several other members of the Smithfield GardenClub met with the Board and requested that a pink dogwood on the north side of the Ellis houseand a promegranate shrub on the south side be preserved and not destroyed along with thedemolition of the property The Garden Club members visited the site with the Board ofCommissioners and explained whereby the two trees could be preserved and not interfere withplans to make the lot into a parking area -The Board after visiting the property with the Garden Club members informed them thatthey would go along with their request and instruct the party who would be demolishing theproperty to look out for the trees2 Road Request - Attorney J R BarefootAttorney J R Barefoot of Benson appeared before the Board requesting that theBoard recommend to the State Highway Commission that a certain road leading off Highway 50 toa farm of his on which several people reside, be taken over and maintained by the StateMr Barefoot was advised by Commissioner Norman C Denning that he would personallycontact Mr W H Pridgen, District Engineer, and ask him to go and check this road with him3 West Smithfield Sanitary DistrictD Cole Ray and V J Underwood appeared before theBoard inquiring into the statusof the latest petition submittedrequesting arecall election for the West Smithfield SanitaryDistrict Board members,Chairman Bailey informed them that grantedCommissioner Adam J Whitley, Jr seconded the motion which was carried11 Health Department - Fee ScheduleMr Ed Haney, Health Director, presented to the Board a program that had beenapproved by, the local Board of Health establishing various inspection fees to be collected bythe sanitarians in accordance with certain inspections that they would be makingThe Board discussed this matter at full length with Mr Haney and Mr Stultz, whowas also present, and decided not to approve this program without further study12W H Britt, Auditor and Ed Haney, Health Director advised the Board that funds herein and as directed by the County through its duly authorized AgentII APPRAISALSThe Contractor shall aid and assist the County Supervisor of Taxation and the listtakers and assessors in the CONDITIONS1 Director of Revaluation ProgramDirection and general administration of the Revaluation Program in JohnstonCounty shall be under the authority, direction and supervision of the Tax Supervisor ofJohnston County All final decisions as to assessed valuation, procedure followed and formsused in the revaluation shall be made by the Tax Supervisor of Johnston County The entireprocedure of the Revaluation Program is to be in accordance with the Statutes of North CarolinaSeptember 2, 1969 Cont2 General InstructionsAll prPperty,,real and personal, herein defined, shall, as far as practicable,be valued at its true value in money, as of January 1, 1971 The intended purpose of thisContract is to haveal-1 property and subjects of taxation,_ herein defined, assessed at theirtrue and actual value in money, in such manner as such property and subjects are usually sold,but not by forced sAle thereof The term true value in money, as used herein, shall meanfor what the property and subjects can be transmuted into cash when sold in such manner as suchproperty and subjects are usually soldIn determining the value of land the appraisers shall consider as to each tract,parcel or lot separately listed at least its advantages as to location, quality of soil,quantity and quality of timber, water power, water privileges, mineral or quarry or othervaluable deposits, fertility, crop allotments, adaptability for agricultural, commercial orindustrial uses, the past income therefrom, its probable future income, the purchase and saleprice of said land and similar lands; and any other factor which may affect its valueThe appraiser shall pay particular attention to the ;value ,o,f any land affectedby the Mocassin Creek Drainage Project and the Mill Creek Water Shed ProjectPrior to the commencement of appraisal work the Contractor shall prepare andsubmit to the County for approval a schedule of land valuesIn determining the value of a building, the appraisers shall consider at leastits location, type of construction, age replacement cost, adaptability for residence, commercialor industrial uses, lease or rental arrangements, the past income therefrom, the probablefuture income,--the_purchase and stale price of such building and othersimilar buildings, andmany other factors which may affect its valueBuildings partially completed shall be assessed in accordance with the degreeof completion as of January 1, 19713 Laws To Be ObservedThe Contractor is assumed to be familiar with and he shall observe all Federal,State and local laws, codes, ordinances and regulations which in any manner affect thoseengaged or employed inthe work or in any way affect the conduct of the work No pleas ofmisunderstanding or ignorance on the part of the Contractor will in any way serve to modifythe provisions of the Contract or these specificationsThe Contractor shall at all times observe and comply with all Federal, State,and local laws, orders, codes, ordinances and regulations in any manner affecting the conductof the work, and Contractor and his surety shall indemnify and save harmless the County, itsofficers, agents, and servants against any claim or liability arising from or based on theviolation of any such law, ordinance, regulation, order or decree, whether by him or hisemployee4 Responsibility