to obtainpublic comment on the proposed ordinance to regulate mass gatherings in Johnston CountyThe Chairman made several opening comments; he invited people wishing to beHeard to place their name on a sign -up sheet if they had not already done so Headvised that copies of the proposed ordinance were available if anyone needed oneThe Chairman announced the public hearing would be recorde for the Clerks useonlyThe Chairman announced again, this ordinance is a pro osed ordinance1° forconsideration by the board He stated there would not be a t i me limit, however,requested speakers to make their remarks as brief as possibleAttorney James R Levinson was present representing Kennethoperator of Scotts Lake; and Attorney George B Mast, representingBetter Community, IncA large delegation of approximately 70 to 75 people was presentThe Chairman opened the Public Hearing and the following spea1 Attorney Jim Levinson, representing Kenneth West and ScottWest, owner andthe Citizens for afor this hearingers were heardLake As most ofLake, there hasyou know this is an ordinance made purposely to limit or close Scottsbeen no concerns expressed from any other events around thecounty that this isprimarily aimed towards, it is brought to you primarily by a°n attorneyhired by someneighbors of Ken West to close Scotts Lake For those of you notamiliar with ScottsLake it is located about three miles north of Benson, a nine acref lakeon Mr Wests 60acre farm, has white sand, similar to White Lake It is a familyentertainment type,open to the public for people that do not have access to a countryclub pool, or somefancy facility, no alcohol is sold at a l I , no beer, no wine; has afenced-in swimmingarea, the concert area is adjacent to the swimming area, dividedby a parking lotThere is one concert a year held there, this is not an over - night campingsituation, theconcerts start around lunch time and ends around 630 in the evening;about a 6 hourevent This facility provides income for people in the community,enjoyment -for somepeople in the community, handles its own security, clean -up, sanitation,water; and doesnot call on the county for any of these type things; handles its on parking As youknow some ordinances have been proposed to you, I contend initifly that the countyshould not get into this area; merely because someone wants to chasea dog in a box, orsome other reason; does not mean the county needs another regulatoryordinance; thereare plenty of laws on the books now to enforce any complaints thatany of you peoplehave about Scotts Lake If littering, driving under the influence, orhealth hazards areproblems, we have laws to enforce them The County Health Directorhas discretion overany health hazards that might go on at Scotts Lake I am not goingto say there hasnot been a drunk driver out there, or littering, like in other placesout in the countytonight and theres not a concert going on now We have plenty oflaws on the booksnow that will handle any problems that might come up Now this groupghasp proposed twoordinances to you; I dont know how man ofY y you have read this ordinancei nance or the otherordinance, but they are quite different The first ordinane theyproposed to you, Ireceived on January 30th, after Mr Mast had drafted it, it was likethe Harnett Countyordinance, it did apply to many of the places around the countyIt applied to BensonMule Days, Benson Singing Convention, football games, political eventsand many thingsaround the county Once the word got out the way that ordinance_ was,it was completelyre- drafted and now primarily affects Scotts Lake, it would not affectthese other thingsThe truth is though, youve got to create a second class citizen, yove got to say youpeople living in town can do anything you want, but if you live otside of town weregoing to pass an ordinance that affects you Now the argument is theydont need it inMarch 16, 1987 Continuedtown because theyve got sanitation facilities and health services When you look at thereality of the situation, when are the Christmas parades held, rodeos held, Saturdaysand Sundays, when the stores are closed, when the only health services in Benson, Selmaand these other places are the same as those at Scotts Lake, or somewhere else Thelocal rescue, the same rescue service as serves the Scotts Lake area The stores thathave 200 bathrooms are not open then, so thats not a valid excuse to say it wontapply to anyone in town, well just apply it to people out in the county I dont thinkwe should create a second class citizen and pass an ordinance that just applies thatway There are ordinances in other counties, some counties have mass gatheringordinances, and some have completely different situations than we do Some counties havemany, many concerts, some of them have ordinances that are on the books that are neverused Harnett Countys ordinance was passed some 15 years ago and in all these manyyears it has only been used 2 or 3 times When I tried to get a permit that was issuedfor the ordinance, the County Health Director couldnt find one, it had been so longsince it was used This ordinance that is proposed now would close Scotts Lake TheHealth Director already has discretion regarding health hazardsMr Levinson reviewed sections of the ordinance that he had objection toThis ordinance does not include anything