Previous page1 22Fit widthBiroMeeting of Board of Commissioners for County of JohnstonJuly 13, 1972The Johnston County Board of Commissioners met in special session in the Auditors Office ofthe Johnston County Courthouse, Thursday, July 13, 1972, at 7 oclock pm, with the following memberspresentJ Dobbin Bailey, Chairman, Norman C Denning, Frank B Holding, Freddie Adams and Howard BentonMembers Absent NoneThe following business was transacted1 Parking Lot Paving Plans and SpecificationsMrs Hubert Denning, Mrs Marvin Taylor and Mrs William Wellons, members of the SmithfieldGarden Club, along with Mr Fred Eichenberger and Mr Bruce Pizzimenti, Landscape Architects, with theNorth Carolina State University School of Design, appeared before the Board by invitation with drawnplans and specifications for bids for the paving of the Courthouse parking areasAfter discussion and review of the plans and specifications, Commissioner Frank B Holding movedthat W H Britt, Auditor, be instructed, upon receipt of final specifications, to advertise for bids forpaving of the Courthouse parking areas Commissioner Holding further moved that specifications be mailedto Barrus Construction Company, Kinston, North Carolina, S T Wooten Construction Company, Smithfield,North Carolina, C C Mangum Construction Company, Raleigh, North Carolina, Gelder and Associates, Garner,North Carolina, Crawford Construction Company, Smithfield, North Carolina, and Shackleford ConstructionCompany, Wilson, North Carolina, Bids to be opened at 3 oclock pm, August 7, 1972Commissioner Freddie Adams seconded the motion which was carried2 Mr Ray Cobb, Chairman, Johnston County PIanning Council on Mental RetardationMr Robert L Harvey met with the Board and explained that he had resigned as Chairman of theJohnston County Planning Council on Mental Retardation, and introduced Mr Ray Cobb, who had agreed totake his position on the Council as ChairmanMr Harvey also reminded the Board that it needed to make an appointment to replace the lateCommissioner Adam J Whitley, Jr, who served on the Mental Retardation CouncilChairman Bailey advised Mr Harvey that the Board of Commissioners desired to wait on theappointment until December, 1972, since at least one new member will be serving on the Board at thattime3 Re- allocation of Funds in Mental Health BudgetM W Stancil, Chairman, Johnston County Mental Health Area Board, appeared before the Board ofCommissioners requesting a re- allocation in the Mental Health Budget, explaing that this would not changethe total appropriation which had tentatively been approvedAfter much discussion, Commissioner Frank B Holding moved to grant Mr Stancils requestCommissioner Freddie Adams seconded the motion which was carried4 Board of Education to Write,OwnChecksMr E S Simpson met with the Board relative to a letter of June 28, 1972, requesting that theJohnston County Board of Commissioners, along with the Auditor and Treasurer, pursue the matter ofmaking changes that would provide less expense and more efficiency with some reduction in time and costto the Auditor and Treasurers Office, and also, his officeMr Simpas,on further; stated that the Auditor and Treasu?er through the years had renderedvaluable and courteous service to the schools, but the Board of Education felt that there may be a moresimple and less expensive method of handling these transactionsAfter discussion and upon the Boards recommendation, Commissioner Howard Benton moved that theBoard of Education be authorized to process and write their own checks, effective as soon as practicable,withthe Treasurer and Auditor receiving copiesCommissioner Frank B Holding seconded the motion which was carried unanimously5 Report - Road at Clayton Landfill SiteChairman Bailey reported he had talked with W H Pridgen, District Engineer, State HighwayCommission, regarding the possibility of a road leading to the Clayton Landfill site In Mr Pridgensopinion it was best to use the?road as is, because it has a solid foundation of rock and there was notenough right-of-way to meet State requirements6 Report - County Farm PropertyCommissioner Norman C Denning reported on the County farm property Commissioner Denning statedthat the farm land was in poor condition and needed to be cultivated with something plantedCommissioner Frank B Holding moved that Commissioner Denning use his best judgement in keepingup the County farm propertyCommissioner Freddie Adams seconded the motion which was carriedv x374July 13, 19727 Report - Courthouse RepairsCommissioner Freddie Adams reported that he had inspected the Courthouse and there were severalareas that needed immediate attention, especially the County Commissioners Room and rest roomsCommissioner Frank B Holding moved that Commissioner Adams use his best judgement in upgradingthe CourthouseCommissioner Howard Benton seconded the motion which was carried8 Sale of Lots in Kenly Approved by BoardWHEREAS on May 1, 1972, The Board of Commissioners directed