for Damage ClaimsThe Contractor and his surety shall indemnify and save harmless the County andall its officers, agents and employees from all suits, actions or claims of any kind, characteror description brought for or on account of any injuries or damages received or sustained byany person, persons, company,, corporation, or property, by or from the said Contractor, hisemployees or by or in consequence of any neglect insafeguarding the work, for amountsrecovered by any infringement of patent, trademark or copyright, or from any,claims or,amounts,arising or recovered under the Workmens Compensation Law, or any other law, ordinance, orderor decree, and so much of the money due the said Contractor under and by virtue of the Contractas shall be considered necessary by the County may be retained, and in case no money is duehis surety shall be held, until such suit or suits, action or actions, claim or claims forinjuries or damages as aforesaid shall have been settled and satisfactory evidence to thateffect furnished to the CountyThe Contractor shall carry public liability insurance and Workmens Compensationinsurance which shall save harmless the County and Countys representative from any claims,demands, actions and causes for action arising from any act or the omission of any act bythe Contractor, his agents, and employees in the performance of these specifications Thepublic liability insurance shall be made satisfactory to, the Countys representative, andshall include not less than 100,000300,000 coverage against all damages to or claims bypersons for bodily injury and not less than 50,000 coverage against all damages to property5 Prosecution of WorkThe Contractor shall begin the work to be performed under the Contractimmediately upon its acceptance by Johnston County Board of Commissioners and shall carry onthe Program of Revaluation without interruption, and shall complete and deliver said work onor before October 1, 1970, with the exception of new buildings completed between July 30, 19702and December 31, 1970, and partially completed buildings as of January 1, 1971, the appraisalof which shall be completed and delivered to the County Tax Supervisor by the Contractor on orbefore February 15, 1971 It is specifically agreed, and so declared, that time is of theessence in the performance of the Contract The appraisals shall be turned overto theCountys representative as they are completed,138September 2, 1969 ContUpon the execution of the contract the Contractor shall forthwith submit tothe Countys representative a proposed work schedule to be approved by the Countys representa-tive The schedule must show the beginning and termination dates for each phase of the workcovered by the Contract, broken down as to 1 geographic coverage, 2 types of property,3 field work, 4 office work, 5 review and 6 such other phases as seem desirable tothe Contractor Upon approval of the proposed schedule by the Countys representative, thework schedule is to be used as a basis for performance of the provisions of thesespecifications6 Liquidated DamagesIn the event -that the appraisal and revaluation of all property herein requiredto be appraised and revalued is not completed by the date set forth in this Contract, thesum of 10000 per day, Saturdays, Sundays and holidays excluded shall be assessed againstthe Contractor for the first month and 30000 per day therefrom, which said amounts shall beconsidered as liquidated damages for such delay in performance and shall be deducted from thefinal payment of the compensation herein provided7 PersonnelThe Contractor shall use- in the work competent employees of good character andan adequate number to expeditiously prosecute the work All employees must have sufficientmaturity, skill and experience to perform properly the work assigned to them Employeesexecuting appraisals or other special or skilled work shall have sufficient education, trainingand experience in such work to perform it properly and satisfactorily in the manner prescribedin the Contract, and shall provide satisfactory proof in affidavit form of their appraisalexperience in their particular field Complete instruction and direction of all members ofthe personnel connected with the revaluation shall be supplied by the Contractor No personunder twenty -five years of age, except clerical personnel or manual laborers, may be used bythe ContractorThe Contractor shall furnish the County a list of all local persons to beemployed for acceptance or rejection by the County No local person may be employed by theContractor without prior approval of the Tax Supervisor and the Board of Commissioners ofJohnston CountyThe County may require the Contractor to remove from the work any person theCounty considers to be incompetent or negligent in the performance of his duties, or who isguilty of misconduct, and such person shall not be employed again in the work without theCountys written consent8 Office SpaceUnfurnished office space necessary for the performance of the clerical work willbe provided for the Contractor by the County at no cost, and necessary tables and chairs forsuch office space may be supplied by the County9 Use of Records and MapsAll maps,-tax records, data and information in the possession of the Countypertaining to properties covered by -this agreement will be made available to the ContractorA system subject to the approval of the County Tax Supervisor shall be employedfor keeping an accurate account of all