Champion ProductsJohn Stott, Tax Administrator, furnished the Board with the following informationregarding a refund request from Champion Products, Clayton Champion Products isrequesting a refund of 2,546,12 County - 1,52332; Town of Clayton - 1,02280 Thisamount was charged because Champion Products made a 101,06876 tax payment on January14, 1988, for 1987 taxesChampion requests refund based on their past history of prompt payment and theirinternal confusion When the tax notices were received by Champion Products personnel, theydid not recognize them to be property tax invoices but rather property tax receipts to beretained for North Carolina income tax return income tax credit for property taxes paid oninventory Consequently, the personal property tax notices were filed away instead of beingprocessed for payment The real property taxes were paid timely on November 18, 1987The Tax Administrator confirmed that Champion Products payment record is excellent,but there is no statutory authority to refund a late payment penalty, however, a release wasmade in May of 1988 to Data General for a similar late payment chargeAfter discussion, Commissioner James W Cash moved that the late payment penalty tothe County of 1,52332 be refunded to Champion Products, Inc of Clayton, N CCommissioner Frank B Holding seconded the motion which carried by unanimous vote7 Road Naming ProjectPlanning Board recommendations for road names in Clayton and Wilders Townshipswere presented to the Board for review and consideration The Policy and Procedures Manualfor Road Naming has been accepted by the Planning Board and recommended to the Board ofCommissioners for adoptionJeff Coutu, County Planning Director, told the Commissioners the Planning Board hasgiven the people in these townships an opportunity to address their complaints about thesuggested road names The main problem in Clayton Township comes about because of thenaming of roads approximately five years ago by the Clayton PostmasterThe Planning Director advised that two petitions had been circulated for naming ofSR #1560; one petition supporting the name Ranch Road, and the other supporting thename, Baptist Center Road The Planning Board, at their meeting on November 22, 1988,recommended the name of Baptist Center Road for SR #1560There were several citizens present who wished to address the Board regarding SR#1560 with reference to these petitionsSR #1560 - Presently known as Ranch RoadBaptist Center Road PetitionsA Dick Lee spoke in favor of SR #1560 being named Baptist Center Road He saidthis has been Baptist Center Community for a long time; this road is one of the oldestroads in our area of the county Mr Lee emphasized the importance of preserving thehistory and heritage of our county He advised that Baptist Center Church was founded in336December 5 1988 Continued1871, six years after the Civil War, and was originally the site of a school known as BaptistCenter School He continued by saying many families come back to the community to holdfamily reunions Mr Lee again stressed the importance of our Countys heritage, it is vitalto the strength that we see in our younger generationsBRuffinCanady, Lawrence Canadyand Rev Robert Brooks Pastor of BaptistCenter Church wholives on SR #1560 presentlyknown as Ranch Road spokevery favorablysupportingthe naming of SR #1560 as BaptistCenter Road They emphasizedthat because ofthe landmark andthe heritage for membersof their families that attendedBaptist CenterSchool andBaptistCenter Church, they urgethe Board to favorably considerthese requeststo name SR# 1560Baptist Center RoadC Edith Casey, who helped with the Baptist Center Road Petition, stated the roadS R #1560 had always been Baptist Center Road until a few years ago when the ClaytonPostmaster renamed the road Ranch Road She expressed concern that residents who signedthe Ranch Road petition were misinformed about problems they might have in getting theirmailD Mary Ellen Causby said she has only been in the community for 10 years Sheattends Baptist Center Church and it has been the biggest influence in making JohnstonCounty her home She favors naming SR # 1560 Baptist Center RoadRanch Road PetitionsA Jean Jones, representing the people who support the naming of SR #1560, RanchRoad, advised the petition supporting Ranch Road was signed willingly by the residents,and there was no intention of misrepresentation on her part She explained that in heropinion, the petitioners representing Baptist Center Road did not fully explain what changeswould have to be made if the name was