The Johnston County Board of Commissioners met in regular session on Monday,October 3, 1988, at 1000 am in the Commissioners Room, Johnston County Courthouse,Smithfield, North Carolina with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, James W Cash,Howard Benton, and John M Booker, DVMMembers Absent NoneAlso Present Richard B Self, County Manager, Eleanor N Creech, Clerk to theBoard, and WR Britt, County AttorneyThe Chairman called the meeting to order and the following business was transacted1 MinutesThe Chairman asked if there were any corrections to the minutes of September 6,1988, board meeting There being no corrections, the Chairman declared the minutes standapproved as recorded2 Road Naming and Signs - Clayton and Wilders TownshipsThe Planning Board has recommended names for the various roads in Clayton andWilders Townships The Chairman stated the Board would take these recommendations underadvisement for the next thirty days and will then make any corrections that need to bemade In the meantime, any requested changes will go back before the Planning Board forrecommendations to the Board of Commissioners317318October 3, 1988 ContinuedAt this time, the Chairman called on any person that wished to speak regardingrecommended road names in Clayton and Wilders TownshipsEdith Casey spoke on behalf of the residents of Johnston Union Road, and presenteda petition signed by what appeared to be a majority of the residents requesting that thename of Secondary Road 1563 Johnston Union Road be restored to its original name ofLittle Creek Church Road A letter was also filed with the Board from Ann Casey Barbour Sloan endorsing thename of SR 1563 as Little Creek Church RoadMrs Edith Casey urged the Board to consider road names that will preserve theheritage of families and communities, as heritage is very important to our countyThe Board was attentive to these requests Commissioner Howard Benton expressed afavorable interest in Mrs Caseys requestJeff Coutu, County Planning Director, advised these revised petitions and or requestswill go to the Planning Board and will be taken into consideration3 SR 1199 Paving AnnouncementRepresentative George W Brannan met with the Board and formally announced thatthe North Carolina General Assembly has made discretionary funds available and the StateBoard of Transportation has approved a project in the amount of 150,000 to pave SR 1199,the Tuscarora Boy Scout Camp RoadRepresentative Brannan, being present to hear comments on the County Road Namingproject, commended the County Commissioners in the way they deal from day to day withproblems of county governmentCommissioner John M Booker asked Representative Brannan to do all he could to helpJohnston County get more Secondary Road money for paving and upgrading of rural roadsHe emphasized that many residents in rural Johnston County have lived on the same road formany years and are still trying to get their road pavedIn closing, Representative Brannan stated, your representatives are trying to carryout the will of the people, that is the most important thing4 SR 1572 - Road Naming and SignsMrs Eunice Clark questioned why SR 1572 was not included in the Clayton Townshipnaming signs list She explained that residents on SR 1572 are on the Clayton mail routeThe County Planning Director explained they are working on the project by township andonly a short distance of SR 1572 is in Clayton Township, the longer portion in SmithfieldTownship Mrs Clark said they do not object to the road name of Rock Pillar Road,however, they do need a road sign as soon as possible and would appreciate considerationalong with Clayton Township because of the rural mail routeCommissioner John M Booker expressed agreement with Mrs ClarkA Wilders Township - Loop Road Changed to Brown RoadCommissioner James W Cash asked about Loop Road in Wilders Township beingchanged to Brown Road He said even Mr Brown wanted it changed back to Loop RoadCounty Planning Director stated they had several Loop Roads, however, he would take itback to the Planning Board if residents so desire He explained that the name, BrownRoad, was suggested at a public meeting in Wilders TownshipB SR 1560 - Clayton TownshipCommissioner Cash also mentioned to the Planning Director that residents on SR 1560would like for the Planning Board to consider changing the naming of their road to BaptistCenter Road instead of Ranch RoadC Road Naming ConcernThe Chairman told Jeff Coutu, Planning Director, to come back to the Board ifnecessary on the road naming project if the Planning Board has a great deal of concern onpublic interest regarding road name changes? Access to Southland WineryThe County Manager informed the Board that Southland Winery is seeking theCountys assistance in getting the Department of Transportation to correct an access problem320October 3, 1988 Continuedfrom SR 2387 to the North entrance ramp on I -95 The letter states that buses andrecreation vehicles are unable to make the turn in order to return to the Interstate highwayThey are having a large number of complaints from touristsDon Spence, Division Traffic Engineer, and Ross Hailey, Maintenance ENgineer, metwith the Board to address this matter Mr Spence told the Board that DOT will investigatethis matter to determine what needs to be done He said he will get a design worked up andlook at funding estimates, and also talk with Southland Winery officials to let them knowwhat they are doingA Maintenance Report SR 2315 Ross Hailey, Maintenance Engineer, DOT, reportedthat he had investigated SR 2315 and found it to be in a satisfactory state of maintenanceThere did not appear to be a traffic change on the road since the last priority list as nofurther development has taken placeB SR 1901 Traffic Signals A letter was received from C A Gardner, Jr, DOTDivision Engineer, stating that traffic signals at the 1901 railroad crossing have been deniedat this time because the crossing does not qualify for improvements under the States FederalAid Railroad Safety Program based on present existing conditions The State says they willcontinue to monitor this site should the existing conditions changeC Paving on SR 1311 Mr Hailey reported that paving is going well on SR 13117 Water Line Upgrading - SR 2508The Board again discussed a request from Ray Whitley to upgrade a proposedpipeline off Highway 70 east of Smithfield to SR 2508Gene Johnson, Ragsdale Consultants, told