maps and records that shall be taken by the Contractorfrom the Countys files Such maps, records, and data will be- carefully preserved and willbe returned to the County as soon as use of same has been completedThe Contractor will furnish copies of the tax maps for use by its appraisersin making field inspections and appraisals10 Record CardsSuitable record cards for residential, farm, commercial and industrial, andpersonal property, appraisals shall be designed to meet the requirements of the County andshall be submitted to the County Tax Supervisor for his approval before being used Theyshall include all items of information in connection with the construction, age, condition,depreciation, outline sketch, and pricing data of each building and item of personal propertytogether with the owners name, available lot, block, map numbers, etc, and shall be used torecord all pertinent information relative to the land, buildings, and personal property, andthe total valuation of land, buildings, and personal property, which cards are to be furnishedat the expense of the- Contractor All cards shall be separated accordingto Townships, and shall be arrangedalphabetically according to the names of the owners of the individual parcels of propertyAn alphabetical index of all properties included in the appraisal, will alsobe prepared and furnishedThe Contractor shall provide at its own expense all supplies, cards, field mapsand field record sheets needed in performing the work and all reports and manuals to bedelivered to the County as set forth in the Contract All filing cabinets of a permanentnature will be provided by the County and shall be the property of the County140September 2, 1969 ContThe Contractor shall retain all such notes, records and data in a place of safestorage for a period of two years from and after the acceptance of the work and that saidnotes, records and data be made available to the County Tax Supervisor upon his request11 Support of ValuesUpon completion of the work the Contractor shall provide the services of one ormore qualified representatives for a continuous two week period after valuation notices aremailed to assist the Tax Supervisor in explaining appraisals and valuation procedure used toall interested taxpayers of Johnston CountyThe responsible head of the field organization of the Contractor in charge ofthe revaluation program in the County shall be present -at all official meetings of the Boardof Equalization and-Review of the ,County following g p and allq Count followin - the - com letion of, the work untilcomplaints are heard and disposed of, to assist in the settlement, of complaints to supportand defend the values placed upon the various propertiesIt is further agreed that qualified appraisers shall be provided by theContractor to assist the County in the event of appeals from the County Board of Equalizationand Review to the State Board of Assessment, or to the Courts This service shall be providedat no additional cost to the County in the case of complaints as to assessed valuations arisingwithin one 1 year following the completion of the work and its acceptance by the County12 Annulment of ContractThe Contract may be annulled by the County for the following reasons a Failure of the Contractor to start the work on the dates specified;b Substantial evidence that the progress begin made by the Contractor isinsufficient to complete the work within the specified time;c Failure on the part of the Contractor to observe any requirement of theContractd Any other legal grounds for annulmentBefore the Contract may be annulled, the0 ontractor and its surety must benotified in writing by the County of the conditions which make annulment of the Contractimminent Ten 10 days after this notice is given, if a satisfactory effort has not beenmade by the Contractor or its surety to correct the conditions, the County may declare theContract annulled and notify the Contractor and its surety accordinglyIn case the Contract is annulled,the County reserves the right, to takepossession of all work completed, work in progress, material,, or any other part of the work,to account for said work and material, and to use the same to complete the project within areasonable time and in accordance with the Contract specifications When the work is thusfinally completed, the total cost of the same will be computed If the total cost is morethan the Contract price, the difference shall be paid by the Contractor If the total costis less than the Contract price, the difference will be paid to the Contractor13 Sub - Contracting or Sub - LettingThe Contractor shall not sub- contract or sub -let any part of thesespecifications without written consent of the County, and from sureties,on Contractors bondand Contractors liability Insurance carriers14 ArbitrationIn case the County and the Contractor cannot agree as to whether any provisionof the Contract has been satisfactorily performed, the dispute shall be referred fordetermination to three arbitrators, one of whom shall be selected by the County and one bythe Contractor; the two thus chosen shall select a third arbitrator; and a decision of themajority of said arbitrators shall be binding upon the County and the Contractor The expenseof the arbitration shall be bonne equally by the County and the Contractor15 Performance BondThe Contractor will furnish a bond with,some surety company authorized to dobusiness in this state, or a deposit of money, certified