March 3, 1969 - Regular1 5Fit width6 Wli ??March 3, 1969The Johnston County Board of Commissioners met -in regular session in the CommissionersRoom of the Johnston County Courthouse at 11 oclock am, March3, 1969, with the followingmembers presentJ D Bailey, Chairman, Norman C Denning, Frank B Holding, Adam J Wb itley, Jr andFreddie AdamsMembers absent NoneThe following business was transacted1 Health AdministratorMr Edsel Haney, who was recently employed by the Health Department as Administrator,met withthe Board and expressed his thanks for the opportunity to work with the County andoutlined some of his plans for developing a more efficient Health DepartmentChairman Bailey welcomed Mr Haney and assured him that the Board was looking forwardto working with him2 Shoe Hill Fire DistrictMr Ermit Stancil and other residents of the Shoe Hill Fire District appeared beforethe Board and requested that their Fire District be permitted to hold a special election,authorizing the levy of a fifteen cents 150 special fire tax for a period of three 3 yearsCommissioner Norman C Denning moved that their request be grantedMotion was seconded by Commissioner Adam J Whitley, Jr and carried3 ReportsThe following reports were filed with the BoardM W Knott Electrical InspectorHarper Godwin Tax CollectorC W Tarlton Extension ChairmanRubert Barbour Dog WardenEleanor Hodks LibrarianH J Whitley Forest RangerL P Creech Veterans Officer4 Expanded Nutrition Education ProgramMrs Sylvia Brixhoff, Home Economics Agent appeared before-the Board, along with MrC W Tarlton, Extension Chairman, and advised that there was money available through the,NorthCarolina Agriculture Extension Service from Consumer and Marketing Service of the U S Depart-ment of Agriculture to finance an Expanded Nutrition Education Program and explained just howthe program would functionrMarch 3, 1969 ContCommissioner Frank B Holding moved that the Board of County Commissioners authorize theExtension Department to inaugurate the program and to hire atleast two aides and if they couldpossibly do so to hire others as this program would reach people in the County that no otherprogram heretofore has doneThe motion was seconded by Commissioner Adam J Whitley and carried unanimously5 Committee Report - Tax DiscountCommissioner Frank B Holding moved that Senator J Marvin Johnson and RepresentativeW R Britt be requested to introduce and work for a special act allowingJohnston County togive 2 discount on the payment of taxes during the month of August, l during the month ofSeptember, and net October, November, December and January, with penalties beginning onFebruarylst as provided by General StatuteThe motion was seconded by Commissioner Adam J Whitley, Jr and carried unanimously13 Registration - Full TimeCommissioner Freddie Adams brought up the question of full time voter registration forthe County of Johnston, following up his suggestion at the last regular meeting 6f the BoardThis matter was discussed by the Board and it was decided to defer any action at thistime, pending legislation requested by-the State Board of Elections, which might be enacted14 Mill Creek WatershedCommissioner Norman C Denning moved that the following resolution be adoptedRESOLUTION BY THE JOHNSTON COUNTY BOARD OF COUNTY COMMISSIONERSWHEREAS, a project for flood control on Mill Creek, in Johnston County, has beenplanned by the U S Army District Engineer in Wilmington, N C, and has been approvedfor design and construction by the Chief of Engineers; andWHEREAS, it is required that certain items of local cooperation must be providedbefore the project can be constructed; and the County has authority to provide assurancesof such cooperation; andWHEREAS, the project will provide substantial benefits in flood protection anddrainage for agricultural lands in a section of,Johnston County which covers almostone- fourth of the Countys area; and benefits will accrue to the County in the form ofincreased values of the lands protected and increased tax revenues therefrom; and otherproposed projects, including the proposed Wilson Mills and Beulahtown Dams will probablyalso require County participation in other sections of the County;NOW, THEREFORE, BE IT RESOLVED by the Johnston County Board of County Commissionersthat it favors the construction of the Mill Creek Flood Control Project, and that itwill provideitems of local cooperation as followsa Provide, without cost to the United ,States, all lands, easements, right -of -way,and utility relocations and alterations necessary for project constructionb Hold and save the UnitedStates free from damages due to construction works, andadjust all claims concerning water rightsc Maintain and operate the project after completion, without cost to the UnitedStatesd Contribute, in cash, 275 percent of the construction cost, now estimated at14,000, it being understood, of course, that eighty per cent of this sum will be