1974 -75 Budget IntentionsCommissioner Howard Benton moved that Chairman Norman C Denning be authorized to advise MrsSandra Raulerson, Director, Johnston County Council on Aging, that it is the intentions of the JohnstonCounty Board of Commissionersto appropriate to the Johnston County Council on Aging for the fiscal year1974 -75 a total amount of 6,79100Commissioner Benton further moved that it be fully understood by the Council on Aging that thisintention is not binding on the part of the, Board of CommissionersCommissioner Freddie Adams seconded the motion which was carried4 1 Resolution - Johnston County Airport Master PlanCommissioner Freddie Adams moved that Ragsdale Engineers be paid in the amount of 189250 forengineering services payment # 5 on the Master Plan, Johnston County Airport projectCommissioner Howard Benton seconded the motion which was carried unanimously6 Payment - Water Line Construction at 70 -A and I -95After discussion and previous negotiations, Commissioner Frank B Holding moved that the Townof Selma be authorized to advertise for bids for construction of the completion of a water line loopserving Shallcross Manufacturing Company and the motel - restaurant development at Highway 70 -A and I -95interchangeCommissioner Freddie Adams seconded the motion which was carried9 Indigent Burial Patient of Rest HomeMrs Raymond Pounds and Mrs Nolton Pounds of Clayton appeared before the Board regarding thedeath and burial of Mr Joseph Henry Barbour of Clayton It was explained to the Board that MrBarbourdid not have any close family or relatives and up until his death last month had been a resident atColonial Rest Home, Sinithfield Mrs Nolton Pounds told the Board that she and Mrs Raymond Pounds hadcared for Mr Barbour, in many, ways as a family would, and had to arrange for his funeral Mrs RaymonPounds explained that Mr Barbour -did-not have any money and only a 200 burial policy and asked theBoard of Commissioners if there were any county funds that could be used to pay the balance of MrBarbours funeralThe Board explained that there were no county funds available for indigent burialsDuring the day the Board learned that there was a balance of 13000 of Mr Barbours unusedroom and board at Colonial Rest Home and arranged for this to be applied to the burial expenses, however,did not take any further action on this matter at this time10 Resolution - South Johnston Girls Basketball TeamRESOLUTIONWHEREAS, the South Johnston Gils Basketball Team has won the Championship in the StateTournament finals by a score of 52 to 49 over Williamston;WHEREAS, THE Trojans showed great ability and courage in winning a very hard fought contest;WHEREAS, the Trojans completed an overall 21 -2 record for this basketball season;-WHEREAS, the South Johnston Trojans in their victories and attaining the State Championship havereflected great credit upon their school and all the people of Johnston County; andWHEREAS, the Commissioners of Johnston County feel it appropriate that they should give duepublic recognition for the splendid record of this outstanding basketball team;NOW, THEREFORE, upon motion by Commissioner Howard Benton and seconded by Commissioner FreddieAdams, the Board of Commissioners of Johnston County does hereby resolve that great praise be given tothe South Johnston Girls Basketball Team and that they be highly commended for bringing great creditto the people of Johnston County as the new State ChampionsThe foregoing resolution was carried unanimously, and the Board ordered that copies of thisresolution be sent to the South Johnston Girls Basketball Team and to the pressBOARD OF COMMISSIONERS OF JOHNSTON COUNTYNorman C Denning, ChairmanFrank B Holding, Vice ChairmanFreddie Adams, MemberHoward Benton, Member-Hoyt Castleberry, Member11 Attorney Appointed - Disposal of Old TiresThe Board of Commissioners again discussed the matter of what to do with old tires It has beendetermined that old tires can not be buried atthe county landfill unless the tires have been sliced,however, no one in this area is equipped to slice old tires The Board has discussed several different•proposals, but have been unable to make any definite decisionChairman Denning suggested contacting the State Health officials to determine if old tires canbe piled up at the landfill in a designated area for storing for a certain period of timer14 Recommendations Submitted to Board of Commissionersfrom Johnston County Planning BoardRecommendations Submitted To The Johnston County Commissioners As A ResultOf The County Industrial Analysis February 5, ,1974Recent events have pointed out the need for an analysis of Johnston Countys present industrialIn planning Y regarding sstanding view of this the tannin board initiated an industrial stud in the fall of 1973 Th?study has recently been CQmpl etecl? As a result of this study certain conclusions were reachedindustry types, industrial mix, industrial wages, industry size, empl_oyees turnover rates, employees,,,,_skill levels, labor market, employee and employer relations, county and