Public Notice Posted Ten days noticeprovided as required under Section 1 of the House Bill; Date and time of HearingSeptember 8, 1987, at 10 oclock amPurpose To provide the public an opportunity to address the Board on an actto authorize Johnston County to levy a Room Occupancy and Tourism Development TaxThe Chairman opened the Public Hearing to hear anyone that wished to speak onthe Room Occupancy and Tourism Development Tax There was no response from theaudience to the Chairmans invitation to address the BoardCommissioner Howard Benton asked for clarification on the Johnston CountyTourism Authority to be created and the term of appointments; these issues addressed inSection 7 of House Bill 893, and discussed by the BoardThere being no one to speak for or against the Room Occupancy and TourismDevelopment Tax, the Commissioners declared the Public Hearing closedCommissioner Howard Benton moved that the Johnston County Tourism Authority becreated under the provisions of House Bill 893 Commissioner Benton fu ther moved thefollowing resolution to levy a Room Occupancy Tourism Development Tax be adoptedRESOLUTIONiWHEREAS, the North Carolina General Assembly enacted House Bi-1 893, ratifiedas Chapter 647 of the North Carolina General Statutes, entitled AN ACTH TO AUTHORIZEJOHNSTON COUNTY TO LEVY A ROOM OCCUPANCY AND TOURISM DEVELOPMENT T X ; andWHEREAS, the provisions of this law require the Board of C mmissioners ofJohnston County to hold a Public Hearing prior to adoption of this law; andWHEREAS, the Board of Commissioners of Johnston County have complied withall requirements of this lawNOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of JohnstonCounty that a Room Occupancy and Tourism Development Tax in the amount of 3 ishereby leviediAdopted this8th dayof September, 1987CommissionerJames CCash seconded themotion which carried by unanimous vote3 Satellite JailA delegationof arearesidents near theproposed satellite jail site met with theBoard concerned abouttheplacement of a satellitejail in this neighborhood TheChairman explainedreasonsfor the need of asatellite jail; the County i Manager, withiconsent of the Board,made plans for a satellitejail; due to demands from Mate156September 8 1987 ContinuedSeveral citizens spoke to the Board regarding their concerns Hattie Coopersays her main concern is that residents were not informed and did not know what wasgoing on; there are rest homes and day care centers in the area Florence PennyWilliams — a widow with a 16 year old daughter stated Residents needed to `beinformed, they are taxpayers and citizens Jeanette_ Dixon Board needs to take officialaction that this will be a temporary facility and sheriff needs to screen these people tvery carefully; We need to be informed about what is taking place Betty_ JoCoates News said about 40,000 was spent on the facility; if the County is spendingthat much money they are concerned this will not be a temporary jailThe Sheriff addressed the delegation stating he understands their concerns; thiswill be a temporary facility, he will not allow a security risk at the facility; onlyweekenders, DWI and non — violent misdemeanants will, be housed in the satellite jail nearFour Oaks Any security risk will be removed and put back in the County jail at theCourthouseWith further explanation, Commissioner Frank B Holding gave some backgroundinformation on DWI sentencing and the problems with over— crowding in the present jailand plans for 100 new cells in the new Jail Annex Commissioner Holding apologized onbehalf of the Board for not communicating with the Town of Four Oaks and thecommunity, however with a facility already in place that the State would approve andthe minimum amount of money needed to make it a satellite jail, it is an act on thepart of the Board to eliminate the jail problem; and it seems like a good solution TheBoard hopes within 15 months to be able to close the facilityNathaniel Cooper Will this facility be opened again; could this situation Tre —occur and the facility reopened at a later dateCommissioner Holding indicated the County could not spend 18,000 to 20,000and have a permanent jail facility, it is being renovated for week —end offenders TheCounty must provide a minimum security facility for non — violent misdemeanantsThe Sheriff stated that jailers will not be armed, mostly driving violations atthe satellite jailHattie_ Cooper What if a person should decide to leave the facility and godowntown The Sheriff responded, the punishment they would be put in the Countyjail if they tried to escape from the facilityKen_ Carr feels the Board should have held a public hearing and further askedthe Board to adopt a motion that the facility will be closed after 15 monthsCommissioner John M Booker respondedThe Chairman asked the CountyManager to respond to theamount of money thatthe County has got to provide the facility Thehas been spent and will be spent onthe facility; our concerniss afetyFlorence_ Penny_ Williams Could you not find another place to put the satellitejail Commissioner Frank B Holding responded that location of property and cost wasa factor in the decision to locate on this property The County Manager also explained— several sites were looked at and visited; the County had to find a facility that wouldmeet State approval on a temporary basis It was very difficult finding a facility the kState would approveFSeptember 8, 1987 ContinuedThe Board agreed these residents and the Town of Four Oaks should have