May 19, 1986The Johnston County Board of Commissioners met- in special session Monday,May 19, 1986, at 830 am, Commissioners Room, Johnston County Courthouse,Smithfield, North Carolina, with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, JamesW Cash, Howard Benton and John M Booker, DVMMembers Absent NoneAlso present Kramer Jackson, County Manager, Eleanor N Creech, Clerkto the Board and W R Britt, County AttorneyThe Chairman called the meeting to order and the following Businesswas transactedThe purpose of this special called meeting is to discuss the CourthouseAnnex project and parking space around the courthouseCommissioner Frank B Holding moved the board go into Executive Sessionto discuss the acquisition of real property as ,it relates to the courthouse additionand off- street parking around the CourthouseCommissioner James W Cash seconded the motion which carried unanimouslyThe County Manager explained the situation concerning the county purchasingthe L H Sasser property on Johnston Street, Smithfield, NCThe board expressed a desire to purchase this property as it will beneeded to provide parking for the CourthouseThe County Attorney explained the law the county must follow to purchaseby condemnation GS 40 -AThe board discussed the price and declared 36,000 as a good offer After much discussion, Commissioner Frank B Holding moved the Boardof Commissioners of Johnston County, give notice that the County of Johnston intendsto institute a civil action to condemn the L H Sasser property on Johnston Street,Smithfield, North Carolina, opposite the Courthouse property and adjoining propertynow owned by the County of Johnston, but which was formerly owned by HughC Talton, Jr, the amount estimated by the board to be just compensation is36,000 Commissioner Holding further moved the purpose for which this propertyis to be condemned is to provide off - street parking to accommodate persons usingfacilities of the Johnston County Courthouse; the date the county intends to filethis complaint is June 24, 1986IiIIMay 19, 1986 ContinuedCommissioner Howard Benton seconded the motion which carried by thefollowing voteAye Frank B Holding, Howard Benton, James W Cash, John M Booker,DUM, and Norman C DenningNay None2 Gardner PropertyThe board agreed the 1986 taxes county and town on the Gardner Property,corner of Johnston and Second Streets, be pro -rated if it can be worked outwith property owners; if not, the County Manager is authorized by the boardto work out some agreeable solution County Commissioners purchased this property May5, 1986 It was ordered by the Board of Commissioners, at this date and time915 am that the minutes of this Executive Session be withheld from publicinspection for as long as public inspection would frustrate the purpose of theExecutive SessionUpon a motion by Commissioner Howard Benton, duly seconded by Commis-sioner James W Cash and carried, it was moved that Executive Session be closedand regular session be resumedRegular Session3 Property Declared Surplus and Sale AuthorizedCommissioner James W Cash moved that certain county vehicles and othermiscellaneous county property be declared surplus and the County Manager beauthorized to hold a public auction for the sale of this surplus propertyCommissioner John M Booker seconded the motion which carried by unanimousvoteUpon a motion by Commissioner James W Cash, duly seconded by Commis-sioner John M Booker and carried, the board adjournedThe Executive Session minutes ofand not released for public record untilBook at 330 pm, May 21, 1986iEleanor N CreechClerk to the BoardMay 21, 1986; 330 pmthis meeting May 19, 1986 were sealedMay 21, 1986, and recorded in the MinuteNorman C Denning, Chairman659DetailsAnnotationsEntry PropertiesModified11192013 24113 PMCreated4162003 104201 AMTemplateMinutesFieldsMinutes - TypeSpecialMinutes - Date5191986Book17
