Points11, 12, 13, 14, and 15 are adjoining points with Blackmon Crossroads FireDistrict; Points 18, 19, 20, and 21 are adjoining points with Elevation FireDistrict3 Paving Participation Request - NCGS 153 -A- 185 -4 and 153A -205 - Cleveland HeightsSubdivision Streets - Leonard LynchLeonard Lynch met with the Board and again asked for County assistance in pavingstreets in the Cleveland Heights Subdivision in accordance with NCGS 153A -185 4 and153 -A -205 The subdivision plat has been recorded Mr Lynch presented signaturesrepresenting 75 of the property owners who petition the Board for road improvements Theseproperty owners are requesting the County participate in the amount of 25 of the total costto 1 bring the roads and ditches up to State standards; 2 to pave the majority of thesubdivision streets; and 3 to repave the existing portionsAfter discussion and review, Commissioner Frank B Holding moved the petition fromCleveland Heights Subdivision be accepted and submitted to the County Attorney forverification in accordance with NCGS 153A- 1854 and 153A -205Commissioner John M Booker seconded the motion which carried by unanimous vote4 Secondary Road Request - Proposed Addition Connecting SR 1152 and NC 96Mrs Pearline Johnson and a group of property owners met with the Board seekingendorsement and assistance on getting Secondary Road 1152 extended from SR U50 to NC 96A road is needed to be able to get farm machinery to and from their property Mrs Johnsonexplained that originally a path gave them access from NC 96, however, since early 1987,Wade Stanley property owner adjoining Mrs Johnson had closed the path and they areunable to get large farm machinery to their propertyRoss Hailey, DOT Maintenance Engineer, had investigated a request earlier, which heunderstood was to connect SR 1150 and NC 96J 0 Ethridge, DOT District Engineer, being present at this time, explained theyhad not investigated extending SR 1152, however, the entire road would have to beconstructed to the Department of Transportations minimum construction standards whether onan existing location or on a new location and the cost would be tremendousAfter a lengthy discussion, the Board asked that DOT officials meet with thesecitizens to see what can be worked out and to come back to the Board for any necessaryaction5 Secondary Road - Add to System - Street Intersecting SR 1908Commissioner John M Booker moved the Board concur in the recommendation from theDepartment of Transportation to add the street intersecting with 1908 at Highway 1989,Wilsons Mills Community, to the State Secondary Road system for maintenanceCommissioner Frank B Holding seconded the motion which carried by unanimous vote6 Secondary Road # 1199 - Request for PavingThe Board received a request from Tuscarora Council, Inc #424, Boy Scouts ofAmerica, that consideration be given for the paving of State Road #1199 that crosses in frontof the boy scout reservationI?,I297July 5, 1988 ContinuedWilliam D Lappin, Scout Executive, in a letter advised that scout officials had metwith DOT personnel They were advised that funds appropriated in the Johnston CountySecondary Road Construction Program would have to be allocated to pave this road MrLappin also stated in his correspondence that with over 5,000 vehicles utilizing this road,we feel that this should be a major paving priority They expressed strong feelings thatpaving is needed for the safety of the campers and visitorsJ 0 Ethridge, DOT District Engineer, told the Board the cost to pave SR 1199 wouldbe approximately 320,000 He stated, about 170,000 of State discretionary funds could beallocated to this project leaving 150,000 to come from funding appropriated to JohnstonCountys Secondary Road ProgramThe Board asked the County Manager to contact DOT officials to see if more Statediscretionary funds can be made available for this project Commissioner Frank B Holdingmoved that a Public Hearing on the funding allocation for SR #1199 be set for Monday,August 1, 1988, at 10 oclock am, Commissioners Room, Johnston County Courthouse,Smithfield, North CarolinaCommissioner seconded the motion which carried by the following voteAyes Frank B Holding, James W Cash, John M Booker, DyM, Howard BentonNays NoneAbstaining Norman C Denning7 Tax Appeal - William Joseph EdwardsWilliam Joseph Edwards of Four Oaks appeared before the Board appealing the valueplaced on 1005 acres of land located on Highway 301 just outside Four OaksThe Tax Administrator advised that deed records show the land sold for 125,000 inJune of 1987 He stated, with this type of sales price, the property status was changed fromfarmland to commercial land at 12,000 per acre, resulting in an assessment value of 120,600Mr Edwards stated the property is farm land and should be valued as such; it isnow being used for farming He said he was in a position to have to buy the property tokeep anyone else from getting it as it is located just across from his present businessIn discussion, the Board felt that Mr Edwards is in a unique situation, and askedthe Tax Administrator to talk with Local Government officials to see if any consideration canbe given in this type situationThe Tax Administrator filed a Tax Collections Report with the Board for the month ofJune, 19888 HAPP - Revised Administrative PlanThe County Manager explained the Federal Government has modified eligibilityrequirements for the HAPP Federal Priority Amendment to the Housing and CommunityDevelopment Section of the Housing and Urban Rural Recovery Act of 1983 In order tocomply with requirement, the Administrative Plan , must be revised and approved by theBoard The changes are as followsPresent Plan Priority 1 Applicants displaced by Government action 2Consideration given to applicants who are displaced by natural disasterAmended Plan Priority 1 Applicants who pay more than 50 of income for rent andutilities 2 Applicants who are involuntarily displaced; motion by Commissioner James W Cash, seconded by Commissioner HowardBenton and carried; plat executed by ChairmanGeorge13 Frank H Scholarship Fund Sterilization Trust FundJames P George presented a Declaration of Trust for the Boards consideration Heasked the Commissioners to consider