beencontacted and communicated with; however, they can not foresee any great problemsThe Board asked these residents to make an effort to work with the Board in an attemptto make a bad situation as good as we can Sammy_ Boyette, Four Oaks_ Commissioner, stated he had received several callsfrom concerned citizens, and he as a commissioner, is concerned about the zoningregulation as related to the Town of Four Oaks He feels the area is within the townsplanning and zoning jurisdiction, and stated that the Town of Four Oaks zoningordinance does not allow a satellite jail within its jurisdiction, and that Four Oaksplans to meet soon to discuss the matter Mr Boyette also indicated the town Boardsconcern regarding ,the Countys need for a satellite jailTim_ Grad , Four Oaks Commissioner, would like further assurance that onlynon - violent misdemeanants will be housed at the facilityHelen Holt ,says I do not feel safe nowCommissioner Frank B Holding moved this facility be operated to house onlynon- violent misdemeanants until such time as the new Courthouse and Jail Annex isopened and at that time the satellite jail facility is to be closedCommissioner John M Booker seconded the motion which carried by unanimous voteCommissioner Frank B Holding further moved the Board express an apology tothe Four Oaks Town Board of Commissioners and to the citizens in the area for the lackof communication on the part of the Board of CommissionersCommissioner James W Cash seconded the motion which carried by unanimous voteFlorence_ Penny _Williams asked, What will the building be used for when thesatellite jail is closed The Board of Commissioners responded they did not know whatthe Board of Educations plans are for the building once it is vacated by the CountyCommissioner James W Cash indicated the building could possibly be used as acommunity centerCommissioner Howard Benton stated that the amount of money Johnston County hasspent as compared I to to other counties, this seems to be a good economical moveCommissioner John M Booker recommended open house at the satellite jailshould anyone wis to visit the facility - there seemed to be no interestThe Board again apologized for the lack of communication with the communityand Town of Four Oaks, and again assured these residents this facility will be wellsupervised at all, times Should they have any problems, they should not hesitate tocall the Sheriff, County Manager, or County Commissioners4 Tax -- Appeal of Penalty- - Interest - James- Edward - Sullivan- and - wife,- DianeSullivan ,James Edward and Diane Sullivan met with the Board seeking a refund ofpenalty and interest in the amount of 1427 paid on 1986 taxes on property purchasedfrom Norris Ray Sullivan in June, 1986 Mrs Sullivan stated to the Board she shouldnot be held responsible for the penalty and interest as she nor her husband hadknowledge that these taxes had not been paid They had not received a tax noticesince the proper?y was transferred from Norris Ray Sullivan Mrs Sullivan paidthese taxes under protest including the 1427 interest and penaltyThe Board was advised they have no legal authority to abate of refund interestor costThe Board asked that the County Attorney be instructed to check into thematter and report I,back to the Board with a letter to Mr Mrs Sullivan5 Alert Cable TV - Franchise ExtensionPam Greenan amendment toto the cable syst e70A, approximatelyJames Paul EdwardSwood, General Manager, Alert Cable TV, met with the Board requestingthe franchise ordinance to allow Alert Cable TV to make extensionsm to serve Buffalo Road residents between WMPM Radio Station and16 miles, and Davis Mill Road from Pine Level south to just pastCo, approximately 31 miles157158September 8, 1987 ContinuedIn discussion of this request and cable TV franchises, it was determined theCounty Manager should check on franchised territories by cable TV companies already,operating in the County and franchise deadline dates and report back to the Board6 Health DirectorThe County Manager introduced Jerry Robinson, new County Health DirectorMr Robinson briefly responded to his introductionThe Board welcomed Mr Robinson to Johnston County7 Proclamation — Bicentennial of the Constitution of the United StatesUpon a motion by Commissioner John M Booker, duly seconded by CommissionerFrank B Holding and carried by unanimous vote, the following proclamation wasadoptedP R O C L A M A T I O NWHEREAS, September 17, 1987, is the 200th anniversary of thesigning of the United States Constitution;WHEREAS, The Constitution, by guaranteeing liberty, promoting oppor-tunity, and evolving to protect the rights of all Americans,has enabled the United States to grow and prosper; andWHEREAS, The bicentenary provides an opportunity for Americans torededicate themselves to the great principles that havelaid the foundation for our national strength and pros-perity; andWHEREAS, Congress has established the Commission on the Bicentennialof the United States Constitution, chaired by Chief JusticeWarren L Burger, to foster among the people of the UnitedStates a just appreciation and a clearer understanding oftheir constitutional heritage; andWHEREAS, citizens and businesses are vitally interested in improving andincreasing travel via railroad from Johnston County to the western sections of NorthCarolina; andWHEREAS, North Carolina and South Carolina have joined to form the CarolinaAssociation of Passenger Train Advocates known as CAPTA to promote this servicewithin the Carolinas;
