Octobe-r 5th and October 21, -1987, board meetings stand approved asrecorded2 Public Hearing Readoption of Local Option Sales TaxDuly advertised October 16, 1987 and Notice PostedPurpose To provide the public an opportunity to address the Board on the readoptionof the local option sales taxesBy a motion of Commissioner Frank B Holding, duly seconded by Commissioner JohnM Booker and carried, the Chairman opened the public hearing and asled if anyone wishedto address the Board regarding the readoption of the local option sales taxes There beingno response, the Chairman declared the Public nearing closedUpon a motion by Conimissioner Howard Benton, duly seconded by Commissioner ,namesW Cash and carried by unanimous vote, the following resolution was adoptedA RESOLUTION REENACTING LOCAL GOVERNMENTSALES TAXES WITHIN JOHNSTON COUNTYWHEREAS, the North Carolina General Assembly authorized thelevyof localgovernmentsales and use taxes throughenactment of Chapter 77 of the 1971 Session Laws,codified asArticle 39 of Chapter 105 ofthe General Statutes; Chapter 908 ofthe1983 Session Laws,codified as Articles 40 and 41of Chapter 105 of the General Statutes;andChapter906 of the1985 Session Laws RegularSession, 986, codified as Article 42ofChapter105 of theGeneral Statues; andnotice of the publichearing to be given,as required by Section 9 41 Chapter 832WHEREAS, these sales and use taxes authorized by the General A s e-nbly have beenlevied in Johnston County by action of t1he Board cf Commissioners acting pursuant to theauthorizing legislation; andWHEREAS, enactment by the General Assembly of Chapter 832 of th 1987 Session Lawsredefined the situs of a transaction for the purpose of collecting loca government sales anduse taxes, thus redefining the application of those taxes and requiring readoption of thesetaxes by county board of commissioners; andWHEREAS, Section 10 of Chapter 832 of the 1987 Session Laws provides that failure toadopt expansion of the Local Government Sales and Use Tax Act will result 4n repeal of thesetaxes in Johnston County because they would be inconsistent with the scope of the leviesauthorized by Articles 39, 40;, 41 and 42 of Chapter 105 of the General Stat-Lztes as amended;andWHEREAS, apublic hearing was held on November 2, 1987, toconsider the expansionof local governmentsales and use taxes authorized, by Articles39, 40,41 and 42 if Chapter105 of the GeneralStatutes, and interested citizens presentedtheirviews to the ofCommissioners; andWHEREAS, the Board of County Commissioners causedpublicnotice of the publichearing to be given,as required by Section 9 41 Chapter 832of the1987 Jession, Laws, atleast ten days priorto the date of the hearing; and1November 2, 19V CQT1t;1nued --WHEREAS, the Board of Commissioners of Johnston County does hereby find thatadoption of the expansion of the Local Government Sales and Use Tax Act within JohnstonCounty is both desirable and necessary to adequately finance the operation of the county andcities and towns herein; EINOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of JohnstonCounty as followsSection 1 The expansion of the Local Government Sales and Use Tax Act, as definedin Section 4 of Chapter 832 of the 1987 Session Laws, is hereby adopted The Taxes herebyimposed and levied shall apply to the same extent and be subject to the same limitations asare set forth in Articles 39, 40, 41 and 42 of Chapter 105 of the General Statutes, asamendedSection 2 Collection of the expanded Local Government Sales and Use Tax by theNorth Carolina Secretary of Revenue, and liability therefor, shall begin and continue on andafter the first day of March 1, 1988Section 3 The net proceeds of the taxes levied herein shall be distributed by theSecretary of Revenue to Johnston County and the municipalities therein as prescribed byGS 105 -472, 486, 493 and 501 The amount distributed to Johnston County shall be dividedamong the county and the municipalities herein in accordance with the method previouslyselected by the Board of Commissioners of Johnston County in accordance with the provisionsof GS 105 -472Section 4 This Resolution if effective upon its adoption and a certified copy hereofshall be forwarded to the North Carolina Secretary of Revenue, pursuant to the provisions ofSection 9 of Chapter 832 of the 1987 Session LawsAdopted this 2nd day of November, 19873 Secondary Road # 1375Ross Hailey, Maintenance Engineer, reported on an inquiry from Billy Blackmonregarding the priority rating on SR # 1375 The priority rating did not reflect that this roadcarried school bus routes Mr Hailey stated this had been corrected which will change thepriority on the next rating scheduleIAfter discussion, Commissioner Frank B Portion of the Force Main3 Data General agrees that so long as it is the sole user of the County Portion,Data General will maintain the County Portion and bear all costs and expensesrelating thereto, including without limitation the burden and expense of keeping inforce any required