l106Meeting of Board of Commissioners for the County of JohnstonAugust 19, 1975The Johnston County Board of Commissioners met in special session inthe CommissionersRoom of the Johnston County Courthouse, Smithfield, North Carolina, Tuesday, August 19, 1975, at8 oclock pm, with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, Freddie Adams, Howard Bentonand Hoyt CastleberryMembers Absent NoneThe following business was transacted1 Recreation Grant Requested - Princeton Area RecreationMr and Mrs J P Keen, appeared before the Board representing the Princeton Area RecreaCommittee, requesting a recreation grant in the amount of 3,000 for a multi- purpose play areaThe Board explained to Mr and Mrs Keen that they had not yet set a deadline date forreceiving recreation applications, however, they would at this meeting, and act on all requestsafter the deadline date2 Corinth Holder Community Request Consideration for Deputy SheriffMr Kenneth Nowell and Mr James L Creech met with the Board requesting consideration fora deputy sheriff for the Corinth Holder Community Mr Nowell stated that this is a large ruralcommunity and needs more police surveillance Mr Creech, Principal, Corinth Holder ElementarySchool, stated that the school had been broken into several timesThe Board explained that the Sheriffs Department had recently increased its personnel withadditional office help, special deputies and two deputy sheriffs Chairman Denning asked Mr Nowelland Mr Creech to talk with Sheriff Wood regarding surveillance in this areaThe Board further advised Mr Creech and Mr Nowell that if the Sheriffs Department shouldhire another deputy they would certainly give consideration to this area3 Mobile Home Ordinance EnforcementWayne Strickland, Code Enforcement Officer, met with the Board regarding the enforcement ofthe Mobile Home and Mobile Home Park Ordinance Mr Strickland advised the Board that he had givenMr Jackson, County Administrator, a list of mobile home owners that have not complied with theordinance requirement that mobile homes be anchored to guard against wind and storm damage MrStrickland told the Board that these people had been visited, advised and counselled regarding theregulations of the Mobile Home OrdinanceThe_Bo -ard` discussed this matter at length, Commissioner Freddie Adams stated that he feelsthat this ordinance goes to far, telling people what they have to do with their own propertyAt this time, Commissioner Adams moved that Item 5, Article VI, Section B anchor regulationbe deleted from the Mobile Home and Mobile Home Park OrdinanceThis motion received no second and diedAfter further discussion, Commissioner Hoyt Castleberry moved that Kramer Jackson, CountyAdministrator, be authorized to write these people who have failed to comply with the Mobile Homeand Mobile Home Park Ordinance and advise that they have thirty 30 days to comply with the tie -down requirement, then if compliance is not met the county will proceed with legal actionCommissioner Howard Benton seconded the motion which was carried by the following voteAye Commissioners Hoyt Castleberry, Howard Benton and Frank B HoldingNay Commissioner Freddie Adams4 Farmers Home Administration ReportMr Ottis Ross, Supervisor, Farmers Home Administration, met with the Board of Commissioners,and gave his annual report for the fiscal year 1974 -1975Mr Ross further advised the Board that he had requested two positions from the EmergencyEmployment FundsUpon recommendation of Mr Jackson, the Board approved two positions for the FHA fromEmergency Employment Funds5 Engineering Contract - Ragsdale Engineers Cutler Hammer SiteCommissioner Freddie Adams moved that Ragsdale Engineers be employed for professionalengineering services in connection with the proposed water supply and sewerage facilities to servea new industrial site on US Highway 70 East of the Town of Smithfield Cutler Hammer CommissiiAdams further moved that Ragsdale Engineers is just to design the facility, until further notice fthe BoardCommissioner Hoyt Castleberry seconded the motion which was carried unanimouslyii108August 19,1975 Cont8 201 Wastewater Plan DiscussedTom Moore and Tim Broome of Ragsdale Engineers advised the Board that the towns had agreedthat the county should own, operate and control the County -wide Wastewater Collection System, Plan1B of the 201 Wastewater Facility PlanThe County Board of Commissioners did not agree that the county should own and operate theWastewater Collection System The Board expressed the opinion that a metropolitan sewage districtshould be established to run this systemMr Broome advised that the agencies would need to call a meeting to work out the administ-ration of this wastewater system Mr Broom advised that the County would be notified when themeeting date is set9 Johnston Memorial Charter AmendedThe Board of Commissioners discussed at length the Johnston Memorial Hospital Charter, andafter consideration, Commissioner Howard Benton moved that the charter be amended as follows1 the term for Board of Trustee membership be reduced from six 6 years to three 3years,2 the Board of Trustees elect the Chairman