the document in relation toits good for the individual,family, taxpayer and societyThe Board read and reviewed the document and agreed it should be turned over tothe County Attorney for a legal opinion14 Extension of Employment - Health Department EmployeesJoyce Jones and Martha Stevens, part -time employees atthe Johnston County HealthDepartment, have reached the age of 70+ and wish to continue tobe employed In accordancewith Johnston County Employee Handbook, Article VII, Section 13Compulsory Retirement, theBoard of Commissioners must grant permission for an extensionof employment following the70th birthdayCommissioner Howard Benton moved that a one yearextension of employment begranted to Joyce Jones and Martha Stevens, part -time employees of the Johnston CountyHealth DepartmentCommissioner Frank B Holding seconded the motion whichcarried by unanimous vote15 Water Study and Water Line to Benson - EngineeringThe County Manager requested permission to contract with Ragsdale Consultants,PA, for engineering of the transmission line from Four Oaks to Benson and for acounty -wide water study 580,000~ has been budgeted this year for the engineering andconstruction of the Benson water line, and 39,,400 for a county -wide water studyCommissioner Frank B Holding commented on the need for the transmission line fromFour Oaks to Benson to be engineered so that if necessary it can be done in two phasesCommissioner Holding stated the needs and justification for water to South Johnston HighSchool could enhance the Countys application for State Clean Water Loan funds, and that theCounty needs to be in position to take advantage of this should that be the caseCommissioner Howard Benton says the Town of Benson wants to know what they canexpect from Johnston County this year Commissioner Benton strongly emphasized the need tobuild the water line; he said Benson needs water desperately to fulfill water commitmentsmade to various groups I l299Julv 5 1In discussing the Benson Water line further, Commissioner Benton stated that waterlines were run to Princeton and Clayton, and other areas of the County, when water wasneeded; now Benson needs water, the growth is there He further commented that Bensonis fast using up the amount of water they have contracted for with Dunn, and it looks likethey may have to re- negotiate their contract with Dunn for additional water He continuedthat Benson will be desperate for water in 12 to 18 months and I do not want to see Bensonturn to Dunn for that waterCommissioner Holding says the Board is counting on Clean Water Loan money, ifSenator Royalls bill passes, which will enhance the Four Oaks to Benson water line, and ifthe town of Benson has industrial plans, he is willing to work out plans to build the waterline right now He continued that it is very important to Benson, Dunn, Smithfield and FourOaks to have capabilities to draw water from the Cape Fear if need beThe Chairman commented favorably that it is the good intentions of this Board tobuild the Benson water line, all members of this Board want to build the water line, it isbecause of pending State applications for financing that there might be `needs to look atengineering and design in two phasesM Deer Spotlighting - ProhibitedUpon a motion by Commissioner Howard Benton, duly seconded by Commissioner FrankB Holding and carried by unanimous vote, the following resolution was adoptedRESOLUTIONWHEREAS, the North Carolina Wildlife Resources Commission, actingunder authority of GS 113- 2911el, has heretofore adopted a regulationprohibiting shining lights on deer between 11 oclock pm and one -half hourbefore sunrise in Johnston County; andWHEREAS, the Johnston County Board of Commissioners has beenpetitioned by citizens and residents to enact the proper regulationprohibiting the spotlighting of deer at night by means of any artificial lightfrom any state or county maintained road;NOW, THEREFORE, it is respectfully requested by the JohnstonCounty Board of Commissioners, in accordance with GS 113- 2911e2 , thatthe period during which shining lights on deer is prohibited be extended tothe hours between one -half hour after sunset and one -half hour beforesunriseAdopted this the 5th day of July, 198817 Four Oaks to Benson Water Line - Engineer Discussed with BoardTim Broome, Ragsdale Consultants, was asked to address the issue of engineering theFour Oaks to Benson water line in two phases Mr Broome says it is practical to think interms of designing the water line so that it can be- done in two phases; from Benson toSouth Johnston High School, as they have been having problems with well water; and fromSouth Johnston School to Four Oaks He told the Board the Four Oaks booster pump stationwill need to be modified and a tank will be needed for pressure It will take approximatelyone year to build the water tank; and at least a year for the water line, depending on thetime of year the County takes advantage of The engineer continued, if the work was startedright now, it would be difficult to spend more than a half million dollars in this budgetyear He further stated that usually you create more interest and receive better bids bybidding a big job in two parts Total project cost has been estimated at approximately 21million; and he says the Countys chances of getting Clean Water ,Loan money are good if theCounty gets its priority points in order showing the need in Benson, the schools needs, andby having construction plans ready Engineering plans can be ready for bids in 120 to 140days at the most18 Water Line - Four Oaks to Benson Engineering AuthorizedAfter much discussion, Commissioner Frank B Holding moved that RagsdaleConsultants be authorized to design the Four Oaks to Benson water transmission line in itsentirety, complete, ready for bidsCommissioner Howard Benton seconded the motion which carried by the following voteAyes Frank B Holding, James W Cash, John M Booker, Howard Benton, NormanC DenningNays None11July 5, 1988 Continued19 Water Study - County -WideTim Broome, Engineer, also elaborated on the proposed county -wide water study Hesays the study would identify the needs throughout the County, as to where people are nowand where people may go;
