January 4; 1983The Johnston County Board of Commissioners met in regular session on Tuesday, January4, 1983, at 10 oclock am, in the Commissioners Room of the Johnston County Courthouse,Smithfield, Cash moved that the petition presented to the board requesting thepaving of Secondary Road # 1569 Loop Road located in Clayton Township be mailed to the NorthCarolina Department of Transportation for considerationCommissioner Howard Benton seconded the motion which was carried by unanimous vote3 Budget Amendment - Health DepartmentUpon motion by Commissioner Howard Benton, duly seconded by Commissioner James W Cashand carried by unanimous vote, the following budget amendments for the Johnston County HealthDepartment were approved;TB Program Revenues Increase 103519820Expenditures FireMarshal, Commissioner James W Cash moved that E T Benton and J C Johnson be appointed toserve on the Cleveland Volunteer Firemen Relief Fund BoardCommissioner Howard Benton seconded the motion which was carried by unanimous voteJanuary 4, 1983 Continued5 Capital Health Systems Agency Board - RecommendationCommissioner James W Cash moved that Donald L Westbrook, DDS of 512 Rosewood Drive,Smithfield, NC, be recommended to the Capital Health Systems Agency to replace N B Grantham,Jr, DDS, who submitted his resignation from the board as of December 29, 1982Commissioner Howard Benton seconded the motion which was carried by unanimous voteI6 Clayton ABC Store IssueRev Larry Harrison, spokesman, and a group of Clayton ministers, Lloyd F Hargis,L E Godwin, Jr, Richard Boger, Tom V Herndon, and Charles Ray Ennis, appeared before theboard expressing much concern and opposition to the decision of the County ABC Board to placean ABC Store at Clayton Rev Harrison asked the Board of Commissioners toassist the groupin an effort to be able to have a voice in the decision of whether or not an ABC Store wouldbe built at Clayton The board was reminded that 55 of the Clayton residents voted againstABC control in the county when it was voted in several years ago In response to this request,Chairman Denning stated the board was always glad to hear from the citizens in the county andit was the boards desire to do the things they feel in the best interest of all Johnston Countycitizens Chairman Denning further emphasized, however, that the ABC Board has full authorityto place ABC stores in the county and the Board of County Commissioners has no say -so whatso-ever The only other alternative to the ABC Boards decision would be an appeal to the StateABC Commission for a hearingThe Commissioners stated they respect this delegations position and concern, as wellas the concern of other Clayton residents, however, they have no responsibility or authorityin this matter and referred this group to the ABC BoardThe Board of Commissioners talked with the group about revenues from ABC stores andhow these funds had benefitted the county in running water and sewer lines to new industrieswhich created new jobs and additional revenue for the countyIn closing, Rev Harrison requested that the board ask the ABC Board for an appointmentto appear, so they might be heard regarding the ABC Boards decision to place a store atClaytonThe board asked the County Manager to contact the ABC Board Chairman and request thatthis board hear this group from Clayton regarding the placement of an ABC Store at Clayton andthat this meeting be held as soon as possibleRev Harrison and the Clayton ministers thanked the Board of Commissioners for theirtime and consideration7 Swift Creek Extension Homemakers Club - Request Trash Disposal SiteEdith Casey, President, and members of the Swift Creek Extension Homemakers Club,ipresented the following request by resolution to the board for consideration;We, as Extension Homemakers, are aware of the problem of waste disposal that ourcounty faces With this in mind, The Swift Creek Extension Homemakers Club is presenting thefollowing proposalIn the interest of helping to Keep Johnston County Beautiful ; to make it convenientfor more people to dispose of their trash, the Swift Creek Extension Homemakers Club proposesthat a trash disposal site be located on SR 1501 between the Burkett Jones Crossroad andSwift Creek More specifically, it could be located at the end of SR 1572, this road ends atSR 1501 This site would be on the Johnston County Airport propertyThere is ample space for such a site as the one located at the Produce Market andsince the county owns the property, land acquisition would be no problemWe hope the Commissioners will take this proposal under consideration and that positiveaction will be forthcoming The need is real, such a site would be utilized, and perhaps someof the ugly sites now in use could be eliminatedRespectfully submitted, The Swift Creek Extension Homemakers Club; Edith Casey,President, Members