community,facili,ties,`countyindustrial corrdination and planning, selectivity of new industry, location of industrial plants, andpresent industrial policiesThese conclusions indicated a need for establishing a policy based upon all these criteriaregarding the encouragement of new industries which may be interested in locating in Johnston CountyThe Johnston County Planning Board, therefore, recommends as a method of initiating an industrialpolicy, that some type of coordinating agent be establishedpolicyIn considering this, we have come up with four 4 possible alternatives for initiating this1 The county hire a county administrator to handle industrial affairs in addition to otherduties which would normally be assigned2 The county establish an industrial commission and hire a staff person to handle industrialaffairs3 The county hire a staff member to handle industrial development4 The county commissioners appoint an individual to work closely with the planning board andother agencies and organizations in the county in handling industrial mattersThe planning board recommends that the first alternative be given top consideration We feel,however, that selecting one of the above mentioned courses of action should be the first step ininitiating a county wide industrial policyRespectfully submitted,Johnston County Planning Morgan and R L Holt, and advised that the first alternative item # 1would be given top priorityMr Grantham also called to the attention of the Board that funding for planning services forcounties and communities for 1974 -75 on a two - thirds basis 23 is being considered at this time andthat interested applicants must be submitted to HUD Greensboro by April 1, 1974 Mr Grantham furtheradvised that the HUD funding level will be reduced across the State and nation by about 25 , and it isimportant, if the Board is interested in this program, to get this application in early, and also thatif the Board does indicate an interest or intent in a grant at this time, it will in no way obligatethem to enter into a contractThe Board of Commissioners indicated an interest in planning services and a full -time planner forJohnston County on a two - thirds matching basis and discussed this matter at length, however, it wasdecided to postpone action on a full -time planner until the next Board meetingII pillow555March 4, 1974 Cont15 Paul Anderson - District Highway EngineerPaul Anderson, District Engineer, North Carolina Department of Transportation and Highway Safety,Highway Division, met with the Board of Commissioners and discussed several road problems in the Countyright -of -way county landfill road and Parker road 16 Director - North Carolina Bicentennial CommissionMs Dabney Enderle, Director, and Ms Liz Fintress, Publicity Director, North Carolina BicentennialCommission, met with the Board of County Commissioners and several interested citizens of Johnston Countyat a luncheon regarding Bicentennial projects for Johnston County communities Ms Enderle explained thatmost any kind of project may qualify for Bicentennial grants, explaining that these grants will be madeon a 50 -50 matching basis Ms Enderle and Ms Fintress further indicated and exampled projects such ashistorical preservation, outdoor recreation, heritage, civic centers, parks, community festivals and etcThe Board back in session in the Commissioners Room, agreed to set up a Johnston CountyBicentennial Commission to coordinate local plans for celebrating the nations 200th birthday in 1976The Board agreed, by motion of Commissioner Frank B Holding, duly seconded by Commissioner Freddie Adamsto ask each mayor for a recommendation or appointment to the commission and inturn the Board willappoint members at large to constitute a fourteen member commission17 County Administrator EmployedAfter a lengthy discussion and much consideration for some time, Commissioner Frank B Holdingmoved that the Board of County Commissioners hire a County Administrator and that this Board commenceimmediately to recruit applicants for this position, with every effort made to employ a person for thisposition by May 1, 1974Commissioner Holding further moved that the County administrator is to work for the county atthe disposal of the Board of County CommissionersCommissioner Howard Benton seconded the motion which was carried by the following -vote;Aye Frank B HoldingHoward BentonNorman C DenningNay Freddie AdamsComments Commissioner Howard Benton Search out the best possible man, being able to performduties subject to the wishes of the Board of Commissioners and in no way interfere with any electedoffice, but to work with these public officials cooperatively18 Health Department Request Gas TankDr Mark Pomerans, Director, and Mrs Helen Ray, Supervisor of Nurses, Johnston County HealthDepartment, appeared before the Board requesting a gas storage tank-for the Health Center Dr Pomeransexplained that because of the gas shortage, to assure continued public health services, he felt that itwas-necessary to have a gas storage tank installed at the Health CenterThe Board discussed this matter at