within the town limits, but it does not say itdoes not include the Benson Tractor Pull and political gatherings If you have a pigpicking, or football games at SSS or South Johnston, or graduation, somewherethat has a place large enough to get this size of a crowd, there will be some otherthings that it could possibly include 1 Definition of bass Gatherings, whose going tocount the people, and when do you start counting; does this number include theemployees; various figures have been submitted; who is going to count and when ; 2Section 3 - a different permit for each gathering; during the summer in swimming seasonon a Sunday there may be more than 3,000 people there, have you got to have a permitfor that; next Sunday have you got to have another permit; the next Sunday anotherpermit Bach day you have more than 2,000 you have got to have a completely separatepermit I think the County Health Director is going to find this is going to be a fulltime job just handling permits In Section B it says what the Health Director has got todo, first for every building, for every facility for every gathering the County HealthDirector has got to determine whether or not this event is a threat to public safety,health and welfare, he has to make this determination, not only is it going to take sometime, but is opening the county up to a law suit Any time anyone ask for a permit youhave got to rake an investigation, you got to issue the permit and monitor each stepthat is taken as far as the installation of port -a- johns, water, he has got to make aninvestigation of each area; and then at some point the ordinance requires him todetermine if the ordinance has been violated, and at this time he has to make aninvestigation; has to handle fees for each application, 100 fee for each applicationSection 5 - got to ask for a provisional permit, application has to be reviewed anddecide whether the area qualified; then you get to the cash bond, got to put up a cashbond of 5,000 for up to ten thousand persons, with an additional 1,000 for eachadditional five thousand persons; there are going to be many complaints from people inthis area about things caused by the concerts, because theres cash and the way we canshut them down is to make them forfeit that cash Text section requires that whoever getsthese permits has to get insurance in an amount of at least 100,000 and up to a milliondollars You gentlemen are familiar with the problems in getting insurance these days, Icontend you can not get a million dollars worth of coverage to cover a concert thesedays, unless you pay a million dollars No company will issue that kind of policy Ondown in the next section, another inspection by the Health Director, 15 days prior to thestartinrg of the concert, a concert is not the type of thing you set up on 15 days notice,you got to book a band, arrange travel, advertise and sell tickets, not the type of thingthat can be done on short notice, maybe a political rally is, but this is not In thenext section, if permit revoked, he draws up an order, he tells the grievances and thenhe is given power by this ordinance to use county facilities and county equipment to goout there and clean up the place, and use county funds to do that; now are you givinghim a blanket authority to go out there and use county funds, and make the resourcesas may be available to him Theres a lot of discretion here, Health Director authorizedto apply more rigid or less rigid standards; this puts him in the position whereeverybody is going to come to him and say i ets make this a little tougher, somethingmight happen There is a command post required, Ive never seen a command post at oneof the political gatherings or tractor pulls, or anything else; a command post set up forthe health, law enforcement and other government agencies A separate building equippedwith adequate telephones and other utilities, and adequate parking spaces; thatsunrealistic Ingress `and egress roads, many of these items are worded very carefully sothey wont fit Scotts Lake The people that are opposed to Scotts Lake know where theroads are into Scotts Lake, and that he doesnt have separate roads, put in thisordinance that you have got to have a separate road, that would shut it down Theamount of paper work that is required, looking at item 8 on page 6; the applicationshall be accompanied by a written plan, you got to have a written plan for yourlG67March 16, 1987 Continuedsecurity enforcement, signed by the Sheriff that the plans seem adequate; of course thatmeans the Sheriff has got to go out there and make some sort of investigation, and ifhes wrong someone is going to sue him Provisions for adequate health care; years agothis provision was reasonable, but it requires a doctor licensed to practice medicine inNorth Carolina to be responsible, to sign a notarized statement by the doctor acceptingthe responsibility for the concert Now, where are you going to find a doctor that willsign a blanket notarized statement saying he will be responsible for everything thathappens out at a concert, I can tell you, you cant get it Even though the rescuesquads are out there, they have been adequate in the past, thats not any good if thisordinance is past, you got to have a doctor A closed structure for a medical treatmentcenter, a total of 450 square feet; are