February 3, 1975 - Regular1 4Fit width,46The Johnston County Board of Commissioners met in regular session in the Johnston CountyCommissioners Room, Courthouse, Smithfield, North Carolina, Monday, February 3, 1975, at 10 oclockam, with the following members presentNorman C Denning, Chairman, Frank B Holding, Freddie Adams, Howard Benton and HoytCastleberryII Members Absent NoneThe meeting was called to order by the chairman, Commissioner Hoyt Castleberry opened themeeting with prayerThe following business was transacted1 Lease Extended County Property on North StreetKathy Lancaster met with the Board of Commissioners and asked the Board to consider extendinher lease on the County property she has leased at 19 North Street, Smithfield, North Carolina, whershe operates a day nurseryCommissioner Howard Benton moved that this lease be extended for a period of six 6 monthsCommissioner Hoyt Castleberry seconded the motion which was carried unanimously2 Minutes ApprovedThe Board of Commissioners reviewed the minutes of the November 19, December 2 and 11, andJanuary 6 and 21, board meetingsCommissioner Howard Benton moved that the minutes of these meetings be approved as recordedCommissioner Hoyt Castleberry seconded the motion which was carried unanimously3 Planning Board Meets With Board Regarding Mobile Home and Mobile Home Park OrdinanceMr N B Grantham, Chairman, and Mr M A Morgan, member, Johnston County Planning Board,and Leon Powell, Sanitarian, Johnston County Health Department,met with the Board of CountyCommissioners to further discuss the Mobile Home and Mobile Home Park Ordinance Some of theregulations in this ordinance are being contested by mobile home park owners, these boards meetingtogether to try to resolve some of these problems and consider the possibility of some recommendedchanges that might need to be made in this ordinance The 15,000 square feet per trailer, if servedby septic tank, being the main objection by the park ownersalimFebruary 3, 1975 ContMrs Thorne Reynolds, a mobile home park owner, was also present at this meeting and statedthat the requrment of 15,000 square feet was very impractical and would put most mobile home parkowners out of businessNorman B Grantham pointed out that this ordinance still provided for mobile homes to be on lotof 5,000 square feet if the park is served by a community water and sewer systemThe Board of Commissioners and these representatives discussed this ordinance at length, tryingto consider the responsibility of the County, the Planning Board and also to protect the mobile homepark ownersIn discussion of this ordinance the Board of County Commissioners had advised the Mobile HomePark owners that they would not make any corrections or changes in this ordinance without consultationwith the Johnston County Planning Board However, the Board did agree that it would ratify any changesrecommended by the Planning Board after they reviewed it at a meeting scheduled for Wednesday,February 5, 1975The Board of Commissioners agreed that the County needed some kind of ordinance and a rathertight oneAfter this lengthy discussion, Commissioner Frank B Holding moved that the effective date ofthe Mobile Home and Mobile Home Park Ordinance be postponed until March 1, 1975, in order for thePlanning Board to have time to review and make recommendations for any changes if any to the BoardOf CommissionersCommissioner Freddie Adams seconded the motion which was carried unanimously4 State Water Grants Clean Water Bond MoneMr Paul Parks, State Director, FHA, and Mr J Livingston Jones, Supervisor, Water SupplyGrants Unit, State Division of Health Services, along with Tom Moore, Tim Broome and Gene Cobb ofRagsdale Engineers, met with the Board of County Commissioners to discuss the possibility of availablegrants for the construction of water line or water supply systems in Johnston CountyThe Board discussed this funding and priority of projects in the County at the present time,first the Smithfield - Four Oaks Water Line, this project already planned by the engineers and awaitingapproval of the Board of Commissioners to receive bids, however, county funds are not available at thistime for this project, but the County has approval of a Clean Water Grant of approximately 150,000The next priority discussed was a link from Smithfield to Clayton and the possibility of CleanWater Grants to help finance this projectMr Parks advised the Board that FHA makes loans to qualifying counties of about 5 up to 40years Mr Jones advised the Board that 213,066 was remaining in Johnston Countys allocation ofClean Water Grant money that could be used for the Clayton water line, if the application was filedin time, with no other applications pending, or filed prior to the Clayton application Mr Jonesfurther stated