length and acknowledged this problem, however, asked theHealth Department to go along with this situation for awhile longer The Board further expressed thatif the gas shortage got to be critical, then they certainly could not see health services curtailed19 Vacation - Sick Leave PolicyThe Board of Commissioners discussed briefly a vacation - sick leave policy for county employees,however, postponed action until the next Board meeting20 Emergency Preparedness Ordinance AdoptedUpon motion by Commissioner Howard Benton, duly seconded by Commissioner Freddie Adams andcarried, the following ordinance was adoptedEMERGENCY PREPAREDNESS ORDINANCEFOR JOHNSTON COUNTYANDBENSON, CLAYTON, FOUR OAKS, KENLY, MICRO, PINE LEVEL, PRINCETON, SELMAAND SMITHFIELDThe County of Johnston and the municipalities therein ordains Article 1 - JOHNSTON COUNTYOFFICE OF EMERGENCY PREPAREDNESSSection 1, Short TitleThis Ordinance shall be known and may be cited and referred to as JOHNSTON COUNTY CIVILPREPAREDNESS ORDINANCE Section 2 Intent and Purpose1 It is the intent and purpose of this ordinance to establish an office that will insure thecomplete and efficient utilization of all the County of Johnston and municipalities thereinresources to combat disaster resulting from enemy actions or other disasters as defined herein,and tocoordinate-and or direct other emergency services as directed by the gove - ing body of theJohnston County or any municipality thereinr5b6March 4, 1974 Cont2 The Johnston County Office of Emergency Preparedness will be the coordinating agency for-all activity in connection with Emergency Preparedness; it will be the instrument through whichthe Johnston County Board of Commissioners and or the Town Boards of Commissioners of eachmunicipality may exercise the authority and discharge the responsibilities vested in them duringdisaster emergencies3 This ordinance will not relieve any County or City Department of the moral or legalresponsibility or authority given to it in the County or City Charter or by local ordinances,nor will it adversely affect the work of any volunteer agency organized and authorized forrelief in disaster emergenciesSection 3 Definitions1 The following definitions shall apply in the interpretation of this articlea Emergency Preparedness in its broad meaning is to carry out the basicgovernment functions of maintaining public peace, health and safety before,during and after an emergency This shall include plans and preparations forprotection from relief, recovery and rehabilitation from effects of an attackby the forces of an enemy nation or the agents thereof, and it shall includealso such activity in connection with disaster as defined herein It shallnot, however, include any activity that is the primary responsibility of themilitary forces of the United States or any authorized aid agency organizedfor reliefb Attack shall mean direct or indirect assault against the County of Johnstonand the municipalities therein, its government, its environs, or of the nation,;by the forces of a hostile nation or the agents thereof, including assault bybombing, conventional or nuclear, chemical or biological warfare,, or sabotagec Disasters includes, but is not limited to, actual or threatened enemy attack,extraordinary fires, flood, storm, epidemic or other impending or actualcalamity endangering or threatening to endanger health, life or property orconstituted governmentd Emergency Preparedness Forces shall mean employees equipment and facilitiesof all City or County departments, boards, councils, institutions andcommissions; and, in addition, it shall include all volunteer personnel,equipment and facilities contributed by, or obtained from volunteer persons oragenciese Volunteer shall mean contributing a service, equipment or facility to theEmergency Preparedness agency without renumerationf Emergency, Preparedness Volunteer shall mean any person duly registered,identified and appointed by the Coordinator of the Johnston County EmergencyPreparedness Office and assigned to participate in the emergency preparednessexercises and activitiesg Coordinator shall mean the Coordinator of the Johnston County Office ofEmergency Preparedness, appointed bythe Johnston County Board of Commissionersas prescribed in this ordinanceSECTION 4 Organization and Appointments1 The organization shall consist of the followinga An Office of Emergency Preparedness within the Executive Department of theCounty of Johnston and the City governments approving this plan The officeshall be under the direction and supervision of the Coordinator who will selectassistants and other employees as are deemed necessary for the proper function-ing of the office These will be upon approval of the Johnston County Board ofCommissionersb The employees, resources and all boards, councils, agencies andinstitutions of the County of Johnston and the subscribing municipalities willbe expected, as partof their employment responsibilities, to participate inEmergency Preparedness exercises and training programs Duties assigned tothese shall be the same or- similar