we going to have to have that for every Jayceestractor pull Who is going to go out there and see if the wiring is right, if theplumbing is right Water supply, talking about how many gallons per person that has tobe available; who is going to measure that for the county Water supply sources, toiletfacilities, the inspections required for that; solid waste collection and disposal, inspectionrequired for that; I contend you are asking for alot of extra work Rost gathering andclean-up; it says any litter and solid wastes attributed to the mass gathering within onemile of the areas which can be attributed to the mass gathering shall be removed, nowwho is going to decide if that coca cola can that might have been there for a month canbe attributed to the mass gathering I contend to you that every neighbor up and downthe road is going to complain about trash being in their yardIn summary, Mr Levinson contended this ordinance is discriminatory and drafted for onething to close Scotts Lake He stated to the board there are laws on the books to takecare of any problems the county might have at mass gatherings and urged -the board touse the laws that are on the books, saying, 11we do not need another ordinance2 Mr Leonard Honeycutt, President Citizens for a Better Community, IncMr Honeycutt, thanked the board for the opportunity to speak, stating he wouldread a letter which sums up the organizations stand on the proposed ordinance on MassGatheringsTo All Members of the Citizens for a Better Community, Inc, Friends of this Community,and to our Elected Officials of the County of Johnston as well as the Town of Benson, NCDear Members, Friends and Elected OfficialsThis letter is being written with the unanimous approval of your Board ofDirectors During the summer of 1986, our, community experienced and was subjected tothings that seemed too bad for our citizens to have to endure We shall not go into thedetails of this 1986 summer and the past summers since our members and our countyofficials have been present in community meetings to hear about the different happeningsAs a result of the July 19 happenings, our citizens decided that something should bedone to protect not only our citizens, but the surrounding area which included the Townof Benson and the thousands of people who travel up and down NC Highway 50 and ourrural roads The concerned citizens met in a very large number on July 31, 1986 Thesecitizens elected a committee to look into the possibility of organizing our communityinto a non - profit corporation for the purpose of having a community effort not onlyfor our July 19 problem but for seeking ways to helping and improving all of our com-munity, in many different aspects This first appointed committee gave many hours oftheir time in discussing and recommending a set of articles of incorporation and by -lawsto our citizens The citizens unanimously accepted the committees recommendationsand the Citizens For A Better Community was chartered by the State of North Carolina,and has since been given tax exemption by the Internal Revenue Service and the NorthCarol ina Department of RevenueNow after many hours of work, your Board of Directors along with our legalcounsel has decided to petition our County Board of Commissioners to pass an ordinancethat would control mass gatherings in our county We are well aware that this proposedordinance should not be a hindrance to gatherings such as the Benson Mule Days andthe Benson Annual Sing For this reason, we are asking that this ordinance applyonly to the non- incorporated areas of our county It seems that the, opposing side tothis proposed ordinance would have people believe that it would do away with MuleDays, which is far from the truth Please help us correct this sort of thinkingWe have now, come to the time of having a public hearing on a proposed ordinancefor mess gatherings in our county Our County Board of Commissioners has been realattentive to our request and problems This public hearing has, been set for 730 pmMonday, March 16, at the Johnston County Courthouse Please make -plans upon receiptof this letter to attend this public hearing You are urged to come out and show yoursupport by your presence to your Board of Directors, and let our County Board of Com-missioners know that you are concerned, and that you are seeking help in the waythat we are taught to go about solving problems of this kind Please bring your entirefamilyi as well as any neighbor that might not receive a copy of this letter May ourLord guide this hearing for His glory onlyYours truly, Your Board of Directors Signed Leonard C Honeycutt, J Barry Barbour,Gene C,a 1 cote, Norwood Gene Ryal s, Joseph E Denning, Roy Joe Godwin, Robert E Leer00 #JMarch 16,, 1587 ContinuedMr Honeycutt related to the happenings at Scotts Lake during the July 15thconcert; and the problems with mass gatherings with no control Mr Honeycutt statedto the board, we have come to you, our County Commissioners for help He saysour county is growning and will continue to grow Mr Honeycutt in referring to theJuly 19th concert stated the Highway Patrol and the Sheriffs Department did all theycould do with the officers on duty in that area Mr Honeycutt stated it seemed likea little battleground10 on July lc, 1986 In closing, he stated; I contend, and ourorganization