paidto the County of Johnston by the State of North Carolina and the Department of Waterand Air Resources, and that the remaining twenty per centbbe paid to ,the County ofJohnston by the landowners along the Mill Creek Water Shede Prevent future encroachment which might interfere with proper functioning ofthe project for flood controlf Encourage individual landbwners to apply land - treatment measures to lands within,the basin to minimize soil erosion and subsequent silt deposition in the improved channelstrMarch 3, 1969 ContBE IT FURTHER RESOLVED that the Tax Supervisor for Johnston County shall hereafterpay particular attention to the assessed valuation of the property owned by the land -owners interestedin and deriving benefits from the proposed Mill Creek Water Shed andFlood Control Project after completion, and from time to time adjust the assessedva fiation of any real property which has increased in value by reason of the afore-mentioned flood control projectBE IT FURTHER RESOLVED that the County of Johnston does hereby accept responsibilityfor future maintenance of the Moccasin Creek Drainage District located in the north-eastern section of Johnston County near Pine Level and SelmaThis the d day of March, 1969The motion was seconded by Commissioner Adam J Whitley, Jr and carried unanimously15 Food Stamp ProgramCommissioner Adam J Whitley, Jr moved that the County of Johnston inaugurate theFood Stamp Program, replacing the Surplus Food Distribution Program now being operated and thatthe State Welfare Department be advised and W H Britt, Auditor make formal applicationMotion seconded by Commissioner Norman C Denning and was carried16 Jail WindowsIt was calledto the attention of the Board that several windows in the jail neededrepair, that the panes were loose and ready to fall outAfter a discussion, Commissioner Adam J Whitley, Jr was authorized to have thenecessary repairs made to the jail windows using his own discretion17 Joe Overby - LetterA letter from Joe Overby to Chairman Bailey was presented, in which he proposed totake over the ambulance service if the County would subsidize himCommissioner Frank B Holding moved that W H Britt, Clerk, to the Board, reply toMr Overbyts getter and thank him and advise that the present ambulance service plan is operatingvery efficiently and satisfactorilyCommissioner Norman C Denning seconded the motion which was carried18 Road PetitionThe Board of Commissioners received a petition signed by Mr and Mrs Morrison Hardeeand others, requesting pavement of S R # 1350 in Elevation TownshipCommissioner Adam J Whitley, Jr made a motion that the petition be approved andforwarded to the State Highway Department in Wils6n, N C, requesting that -the State checkthis road and expedite its pavingCommissioner Frank B Holding seconded the motion which was carried19 Sale of Town Commons PropertyCounty Attorney, W R Britt, advised the Board tbat advertisement and sale of theTown Commons Property had been consummated The Town of Smithfield being the last and onlybidderCommissioner Adam J Whitley, Jr moved that the sale of the Town Commons Propertyto the Town of Smithfield for 165000 be approved, and that Chairman J D Bailey be authorizedto execute the deed That it be specified in said deed that the American Legion Post # 132shall have the right of egress and regressThe motion was seconded by Commissioner Freddie Adams and carried unanimously20 Payment to Britt and AshleyCommissioner Frank B Holding moved that Britt and Ashley, Attorneys be paid 5000for advertisement and selling of the Town Commons propertyCommissioner Norman C Denning seconded tbe motion which was carried21 Estimate of Repairs - Welfare DeptCommissioner Adam J Whitley, Jr reported that he had secured estimates on the costof repairing and renovating the Welfare Offices, and suggested that this work be done as soonas possible after the-adoption of the 1969 -70 budgetCommissioner Frank B Holding moved that Commissioner Adam J Whitley, Jr beauthorized and instructed to proceed with the necessary repairs and renovation to the officesin the Welfare Department, when he sees fitMotion was seconded by Commissioner Norman C Denning and carried22 Notice of Intention to Apply for-the Sale of Alcoholic BeverageCommissioner Norman C Denning moved that the Notice of Intention to Apply to theNorth Carolina Alcoholic Beverage Control Board for a permit to sell beer for Lamar Smith andE G Lambreth of Smithfield, N C be approvedCommissioner Frank B Holding seconded the motion which was carried23 Storm Door-- Tax Collectors OfficeCommissioner Freddie Adams moved that the Tax Collector be authorized to have installedat the rear of the office a storm doorMotion seconded by Commissioner Adam J Whitley, Jr and was carriedCommissioner Norman C Denning moved that the meeting be adjournedCommissioner Frank B Holding seconded the motion which carried,7 ailey, ChairmanW Britt, Clerk
