March 13, 1974The Johnston County Board of Commissioners met in special session in the Commissioners Roomof the Johnston County Courthouse, Wednesday, March 13, 1974, at 7 30 pm, with the following memberspresentNorman C Denning, Chairman, Frank B Holding, Freddie Adams and Howard BentonMember Absent Hoyt CastleberryCommissioner Freddie Adams opened the meeting with prayerThe following business was transacted1 Plantings at Courthouse and Annex GroundsCommissioner Howard Benton moved that the statement from Willard Stanleys Seed Store in theamount of 3,97090 for plantings for the parking lot around courthouse and tax collectors parkingarea-be paid This statement included changes that were made in plantingsCommissioner Freddie Adams seconded the motion which was carried2 Smithfield Appearance CommissionMrs M A Morgan, Chairman, Mrs Tom Lassiter, Co- Chairman, and other members of the SmithfieldAppearance Commission appeared before the Board of Commissioners requesting assistance in landscapingthe median areas approaching Smithfield on Highway 70 east and west and Highway 301 North and southMrs Morgan explained that they had talked with the highway officials regarding right -of -waysAfter discussion, Commissioner Frank B Holding moved that the Johnston County Board ofCommissioners respectfully request the North Carolina State Department of Transportation, Division ofHighways, to landscape the median areas approaching Smithfield on highway 70 east and west and highway301 north and south for one 1 mile in both directionsCommissioner Freddie Adams seconded the motion which was carriedLeoMarch 13,1974 Cont3 Repairs -_Courthouse Storage SpaceJames C Woodard, Clerk of Superior Court, reported on repairs and replacements that had beendone at the Courthouse, and also that there is still some work to be completedMr Woodard also told the Board that storage had become a problem in trying to clear the halls,and that he had stored old tables, chairs and other things in thebuilding` recently purchased by thecounty from Joe OverbyThe Board commended Mr Woodard on the improvements and repairs done in the Courthouse andasked him to work with Mr McLamb, Maintenance Supervisor, regarding storage space4 Graduated Annual Leave Policy Adopted for County EmployeesThe Board of Commissioners discussed at length an annual leave policy for county employees,which was brought before the Board by a committee appointed some time agoby the Chairman The Chairmanhad recommended that the committee study an annual leave policy and appear back before the Board at alater date with recommendationsCommissioner Frank B Holding and Commissioner Freddie Adams along with James C Woodard,members of the committee, explained this graduated annual leave policy for county employees in detailto the other members of the BoardAfter discussion and upon motion of Commissioner Howard Benton,duly seconded by CommissionerFrank B Holding and carried, the following graduated annual leave policy was adopted for all countyemployees, effective July 1, 1974;JOHNSTON COUNTYGRADUATED ANNUAL LEAVE POLICYAbsences from work during scheduled working hours shall be charged to the appropriateleaveaccount of the employee Administration of the leave program within the scope of established policyshall be the responsibility of the appointing authorities which are the various department heads, bothelected and appointed officialsAnnual Leave1 Amount Earned - recurring activities; or for disciplinary duties resulting fromfailure of the reservist to fulfill an obligation If the employee is not eligiblefor leave-with-pay, all lost time shall be charged to petty and or annual leaveIf all annual leave is exhausted, the employee shall be placed on leave- without -payd Maximum Amount of Leave - without -pay and to requirea copy of military orders The appointing authority shall explain to the employee therights and benefits concerning leave, retirement status and reinstatement from leavee Retention and Continuation of Benefits During the period of leave- without -pay formilitary service, the employee shall retain all accumulated sick leave and retirementstatus -f Reinstatement from Leave-Without-Pay for Military Services Employees on leave - without-pay who are separated or discharged from military service under honorable conditionsand who apply for reinstatement within the established time limits shall be reinstatedto the same position or one of like status, seniority and pay with the same agencyThe employees salary upon reinstatement shall be based on his last salary plus anygeneral salary increases Employees who resign without knowledge of their eligibilityfor leave - without -pay and reinstatement benefits, but who are otherwise eligible forthe reinstatement benefits of this paragraph, shall be reinstated from military servicethe same as if they had applied for and been granted leave - without -pay for militaryservice An employee on leave- without -pay who receives a dishonorable discharge and orseparation may be considered for reinstatement The decision to reinstate a dis-honorably discharged employee shall be the responsibility of the appointing authorityIf during military service, an employee is disabled to the extent that he cannot performthe duties of his original position, he shall be _reinstated to a position with dutiescommensurate with the disabilityF Leave- Without -Pay1 Employees Eligible Only full -time permanent, probationary, and proviisional employeesmay be granted leave- without pay2 Maximum Amount of Leave-Without-Pay shall be twelve months except for military leave,which has no specific time limit3 No Lump -Sum Payment of Terminal Leave shall be made due to the granting of certaintypes of leave - Extended training period which will better equip theemployee for the performance of his duties and responsibilities2 To Serve as a Witness in A Private Litigation Suit3 Extended Illness - Employee shall exhaust first all accumulated sick leave andthen may use all annual leave in lieu of sick leave not to exceed the amountpayable or allowable that calendar year before going on leave- without -payMarch 13, 1974 Cont4 Drawing Workmens Compensation Due to Illness or Injury of Employee on the Job -Employee has option of choosing between going immediately on leave without -payand drawing workmens compensation or drawing upon his accumulated leave andthen drawing workmens compensation Should he choose the latter option, firstsick leave and then annual leave must be exhausted not to exceed the amountpayable or allowable that cA endar year before going on leave- without -pay5 Extended Cases of Illness or Injury to Member of Immediate Family - Employeeshall exhaust accumulated annual leave not to exceed the amount allowable thatcalendar year Sick leave is not applicable unless employee is under quartine6 Disciplinary Action - The appointing authority may penalize an employee bysuspension from the payroll on leave- without -pay for a period to be determinedby the appointing authority Accumulated annual leave shall not be taken orpaid for in such cases but shall be held in suspense7 For Vacation Purposes An employee may be granted leave- without -pay forvacation purposes if, for reasons acceptable to the appointing authority, suchaction may be warranted8 For Military Purposes -
