Transportation with the boards recommendation for considerationCommissioner Howard Benton seconded the motion which was carried4 Benson Water and Sewer Request - 1 -40 Rest AreaSteve Harrell, Administrator, Town of Benson, met with the board againregarding water and sewer to serve the proposed 1 -40 Rest Area near BensonAfter a lengthy discussion, Commissioner Frank B Holding moved thatthe county install fire hydrants on the water line route along Secondary Road1331, and further that the county purchase, if necessary, a small tract of landto house one wastewater I i ft that he appreciated this recommendation andthe confidence, however declined Commissioner Holding further stated that theentire Board of Commissioners will have to be involved in the industrial Continued9 Law Enforcement Assistance _Contract;- AdoptedUpon a motion by Commissioner Howard Benton, duly seconded by CommissionerJames W Cash, and carried, the following Law Enforcement Assistance Contractwas adoptedTHIS CONTRACT, made and entered into this 5th day of December, 1983,by and between Johnston County Sheriffs Department hereinafter referred to asthe Requesting Agency, and adjoining counties Sheriff Departments, and PoliceDepartments located in Johnston CountyWITNESSETHTHIS CONTRACT is entered into between the Requesting Agency and theAssisting Agency, pursuant to the provisions of GS 160 -288, which allows mutualassistance and cooperation between law enforcement agenciesBOTH PARTIES acknowledge mutual benefit in the form of enhanced lawenforcement capabilities and efficiency within the jurisdictions of both agencieswhich inures to the benefit of bothThe terms and conditions of this contract are as followsFIRST The Assisting Agency covenants and agrees to temporarily provideassistance to the Requesting Agency in enforcing the laws of the State of NorthCarolina This assistance shall includeA Allowing law enforcement officers of the Assisting Agency to work tempor-arily with law enforcement officers of the Requesting Agency;B Temporary lending of equipment;C Temporary lending of suppliesSECOND This Contract shall remain in effect for a period of four yearscommencing on December 5, 1983, and ending December Ist Monday, 1987THIRD While on duty with the Requesting Agency, a law enforcementofficer provided by the Assisting Agency hereinafter referred to as a loaned officershall have the same jurisdiction, powers, rights, privileges, and immunities asthe officers of the Requesting Agency in addition to those which he normally possessesFOURTH While on duty with the Requesting Agency, a loaned officer shallbe subject to the lawful operational commands of his superior law enforcementofficers in the Requesting Agency The loaned officers superior officers in theRequesting Agency shall be solely responsible for the direction and guidance ofthe loaned officer However, for personnel and administrative purposes includingfor purposes of pay, the loaned officer shall remain under the control of theAssisting Agency and shall be entitled to Workmens Compensation and the samebenefits which ordinarily inure to him as a member of the Assisting Agency tothe same extent as though he were functioning within the normal scope of hisduties with the Assisting AgencyFIFTH This Contract in no way reduces the jurisdiction or authorityof State law Transportation visited with the board12 Industrial Development Prospects - Clayton AreaKramer Jackson, County Manager, advised the Board of County CommissionersHowardthere are prospects of industrial development near Clayton He told the boardseconded the motionthat Cutter Labs is considering another major expansion, CK Components is planningcalledto enlarge its plant, and a new industry is considering building a plant inother nominations for Vice Chairmanthis same industrial area Mr Jackson told the board the Clayton WastewaterJohn MTreatment Facility is already at maximum capacity and can not be added onmoved that the nominations be closedfor future growth, and that the county may need to look at building a separateHowardwastewater treatment facility in this area to handle industrial growthseconded the motion which was carriedAfter discussion, Commissioner James W Cash moved that the countysengineering firm be authorized to begin work on plans and cost for a new waste-water treatment facility to serve the Clayton industrial areaCommissioner Frank B Holding seconded I the motion which was carriedby unanimous vote12 Reorganization of Board of County CommissionersNorman C Denning asked the Clerk to the Board to preside in the electionof a Chairman of the boardThe Clerk called for nominations for Chairman of the Johnston CountyBoard of Nomination to Hospital Board of TrusteesCommissioner Howard Benton recommended and nominated Maynard Barnesof Benson to the Hospital Board of Trustees to succeed him as a citizen represent-ative for the Benson areaAt this time in discussion of appointments, Commissioner John M Bookerstated that he respects Commissioner Bentons nomination, however, if it is theboards intentions to follow the policies and procedures for appointments to boardsthat they adopted, the public needs to be notified of this vacancyAfter discussion, Commissioner Howard Benton withdrew his nominationof Maynard
