May 6, 13, 20, 1988Date and Time May 23, 1988 - 730 pmAttendance Approximately 50 peopleThe Chairman asked Mr Frank Morris with the Division of Health Services toaddress the procedures for creating a sanitary district in accordance with the GeneralStatutes Mr Morris stated everything seemed to be in order to proceed with theestablishment of a sanitary district; map and description of proposed area, petitionsigned by at least 51 of the resident freeholders and public notice advertised in thelocal newspaper for four successive weeksMr Morris called on the following people who wished to speak¦r259May 23, 1988 Continued1 Frank B Holding, County Commissioners Commissioner Holding, speaking onbehalf of the proposed sanitary district, remarked that he had been contacted bymany citizens from this community about their water problems Commissioner Holdingsaid he certainly recognizes their need and feels they need relief, planning in thisdirection is some relief2 Charlie Barefoot - We need water, if a sanitary district is the way to go,Im all for it3 Alyce Sumrell - Ms Sumrell testified that her water has the highest levelof bacteria , her water is not suitable for drinking, she said she has been bummingwater since September of 1986, and many of her neighbors have the same problem,she supports the sanitary district4 Tim Evans - Mr Evans stated that he did not have a bacteria problem,howeve , his water has a bad taste; he supports a sanitary district5 Ed McLeod - Mr McLeod said he has no water problem, but he supports thepropose sanitary district, he feels it w i l l increase the value of his property6 Chuck Coats - Mr Coats said that his water is clear and clean , he justdoesnt have enough, he supports the sanitary district, but thinks it should bemandatory for everyone in the district Mr Coats expressed appreciation to the Boardof County Commissioners and the Department of Human Resources for assistance7 1 Ed Bryan - stated his water is clear and good, but not enough of it; welloften g es dry, and he supports the proposed sanitary district8 Charlie Moore - stated he has two wells; a shallow well and a deep well;the shallow well is clear and taste good, b,ut tested high in bacteria; the deep wellhas iron, we need water badly Mr Moore told the board there are four residentsliving on Juniper Drive that favor the proposed sanitary district that were unable toattend tonight9 Tommy Ives - Mr Ives expressed appreciation for the County and Stateholding this Public Hearing; he said they need water for fire protection also, thiswill lower insurance ratesIN 10 Macy Hoyle - Mr Hoyle said he built 23 years ago on Cloverdale Drive, hehas no water or sewer problems compared to others, but feels what is good for hisneighbors is good for him, hopes this area can have a sanitary district estabI i shedand every property owner will participate He thanked the Board of County Commis-sioners and Department of Human Resources for holding this Public Hearing11 Doris Cannon, - stated she has bad water, has to have a filter system largeenough to take care of a motel ; her water is black with a horrible odor, hassulphur, iron and rust, her pipes are eaten out; she supports a sanitary district12 Anne Lee - Ms Lee lives on Cloverdate Drive; has a severe water problemwith iron; both wells filled with iron, cant do her Laundry, needs water badlyMr Morris asked if any one present was against establishing a sanitarydistrict in Whitley Heights There was no opposition13 A B Boykin - Mr Boykin said at times his water is black and we needa water system Mr Boykin questioned the countys proposal for a future water lineto McGees Crossroads in relation to Whitley Heights residents having to pay forwater lines to connect to the county system In response the County Manager andCommissioner Frank B Holding explained the county runs high pressure distributionlines from one governmental unit to another and to industrial sites , but not toprivate homes or subdivisions The county has no retail water customers, all water issold to other governmental units, however, if a private home wishes to hook on to adistribution line that is accessible they can do so at their expense Major distributionlines are run with consideration given to as many connections, where water isneeded, as possibleIf a distribution line is run to McGees Crossroads, subdivisions and orhomeowners w i l l have to do the same as Whitley Heights, create a sanitary districtQuestion - The Wilsons Mills Community Development Target Area water line- Commissioner Holding explained a Community Development Block Grant was awardedto the area and the county put matching funds to assist with a connectingdistribution line from Highway 70 to the target area260May 23, 1988 ContinuedQuestion - If residents on Highway 70 already connected to the water linewill be part of the sanitary district The response was that the Sanitary DistrictBoard will have to address this matterCommissioner Frank B Holding further explained that getting a water systemin place w i l l be a mechanism to provide sewer later should this area need sewerCommissioner Howard Benton spoke to the group saying the board recognizesthat Whitley Heights needs some relief; the County Commissioners are in favor ofgiving you some help to see that you get good water and the board will cooperateLib Hoyle - asked, What happens to our well Mr Morris said that allwells w i l l have to be separate from the water system, can not connect to anyplumbing, you could use your °wells to water your lawns Chairman Denning and Mr Morris called for anyone else that wished tocomment in any wayQuestion from another resident speaking in favor of the sanitary district;- How will the system be paid for, tax assessments or water bills Mr Morrisexplained the best water saver is a water meter He suggested water meters asbeing the best method, this way the district charges people for the water they useCommissioner John M Booker asked how the Board of Directors for thesanitary district will be determined and when the resolution is neededMr Morris explained the Board of County Commissioners need to adopt aresolution at this time if they concur in the establishment of the Whitley HeightsSanitary District The resolution will be brought before the Commission of HealthServices, which meets again in September He said he sees no reason why theCommission would not approve this request as all data is in order Mr Morris saidin accordance with General Statutes, if the Sanitary D i st i ct is approved, the Boardof County Commissioners appoint a Sanitary District Board of three members, residentswithin the district, and this board will serve until their successors are elected atthe next general electionThe Chairman asked if any one else wished to be heard concerning theproposed sanitary district There being no one else that wished to speak, theChairman declared the Public Hearing closed at 805 pm, and that regular sessionbe resumedREGULAR SESSION Upon a motion by Commissioner Howard Benton, dulyseconded by Commissioner John M Booker and carried by unanimous vote, the follow-ing resolution was adoptedRESOLUTIONWHEREAS, the Johnston County Board of Commissioners was petitioned by51 of the freeholders of Whitley Heights, andWHEREAS, the Board of County Commissioners concurs in the needs andjustification for - the provision of a basic infra - structure system in Whitley Heights,andWHEREAS, the procedures of North Carolinabeen followed and a public hearing held in the proposedNOW, THEREFORE, BE IT RESOLVED that thJohnston County unanimously approve the creation ofDistrict, the meets and bounds of which are on fileBoardBE IT FURTHER RESOLVED that a copy ofto the Department of Human Resources, Division of HealthAdopted this 23rd day of May, 1988General Statutes 130A havedistrict;Board of Commissioners ofthe Whitley Heights Sanitaryin the Office of Clerk to thethis Resolution be forwardedServices2 Resolution to Proceed - Senate Bill 2 - SR 2398 Water Facilities ImprovementUpon a motion by Commissioner James W Cash, duly seconded by CommissionerJohn M Booker and carried by unanimous vote, the following resolution was adoptedRESOLUTIONTO PROCEED WITH ELIGIBLE PROJECT UNDER SENATE BILL 2WHEREAS, Senate Bi 1 I 2, Chapter 480, 1985 Session Laws of the State ofNorth Carolina authorizes funds for water and sewer projects;