that there was a possibility of additional clean water money, some grant money thatmight be returned to the State unused, if so this money will revert back into the State fund forreallocationMr Jones advised that there are no pending applications from Johnston County at this time,and the County could receive the grant money remaining in Johnston Countys allocation if it gets anapplication in and approved within the required time periodThe Board feels that the County should be prepared to take advantage of any available grantfunds for Johnston County, however they took no official action on making applications for any grantsat this time5 County Planner DiscussedN B Grantham, Chairman, Johnston County Planning Board, advised the Board that the JohnstonCounty Planning Board is recommending the employment of Mr Kenneth Windley, as a Planner for JohnstonCounty Mr Grantham stated that Mr Windley was Assistant Planner for Cobb County in Georgia,originally from Carteret County and a graduate of East Carolina UniversityThe Board advised Mr Grantham that they would like to interview Mr Windley at the March 3,11975, meeting and asked Mr Jackson to contact him6 Sewer Wastewater Grant Accepted by County to Smithfield - Wilsons Mills Junior HighCommissioner Howard Benton moved that the following resolution be adoptedWHEREAS, by a pervious resolution dated September 3, 1974, the County of Johnston has agreedto construct a wastewater collection system project consisting of a sanitary sewer line to serve theSmithfield- Gilsons Mills Junior High School, andWHEREAS, on January 28, 1975, the County of Johnston received a Clean Water Bond grant offerin the amount of 23,200 for said project, which is 25 per -cent of the cost of said project,NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF JOHNSTONThat the County of Johnston accepts the grant offer and acknowledges that the assurances includein Part A of the grant offer will behonoredThat Norman C Denning, Chairman of the Board of Commissioners and authorized representative,48is hereby authorized to execute the Offer and Acceptance DocumentAdopted this 3rd day of February, 1975, at Smithfield, North CarolinaNorman C Denning, ChairmanJohnston County Board of CommissioneBentonCommissioner further moved however, that this grant acceptance is not to obligate the Countyin any way to construct this sewer lineCommissioner Hoyt Castleberry seconded the motion which was carried by the following voteAye Commissioner Howard Benton, Commissioner Hoyt Castleberry and Chairman Norman CDenningNay Commissioner Freddie AdamsAbstaining Commissioner Frank B Holding7 Doug Carter - Local Government CommissionDoug Carter, Deputy Secretary, North Carolina Local Government Commission, met with the Boardof County Commissioners and advised that the Local Government Commission had been working with MrJackson, County Administrator, for several weeks and the County Accounting System had been up -datedand was working very well at this time Mr Carter also talked with the Board about an ImpressedPayroll Account, this would be a separate bank account for the payroll, with checks designated forjust the payroll account, with the checks written and accounting done in the Finance Office Thissystem would save time in preparing the payroll for county employeesMr Carter further talked with the Board of Commissioners about considering a single levy ofad valorem tax for Johnston County for the next fiscal year Mr Carter fully explained the procedureof a single levy tax which would consolidate all levies except any special district tax This wouldroute all money into the County General Fund and monies would be appropriated to the differentdepartments as needed to operate, giving the General Fund more money to invest to earn interest forthe CountyCommissioner Frank B Holding indicated by expression that he liked the separate levy, as hefeels it gives more control of annual budget appropriationsThe Board took no action on this matter at this time, however, the Board of Commissionersexpressed their appreciation to Mr Carter for his assistance in these matters8 ReportsThe following reports were filed with the Board of CommissionersHarper Godwin Tax CollectorL P Creech Veterans Service OfficerBobby Corbett Electrical InspectorArthur Goetz Library DirectorRubert C Barbour Dog Warden9 Workmens Compensation County Employees Discussed by Sheriff and County Sheriffs CarSheriff Aaron Wood met with the Board of Commissioners and talked with the Board regardingWorkmens Compensation for County employees Sheriff Wood also advised the Board that he had turnedthe County Station Wagon over to the new deputy from Clayton, Kenneth Eatman, there is not a car available for Mr Eatman at this time Mr Eatman is the llth deputy for the Johnston County