Miss Rhetta Martin, Tax Attorney,and William R Britt, County Attorney, to advertise three parcels of land in the town of Ke nly forpublic sale to -the highest bidder for cash, said parcels being described in Item No 15 of the minutesof the meeting of the Board of May 1, 1972; that said attorneys duly advertised said parcels of realproperty and personally conducted the sales of said parcels on the premises in the Town of Kenly on--Monday, July 10, 1972; whereas Chairman J Dobbin Bailey and Tax Collector Harper Godwin also attendedall three of said sales; that Mary H Ballance became the last and highest bidder of parcel one at aprice of 1100; whereas Paul William Willoughby became the last and highest bidder of Parcel No Twoat a price of 125000; whereas John Henry Jones became the last and highest bidder of Parcel No 3at a price of 235000; whereas it is the opinion of the Board of Commissioners of Johnston Countythat said prices are fair and adequate and that the sales of said lands should be approved and confirmedby the Board of Commissioners of Johnston County; and whereas the chairman of the Board should beauthorized and empowered to convey title to all three of said parcels of land to the highest bidderrespectively of said lands upon full payment of the purchase priceNOW, THEREFORE, upon motion of Commissioner Norman C Denning and seconded by CommissionerFreddie Adams it was unanimously adopted that said sales be in all respects approved and confirmed andthat Chairman J Dobbin Bailey be authorized and empowered to convey title to the purchasers uponreceipt of the full purchase price, and further that Miss Rhetta Martin be allowed the sum of 23500and William R Britt be allowed the sum of 23500 for their services It was further ordered that -all other costs of the sale be paid9 1 Release of Welfare Lien - Leamon Whitfield Rhodes PropertyWHEREAS Mrs Mattie Rhodes obtained title to an acre of land in Bentonville Township, JohnstonCounty, on October 10, 1951, of record, in Book 501 page 59 of Johnston County Registry, said propertybeing described as followsBEGINNING at an iron stake, the center of the road ditch on the south side of the old Goldsboro-Fayetteville Road and runs South 32 East 138 feet to a stake; thence North 58 East 316 to a stake;thence North 32 West 138 feet to the center of said road ditch; thence with the center of said roadditch South 58 West 316 feet to the BEGINNING, containing one acre, more or lessWHEREAS, Mrs Mattie Rhodes has in recent months died leaving no Last Will and Testament, andwhereas she left four children, one of whom is Leamon Whitfield Rhodes; that Leamon Whitfield Rhodeshasand is now been a recipient of benefits from the Johnston - County Department of Social Services,and whereas there is a lien against any and all real property in which the said Leamon Whitfield Rhodeshas any interest; and whereas all of the heirs of the late Mrs Mattie Rhodes have agreed to sell andconvey title in and to said one acre tract of land to Betty Jo Lassiter, a granddaughter of the lateMrs Mattie Rhodes for a total consideration of 250000; and whereas Commissioner Norman C Denninghas inspected said property and is of the opinion that said price of 25000 is fair, adequate andreasonable for said real property and is as much as, if not more than, could be received from a publicsale thereof; and whereas Commissioner Denning is familiar with land values in the community in whichthis property is locatedNOW THEREFORE, upon motion of Commissioner Norman C Denning and seconded by CommissionerFrank B Holding it was unanimously carriedthat the Board of Commissioners authorize W R Britt,County Attorney, and he is hereby directed to release the above described lands from the opeationof the lien against the property of Leamon Whitfield Rhodes, recipient, in the office of Clerk ofSuperior Court of Johnston County upon receipt by the Treasurer of Johnston County of the sum of62500, the same constituting a one- fourth of said purchase price of 2500 It is ,further orderedthat said lien remain in full force and effect as to any other property owned by Leamon WhitfieldRhodes or which he may hereafter inherit or otherwise acquire or own from and after this date10 Smithfield Planning and Zoning BoardUpon the recommendation of the Board of Commissioners of the Town of Smithfield, CommissionerNorman C Denning moved that Ed Renfrow and Lester Woodard be appointed to the Smithfield Planningand Zoning Board, these terms to expire July 1, 1975Commissioner Frank B Holding seconded the motion which was carried unanimously11 Commissioner Howard Benton - Fuel Oil BidsCommissioner Norman C Denning moved that W H Britt, Auditor, be authorized to advertise forbids on the amount of fuel oil that would be required in the heating of County buildings for the fiscalyear July 1, 1972 to June 30, 1973The motion was seconded by Commissioner Freddie Adams and was carried unanimously13 Adoption of Budget for the Fiscal Year 1972 -