changed She further emphasized, the people wholive on the road are the ones affected and should be heard and represented She remindedthe Board that church members signed the petition, but do not live on the road Mrs Jonessaid, Heritage is important, but to my knowledge Ranch Road has never been named orcalled Baptist Center Church Road The Chairman reminded these citizens that the Board knows the feelings of both sidesof the issue on SR #1560, indicating they had been well informedDick Lee again reminded the Board this road had been Baptist Center Road since itwas a path; it has always been called Baptist Center RoadMary Ellen Causby asked the Commissioners if the Board will follow the PlanningBoards policiesThe Chairman responded he could not tell her for sure what policy the Board wouldfollow, however, they would try to come up with an answer and hope that it will be in thebest interest of all the people He also advised these citizens that the Board would hopefullyhave an answer on SR #1560 before the meeting adjournedRochelle and Jack Bolyard, 2410 Jack Road, Clayton, N C, met with the Board laterduring the day to speak on behalf of Jack Road, and also spoke in favor of SR #1560being named Baptist Center RoadMrs Bolyard, historian for Baptist Center Church, gave the history of the Churchand Baptist Center School as it relates to the naming of the road Baptist Center Road Shetold the Board the church is 117 years old and years ago she attended Baptist Center Schoolwhich was located in a building in the church yard the old school building was later movedto the Julius Lee farm This historical information is recorded in the Johnston County Room,Public Library of Johnston County and Smithfield She closed by stating she feels the Countywould be losing a very important link in its history if the road name remains Ranch RoadCommissioner Frank B Holding suggested that a historical marker be placed at thechurch and school site8 Subdivisions ApprovedUpon the recommendation of the County Planning Board, the following subdivisionswere considered for approvalA Holland, Norwood Holland; SR 2354; Boon Hill Township, 8 lots; RestrictionsStreet signs; street addresses; Motion by Commissioner James W Cash, seconded byCommissioner John M Booker and carried; plat executed by Chairman B Lee -Chase IV,Percy Lee, Owner; SR 1554; Clayton Township, 24 lots; Motion by Commissioner Frank BHolding, seconded by Commissioner James W Cash and carried; plat executed by ChairmanC Summerbrooke - saving potential of anything the emergency medical serviceshas ever done in Johnston CountyAfter discussion, Commissioner Frank B Holding moved that 19,508 be transferredfrom the Contingency Fund and appropriated to the Rescue Squads Capital Outlay Budget topurchase eight defibrillators for Johnston Countys Emergency Medical ServicesCommissioner John M Booker seconded the motion which carried by unanimous vote16 EMS Advisory Committee - ReportCommissioner John M Booker made the following report to the BoardThe Emergency Management Services Advisory Committee met on December 2, 1988The 50210 request for transport and rescue service was addressed by the committee It wasnoted that Kenly, Princeton, Clayton and Benson all face a similar situation in that they aregeographically located on the border of the County In addition, several communities such asBentonville, Emit, Corinth Holder and others also face similar situationsThe issue is a broad one and one which must be dealt with in a uniform manner ifat all possible Information is still being gathered to put together a complete picture Thisinformation includes response times, manpower, tax information and it would be very helpfulif we had the tax mapsIi339December 5, 1988 ContinuedCurrently, the committee is putting together a long -range plan to address the totalneeds of the County This will include a comprehensive examination of a County -wide systemfor rescue and EMS as well as supplementing the existing systemCommissioner Booker asked the Board for directions He said the entire Board willneed to look at rescue districts outside the County, and he hopes the Committee, along withthe Board, can find a solution that will be uniform He further commented that N C GeneralStatutes say counties are permitted to provide rescue service; not required, but there is ademanding need and the County is trying to provide the service The County depends onvolunteers; without the volunteers, the County would not have any service17 EMS Report - Tornado AssistanceDewayne West, Emergency Management Services