and Vice Chairman annually during the Octoberboard meeting to serve for a one 1 year period,3 board members may not be appointed to serve more than two 2 consecutive full termsCommissioner Hoyt Castleberry seconded the motion which was carried unanimouslyThe Board deferred action on the appointment of the three vacancies on the Hospital Boardof Trustees until the September 2, 1975, Board of Commissioners` meeting10 NDP Neighborhood Development Lot - SelmaThe Board deferred action until September 2, 1975, on the purchase of the NDP lot in Selma11 Ordinance - Disposal of Solid Waste - Johnston CountyKramer Jackson, County Administrator, advised the Board that the Board of Health had askedthat the Board of County Commissioners consider the adoption of an ordinance Rules and RegulationsGoverning the Storage, Collection, Transporting and Disposal of Solid Waste in Johnston County ,be be enforced by the Johnston County Health DepartmentThe Board discussed this at length and asked Chairman Denning to investigate the feasibilityof adopting this ordinance and deferred any action at this time12 Resolution - Johnston County Landfill Relative to Health DepartmentCommissioner Freddie Adams moved that the resolution adopted on the 5th day of November,1973, and recorded on Page 523, Item # 11, of the Johnston County Commissioners Minute Bookregarding the administrative responsibility of the Johnston County Landfill designated to theJohnston County Health Department be rescindedCommissioner Hoyt Castleberry seconded the motion which was carried unanimously13 Agencies Request County Emergency Employment PositionsKramer Jackson, County Administrator, advised the Board that the following agencies hadrequested Emergency Employment CETA positions; Farmers Home Administration, two positions;Council on Aging, four positions; Brighter Future Workshop, three positions; and Johnston CountyNew Horizon School, one positionBy motion of Commissioner Frank BHolding, duly seconded by Commissioner Hoyt Castleberryand carried unanimously, the Board of Commissioners authorized five additional positions to befunded through the Emergency Employment Grant as follows`Farmers Home Administration two positionsBrighter Future Workshop two positionsJohnston County New HorizonSchool one position14 Summer Recreation Funds - 6,235The Board asked Kramer Jackson, County Administrator, to call Coach Roy Brown to see if hemight have any suggestions on how to allocate this money 6,235 and in turn get in touch withCommissioner Hoyt Castleberry and work out details for this programriAugust 19, 1975 Cont15 Recreation Grant Request North Johnston High School Panther ClubThe Board received an application from North Johnston High School Panther Club requestinga recreation grant inthe amount of 1,624 to help construct tennis courts at North Johnston HighSchoolThe Board discussed and considered this application, however, decided that they shouldset a deadline date for receiving applications as discussed before, and consider all applicationsafter that dateAt this time, Commissioner Hoyt Castleberry moved that October 15, 1975, be designated asthe deadline date for receiving recreation applicationsCommissioner Frank B Holding seconded the motion which was carried unanimously16 County Jail - Heating and Air ConditioningThe Board discussed a new heating system and also air conditioning system, estimated atapproximately 12,000 for the county jail, as part of the renovation project now in progress TheBoard discussed this matter, but were very reluctant to make any commitments at this time and askedMr Jackson to determine the difference in the cost of installing just heat in the county jail17 Library Board Member - AppointmentCommissioner Frank B Holding moved that Gordon Brown, Selma, North Carolina, be appointedto the Public Library of Johnston County and Smithfield Board of Trustees for a term of three years,term expiring June 30, 1978Commissioner Freddie Adams seconded the motion which was carriedunanimously18 Abandonment of Secondary Road # 1749 Camp Mary AtkinsonAs requested by the property owners on Secondary Road # 1749, Pines of Carolina Girl ScoutCouncil, Incorporated, Camp Mary Atkinson, Johnston County, Commissioner Hoyt Castleberry movedthat this road be abandoned from the State Maintained SystemCommissioner Frank B Holding seconded the motion which was carried unanimously19 Request from First Federal Savings and Loan to beCounty DepositoryKramer Jackson, County Administrator, advised the Board that First Federal Savings and Loan,Smithfield, North Carolina, had requested to be named as a County DepositoryThe Board asked Mr Jackson to ascertain if collateral will be put up on county funds20 Johnston County Soil Survey ContractAs authorized by the Board of Commissioners, Chairman Denning, on behalf of the County,executed the following Cooperative Agreement between the County of Johnston and the Soil ConservationService, U S Department of Agriculture;Cooperative AgreementbetweenCounty of Johnstonand theSoil Conservation ServiceUnited States Department of AgricultureRelative to Acceleration of Soil Surveys for Land