Meeting of Johnston CountyMarch 7, 1988The Johnston County Board of Commissioners met in regular session Monday, March7, 1988, at 10 oclock am, Commissioners Room, Johnston County Courthouse, Smithfield,North Carolina, with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, James W Cash,Howard Benton and John M Booker, DVMAlso present Richard Self, County Manager, Eleanor N Creech, Clerk to the Boardand William R Britt, County AttorneyThe Chairman called the meeting to order and the following business was transacted1 MinutesThe Chairman asked if there were any corrections to the minutes of February 1,1988, board meeting There being no corrections, the Chairman declared the minutes standapproved as recorded2 Public Hearing - Annexation of Bentonville Fire DistrictAdvertised February 5, 1988, and February 9, 1988 - Time of Public Hearing 10oclock amThe Chairman opened the Public Hearing on the proposed annexation of theBentonville Fire District to a five mile districtPurpose To provide the public an opportunity to address the Board of Commissionerson the proposed annexationThere was no one present that spoke on the proposed annexation of the BentonvilleFire District to a five mile district The Chairman declared the Public Hearing closedCertified petitions from the Bentonville Fire District were presented to the Board fortheir reviewAfter review and discussion and upon motion by Commission Howard Benton, dulyseconded by Commissioner James W Cash and carried by unanimous vote, the followingresolution was adoptedRESOLUTIONWHEREAS, the matter of fixing and declaring the amended boundaries of theBentonville Fire District was duly presented;AND WHEREAS, it appears that the Bentonville Fire District has complied withminimum requirements, as contained in the resolution adopted by the Board of CountyCommissioners on October 3, 1955, pertaining to the establishment of Fire Departments andFire Districts in Johnston County; and with General Statute 69 -2511 Changes in Area ofDistrict ;AND WHEREAS, the enlargement of its fire district has met the approval of the NorthCarolina Fire Insurance Rating Bureau;NOW THEREFORE, BE IT RESOLVED that the boundaries of the Bentonville Fire Districtto be served by the Bentonville Fire Department be amended and officially designated andfixed as followsFive Mile Boundaries ofBentonville Fire DistrictJohnston County, North CarolinaqaIIBeginning ata point 1 on Bentonville Road 1009, at the Ellis Branchand 04 milenorthof the bridgeover Mill Creek; thence in a southwesterly direction to apoint 2 onJoynerBridge Road1185 02 mile north of its intersection with Blackmon MillRoad 1136;thencein a southwesterlydirection to a point 3 at the intersection of Roads1136 and 1188,then in a southerlydirection to a point 4 on the Harper House Road 1008 04 mile east ofits intersection withUS 701; thence in a northerly direction to apoint 11 on Road 1200 12 miles north of its intersection with Road 1008; thence in awesterly direction to point 1, the beginning3 School Bond IssueRoyster Martin, Chairman, Johnston County Board of Education, and James HEllerbe, Superintendent, present at this meeting, were welcomed by the Chairman and givenan opportunity to address the BoardDr Ellerbe stated the needs of the schools are well documented and the Board ofEducation appreciates action of the Board of Commissioners; this bond issue is a stepforwardThe County Manager read the proposed School Bond Issue OrderChairman Norman C Denning called for discussionCommissioner Frank B Holding commended the schools saying the schools are thelargest responsibility the County has, some people want a larger bond issue, some less Thisbond issue will be a pay back with general fund revenues Commissioner Holding proposed9,000,000 General Obligation School Bonds saying it is a fair and reasonable way because a9,000,000 issue will not have to be paid back out of any of the sales tax revenue committedto the Board of Education for school construction Commissioner Holding pointed out that localsales tax over a 10 year period, along with this bond issue, will provide money for schoolconstruction needs in the County without having to raise the tax rateCommissioner Howard Benton agrees with Commissioner Holding, however, would likefor the Board of consider alternatives to strengthen the whole bond issue question to givethe School Board and this Board greater hopes in getting school facilities in better shapethan they are now and in better shape than they will be in the next few yearsCommissioner Benton continued the 9,000,000 plan is just stop -gap action to take care ofcurrent needs and does not speak to the future needs of the schoolsCommissioner Benton Proposed This Board consider, in addition to the 9,000,000bond issue proposed, to give the voters a choice by putting another issue on the ballotcalling for a 20,000,000 bond referendum, with a stipulation that 9,000,000 of the20,000,000 shall be sold immediately; and the other 11,000,000 not be sold until the schoolsdemonstrate a needCommissioner Benton emphasized there is a need to use reasonable judgement thatwill reach into the future needs of the schoolsIn response, Commissioner