The Johnston County Board of Commissioners met in special session in the CommissionersRoom of the Johnston County Courthouse, Smithfield, North Carolina December 16, 1975, at 730pm with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice- Chairman, Howard Benton, FreddieAdams, and Hoyt Castleberry Commissioner Frank B Holding arrived at approximately 9 oclockMembers Absent None11 Commissioner Hoyt Castleberry opened the meeting with prayerThe following business was transacted1 Secondary Road Program 1975 -1976December 16, 1975Meeting of Board of Commissioners for the County of JohnstonRESOLUTION,Mr T E Ricks, Councilman, and Mr Paul Anderson, DistrictEngineer, with the Division of Highways, North Carolina State Departmentof Transportation and Highway Safety, appeared before the Board ofCommissioners and presented the Secondary Road Program for StateConstruction survey and right of way and Paving for 1975 - 1976After reviewing with Mr Ricks and Mr Anderson the proposedconstruction and paving program for 1975 - 1976, Commissioner FreddieAdams moved that the following resolution be adoptedWHEREAS, The Board of County Commissioners of Johnston Countyhave received from Mr Ricks and Mr Anderson the Secondary RoadProgram for construction and paving for 1975 - 1976 as presented byMr Ricks and Mr Anderson, said roads being a part of the systemmaintained by the North Carolina State Department of Transportationand Highway Safety;AND WHEREAS, after careful- consideration of the servicesrendered by said roads and the traffic demands of said County, it isdeemed necessary that said roads be improved, in order to better servethe interest of the people of the County;NOW THEREFORE, BE IT RESOLVED that the Board of Commissionersof Johnston County hereby approve and request that the North CarolinaState Department of Transportation and Highway Safety make the followingimprovements in said roads listed142December 16, 1975 ContSECONDARY ROADS PROGRAMJOHNSTON COUNTYWilsons Mills Volunteer Fire DepartmentNOTE Pr # 5 SR 1302 unable to secure Right of Way1,400Commissioner Howard Benton seconded the motion which was carried unanimously2 Road Petition - Paving 13111,40000TOTAL 45,99372A road petition was presented to the Board of Commissioners by the Clerk from propertyowners on Secondary Road # 1311, requesting that this road be pavedAfter review of this petition, Commissioner Howard Benton moved that the petition beforwarded to the North Carolina State Department of Transportation and Highway Safety for considera-tionCommissioner Hoyt Castleberry seconded the motion which was carried unanimously3 Micro Request Financial Aid Land PurchaseMayor Ray Woodard, Carl Smith and Wayne Vann, Councilman from Micro met with the Boardrequesting financial help from the County to purchase approximately an acre of land from SeaboardRailroadMayor Woodard told the Board that the Town of Micro would like to develop the land intoa public park facility, but are financially unable at this time to purchase the property MayorWoodard further stated that they hoped the County could appropriate some of the Revenue Sharingfunds allocated for recreation to the Town of Micro for the purchase of this property Mayor Woodardalso explained that the Railroad Company had onl_4 given them 30 days to make a decision and theyonly have two weeks to notify them of their decisionAfter discussion, Commissioner Howard Benton moved that the County award 2,000 to theTown of Micro to be used to purchase approximately one acre of land from Seaboard Railroad to bedeveloped into a public park facilityCommissioner Benton further moved that the Town of Micro is expected to invest an addition-al 1,334 40 of the total toward the development of the park during the Calendar Year 19764 George Cuddington RequestGeorge Cuddington of Smithfield appeared before the Board and advised the Board that histruck had been stolen and driven to North Plainsville, N J by a prisoner that escaped from theJohnston County Jail Mr Cuddington told the Board that he had driven to N J and towed his truckback to Smithfield and felt that the County should reimburse him for his expenses incurred in theamount of 30385Mr Cuddington further advised the Board that the prisoner had been released in New Jerseybecause the authorities there could not hold him as no papers had been sent from Johnston County,which he thought was negligence on the part of the Johnston County Sheriffs DepartmentThe Board discussed Mr Cuddingtons request and advised him that they would like to talkwith the Sheriff before making a decision and would take his request under immediate advisement5 Mayor Wallace - Lee Community Action - Out -of- County VanThe Board received a letter from Paul Keller, Director, Johnston - Lee Community Actionadvising that he has authorized J London Creech to drive the Out -of- County