contends, we need help and we are trying to go about it in a lawfulmanner in the way it should bell He stated there are many immoral acts that goon during a concert People come before the gates are open, they are parking allup and down the roads and in peoples fields If someone living along this ruralroad needed rescue service, the rescue ambulance could not get through People leavingthese concerts are in no condition to be driving, they are out on the highways andthis is of great concernMr Honeycutt said he had read this ordinance and he does not interpret it to meanwhat Mir Levinson is reading into it; I think it would be fair for the whole county ,he continued, if it is not fair for all the rural areas of the county then it couldbe re- drafted, but we people in the rural areas of the county have to have somehelpMir Honeycutt urged the board to consider the request of the organization,Citizens For A Better Community, Inc, to adopt a Mass Gathering Ordinance3 Donnie Adams, Deputy Sheriff Mr Adams stated he had observed eventsat Scotts Lake and Mr West had run this business as well as anyone could, hefeels it would be unfair to adopt an ordinance that applied to rural areas and notincorporated towns4 Sill Newsome, ALE Agent Had no comments, stated he was here to answerany questions anyone might have on the ABC laws5 Joe Denning Mr Denning stated, we do have a problem, he does not feelthis ordinance is to stringent on anyone, we do need help, if there is not somethingdone, I would like to invite everyone of you to the next concert6 Rev Carl Dixon Rev Dixon related that it is a moral situation the communityis confronted with and he is greatly concerned The neighbors are not opposed toanyone with property to making a gainful profit, but to have availability withoutresponsibility is another question Rev Dixon asked the board to use their authorityand power to join with the community, to improve the community; one that we canbe proud of Rev Dixon stated that he was in sympathy with Mr Kenneth West RevDixon says we need to clean up the area of Scotts Lake and the entire county; cleaningup and keeping our community clean and moral will help everyone7 Eddie Byrd Stated the lake is directly behind his home, Kenneth West isa close friend, Mr Byrd said he wants what is right for everyone in the community,his property has not been damaged, he personally has not been hurt, however, sym-pathizes with anyone that has been hurt, he does not want this ordinance to createenemies8 Dr N B Grantham Dr Grantham spoke on behalf of the Boy Scouts ofAmerica, Dr Grantham stated that he is a member of the Executive Board of the TuscaroraCouncil; he expressed concern of the affect this ordinance might have on their programand the program area in Bentonville; sometimes they have as many as 1,500 to 2,000people; he is also concerned about the cost of permits as so many of their workersare volunteers The ordinance could affect the Mary Atkinson Girl Scout Camp alsoDr Grantham says they already comply with all the safety factors, an ordinancemight impede on some of their programs at the Boy Scout Camp at Bentonville DrGrantham further stated that he would hope there would be exclusions for the non - profitorganizations such as the boy scouts or the allied groups they work with, shouldthe board determine that an ordinance is necessary9 Robert Lee, Garner, NC owns property that joins Scotts Lake Mr Leestated this situation is of great concern, each time there is a concert at Scotts Lakehe comes down to guard his property, his Bother lives at the entrance to ScottsLake, she is a senior citizen Mr Lee related to the board some of the things thatgo on when there is a concert at Scotts Lake 1 bring in beer; 2 drinking; theyknow, no bounds, go anywh ere; `crusing; 3 impaired on the road; 4 smoking marijuana;no fear of being arrested; 5 witnessed an intercourse beside the road; o filthylanguage; 7 very loud music; 8 after the concert they leave and are on the roads,which is very dangerous to everyone Mr Lee asked the board for help; we havecome to you for help; our intentions are not to close Scotts Lake, but to have orderlygatherings Mr Lee says Johnston County is growning, if an ordinance is not passed,Johnston County will be a haven for this type thing It is because of an ordinancethat Harnett County is not having concerts and this type of problem We need anordinance to help control this type gatheringflLe iJMarch 16, 1 587 Continued 10 Ken Neighbors, Benson Mr Neighbors stated that he lives in this community,he was not aware of any problems caused by a mass gathering; you need to bearin mind the people that operate this lake, this is their living11 Barry Barbour Mr Barbour stated, our County Commissioners have the re-sponsibility to be concerned about each citizen of Johnston County; if this ordinancecan not serve both, you need to get an ordinance that will deal with a situationof this type, something has to be done for Johnston County, the way Scotts Lakeoperates now, these are problems for our community Thinks Ken West does as wellas he can under these conditions, but we can not continue under these conditions;a large number of people is hard to control, if you have concerts and a large numberof people, alcohol and drugs are hard to control, we need to try to eliminate