Eunice Clark, Mae Gardner, Ruth Warrick, Julia Slayton, Lynda Creech,Frances Hinton, Dorothy Underwood, Shirley Hatcher and Ida Mae BridgesThe board discussed trash disposal sites in this area, to learn that people in thisarea travel to the landfill as there are no public containers located near Swift Creeki1January 4, 1983 ContinuedAfter further discussion, Commissioner Frank B Holding moved that the County Managerconfer with people in this area in an effort to locate a site suitable for trash disposalcontainers, maybe located near the airport or on airport propertyCommissioner James W Cash seconded the motion which was carried by unanimous vote8 Resolution - Policies and Procedures for AppointmentsKramer Jackson, County Manager, reviewed the Resolution of Policies and Procedures forAppointments that had been presented at the December 6, 1982, board meeting The board discussedthis resolution and suggested adding the word board referring to board meetings and addingit calendar year is to be defined as a 12 month period beginning on the date of appointment ,these additions on page three, Section EAfter further review and discussion, Commissioner Howard Benton moved that thefollowing Resolution for Establishment of Policy and Procedures for Appointments to CountyBoards, Commissions, Committees or Authorities , be adoptedWHEREAS, it is the statutory duty of the Johnston County Board of Commissioners, asthe Governing Body of Johnston_ County, to appoint persons to various boards, commissions,committees or authorities, to assist in the operation of county government, andWHEREAS, the Board of Commissioners is desirous of appointing qualified, knowledgeable,and dedicated people to serve on the aforesaid boards, commissions, committees or authorities,and to that end solicits the interest and input of the citizens of Johnston County in makingsaid appointments, andWHEREAS, the Board of Commissioners is of the opinion that a policy and procedure thatwill make the citizenry more aware of the various appointments that are to be made from time totime and the solicitation by the Boardof Commissioners of information and recommendations fromthe public will assist the Board of Commissioners in the appointment of qualified, knowledgeable,and dedicated persons to serve on the various boards, commissions, committees or authorities,andWHEREAS, the Board of Commissioners desires to increase public awareness of theappointments to be made from time to time by the Board, to increase the public interest in theappointing process, to solicit the publics input in the making of the aforesaid appointments,and to insure attendance at meetings;NOW, THEREFORE, BE IT RESOLVED by the Johnston County Board of Commissioners thatSection 1 The policy of Johnston County governing appointments to the various boards,commissions, committees or authorities made by the Board of County Commissioners is as followsA Any citizen of Johnston County is eligible to serve on the appointed boards,commissions, committees or authorities of the County where such appointments is notprohibited by state statuteB All appointments will be made according to the Appointment Statute or Ordinancethat created that hoard, commission, committee or authorityC No citizen of Johnston County may serve in more than two appointed positions ofJohnston County Government unless exempted by nature of the position he or she mayhold in Governmental ServiceD Unless otherwise stated by statute, all terms of office shall be two years Nocitizen may serve more than three 3 consecutive terms or a total of ten 10years in any one position This policy may be waived 1f the Board of Commissionersdetermine that the removal of a number of individuals made ineligible by thisstatute would be detrimental to the functioning of that board, commission,committee or authorityE If an appointee has unexcused absences which constitute more than 25 of theBoard meetings in any calendar year which he or she is to attend pursuantto his or her appointment, he or she is obligated to resign Excused absences aredefined as absences caused by events beyond ones controlIf the individual refuses to resign, he or she may be dismissed by action of theBoard of County Commissioners subject to state or local lawA calendar year is to be defined as a 12 month period ,beginning on the date ofappointmentf?January 4, 1983 ContinuedF Each County Commissioner will have available to him or her a binder containinga list of all County Appointments, with the following data provided1 Name of the board, commission, committee or authority2 Brief on the functions3 Statute or cause creating board, commission, committee or authority4 Number of members and terms of office5 Current members and terms of office, including number of terms served6 Regular meeting day, time and location, if determinedSection 2 Procedures