Road Program Mr Ricks advisedthe Board that the State Secondary Road Program for 1975 -1976 was allocated 30,000,000 statewide,and Johnston Countys pro -rata share was 311,0004 Mr Ricks further explained that with the 15withheld for contingency if this 15 is not used it remains in Johnston County and is programmedat the end of the fiscal year it would leave approximately 250,000 for construction in JohnstonCounty Mr Ricks also discussed with the Board Senate Bill 166 and House Bill 575 Senate Bill166 - subdivision street standards and House Bill 575 - county assessment for subdivision streetsThe Board discussed this program at length with Mr Ricks, Mr Paul Anderson, DistrictEngineer and Mr David Roberts, Division Engineer, who appeared with Mr RicksMr Paul Anderson, District Engineer, with the Division of Highways, North Carolina StateDepartment of Transportation and Highway Safety, appeared before the Boardof;Commissionerssand;pre-sented the Secondary Road Program for Paving for 1975 - Presented to Board of Commissioners by Planning BoardMr Norman Grantham, Chairman,Mr R L Holt, Member, Johnston County Planning Board andKen Windley, County Planner, met and presented to the Board for consideration and adoption thefinal draft of the Johnston County Subdivision Regulations adopted by the Planning Board August 20,1975The Board reviewed and discussed the Subdivisions Regulations with Mr Grantham and MrWindley and advised that they needed more time for consideration and study before making a decisionon these regulations5 Grand Jury OfficerRequest Pay RaiseMr W A Byrd, Grand Jury Officer, appeared before the Board and requested consideration bythe Board of Commissioners for a pay raise Mr Byrd stated that he is being paid 1200 per dayAfter discussion, Commissioner Hoyt Castleberry moved that the Grand Jury Officers salarybe increased to 1500 per dayCommissioner Frank B Holding seconded the motion which was carried unanimously6 Jury Commission - AppointmentCommissioner Freddie Adams moved that Mr L J Worthington of Princeton be reappointed tothe Johnston County Jury Commission for a term of two years effective September 1, 1975Commissioner Frank B Holding seconded the motion which was carried unanimously?, JSeptember 2, 1975 Cont7 Appointment of Hospital Board Members - DeferredThe Board of Commissioners again discussed the appointment of the Johnston Memorial HospitalBoard of Trustee member vacancies, however, deferred action for another fifteen 15 daysThe Board received a letter of resignation from Board of Trustee member Ralph Medlin effectiveOctober 1, 1975 The Board accepted this resignation with regrets8 Selma NDP LotKramer Jackson, County Administrator, reminded the Board that they deferred action on August19, 1975, on the Selma NDP lot, however, no action was taken at this timeCommissioner Frank B Holding indicated that he would contact Colonel Collings, Selma TownManager, regarding this matterI 9 Solid Waste OrdinanceKramer Jackson, County Administrator, talked with the Board again regarding the JohnstonCounty Solid Waste Ordinance proposed for adoption by the Johnston County Health DepartmentThe Board of Commissioners agreed that Johnston County is not ready for this ordinance anddeferred action at this time10 Discussion - Massage Parlor OrdinanceThe Board discussed an ordinance regulating Massage Parlors, if and when established in theCounty Mr Jackson advised the Board that he had requested ordinances from Harnett, Wayne andDurham Counties to studyThe Board asked W R Britt, County Attorney and Kramer Jackson, County Administrator, todraft an ordinance for Johnston County11 Burial of Foster ChildrenCommissioner Howard Benton advised the Board that the Social Services Board had asked him totalk with the Board of Commissioners regarding the burial expenses of county foster childrenThe Board discussed this matter and agreed they should not take any action at this timeThey expressed that a-situation-of thisnature, seems to take care of itself12 Approval of MinutesThe Board reviewed the minutes of the August 4 and August 19, 1975, board meetingsCommissioner Howard Benton moved that the minutes of the August 4 and August 19, 1975, boardmeetings be approved as recordedCommissioner Frank B Holding seconded the motion which was carried unanimously13 Lab Technicians at Health Department RequestedKramer Jackson, County Administrator, talked with the Board regarding lab technicians neededat the Health Department Mr Jackson told the Board that Dr Pomerans and Helen Ray had advisedhim that lab technicians at the Health Department would bring in enough Medicaid revenue to compensatethe salaries through June 30, 1976The Board discussed this matter and related that it should be discussed with the hospital andapproved by the Board of Health, before they made any final commitments on hiring lab technicians atthe Health Department14 Matrons for County JailKramer Jackson, County Administrator, advised the Board that Sheriff Wood had again approachedhim requesting that the County hire three matrons with CETA funds to be on call duty for work in theCounty Jail The Board discussed this matter and Mr Jackson explained that matrons are required bylaw for County JailsAfter further discussion, Commissioner Freddie Adams moved that Sheriff Wood be authorized toretain three matrons for the County Jail for stand, by duty call duty to be paid on an hourly basiswith CETA funds through June 30, 1976Commissioner Frank B Holding seconded thel,motion which was carried unanimously114September 2,1975 Cont15 Agreement - County of Johnston and Board of Transportation - State of North CarolinaUpon motion by Commissioner Freddie Adams, duly seconded by Commissioner Frank B Holdingand carried unanimously, Chairman Denning was authorized to execute the following agreement betweenthe County of Johnston and the Board of TransportationSTATE OF NORTH CAROLINACOUNTY OF JOHNSTONTHIS AGREEMENT, made and entered into this the 27th day of August, 1975, by and between theCounty of Johnston, Grantors, of the State aforesaid, and the BOARD OF TRANSPORTATION, an agency ofthe State of North Carolina, Grantee;W I T N E S S E T HTHAT WHEREAS it is mutually agreed between the parties hereto that the Grantee, may use anarea owned by Johnston County, for a period of 15 years from the date hereinabove written for thepurpose of hauling material from land lying to the northeast of the Johnston County tract, belongingto Robert Lee Holt; said area over which the Board of Transportation shall have full right of ingressand egress is described as follows Being an area 15 in width on each side of the following describesurvey line Beginning on a point lying in the centerline of SR -1503 said point is approximately050 miles northeast of the interseciton of SR -1503 and NC 210; thence north 77 degrees 14` east71930 to a point; south 85 degrees 14 east 30030 to a point; thence north 83 degrees 31 east30000 to a point; thence north 57 degrees 11 east 84661 to a point; thence north 43 degrees 10east 180 to a point, said area containing approximatley 124 acres Shown on sketch attached heretoThe above described area is located in Smithfield Township, Johnston County and is a portionof that tract of land recorded in Deed Book E -3 at page 1 Land Division E Page 305 of the JohnstonCounty RegistryThe Grantors covenant that they are the sole owners of said land in fee; that they are theonly persons having the right to execute this agreement; and it is agreed between the parties heretothat the sum of one dollar 100, receipt of which is hereby acknowledged is fair and justcompensation for the full right of ingress and egress as described aboveNOW THEREFORE, for and in consideration of the premises and payment of the sum hereinaboveset out, Grantors do hereby give, grant, bargain and convey unto Grantee, its successors and assigns,for the term set out above, the right of ingress and egress as described aboveIN WITNESS WHEREOF, the Grantors have hereunto set their hands and seals the day and yearfirst above writtenCOUNTY OF JOHNSTONBY Norman C Denning SEALChairmanCounty Board of CommissionersATTEST BY Eleanor N CreechClerkAPPROVED AS TO FORM LEGALITYStaff Attorney, Department of Justice16 Heating and Air Conditioning -