check or Government securities, forthe full amount of the Contract for the faithful performance of the Contract within the timeherein specified and quaranteeing payment for labor, services and materials required inperforming said Contract, said performance bond to be furnished the County at the costs shall be made Prices of materials in variousquantities and qualities shall be obtained from local material dealers Currentwage scales for various types of building construction shall be carefullyinvestigated Labor efficiency for the several trades and on the various classesof work shall be considered in the determination of building schedulesFrom the foregoing information unit construction costs shall be analyzedfor all materials and fixed equipment entering into the construction of all typesof buildings, which construction costs shall include architects, and engineerstfees, together with contractors overhead` and profit and shall reflect the averagecost of„ materiaghs in place for houses of cheap construction, houses of ordinaryconstruction, and houses of high quality construction Separate unit costs shallbe developed in the same manner for all types of commercial, industrial, farm andspecial purpose buildings After such costsare developed, they shall be appliedto new construction of known cost to prove their accuracy When such accuracy isdetermined or proved in a manner acceptable to the County, all building costs exceptthose of industrial buildings shall be indicated in square foot unitsThe square foot base price shall be established upon definite specificationfor the three best grade houses, having 400 square feet to 4000 square feet, andhouses below these grades having 250 square feet to 2500 square feet, and for variousstory heightsSchedules shall then be prepared for any and all variations from bases,including the value of the following items; all types of wall construction, roofs,floors, heating, plumbing, and lighting systems, fireplaces and stacks, insulation,air conditioning, interior finish, tiling, finished basements, finished attics, etcTables shall show additions or deductions from base prices shown in eachresidence schedule Every change from base specifications shall be recorded inthepricing schedule and on the record cardsPrices for various sizes and types ofporches and additions shall beincluded, also schedules for attached and detached garagesAll of the foregoing data shall be set up in an easily comprehensiblemanner enabling the County to show the taxpayer how property valuations weredetermined2 Property AppraisalsA Commercial Property1 Commercial BuildingsAll commercial buildings shall be carefully measured An outlinesketch of the main body and additions shall be drawn to scale, or dimensions clearlyshown, on the field record card A careful inspection of each building shall bemade from cellar to attic and all construction and fixed building improvements notedon the record card Master teproduction,costcontrols which have been checkedagainst actual recent costs of newly erected construction in the County and comparablEcommunities as developed for the Manual will cover the various elements of buildingconstruction These basic cost data shall be applied to existing construction forthe determination of accurate and consistent replacement values These values shallbe depreciated for age, dondition, obsolescence, inadequacy, surplus area, and storyheight ,A4[ 00kifr1148September 2, 19+69 ContAll apartment houses of two 2 or more dwelling units and other dwellingsdesigned or redesigned for occupancy by more than one family unit, and all groupsof apartment buildings, and all special purpose buildings and structures not classedas industrial, are to be considered as commercial properties and are to be appraisedby the Contractor in the above manner and entered on record cards or a separatereport The appraisal of apartment houses is to be completed with analysis ofincome in the same manner as in the appraisal of other commercial properties2 Commercial LandThe Contractor shall make a study of both the central business districtsand outlying business areas of the Town of Smithfield and other towns in JohnstonCounty Upon completion of this study, an outline block map is to be prepared bythe Contractor listing frontfoot land values for each side of each block of thespecified business districts Depth tables, and corner and alley influence tablesshall be developed by the Contractor for the pricing of commercial lots Thesetables shall be in accordance with current sound practices of land valuationUpon the determination of such final front foot values for commercialproperties, the Contractor shall compute the value of each individual parcel ofcommercial landIf all or part of such property shall be within the boundaries of anyincorporated town or city,-such fact shall be specified and the part within suchtown or city shall be defined and listed accordingly3 Review of Commercial PropertiesUpon completion of the appraisal of individual parcels of commercial land,each commercial property shall be carefully reviewed by the Contractors appraisersfor the careful consideration of the economic factors which enter into itsvaluation, such as location, design, surplus capacity or inadequacy, obsolescence,and rental possibilities both present and expectedB Industrial PropertiesA complete appraisal of each industrial plant in the County shall beprepared by the Contractor based upon the careful inspection