to the normal duties of their departments,where possiblec Volunteer personnel and agencies offering service to, and accepted by thecounty or municipalities2 The Coordinator appointed by the Johnston County Board of Commissioners shallbe a person well versed and trained in planning operations involwIng theactivities of many different departments, groups and agencies which will operateto protect the public health, safety and welfare in the event of danger fromenemy attack or any other disaster or emergency3 The Coordinator shall designate and appoint Deputy Coordinators to assume theduties of Coordinator in the event of his absence or inability to perform theduties as described herein557March 4, 1974 ContSection 5 Emergency Powers and Duties1 Coordinator of the Johnston County Office of Emergency Preparednessa Prior to, during or following any period when disaster or Johnston County has beenstruck by disaster, within the definition of this Ordinance, the EmergencyPreparedness Coordinator may promulgate such regulations as he deems necessary toprotect life and property and preserve critical resources This promulgation ofregulationssolely by the Coordinator will be ONLY when immediacy of action precludescontact and discussion with the Johnston County Board of Commissioners or the TownBoard of Commissioners as would be appropriate for a given emergency or disasterSuch regulations may include, bur shall not be limited to the following;1 Regulations prohibiting or restricting the movement of vehicles in order tofacilitate the work of Emergency Preparedness forces, or facilitate the massmovement of persons from critical areas within the County of Johnston2 Regulations pertaining to the movement of persons from areas deemed to behazardous- or vulnerable to disaster3 Such other regulations necessary to preserve public safety, peace and health4 Regulations promulgated in accordance with the authority above will be givenwidespread circulation through all avenues of the news media in Johnston CountySection 6 Day To Day Duties and Responsibilities of the Coordinator1 The Coordinator shall be responsible to the Johnston County Board of Commissioners and thegoverning bodies of each municipality approving this Ordinance in regard to all phases ofEmergency Preparedness activity and planning The Coordinator shall be responsible for theplanning, coordination and operation of the Emergency Preparedness activities of JohnstonCounty The Coordinator shall maintain liason with State and Federal authorities and theauthorities of nearby counties and municipal subdivisions so as to insure the most effectiveoperation of the Emergency Preparedness plans The Coordinators duties shall include, butnot be limited to, the follolwing;a C oordinating the recruitment of volunteer personnel and agencies to augment thepersonnel and facilities of the County of Johnston and the municipalities thereinfor Emergency Preparedness purposesb Development and coordination of plans for the immediate use of all facilities,equipment, manpower and other resources of the County for the purpose of minimizingor preventing damage to persons and property; and protecting and restoring to useful-ness governmental services and public utilities necessary for the public health,safety and welfarec Negotiating and concluding agreements with owners or persons in control of buildingsor other property for the use of such buildings or other property for EmergencyPreparedness purposes and designating suitable buildings as public sheltersd Through public informational programs, educating the populace as to actions necessaryand required for the protection of their persons and property in case of enemy attackor disaster as defined herein, either impending or presente Conducting practice alerts to insure the efficient operation of the EmergencyPreparedness forces and to familiarize residents with Emergency Preparedness regulation,procedures and operationsf Coordinating the activities of all other agencies, public or private, engaged in anyEmergency Preparedness activityg Periodically inform public and private officials on a need to know basis ofEmergency Preparedness plans, operational data and activitied when in the publicinterest and operational efficiencySection 7 Emergency Preparedness Plans1 Comprehensive Emergency Preparedness plans shall be adopted and maintained by Resolutionof the Johnston County Board of Commissioners and the Town Council of each participatingmunicipality In the preparation of these plans as it pertains to city and countyorganizations, it is intended that the services equipment and facilities and personnel ofall existing departments and agencies shall be utilized to the fullest extent Whenapproved, it shall be the duty of all municipal and county departments and agencies toperform the functions assigned by these plans and to maintain their portion of the plansin a current state of readiness at all times The Basic Emergency Preparedness OperationsPlan and the Disaster Operations Plan shall have the effect of law whenever a disaster, asdefined in this