Frank B Holding said he does not feel two issues willcarry; he thinks the 9,000,000 proposal is a reasonable approach at this time, andcontinued, there are limits to what the people should be expected to payChairman Norman C Denning - This Board knows school needs are far greater than9,000,000 or 20,000,000; the 9,000,000 is not a cure all, it will just put the schools alittle further ahead Chairman Denning said he thinks there will be State money for theschools in the near futureCommissioner James WCash said it is not the intentof this Boardthat the9,000,000 will satisfy the schoolneeds We dont expect it to beenough, we aretrying todo what the School Board askedCommissioner Cash committed hissupport of the9,000,000bond issue stating he feels thecitizens in Johnston County thatare interested in buildingnew schools will support it It is a fair way to goCommissioner John M Booker stated, as he understands it, with the sales taxrevenue designated, it will produce about 3,000,000 per year for school construction; theschools are assured of 3,000,000, and both boards are committed to a building program inJohnston County Commissioner Booker continued this is a strong move, as the County isfaced with more and more pressure being placed on the advalorem tax dollar He emphasizedthat he is going to do what he sees best for the citizens of this County at this time Theloss of the Four Oaks school was a disaster and there is much concern about busingstudents, however, he agrees with the Chairman in thinking the State will come up withadditional money for schools Commissioner Booker stated the 9,000,000 bond issue, if220March 7, 1988 Continuedpassed, will get the program going strong; he continued I will support this bond issue andwill continue to support the schools construction program in the County in a fair practicalway In his closing remarks, he explained that one of the main reasons he is supportingthe 9,000,000 is that a 20,000,000 issue would divert all sales tax dollars to paying for theschool bondsCommissioner Howard Benton further stated his concerns; -- our school buildingprogram is going to be slowed down and not satisfy the majority of the people In his ` Iproposal to escalate the building program, he indicated it had been slowed down too long,however, his proposal seemed to fall on deaf ears Commissioner Benton pledged hissupport to the 9,000,000 bond issue, if other Board members feel the 20,000,000 is notwise, but strongly feels we should get the bond issue behind usADOPTION OF BOND ORDERCommissioner Frank B Holding introduced the following Bond Order, the title ofwhich was readBOND ORDER AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION BONDS OFJOHNSTON COUNTY IN THE MAXIMUM AGGREGATE PRINCIPAL AMOUNT OF 9,000,000THE ACQUISITION, CONSTRUCTIONi FINANCING, IN PART Q ,FOR THE PURPOSE OF FI N ,INSTALLATION AND EQUIPPING OF SCHOOL FACILITIES IN JOHNSTON COUNTYWHEREAS The Board of Commissioners of Johnston County the Board has decided topursue the issuance of general obligation bonds in the maximum aggregate principal amount of9,000,000 under the Local Government Bond Act the Act to finance, in part, theacquisition, construction, installation and equipping of school facilities in Johnston County;andWHEREAS The Board has filed an application with the Local Government Commissionof North Carolina for approval of such bonds as required by the Act;BE IT ORDERED BY THE BOARD OF COMMISSIONERS OF JOHNSTON COUNTY1 It is hereby determined necessary and expedient for Johnston County to borrowmoney, and there are hereby authorized to be issued general obligation bonds of Johnston fCounty for the purpose of providing money to finance, in part, the acquisition, construction,installation and equipping of school facilities in Johnston County2 The bonds shall be in a aggregate principal amount not to exceed 9,000,0003 The bonds shall be general obligations of Johnston County for the payment ofprincipal of and interest on which its full faith and credit shall be irrevocably pledged andtaxes will be levied in an amount sufficient to pay the principal of and interest on thebonds4 A sworn statement of debt has been filed with the Clerk to the Board pursuantto GS Section 159 -55 and is open to public inspection5 This Bond Order will take effect when approved by the voters of JohnstonCounty pursuant to GS Section 159 -61Commissioner Frank B Holding introduced the following resolution the title of whichwas readRESOLUTION PROVIDING FOR PUBLIC HEARING ON BOND ORDER FOR 9,000,000GENERAL OBLIGATION BONDS AND PUBLICATION OF BOND ORDER AND NOTICE OFHEARING AND OTHER ACTIONWHEREAS There has been introduced to the Board of Commissioners of JohnstonCounty a Bond Order entitled, BOND ORDER AUTHORIZING THE ISSUANCE OF GENERALOBLIGATION BONDS OF JOHNSTON COUNTY IN THE MAXIMUM AGGREGATE PRINCIPAL AMOUNTOF 9,000,000 FOR THE PURPOSE OF FINANCING, IN PART, THE ACQUISITION,CONSTRUCTION, INSTALLATION AND EQUIPPING OF SCHOOL FACILITIES IN JOHNSTONCOUNTY, andWHEREAS GS Section 159 -54 provides there shall be a public hearing on the Bond,Order and GS Section 159 -56 provides for publication of the Bond Order and notice of thehearing;