Use Planning in Johnston CountyAuthority PL -46 - 74 Congress, 16 USC 590 a -fTHIS AGREEMENT, made and entered into this 19th day of August, 1975, by and between theCounty of Johnston hereinafter referred to as the Cooperator and the United States of America,acting by and through the Soil Conservation Service of the United States Department of Agriculturehereinafter referred to as the Service THE SERVICE, in carrying out its assigned responsibilities under applicable legislation, hasneed for certain information that may be obtained as a result of this cooperation; has certain re-sources available, but does not have sufficient resources available to obtain the desired informationwithin the period specified in this agreementTHE COOPERATOR, for planning purposes, has requested certain soil survey information thatis presently unavailable, and within the limits of its resources, is willing to reimburse the Servicefor a portion of the costs of obtaining such information within the period specified in this agreementupon receipt of a properly prepared billingTHEREFORE, both the Cooperator and the Service deem it mutually advantageous to cooperatein this undertaking, and hereby agree as follows1 THE COOPERATOR AGREESa That all information obtained under the terms of this agreement is public property,and is to be used only in the development of a master plan for Johnston County¦110August 19, 1975 Contb To reimburse the Service for ortion of the costs incurred in thev a pacceleration of the soil survey, to include1 Technical services of Service personnel - included herein are the costsof salaries and allied benefits such as leave, holidays, retirement,health benefits, and life insurancec Reimburse the Service 120,000 for the Cooperators share in this cooperativeffort based on a total cost estimate for the job of 280,000 at the fieldlevel The amount to be reimbursed for FY 75 -76 is not to exceed 15,000d That the signature of the authorized representative of the Cooperator on Ey`this agreement is official notice for the Service to commence work on theeffective date specified in 3e2 THE SERVICE AGREESa To provide the Cooperator with 50 copies of the published soil surveyAdvance copies of this survey will be provided as photostatic copies of thesoil survey field sheetsb To provide the necessary technical services, on -site assistance, equipmentand materials normally needed to produce, edit, and compile a soil surveyC If requested, to make available to the Cooperator in preliminary form only,the results of the investigations and surveys as soon after completion ofthe field work as is possiblerd To provide the Cooperator Tables of Interpretations fori1 Sanitary Facilities2 Construction Materials3 Construction Sites4 Engineering Properties and Classification5 Physical and Chemical Properties6 Recreational Development7 Soil and Water Features8 Wildlife Habitat9 Woodland Management and Productivitye To absorb from its own appropriations that portion of the estimated costsof this undertaking not covered by the amounts to be reimbursed the Serviceas agreed to above3 IT IS MUTUALLY AGREEDia Completion Date Completion date of field work is estimated to be eightyears after start of survey dependent upon availability of soil scientistsand federal and local fundsb Area Covered - All lands of Johnston County, N Cc Method of Payment - The Service will bill the Cooperator at the times andin the manner set forth as followson a triannual basis during the year Billings will be based on timeactually charged against the reimbursable account for the period coveredBillings for the year will not exceed the amount agreed to in 1c aboved Intent to Cooperate - it is the intent of the Service to fulfill itsobligations under this agreement However, commitments cannot be madebeyond the period for which funds have been appropriated by Congress Inevent funds from which the Service may fulfill its obligations are notappropriated, the agreement will automatically terminate Reimbursementwill then be for work completed that is otherwise eligible for reimbursementprior to the effective date of terminatione Effective date and Renewals -This agreement becomes effective August 19,1975 and will remain in force until June 30, 1976 It may be affirmativelyrenewed each fiscal year by the parties through an exchange of correspond-ence until the purposes of the agreement are complete - but not later than Cthe end of the fiscal year in which the work is completedf Modification - This agreement may be modified by amendement duly executed,by authorized officials of the Cooperator and the Service, provided suchmodification does not extend the agreement beyond the close of the fiscalyear in which the work is completedg Officials Not to Benefit - No member of or delegate to Congress or residentCommissioner shall be admitted to any share or part of this agreement, or toany benefit that may arise therefrom; but this provision shall not beconstrued to extend to this agreement if made with a corporation for itsgeneral benefitIN WITNESS WHEREOF the Cooperator and the Service have executed this agreement as of thedate first above -