permits relating thereto such as, but not limited to, any NPDESpermits required under the Federal Clean Waters Act Further, so long as DataGeneral is the sole user of the County Portion and so long as the County Portionhas not been maintained, altered or affected by any other party, Data General willindemnify and hold the County harmless from any loss, cost, damage or expensearising from Data Generals improper use of the County Portion, provided that theCounty shall give Data General prompt notice of any matter as to which the Countymay have cause to seek protection under this indemnification, and shall give DataGeneral complete control and authority to defend or otherwise handle such matter,and shall cooperate with Data General in such event The County will cooperate withData General relative to the matters above - described, including without limitationgiving Data General access to the County Portion and permission to perform anymaintenance required thereon4 The County may permit others to use the County Portion, upon the followingterms and conditionsA At no time shall such use cause the capacity of the County Portion reservedfor Data General to be less than 450,000 gallons per dayB Prior to connection of any user other than Data General, the County and DataGeneral shall enter into appropriate written agreements, satisfactory to both theCounty and Data General, making arrangements for the continued operation andmaintenance of the County Portion Without limitation, such agreements shall coverthe following matters1 Modification of this agreement, to provide that Paragraph 3, above,shall no longer be effective From and after the connection of any otheruser to the County Portion, the County shall maintain the CountyPortion, subject to such provisions for reimbursement of its costs fromthe users and or taxpayers as may be appropriate, and2 Appropriate adjustments to all required permits and approvals,including without limitation assignment of Data Generals NPDES permit tothe z County if permitted and the Countys assumption of all DataGenerals obligations thereunder, and or the Countys obtaining its ownNPDES permit5 So long as Data General shall remain the sole user of the County Portion, DataGeneral shall have the right, with the Countys approval, to alter or modify theCounty Portion The County agrees that its approval in such circumstances shall notbe unresonably withheld or delayed8 This Agreement and all amendments shall be governed by and constructed inaccordance with the laws of the State of North Carolina9 Each notice, request or demand required or permitted to be given pursuant tothis Agreement shall be in writing and shall be deposited in the United States mailby registered or certified mail, or consigned to a courier delivery service, in eachcase return receipt requested, and addressed to the address of the intendedrecipient at its address as set forth above, in the case of Data General, directed tothe attention of the Plant Manager, and in the case of the County, directed to theattention of the County Manager, or to such other address as may be specified inwriting by the parties hereto Each such notice, demand or request shall be deemedgiven upon receipt by the intended recipientiIiikI?p6DataGeneralmay assign its interest under this Agreement to any successorownersto all oranyportion of its land in Clayton, North Carolina7DataGeneralandthe County act hereunder solely as independent contractors,andnot as agentsorrepresentatives of the other party Neither party has authoritytotransact business,enter agreement or otherwise make commitments on behalf oftheotherparty8 This Agreement and all amendments shall be governed by and constructed inaccordance with the laws of the State of North Carolina9 Each notice, request or demand required or permitted to be given adjusted to conform to the requirements forvalidity as declared at such time, and as so adjusted, shall be deemed a provision ofthis Agreement as though originally included herein In the event that the provisioninvalidated is of such a nature that it cannot be so adjusted, the provision shall bedeemed deleted from this Agreement as though the provision had never been includedherein In either case, the remaining provisions of this Agreement shall remain ineffect12 This Agreement embodies the entire understanding of the parties and there areno other agreements or understandings, oral or written, between the parties relatingto the subject matter hereof No amendment or modification of this Agreement shallbe valid or binding upon the parties unless made in writing and signed on behalf ofeach of such parties by their respective- representatives However, this Agreementdoes not supersede or alter other Agreements between Data General and the Countyfor provision of water and sewer utilities for the Data General Clayton PlantAmendments #1, #2, and #3, stated just previous to this agreement - encompassed inthis agreement13 In no event shall either party hereunder be liable for