thesetype situations, we need to have a safe community each day, we have a responsibilityto each other This is a county situation, not just Scotts Lake, this is a great burdenon you County Commissioners and if you see this ordinance will not meet both factions;adopt one that will represent both sides and that will not place great burdens oneither side 12 Richard Daughtry - Vice President of Smithfield Jaycees Says this ordinanceaffects the entire county; as Johnston County grows we need to be interested in thepublic health of Johnston County; this ordinance will affect the Smithfield Jayceesas our tractor pulls attracts a number of people; probably exceeds 2,000 and theSmithfield Jaycees are concerned about the cost; to meet these requirements the tractorpulls would not be feasible to operate trying to comply with this ordinance Mr Daughtryasked the board to -consider the Jaycees interest and exempt the Smithfield Jayceesfrom having to compiywith these provisions13 EltonBlackmon MrBlackmon says he believes thisordinanceis wrong;he commentedon Benson Mule Day, running for four days; saysthere isdestructionof property;Scotts Lake cantbe any worse than Mule Day inBenson; and no moredrunks thanin Benson; if youhave an ordinance of this kind,it shouldprotect thepeople in town alsoisas much againstalcohol and drugs as anyone, but where you have concerts you14 JerryHolloman - DeputySheriff Stated he had worked Scotts Lakeand otherfunctions ofmass gatherings inthe county and Scotts Lake hasbeen runlike anyother gatheringin the countyheis not here to16 Freddy Narron - Johnston County Sheriff Sheriff Narron stated he takes theposition of Sheriff very seriously He asked for permission to make a statement tothis delegation; - whether Johnston County has an ordinance or not, mass gatheringsrequire some special attention; during the concert the Sheriffs Department did nothave the proper number of officers present; I will rely on resources within my department,I will call on extra help to monitor any mass gathering and_ will provide the bestpossible protection for the citizens of Johnston County 17 George Mast, Attorney, Representing the Citizens For A Better Community, IncMr Mast thanked the Board of County Commissioners; Mr Mast stated; this is veryimportant for Kenneth West who is trying to make a living and terribly importantfor those people who live in this community of Elevation Township; citizens throughoutthe county are concerned about the security, welfare and health of the citizens Iwould like to thank Mr Billy Britt and the County Manager, Mr Richard Self, whodrafted this ordinance, I would like to take credit for this ordinance, but I sawit about the same time you saw it, I did draft an ordinance, and submitted it tothem, but I had nothing to do with the ordinance you have before you I want youto understand this is not an ordinance prepared to close, Scotts Lake I dont wantyou to close Scotts Lake, I want Scotts Lake to stay open; we need more entrepreneurial ,type ventures in Johnston County; it creates jobs for the people; hopefully along1 -95 there will be more places to serve people I can understand Mr Wests concern;but thats not what the people of Elevation Township and the rest of Johnston Countyare here to talk about, We are here to talk about the welfare or our citizens, nomatter what kind of gathering The Boy Scouts have realized that it is important15Kenneth West- Owner and Operator of Scotts Lake Mr Vest stated he hadrunScotts Lake foreleven years, never intended to break any laws at Scotts Lake,hehad at one timeallowed camping to go on; but had to stop over -night campingbecause it did causeproblems; the last two concerts were held from 11 am to 7,pmHe continued that he had run it as clean as he possibly could, he says heisas much againstalcohol and drugs as anyone, but where you have concerts youwillhave drugs andalcohol Mr West stated he realizes that concerts are a problemandhe is ready towork out something, but is concerned about how the number ofpeople was determined,he is concerned about this; says Scotts Lake is his income,heis not here tocause any problems, but he has 3,OQ0 people on many Sundays,heis trying to run a clean safe place, and I dont want you to think I have violatedanylaws; and I askyou to look fairly at the situation, before you adopt an ordinance1116 Freddy Narron - Johnston County Sheriff Sheriff Narron stated he takes theposition of Sheriff very seriously He asked for permission to make a statement tothis delegation; what kind of recreation youhave; that you have a certain degree of health care for any time you have over 500people with proper facilities; and proper security; and proper traffic control Nowthe tragedy of` this would be that we would end up with three or four paraplegicsbecause of an accident occurring at the Boy Scout Camp or the tractor pull or goingswimming at Scotts Lake We have been very fortunate to this point, not havinga mass gathering ordinance, in that we have not had any serious tragedy I thinkwhat the people of Elevation Township and the citizens of this county;, and whichI am confident you will give them, is an ordinance that is not a burden that willnot put anybody out of business, but that will insure that people will be properlyprotected when they go to a facility in Johnston County;
