July 3, 1972 - Regular1 4Fit widthJuly 3, 1972EildThe Johnston County Board of Commissioners met in regular session in the Commissioners Roomof the Johnston County Courthouse, Smithfield, North Carolina, July 3, 1972 at 11 oclock am, withthe following members presentJ Dobbin Bailey, Chairman, Norman C Denning, Frank B Holding, Freddie Adams and HowardBentonMembers Absent NoneThe following business was transacted1 Interim ResolutionUpon the recommendation of W H Britt, Auditor, Commissioner Norman C Denning moved that thefollowing Interim Resolution be adoptedRESOLVE, that under authority of Chapter 153, Public Laws of 1943, as amended, Section 128, theAuditor of Johnston County and Treasurer of Johnston County be, and they are hereby authorized to approveand pay current expenses in the several departments of the County Government not to exceed 90 ninetydays from the date hereof pending the making of the annual appropriation as authorized in said law, andfurther that the expenses so authorized be charged against the final appropriation of the severaldepartments of the County respectively when said appropriations are made for the current yearCommissioner Howard Benton seconded the motion which was carried unanimously2 Road Petition - S R # 1336Mrs Roscoe Byrd from Elevation Township appeared before the Board and presented a petitionsigned by all residents on Secondary Road # 1336 requesting pavingCommissioner Frank B Holding moved that the Board approve the petition and that it be mailedto the State Highway Commission in Wilson, North Carolina, and also requested that this road be re-evaluated, since there were several new homes on itCommissioner Norman C Denning seconded the motion which was carried3 -Mr John L Perkinson, State Board of Health - Regarding Health BudgetMr John L Perkinson, Section Chief, State Board of Health, along with Helen Ray, ActingAdministrator, Johnston County Health Department, appeared before the Board in regards to the HealthDepartment Budget Mr Perkinson advised the Board of County Commissioners that in order to receiveState participation there would have to be an appropriation made for a Director or an Administratorin the 1972 -1973 budget, or an amount of 14,37600 set up as a contingent within the Health Departmentbudget to be used to pay an Administrator or Director when and if one becomes available37July 3, 1972 Cont4 Release of Described Lands From Old Age Assistance Lien Against A A Hicks, RecipientUpon the recommendation of W R Britt, County Attorney, the following resolution was adoptedWHEREAS Addie Hicks obtained title to a sixteen acre parcel of land inONeals Township,Johnston County, hereinafter described from the Division of the lands of her late father, Stephen Hicks,of record in Land Book 8 page 123, Office of Clerk of Superior Court of Johnston County; whereas saidparcel of land is described as followsBEGINNING at a stake Joe Hogg corner and runs thence with his line South 85 East 1296 feet toa stake, C A Fitzgerald corner; thence with his line North 5 45 East 566 feet to a stake, corner ofLot No 1; thence with the line of Lot No 1 North 85 15 West 1293 feet to a stake, HermanPittman corner;thence with his line South 5 10 West 554 feet to the BEGINNING,WHEREAS Addie Hicks died April 26, 1971 and left a last will and testament in the office ofClerk of Superior Court under the file designated 71 E 160; whereas in Item 3A of said will A A Hickswas devised a one -ninth interest in the real property of Addie Hicks; whereas A A Hicks is a recipient,of benefits from the Johnston County Department of Social Services and whereas said money paid to himamounts to 208900; whereas all of the heirs of the late Addie Hicks have agreed to sell and conveytitle to said 16 acree tract of land to Coy Batten for cash consideration of 10,500; whereas threedisinterested freeholders of Johnston County have signed affidavits stating that said price of 10,500is a fair price for said lands, and whereas it appears to the Board of Commissioners of Johnston Countyfrom said affidavits that said price of 10,500 is fair and reasonable -and` is as much as, if ,not, morethan, could be received from a public sale thereof; and whereas the 1972 crop allotment on the AddieHicks farm in ONeals Township is 83 100ths acre of tobacco with 1524 poundsNOW, THEREFORE, upon motion of Commissioner Freddie Adams and seconded by Commissioner Frank BHolding it was unanimously carried thatthe county authorize W R Britt, County Attorney, and he ishereby directed?to release the above described lands from the operation of the oldage assistance lienagainst the property of A A Hicks, recipient, in the office of Clerk of Superior Court of JohnstonCounty upon receipt by the Treasurer of Johnston County of the sum of 1,66666, the same constitutinga one - Clayton Requesting Financial AssistanceMr Douglas McCormac of Clayton, advised the Board of County Commissioners that the Town ofClayton had purchased a 75 acre tract of land east of Clayton, to be used as a landfill, and requestedfinancial, assistance He advised the Board that a road would have to be constructed to the landfilland that it would require approximately 58,000 to put the landfill in operation Mr McCormac wasadvised by the Chairman that at this time the Board could not make any definite commitments, but lookedwith favor upon this project and would attempt to render some financial assistance8 Raleigh Rescue Mission - Tax Exemption RequestMr Waymon Pritchard and Mr Charlie Morton from the Raleigh Rescue Mission appeared before theBoard and requested tax exemption for the Rescue Mission property located in Wilders TownshipThe Board took no official action on this matter, but took it under advisement9 Landscaping Plans for County ParkinE AreasMrs Marvin Taylor and Mrs Hubert Denning presented to the Board drawn plans for paving andlandscaping of the County parking lotAfter a discussion, the Board requested Mrs Taylor and Mrs Denning to invite the designersto meet with the Board Thursday night, July 13, 1972, and arrangements would be made for advertisementfor bids10 Secondary Road Program - 1971 -1972 Audit Contract nDaniel G Matthews, CPA, of Smithfield, North Carolina, appeared before the Board and agreedto audit the County accounts for the fiscal year 1971 -1972 for the amount of 284000Commissioner Norman C Denning moved that Mr Matthews be awarded the contract for 284000for the year 1971 -1972Commissioner Frank B Holding seconded the motion which was carried unanimously12 Johnston Memorial Hospital - Audit Contract 1971 -1972Commissioner Norman C Denning moved that the Board of County Commissioners concur in theawarding of the audit contract to Koonce, Wooten and Hayward by the Hospital Board of Trustees for theauditing of the Hospital accounts, for the year 1971 -1972Commissioner Frank B Holding seconded the motion which was carried13 Terms of Office -