van home at night becausethey have had three batteries stolen in two months in spite of the fact they have kept the van lockedin a fenced area every nightThe Board discussed the matter and asked Commissioner Howard Benton to talk with MrKeller10 Letter of Appreciation - Kenly Kiwanis ClubThe Board acknowledged receipt of a letter of appreciation from the Kenly Kiwanis Club,for the countys support and grants for recreation projects from revenue sharing funds11 Delinquency Prevention and Youth Services House Bill 456Kramer Jackson, County Administrator, advised the Board of House Bill 456 which createdtheTechnical Advisory Committee on Delinquency Prevention and Youth Services Committee to aid thecounties in developing community based programs to serve as alternatives for the placement of delin-quent juveniles in training schools House Bill 456 requires that each county wishing to participatein the program offered under the Act conduct an assessment of the youth needs within the countyand appoint a task study force by January 1, 1976Mr Jackson further explained that a letter or resolution from the Board of Commissionersnotifying the Department of Human Resources that the county is interested in participating in theprograms offered by the Act will be sufficient to comply with the January 1, 1976 deadlineAfter discussion, the Board authorized the Chairman to notify the Department of HumanResources that Johnston County is interested in complying with Chapter 929 House Bill 456 of the1975 Session Laws relating to Juvenile delinquency prevention and community based servicesSfl d -12 Right of Way Encroachment Agreement Sewer Line - Wilsons Mills Junior HighThe Bo authorized the Chairman to sign the Right of Way Encroachment Agreement for theSewer line to the Wilsons Mills Junior High School13 Four Oaks Public Library ConstructionThe Board received correspondence from the Four Oaks Library Board requesting permissionto serve as their own general contractor in order to take advantage of some free labor and some 144December 16, 1975 Contdiscounts on materials for the construction of the new public library facility in Four OaksThe Board granted the request and asked Kramer Jackson, County Administrator to adviseMr James Bryan Creech of Four Oaks by letter of their decision14 Four Oaks Fire Department Purchases TruckThe Board of Commissioners was advised that the Four Oaks Fire Department had made applica-tion to the FHA for financial assistance to purchase a fire truck for the Four Oaks Voluntary FireDepartmentBy motion by Commissioner Frank B Holding, duly seconded by Commissioner Freddie Adamsand carried unanimously the Board agreed that the purchase of the proposed fire truck for the FourOaks Voluntary Fire Department is consistent with Johnston Countys plans15 Budget Amendment - Social Services Title IV -D ProgramKramer Jackson, County Administrator, advised the Board that he had received a billfrom Andy Holland, Attorney, and Title IV -D Agent, in the amount of 66780 for services renderedon Title IV -D Child Support Enforcement Program during the month of November-, 1975After discussion, Commissioner Howard Benton moved that the above bill in the amount of66780 to Andy Holland, Attorney, be paid Commissioner Benton further moved that the proper budgetamendment be made to cover Title IV -D Program expenses as followsBudget AmendmentFrom 10 - Lions Club Same Call NumberKramer Jackson, County Administrator, advised the Board that he had been informed theBenson Rescue Squad and the Smithfield Lions Club had the same call number and the Smithfield LionsClub had been asked to change, however they would not agree to do so and there was some confusionon the matterThe Board discussed this briefly and decided that they would rather let the matter besettled between the two organizations if possible18 Johnston County Civil Defense Rescue SquadThe Board was also advised that there has been several requests that the Johnston CountyCivil Defense Rescue Squad change its name as it seems people get the idea that the Johnston CountyCivil Defense Rescue is to serve the entire County No official action19 Four Oaks School Request SoilThe Board was advised that Four Oaks School had requested 325 cubic yards of soil fromthe County Landfill,The Board granted the request20 Johnston Memorial Hospital Board of Trustee Member NomineeThe Board again,w discussed the one remaining vacancy on the Johnston Memorial HospitalBoard of TrusteesCommissioner Freddie Adams nominated Kenneth Deacon Jones of Princeton to fill thevacancyThe Board discussed the nomination, however, took no official action at this time0 IiiUpon a motion by Commissioner Freddie Adams, duly seconded by Commissioner Frank B Holdinand carried unanimously, the Board recessed to meet again Tuesday, December 23, 1975, at 3 oclock pmEleanor N Creech, C erk