Ordinance, has been proclaimed558March 4, 1974 Copt2 The Coordinator shall prescribe in the emergency plans those positions within the disasterorganization, in addition to his own, for which lines of succession are necessary In eachinstance, the responsible person will designate and keep on file with the Coordinator acurrent 1 ist of three 3 persons as successors to his position The list will be in orderof succession and will, as nearly as possible designate persons best capable of carryingout all assigned duties and functions3 Each service chief and department head assigned responsibility in the Basic Plan shallbe responsible for carrying out all duties and functions assigned therein, Duties willinclude the organization and training of assigned employees and where needed, volunteers-Each chief shall formulate the operational plan for his service which, when approved,shall be an annex to and a part of the Basic Plan4 Ammeridments to the Basic Plan will be submitted to the Coordinator If approved, theCoordinator, will then submit the amendments to the governing body of each municipalityincluded herein and the Johnston County Board of Commissioners with his recommendation fortheir approval Such ammendments shall take effect immediately upon approval by a governingbody l5 When a required skill or competency for a disaster function is not available within theaffected local government, the Coordinator is authorized to seek assistance from personsoutside that local government The assignment of duties, when of a supervisory nature,shall also grant authority for the person, or persons, so assigned to carry out such ,duties prior to, during and or after the occurrance of a disaster Such services frompersons outside of government may be accepted by local government of a volunteer basisSuch citizens shall be enrolled as Emergency Preparedness volunteers in cooperation withthe heads of local government departments affected,Section 8 No Municipal or Private Liability1 This Ordinance is an exercise,by the County of Johnston and the municipalitiesapproving of its, governmental functions for, the protection of the public peace, healthand safety, and neft -her the County and the approving Towns, nor agents andrepresentatives if some,,or any individual,,receiver, firm, partnership, corporation,association, or trustee, or any of the agents thereof in good faith carrying out,complying with or attempting to comply with any order, rule or regulation promulgatedpursuant to the provisions of this Ordinance, shall be liable for any damage sustainedto persons or property as the result of said activity2 Any person owning or controlling real estate or other premises who voluntarily andwithout compensation grants the County or any of the approving Towns the right toinspect, designate and use the whole or any part or parts of such real-estate orpremises for the purpose of sheltering persons during an actual, impending or practicedisaster situation shall not be liable civilly for the death of, or injury to, anypersons on-or about such real estate or premises under such license, privilege orother permission; or for loss of, or damage to, the property of such personSection 9 Violation of Regulations1 It shall be unlawful for any person to violate any of the provisions of thisOrdinance or of the regulations or plans issued pursuant to the authority contained -herein, or to willfully obstruct, hinder or delay any member of the EmergencyPreparedness organization as herein defined in the enforcement of the provisions ofthis Ordinanceor any regulations or plan thereunderiSection 10 Severability1 Should any provision of this Ordinance be declared invalid for any reason, suchdeclaration shall not affect the vaidity of other provisions, or of this Ordinance,as a whole, it being the legislation intent that the privisions of this Ordinance shallbe severable and remain valid notwithstanding such declarationSection 11 Conflicting Ordinances, Orders, Rules and Regulations,Suspended1 At alltimes when the orders, rules and regulations made and promulgated pursuant tothis Article shall be in effect, they shall supersede all existing ordinances, orders,rules and regulations insofar as the latter may be inconsistent therewithSection 12 Effective DateThis Ordinance shall take effect on the County Landfill and reported that it was one of the best operatedlandfills in southeastern North CarolinaThe Board of Commissioners commended Mr Hatcher for his sincere efforts at the landfill tomake this report possible22 Bills for County Electrical InspectorCommissioner Freddie Adams -moved that a few miscellaneous bills,such as post office box rentand supplies, be paid for the county electrical inspector, in setting up office at the Johnston CountyHealth DepartmentCommissioner Frank B Holding seconded the motion which was carried23 Maintenance Supervisor - TransportationThe Board of Commissioners discussed briefly transportation for the Maintenance Supervisor andagreed that he could use a truck from the landfill until such time as the county commissioners couldpurchase one for