of each of suchproperties1 Industrial Land ValuationThe Contractor shall make a study of each individual industrial propertyand of the various industrial sections of the County Upon completion of thisstudy, the Contractors appraisers are to prepare an outline block map or sketchindicating front foot, acreage, or square foot land values for each parcel ofindustrial property Upon the determination of final land values for industrialproperty, the Contractor shall compute the value of each individual parcel ofindustrial land2 Industrial BuildingsPlat plans of the buildings shall be drawn to scale, with buildingsnumbered and shown in their proper location and size Buildings shall be describedand priced by their component parts, replacement or reproduction values beingdetermined by a unit cost appraisal, depreciated according to the age, condition,and degree of actual or potential utility which ever is more applicableDepreciated values shall be sound ftility value for the purpose for which eachplant is being or can be utilized3 Machinery and EquipmentIt is expressly understood that the Contract shall cover the appraisal ofthe machinery and equipment of all industrial plants throughout Johnston County,employing five or more personsAll units of machinery and equipment shall be listed individually,building by building Each item of machinery or equipment shall be accurately andcompletely described with data recorded to include the name of manufacturer, nameof machine, serial number, size and model number with accessories and attachmentslisted and included Miscellaneous equipment, and tools are to be described byquantity, name and description, and are to be grouped in lots covering units of asimilar character Each unit of machinery and equipment or lot of minor items isto be priced according to reproduction cost plus cost of freight and installation,and depreciated according toage, physical condition, remaining life of each unit,and any other factor which may affect its true valueThe Company shall prepare and furnish to the County depreciation schedulesappropriate for future annual use by the Tax Supervisorx44-September 2, 1969 Cont4 ReportsEach appraisal of an industrial property shall constitute a complete separatereport, summarized, typed and bound, Each report shall show all tenements, apartmentscommercial buildings and all other real property owned by each industrial company,individually identified and appraised, in addition to its industrial plant, andlocated in the township in which the plant is located Two copies of each reportshall be furnished to the Tax Supervisor Total values of industrial plants, showinga summary of land and buildings shall be place on property record cards for filingpurposes5 Peline and Oil TerminalThe Contractor shall appraise all oil terminal and pipeline propertieslocated in Johnston County The appraisal of these properties shall include allbuildings, storage tanks, and yard petroleum distribution system, consisting of pipe,vatves, pumps and distribution lines Piping shall be listed showing the number offeet of each size of pipe, priced on the basis of reproduction cost plus the cost ofexcavation and back-fill Each appraisal shall constitute a complete separate report,summarized; typed and bound6 Public UtilitiesThe Contractor shall appraise all properties of public utility companieslocated within Johnston County and legally assessable by the County This shallinclude all assessable properties of all Electric Power, Telephone, Telegraph, Gas,Railroad or-other public utility companies An accurate inventory of all physicalequipment is to be made In the appraisal of electric distribution systems, allpoles, street lamps, transformers, substations, services, meters, generating equipmentbuildings, dams, land improvements, etc, are to be carefully inventoried, priced indetail and depreciated as applicableThe appraisal of gas public utilities shall include underground mains anddistribution, piping, control equipment, service and meters Piping shall be listedshowing the number of feet of each size of pipe, priced on the basis of reproductioncost plus thecost of excavation and back fill Services shall be listed by quantity,whether residential, commercial, or industrial Meters will be listed by size andtype, using reproduction cost plus installation, and allowing average depreciationThe appraisal of gas pipe line companies shall include all buildings, gascompressors, filters, cleaners, coolers and accessary oquipment, including allconnected piping that is not considered transmission linesData may be obtained from the utility companies pertaining to an accurateinventory of all physical equipment of distribution systems, subject to a reasonableverification by the Contractor The Contractor must appraise in the field all otherproperty of the utility companies The utility companies appraisal must be typedand bound in book form, set up and indexed according to township and incorporatedtowns sIf all or part of such property shall be within the boundaries of anyincorporated town or city, such fact shall be specified and the part within such townor city shall be defined and listed accordinglyC Urban and Rural Property1 Residences, Buildings and StructuresEach residence and outbuilding shall be accurately measured and a pencilsketch drawn and shown on the field record card Careful inspection shall be made`of both exterior and interior, where entrance may be gained, by a competent