territorial jurisdiction planning area boardLarry Parker Al ternate 3 year termCharles Morgan Member 3 year termElmer P i 1 k i ngton Member 1 year termCommissioner Howard Benton seconded the motion which carried by unanimousvotei15October 6, 1986 Continued3 Enforcement of Building Code Town of Pine LevelThe county manager explained the Town of Pine Level is requesting the Boardof Commissioners authorize the county attorney to work with the towns attorney todraw up an agreement for the county to enforce the State building code in the townsjurisdictionThe manager further explained the county has been making inspections forthe Town of Pine Level since July 1, 1985, by order of the board minutes of March4 1985 ; however, the county has no formal agreementThe board agreed to have the county attorney work with the towns attorneyto draw up an agreement4 Sasser PropertyRudolph Howell, RealEstate Broker,with Marshall and Associates,appearedbefore the board offering tosell the Sasserproperty on Johnston Street,Smithfield,to the county for 60,000 MrHowell told theboard the real estate firm hasexclusiverights to sell the propertyof the new area; 4 county com-missioners discuss request at next meeting; thenthey take the request under advisementThe commissioners advised Mr Howellthey would discuss this matterwiththe county attorney and askedhim to come backto the afternoon sessionand approve the boundaries of the two mile area5 County Mapping - Grant OfferCommissioner Howard Benton moved the county accept a grant offer in theamount of 8,000 from the North Carolina Department of Human Resources and CommunityDevelopment to be used in the county mapping program, and further the Chairmanbe authorized to execute the grant agreement 352,500 has been budget this yearfor the tax mapping projectCommissioner James W Cash seconded the motion which carried by unanimousvote6 Revaluation ScheduleJohnnie Stott, Tax Administrator, and representatives from W P Ferris Associates met with the board Mr Stott explained the boards needs to consider adoptinga revaluation schedule soonThe board agreed to consider this at a later date7 Landmark - Mapping DelayJohnnie Stott, Tax Administrator, advised the board there will be about afive month delay in the mapping project; L ndmark Engineering is not a fault TheNational Geodetic Survey was suppose to release new adjusted datum back in April,1986, numerous delays occured and data was not available until early September,19869 and even then the datum release was not complete Due to the many problemsassociated with the new adjustment datum it has been determined that the newercontracts for orthophoto mapping of North Carolina counties should remain on the1927 datumAMENDMENT # 1 to original contra2 to read 2 Reference paragraph 402 ofshall be extended from existing USGS, NCaccuracy or higher, and correlated to the1927 North American Datum This amendmpreviously stipulated in the original contrathe Contractor dated February 3, 1986 Chairrra Amend page 4, Section I II, partthe Specifications The horizontal controlDOT and NCGS stations of second orderNorth Carolina Plane Coordinate System,ant shall become part of all conditionst of agreement between the County andan executed Amendment # 1 8 Town of Clayton - Request Two Mile Extra- Territorial JurisdictionAs requested by the board, the CountyPlanner made a report on proceduresfor towns applying for two mile extra - territorialjurisdiction as follows 1 Town musthold public hearing to discuss two mile jurisdiction;2 town must zone two milejurisdiction area; town must recommend appointmentsto Town Planning Board andTown Board of Adjustment from the two milearea; 3 must submit written requestto Board of County Commissioners with a mapshowing the proposed boundaries ofthe two mile jurisdiction and the proposed zoningof the new area; 4 county com-missioners discuss request at next meeting; thenthey take the request under advisementfor thirty days, if town regulations are lessstringent than county regulations, theCounty Planning Director and the town officialsdiscuss any revisions that need tobe made; 5 after thirty day period, countycommissioners can act on towns requestand approve the boundaries of the two mile area16October 6, 1986 ContinuedAt the September 2, 1986, board meeting the Town of Clayton made a requestto extend its planning and zoning authority from one mile to two miles beyond thetowns limitsIn discussion, Commissioner James W Cash stated the county needs to cometo some conclusion as to how far it is from county zoning before the board grantsthe two mile extra - territorial jurisdiction requests Commissioner Cash further statedthe town officials, speaking of Clayton, really do not want the two mile authorityThe County Planner told the board the County Planning Board is progressingon a draft on a proposed county zoning ordinance, the main hold up is the countytax mapping, which is just getting underwayThe board took no action on Claytons two mile extra- territorial request atthis time9 Subdivisions ApprovedUponthe recommendation of the County Planning Board,and upon motion byCommissionerHoward Benton, dulyseconded by Commissioner JamesW Cash and carriedthe