October 19, 1984The Johnston County Board of Commissioners met in special session, Friday,- October 19, 1984, at 10 oclock am, Johnston County Courthouse, Smithfield, NorthCarolina, with the following members present;Norman C Denning, Chairman, James W Cash and Howard BentonMembers Absent Frank B Holding, Vice Chairman and John M Booker,The Chairman called the meeting to order and the following business wastransacted1 Wilsons Mills Community Development Block Grant - Acceptance of GrantUpon a motion by Commissioner Howard Benton, duly seconded by CommissionerJames W Cash and carried, the following Community Development Block Grant Agreementwith the North Carolina Department of Natural Resources and Community Developmentwas accepted and the Chairman authorized to execute the Grant Agreement for theWilsons Mills Community Development Project;Grant AgreementCommunity Development Block Grant ProgramUpon execution of this grant agreement, the North Carolina Department ofNatural Resources and Community Development NRCD agrees to provide to therecipient the Community Development Block Grant assistance under Title I of theHousing and Community Development Act of 1974, as amended PL 93 -383 authorizedby the NRCD funding approval, the North Carolina Community Development BlockGrant administrative rules, applicable laws and all other requirements of NRCDnow or hereinafter in effect The grant agreement is effective on the date thegrant agreement and funding approval are signed by the recipient The grantagreement consists of the approval application, including the certifications, maps,schedules and other submissions in the application, any subsequent amendmentsto the approved application and funding approval and the following general termsand conditions4October 19-, 1984 Continued1 Definitions Except to the extent modified or subplemented by thegrant agreement, any term defined in the North Carolina Community DevelopmentBlock Grant Administrative Rules, 15 NCAC 13L shall have the same meaning whenused hereina Agreement means this grant agreement, as described above, and anyamendments or supplements theretob Recipients means the entity designated as a recipient for grant assistancein the grant agreement and funding approvalc Certifications mean the certifications submitted with the grant applicationpursuant to the requirements of Paragraph f of Rule 0407 of the North CarolinaCommunity Development Block Grant Administrative Rules, 15 NCAC 13L 0407fd Assistance provided under this agreement means the grant funds providedunder this agreemente Program means the community development program, project, or otheractivities, including the administration thereof, for which assistance is beingprovided under this agreement2 Obligations of the Recipient - The recipient shall perform the programas specified in the application approved by NRCD The recipient shall complyf with the certifications purs +ueant to Paragraph f of Rule 0407 of the NorthCarolina Community Development Block Grant Administrative Rules, 15 NCAC 13L0407f The recipient shall also comply with all other lawful requirements ofNRCD, all applicable requirements of the General Statutes of the State of NorthCarolina and any other applicable laws and Executive Orders currently or hereafterin forceI _3 Obligations of Recipient with Respect to Certain Third Party RelationshipsNRCD shall hold the reci -pient responsible for complying with, the provisions ofthis agreement even when the recipient designates a third party or parties to-undertake all or any part of the program The recipient shall comply with alliawful requirements or NRCD necessary to insure that the program is- carriedout in accordance with the recipients certifications including the certificationof assumption of environmental responsibilities under Rule 0407 of the NorthCarolina Community Development Block Grant Administrative Rules, 15 NCAC 13L10044 Interest of Members, Officers_; or Employees of the Recipient, Membersof Local Governing Body, or Other Public Off i c i a l s No member, officer, or employeeof the recipient, or its agencies, no member of the - governing body of the ° local i tyin which the program is situated, and no other public official of such localityor localities who exercises any functions or responsibilities with respect to theprogram during his tenure or for one year thereafter, shall have any financialinterest, either direct or indirect, in any contract or subcontract, or the proceedsthereof, for work to be performed in connection with the program assisted underthis agreement Immediate fam i I y members of said members, off i cers, employees,and officials are similarly barred from having any financial interest in the programThe recipient shall incorporate, or cause to be incorporated, in all such contractsor subcontracts, a provision prohibiting such interest pursuant to the purposeof this sectionThe assistance provided under this agreement shall not be used in thepayment of any bonus or commission for the purpose of obtaining NRCD approvalof the application for such assistance, or NRCD approval of applications for addi-tional assistance, or any other approval or concurrence of NRCD required underthis agreement, or the North Carolina Community Development Block Grant Admin-istrative Rules, with respect thereto;