appraiserThe type of construction shall be recorded by component parts such asfoundation, basement area, wall construction, insulation, roof, floors, interiorfinish, heating system, fireplaces and stacks, plumbing fixtures, tiling,, number ofrooms, age, if obtainable,- condition, physical and functional depreciation, generalquality of construction, rent if rented and recent data on salesSurburban and farm homes shall be sketched and appraised by the same methodas other residential buildings All other farm buildings and structures shall beaccurately measured and listed on the property record card according to their use,type of construction, size , age and condition, and shall be appraised as to the valuetheir presence adds to the lands on which they are locatedThese cards shall be returned by the field staff to the office where they shallbe priced, checked, and completed from the schedules previously prepared and made readyfor the final fie d inspection and review The final field inspection and review shallbe made for the purpose of discovering any errors in matters theretofore set up and foxthe application of functional depreciation resulting from good houses in poor locationshouses of bbsolete design, etct? I1451September 2, 1969 Cont2 Valuation of LandThe Contractor shall make a careful investigation of the fair value of allclasses of land, giving due consideration to all factors enumerated in the secondparagraph of section 2 General Instructions under General Conditions aboveSales data shall be secured covering fair sales, which data shall be analyzed,checkedand recordedon cards Owners, realtors, banks and others shall be askedto supply full information relative to sales of property within the County, andContractor shall likewise peruse records in Johnston County Registery for saidpurposeIf all ,or part of such property shall be within the boundaries of anyincorporated town or city, such fact shall be specified and the part within suchtown or city shall be defined and listed accordinglyTimberlands shall be appraised by persons experienced in appraising suchlands and shall reflect their worth for timber- growing purposes regardless of havinggrowth thereon Merchantable timber and pulpwood shall be valued separately andadded to the value of the land on which it is located Crop allotment acreage shallbe entered as a matter of record on the appraisal card in every instance whereverapplicableD Maps - Appraisals Tie leiReady drawn maps of certain areas will be furnished by the County, andit shall be the duty of the Contractor to see that all property appraisals aretied in with the mapsCOMPENSATION AND TERMS1 Progress Reports and PaymentsThe Contractor shall make monthly progress reports on the first day of eachmonth on forms approved by the County Tax Supervisor showing work done or progress madeduring the preceding month according to the schedule prepared under the terms of Item 5 onpage 4, and the County shall make progress payments as followsOn or about the tenth day of each month the County shall pay to the Contractor85 of the value, based on the Contract price, of the work performed by the Contractor up tothe first day of that month as estimated by the County Tax Supervisor from progress reportsand monthly invoices submitted by the Contractor, less the aggregate of previous paymentsThe estimates shall be approximate only, and all partial and monthly estimates and paymentsshall be subject to correction in the estimate rendered following discovery of an error inany previous estimateShould any defective work be discovered, or should a reasonable doubt arise asto the integrity of any part of the work completed prior to the final acceptance and payment,there will be deducted from the first estimate rendered after discovery of such work, anamount equal in value to the defective or questioned work, and this work will not be includedin a subsequent estimate until the defects have been remedied or the causes of doubt removedThe Contract document shall specifically provide that not more than a totalof 75 of the total Contract price shall become due and payable by Johnston County prior toJuly 1, 1970, notwithstanding any other provisions therein2 Acceptance and Final PaymentWhen the work has been completed and delivered to the County by the Contractor,the County Tax Supervisor shall examine and review the same to determine whether the work hasbeen completed in accordance with the specifications, conditions and stipulations contained inthe ContractAll prior-progress or partial estimates and payments shall be subject tocorrection in the estimate made upon completion and delivery of the work, except as to newand partially completed buildingsIf, upon his examination and - review, the County Tax Supervisor finds that thework, except as to new and partially completed buildings, has been completed and deliveredin accordance with the specifications, conditions and stipulations contained in the Contract,then the work shall be accepted and the balance due, less 5 of the total Contract price, shallbe due and payableThe remaining 5 of the Contract price shall become due and payable when allcomplaints of property owners have been heard and finally disposed of146September 2, 1969 ContNOTICE TO PROSPECTIVE CONTRACTORSCOUNTY OF JOHNSTON, NORTH CAROLINAAMENDMENT NO 1The specifications for the appraisal of taxable property for Johnston County,attached hereto, are modified by adding the following paragraph to Item # 2;