Strickland Subdivision, ThomasStrickland, owner, located USHighway 301, IngramsTownship, 9lots, no restrictions,was approved and the Chairmanauthorized to executethe platDeer CrossingUpon the recommendation of the County Planning Board, and upon motion byCommissioner James W Cash, duly seconded by Commissioner Frank B Holding andcarried, the Deer Crossing Subdivision, Nuitt Langdon, owner, located State Road1010, 5 lots, no restrictions, was approved and the Chairman authorized to executethe plat10 Water Line to Prison Unit - AgreementThe County Manager advised the Town of Selma is again requesting the countyto enter into an agreement to build and maintain a 16 waterline to run from theoil and gasoline terminal to the Johnston County Prison UnitOn May 5, 1986, the board agreed to participate in this project and to pay4,300 22 of the design phase and the difference in cost of a 6 line and a 16line cost estimated at 130,000 to accommodate future growth in the Wilsons Millsarea, subject to the Town of Selma deleting the last sentence of the agreement whichstates that DOC -DP will pay the cost of water service to the Town of Selma at thetowns standard outside user rates for a period of at least ten 10 years , however,the Town of Selma returned the agreement requesting approval as before with no changesmadeAfter further discussion, Commissioner Frank B Holding moved the agreementbe approved subject to the following changes1 Johnston County will transfer its prorata share of funds to Selma monthlyas invoice becomes payable;2 Should the County of Johnston decide to operate and maintain its ownwater lines, the contract with DOC -DP shall transfer from Selma to JohnstonCounty;Commissioner Holding further moved the approval of the agreement as followsAGREEMENT FOR PROVISIONS OF WATER SUPPLYDISPOSAL SERVICES FOR THE JOHNSTON COUNTY PRISON UNITThis Agreement made this the 25th day of March, 1986, by and between theDepartment of Corrections Division of Prison hereafter, DOC -DP, the Town of Selmahereafter the Town , and Johnston County hereafter the County is for provisionsof water supply services for the Johnston County Prison UnitWHEREAS, DOC -DP has need for and desires a new water supply system forthe Johnston County Prison Unit, andWHEREAS,the Town of Selma currentlyhasunder design a water project whichwill result in theconstruction of water mainswestof Selma to a point within approx-imately 6,000 lfof the Johnston County PrisonUnit,andWHEREAS, Johnston County desires that any water supply facilities in thearea of the prison unit be appropriately designed to serve as a segment of the county-wide water systemfol I owsNOW, THEREFORE, the DOC -DP, Town of Selma and Johnston County agree as9Y17October 6, 1086 ContinuedThat the town wi I I augment itswatersupply project to includethe design ofa water main extension from a point on WestOak Street Extension SR1919 westwardto US 70 -A and then northwestwardalongUS 70 -A to the JohnstonCounty PrisonUnit, a length of approximately 6,0001f;and will install a servicemeter at theprison unit;John M Booker and carried, the following budgetamendment wasapprovedThat the Town of Selma will receive bids for the work described above as aseparate schedule along with the other water facilities in the towns planned projectand will construct and operate said facilities to serve the Johnston County Prison UnitThat, in order to provide for the future needs of the countywide water system,the water main will be 16 inches in size and will include fire hydrants at appropriatespacings, although it is understood that the water main size required to provide potablewater needs for the prison unit is 6 inches in diameterThat DOC -DP will pay for the cost of a 6 inch water main and appurtenancesThat, Johnston County will pay for the difference in cost between the 6 inchdiameter main and the 16 inch diameter main requiredThat, Johnston County will own the water main from its point of terminationon SR 1929 to the Johnston County Prison UnitThat all costs referred to above shall include technical services, legal, land,easements, permits, construction, contingencies, and related costs to render the facilitiesfully operational and serviceableThat the DOC -DP and Johnston County will make payment in the amounts of15,60000 and 4,30000, respectively, for their respective shares of the design phaseof the project Johnston County will transfer its prorata share of funds to Selma monthlyas invoice becomes payableThat DOC -DP will pay the cost of water service to the Town of Selma at thetowns standard outside user rates for a period of at least ten 10 years Shouldthe County of Johnston decide to operate and maintain its own water lines, the contractwith DOC -DP shall transfer from Selma to Johnston CountySEALAttestSEALAttestSEALAttestEleanor N Creech, Clerk to the BoardDepartment of Corrections,Division of PrisonsTown of Selmaonorab I eJohnston County uees, mayoran C Denning, ChairmanCommissioner John M Booker seconded the motion which carried by unanimousCommissioner John M Booker seconded the motion which carried by unanimousvote Other Mental Health Board vacancies were deferred at this timevote11Health Department -