Director, met ` with the Board andreported on mutual aide assistance worked out with Wake County with regard to tornados thathit Raleigh on November 28th Mr West told the Board that within an hour, Johnston Countyhad 135 fire and rescue volunteers and 15 vehicles available and standing by to offerassistance if neededAt this time Mr West presented the Commissioners their copies of the JohnstonCounty Multi- Hazard Emergency Operations Plan18 Department of Transportation - Maintenance ReportRoss Hailey, Maintenance Engineer, met with the Board and reported that SR 1311should be paved by the middle of April, 1989 He also reported that DOT plans to useexplosives to clear a beaver dam that is causing flooding on SR #119319 Road Names Approved - Resolution - Releasing State FundsUpon a motion by Commissioner John M Booker, duly seconded by CommissionerJames W Cash and carried by unanimous vote, the following resolution was adoptedRESOLUTIONWHEREAS, in North Carolina the Lead Regional Organizations, asvoluntary organizations serving municipal and county governments, haveestablished productive working relationships with the cities and countiesacross the state; andWHEREAS, many counties and cities continue to need assistance inpursing economic and community development opportunities, but federalassistance in the form of intergovernmental revenues has been severelycurtailed in recent years; andWHEREAS, the 1987 General Assembly hasthrough the appropriation of 990,000 each yearLead Regional Organizations assist local governmeconomic development, community development,development and other activities as deemedgovernments; andagain recognized this needof this biennium to help theants with grant applications,support of local industrialappropriate by their localWHEREAS, these funds are not intended to be used for payment ofmembers dues or assessments to a Lead Regional Organization or to supplantfunds appropriated by the member governments; andWHEREAS, in the event that a request is not made by a unit ofgovernment for release of these funds to our Regional Council, the availablefunds will revert to the states General Fund; andWHEREAS, in Region J funds in the amount of 55,000 will be used tocarry out the economic development plan approved by the COG Board ofDelegates and especially to improve the economy of the counties and towns ofthe Region by strengthening ties to and consequently benefits of theResearch Triangle ParkNOW THEREFORE BE IT RESOLVED, that the Johnston County requeststhe release of its 697183 share of these funds to the Triangle J Council ofGovernments at the earliest possible time in accordance with the provisions ofChapter 830 of the 1987 Session Laws HB 1515Adopted this 5th day of December, 198821 Whitley Heights Sanitary District - Proposed Water LineThe Whitley Heights Sanitary District has requested the County upgrade the proposedwater system from 2 and 4 to 4 and 6 lines at a cost of 92,000 The County ManagerriIMY341advised the Board the County does not have uncommitted funds in this amount at this timeThe Board instructed the County Manager to speak with Whitley Heights Sanitary Districtboard members encouraging them to build a 6 line, which is the minimum size required forfire hydrants The Board expressed much concern about 4 lines to serve this area22 City of Raleigh - Discharge PermitAfter review of a memorandum from Tim Broome, Ragsdale Consultants, regardingwastewater and water supply issues, the County Manager referenced that the City of Raleighhas a discharge permit for approximately 40 mgd and is currently treating an average of 25mgd The City applied for and received in August a permit amendment to increase itspermitted capacity to 60 mgdThe County Manager also stated that inasmuch as the City of Raleigh, according toMr Broomes memo, treats its wastewater at a extremely high level, and Durham also isrequired to treat its waste to an equally high level, the potential of approximately 90 mgd oftreated effluent in the Neuse River within 25 miles of the Smithfield Johnston County intakeshould be of considerable concern to usAfter further discussion, Commissioner Frank B Holding moved the County Managerbe authorized to request from the City of Raleigh an explanation of what safeguards exist toensure adequate treatment and what emergency procedures are in place to mitigate pollutionof our supply sourceCommissioner John M Booker seconded the motion which carried by unanimous vote23 Advisory BoardsThe Chairman made the following appointments to County Advisory BoardsNorman C Denning -