SheriffDepartment There was discussion by the Board regarding the employment of this 11th deputy, SheriffWood indicated that it was his understanding from the Board, at an earlier meeting, that he couldemploy this person if his budget permitted, the Board stated that they did not take any officialaction on this matter, however it was discussed at a Board meeting regarding his personnel, and theyconcurred with Sheriff Woods understanding regarding this matterThe Sheriff also wanted to know, if he had to get the Boards permission to employ personnelin his department if he had the money appropriated in his budget The Board of Commissioners advisedthe Sheriff that itIwas the Countys policy and he would need to talk with the Board regarding theemployment of personneli10 Madie Bridges Road Wilsons MillsThe Rev Madie Bridges met with the Board regarding a private road in Wilsons Mills MrsBridges advised the Board that she could hardly get in and out, this road was in such bad conditionThe Board explained to Mrs Bridges that the county did not maintain any roads, all secondary roadsare maintained by the State, and even the State could not maintain a private road Mrs Bridgesexplained that she would like toget this road on the secondary road system, if she could get someof the property owners to cooperate Mr Paul Anderson, District Engineer, came in the meeting atthis time, and talked with Mrs Bridges about this road Mr Anderson stated that he knew the roadand the situation that Mrs Bridges was confronted withiThe Board of Commissioners and Mr Anderson told Mrs Bridges they would contact propertyowners on this road and see what could be done to help with this problemiIiiFebruary 3, 1975 ContThe Board of Commissioners and Commissioner Frank B Holding also advised Mrs Bridgesthat they would be glad to help in any way possible Commissioner Holding to talk with some of theproperty owners to help get this road on the secondary road system for maintenance11 Additional Grant - Emergency Employment Program ManpowerKramer Jackson,County Administrator, advised the Board that Ames Christopher, ManpowerCoordinator, had advised that Johnston County has been granted an additional 63,895 to be usedin the Emergency Employment Program, this making a total grant of 178,443 for this programMr Jackson stated to the Board that he had to advise Mr Christopher immediately if JohnstonCounty would accept this additional grantThe Board of Commissioners discussed this additional money and it was their feeling that theCounty should accept this grant and use it for the employment of a County Maintenance crew, that couldwork for the County and be loaned to various county agencies as neededCommissioner Frank B Holding moved that Kramer Jackson, County Administrator, be instructedto notify Mr Christopher, Manpower Coordinator, that the County of Johnston will accept and administerthe additional Manpower Emergency Employment Grant II14 Request for Tax Listing ExtensionsKramer Jackson, County Administrator, advised the Board of request from businesses andproperty owners for tax listing extensions for listing their 1975 taxes Mr Jackson also explainedto the Board that the law requires a written request seven 7 days prior to the tax listing deadline,and extensions not to exceed March 31, 1975, if businesses can show just cause for needing extendedtimeCommissioner Hoyt Castleberry moved that Kramer Jackson, County Administrator, be authorizedto use his judgement to determine if extension requests are justified, if so, to grant these requestfor tax listing extensions not to exceed March 31, 1975Commissioner Howard Benton seconded the motion which was carried unanimously15 Audit of Cutter Laboratories Water Facility Required To Receive Clean Water Bond GrantCommissioner Frank B Holding moved that Norman C Denning, Chairman, be authorized to executthe contracts from Daniel G Matthews, CPA, for audit of the Cutter Laboratories water facility in ordeto receive the Clean Water Bond Grant award to the projectCommissioner Hoyt Castleberry seconded the motion which was carried unanimously16 County Code Enforcement Officer EmployedKramer Jackson, County Administrator, reported to the Board that Mr Wayne Strickland hadbeen employed as County Code Enforcement Officer under the Emergency Manpower Employment Program andwould be furnished office space at the County Health DepartmentUpon motion by Commissioner Hoyt Castleberry, duly seconded by Commissioner Frank B Holdingthe Board recessed until Tuesday, February 18, 1975, at 7 30 PMJNorman C Denning, ChairmanEleanor N Creec , ClerkCommissionerHoward Benton seconded the motionwhich was carried unanimously12 Budget AmendmentCommissionerFrank B Holding moved that the following budget amendment be adoptedTRANSFER FROM 10- 813 -00 Contingency -
