Meeting of Board of Commissioners - Johnston CountyMay 12, 1983The Johnston County Board of Commissioners met in special called session Thursday, May12, 1983, at 12 oclock noon in the Commissioners Room of the Johnston County Courthouse,Smithfield, North Carolina, with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, James W Cash andHoward BentonMember Absent John M Booker, DVMThe Chairman called the meeting to order and the following business was transacted1 Road Petition - S R # 1302Commissioner Howard Benton moved that the petition presented requesting the paving ofSecondary Road # 1302 be forwarded to the North Carolina Department of Transportation forconsiderationCommissioner James W Cash seconded the motion which was carried2 Cable Television Franchise - AwardedThe board again discussed the request from Billy Braswell of Kountry Kable for a cabletelevision franchise for certain areas of Johnston County along US Highway 70 In discussionthe Chairman advised that it was not the intent of this board to keep anyone in these areas fromgetting cable television, however, they were concerned and interested in the quality of servicethe people would be gettingAfter further discussion, Commissioner Howard Benton made a motion, seconded byCommissioner James W Cash to award a cable TV franchise to Kountry Kable with the proposedcable TV boundary as followsAll of Johnston County North of U S Highway 70 excluding the corporate municipalitiesof Clayton, Smithfield, Selma, Micro, Kenly, Pine Level, and Princeton, and the areas contiguousto Clayton, Smithfield, and Selma already granted by the County to other cable companiesSubject to the following1 The County is to be presented with a financial statement prepared by a CertifiedPublic Accountant showing Small Cities Communications of Chapel Hill, N C financial statusand its financial ability to complete the construction and installation of the proposed systemand to provide the proposed service2 The County is to be presented with a statement setting forth all agreements andunderstanding between Billy Braswell and Small Cities Communications of Chapel Hill, N C,with respect to ownership and control of the proposed franchise3 Kountry Kable shall file a written acceptance of the conditions required for thefranchise, acknowledging before a notary public and filed with the County Manager withintwenty -five days from May 12, 1983 Such acceptance shall acknowledge that the grantee agreesto be bound by and to comply with the provisions of the Johnston County Cable TelevisionOrdinance4 The term of the franchise shall be for 15 years5 Within one year from the date of the franchise, Kountry Kable shall render serviceto subscribers in at least 60 of the franchise area The other 40 shall be serviced by theend of the second year Concurrently with the filing of the written acceptance, Kountry Kableshall file with the County Manager a liability insurance policy as described in Section 1212E6 Faithful Performance Bond Kountry Kable shall, concurrently with the effectivedate of the franchise, post with the County and at all times thereafter maintain in full forceand effect for the term of the franchise the grantees sole cost and expense, a Corporate SuretyBond, as required by Section 1212 F1 of the Countys Cable Television Ordinance7 Kountry Kable shall pay the County 8120 to cover the cost of advertisement forthe public hearing8 Kountry Kable shall, at all times, adhere to the letter and the intent of theJohnston County Cable Television Ordinance Failure to carry out any requirement of the CableTelevision Ordinance will result in the County revoking the franchise9 No subscriber shall pay until such time as cable TV is installed and operatingThis motion was carriedAfter the awarding of the cable TV franchise to Kountry Kable, Commissioner Frank BHolding stated that it was not that he was opposed to th_e franchise, however ?lie,was concerned _and apprehensive abo4t the attoo_ess of thq gQrVi0_0_Q In the absence of Commissioner John Booker,the Chairman advised he had talked with Commissioner Booker and he was not opposed to grantingthe franchisei312May 12, 1983Continued3 Micro Water Association - Request Additional FundsCarl Smith of the Micro Water Association, along with Micro Mayor Percell Holland, andAndy Holland, Attorney, met with the board requesting an additional 8,128 to meet the contractcost of the project to run the 8 water line along US 301 from Oak Grove Inn to the NorthJohnston School property Mr Smith explained that the Micro Water Association a non - profitorganization had no money to help with the cost of this project, nor can they afford toborrow any more moneyAfter discussion, Commissioner Frank B Holding moved that the county grant thisrequest in the amount of 8,128 to the Micro Water Association to complete the water lineCommissioner James W Cash seconded the motion which was carried4 Drug Dog for Sheriffs DepartmentboardSheriff George Johnson met with the requesting 2,500 to purchase a dog LabradorRetriever to be used for drug work The Sheriff stated that this dog would be very beneficialto the Sheriffs Department The board agreed Chief Deputy Freddy Narron and DetectiveRicky Storey told the board that the dog was certified and well trained for drug work and totrack humansCommissioner Howard Benton moved that the Sheriff be authorized to purchase the dogfor 2,500Commissioner Frank B Holding seconded the motion which was carriedUpon a motion by Commissioner James W Cash, duly seconded by Commissioner HowardBenton and carried, the board adjournedrNorman C Denning, ChairmanEleanor N Creech JClerk to the BoardIiDetailsAnnotationsEntry PropertiesModified11192013 23847 PMCreated4172003 20834 PMTemplateMinutesFieldsMinutes -