for filling vacancies for appointed positionsA Notification of available appointments1 A list of available positions stating terms of office, requirements foroffice, and duties of positions will be published in the newspaper ofJohnston County sixty 60 days prior to the month of appointments beingmade This procedure will be carried out by the Clerk to the Board ofCounty Commissioners2 Sixty 60 days prior to the terms expiring, the Clerk to the Board willmail a notice to each person who is eligible for appointment requestinginformation on his or her interest in continuing to serve If a resumeis not on file, one will berequested at this time If an individual isnot eligible for reappointment, he or she will be notified and given reasonfor being ineligiblei3 If, because of policy or otherwise, an individual is unable to be reappointedhe or she will be sent a letter of appreciation by the Chairman of the Boardof Commissioners at the expiration of his or her term thanking him or herfor the past services renderedB Selection Process1 Thirty 30 days prior to the date a vacancy occurs, all resumes ofapplicants for a particular position will be given to the County ManagerThe Manager will check for eligibility2 A list of all names submitted will be sent to all Commissioners with thosewho are ineligible noted and the reasons for ineligibility given3 The Clerk to the Board shall be given a copy of the information to beplaced on the agenda as the Appointments for action at the next meetingof the County Board of CommissionersC Notification of AppointmentThe Clerk to the Board shall prepare a letter of notification to theappointee and a copy of the affected board, notifying each of the appointmentThis letter will include a congratulation statement, the time, data and placeof the first meeting he or she is to begin service; and when and where he orshe is to be sworn in, if this is requiredD ResumesAll resumes received shall be retained for at least two 2 years Resumesshall be kept on file for all active appointees All the above data shall bemaintained as confidential for County Howard Benton moved that Jack Dossenbach, Jr, Lee County Commissioner,be recommended for appointment to the Board of Directors of the North Carolina Association ofCounty Commissionersto serve the and AugustB Electrical InspectorC Dog WardenD Tax CollectionsE Landfill the County Manager reported on truck accident12 Tobacco AllotmentChairman Denning acting as farm agentas designated by the boardfor the countystobacco allotment reported that the countys tobacco allotment of 7,227 pounds can be soldand that it was his recommendation that the county sell this allotment in 7 parcels by sealedbidsThe board discussed this matter at length After discussion, Commissioner FrankB Holding moved that the County Manager be authorized to advertise the county tobaccoallotment of 7,227 pounds for sale in 7 parcels by sealed bids to be opened by the Chairmanof the Board and the County Manager on Wednesday, January 19, 1983, at 12 oclock noonCommissioner Holding further moved that the Chairman and the County Manager be authorizedto award the bids and that the Chairman be authorized to execute all necessary papers requiredby the ASCS Office to convey this allotmentCommissioner James W Cash seconded the motion which was carried by unanimous vote13 Mental Health - Personnel Policy ChangeDan Searcy, Area Director, Johnston County Mental Health Center, met with the boardrequesting an increase in the Other Pay Provisions from four dollars 400 per houror 15 of the hourly salary rate whichever is less to six dollars,600 per hour or20 of the hourly salary rate whichever is lessDr Searcy further explained that the increase in the rate for on call emergencyduty is being funded by the N C Division of Mental Health, Mental Retardation and SubstanceAbuse Services, and that the Division of Mental Health, Mental Retardation and Substance AbuseServices has provided funding for the third psychiatrist These funds to increase the on callemergency duty compensation was provided to maintain the psychiatrists salaries at acompetitive level in an effort to stabilize the deinstitutionalization effort in North CarolinaAfter discussion,Commissioner John M Booker moved that the above request begranted and that Article III - Section 16 of the County Personnel Policies read as follows;OTHER PAY PROVISIONSEmployees who are required to be available to work on an emergency on call basismay be compensated monetarily if compensatory time off interferes with the accomplishment ofthe required work during the standard work day The rate of monetary compensation for oncall emergency duty will be six dollars 600 per hour or 20 of the hourly salary ratewhichever is less No employee shall be paid for on call emergency duty without the approvalof the AdministratorCommissioner Howard