the Board that Mr Whitley is proposing todevelop a mobile home park on SR 2508 of approximately 117 spaces A 4 line would servethe mobile home park and Mr Whitley is willing to pay for the 4 line at a cost of 20,000Mr Johnson, in presenting an estimated cost summary, says in order to accommodate futureresidential growth in this area, an 8 line will be needed at a cost of an additional 31,000from the County in order to upgrade the lineThe Chairman stated to Mr Whitley that the Board would take this request underadvisement8 Alert Cable TV - Merger of Wometco Cable TV, Inc and Cablevision IndustriesCorporationPam Edmundson, General Manager, and Dan Fraizer, Systems Manager, met with theBoard requesting approval of a change in control of Alert Cable TV of NC, IncMrs Edmundson explained andstated thatWometco Cable TV,Inc, owns all of theoutstanding stock of Alert Cable TV ofNC, Inc ,and has enteredinto an agreement andPlan of Merger with Cablevision Industries Corp,which providesfor a restructuring ofWometco Cable and a change in control of Alert CableTV of NC, Inc She said they do notanticipate any major changes during thefirst yearShe further statedthis should be a goodchange for Alert as the new owner isan operatorof cable systems as opposed to an ownerfor investment purposesMrs Edmundson and Mr Fraizer reported on areas they have been working onDavis Mill Road and Buffalo Road are complete; working on Barbour Mill Road; looking atother areas that might meet the criteriaAfter discussion and upon motion by Commissioner Frank B Holding, duly secondedby Commissioner Howard Benton and carried by unanimous vote, the following resolution wasadopted contingent upon FCC approvalRESOLUTIONWHEREAS, Alert Cable TV of North Carolina, Inc, a wholly owned_ subsidiary ofWometco Cable TV, Inc, is a cable television franchisee in Unincorporated Johnston County;andWHEREAS, Wometco Cable TV, Inc is presently controlled by members of itsmanagement and investors associated with the Robert M Bass Group, Inc; andWHEREAS, Wometco Cable TV, Inc, has requested approval of a transaction involvinga merger with Cablevision Industries Corporation or a Company under common ownership orcontrol with Cablevision which will result in a transfer of ultimate control of Alert Cable TVof North Carolina, Inc, all as set forth in the letter application dated September 2, 1988321October 3, 1988 ContinuedNOW, THEREFORE, BE IT ORDAINED that Unincorporated Johnston County herebygrants its approval, as requested, to the ultimate change in control of Alert Cable TV ofNorth Carolina, Inc, a cable television franchisee in Unincorporated Johnston County, all asset forth in the letter application dated September 2, 1988Passed this 3rd day of October, 1988, effective October 3, 19889 Report on Clean Water ApplicationTim Baldwin of Ragsdale Consultants reported that the Clean Water Grant Applicationsfor County Water projects Smithfield Water Plant Expansion; Four Oaks to Benson Waterline;and Equalization Basin were delivered to the State office on Friday, September 30, 1988 Hesaid that the applications will be reviewed in early DecemberCommissioner James W Cash asked Ragsdale Consultants to furnish the County with aSchedule of Construction on the Four Oaks to Benson Water Line Mr Baldwin explained theconstruction schedule is included in the Clean Water Grant applicationsCommissioner James W Cash offered a motion to create a non - profit corporation tofinance the Four Oaks to Benson Water Line if Benson does not have one in existence, andin the event State Clean Water funds are short of construction costCommissioner Frank B Holding seconded the motion which carried by unanimous vote10 Resolution Concerning Water ConservationUpon a motion by Commissioner James W Cash, duly seconded by CommissionerHoward Benton and carried by unanimous vote, the following resolution was adoptedJOHNSTON COUNTY BOARD OF COMMISSIONERSRESOLUTION CONCERNING WATER CONSERVATIONWHEREAS, Johnston County has developed and owns a countywide water supply anddistribution system, andWHEREAS, Johnston County intends to continue to expand its countywide watersupply system, andWHEREAS, planned extensions of the system will result in the demand for additionalwater, andWHEREAS, it is in the best interest of all users of the system as well as all citizensof Johnston County to make wise and prudent use of this limited natural resourceNOW, THEREFORE, BE IT RESOLVED by the Johnston County Board of CommissionersTHAT, water conservation and prudence in water is encouragedTHAT, in addition to the Towns of Smithfield and Selma in which conservationordinances have been adopted, the Board of Commissioners will encourage all other municipalusers of the system to adopt definitive strategies for water conservationareaTHAT, the County will enforce the NC Plumbing Code in its entire jurisdictionalTHAT, the Countys bulk rate structure will not encourage excessive use of waterTHAT, water recycling, particularly in industrial applications, will be encouragedTHAT, the County will endorse and support educational programs for waterconservationAdopted this the 3rd day of October, 198811 American Red Cross - Disaster ServicesVicki Medlin and Pete Montague appeared on behalf of the American Red Cross andits current status in Johnston County Mr Montague pointed out the Red Cross in JohnstonCounty has been assigned to open shelters in Johnston County under the new DisasterProgram the County has organized which has been approved by the Board of Commissioners322October 3, 1988 ContinuedMr Montague stated the purpose of this meeting with the Board is to determine whatlevel of support will be coming from the County in order to co- ordinate services with countyagencies in respect to Disaster Services Regulations and ProceduresDewayne West, Emergency Management Services Director, told the Board the RedCross is a resource for EMS, and they included the Red Cross in the County Disaster Planbasically for sheltered purposes along with the Department of Social Services, Health andMental Health The Red Cross provided imput in the preparation of the Multi - Hazard Operation ` - JPlan for Johnston CountyThe Board asked the County Manager and Mr West to work together in an effort toco- ordinate services with the Johnston County Red Cross Chapter12 One Room School House - RepairsMrs Lib Morgan, along with Julia McCullers, Director of Planning, JohnstonCommunity College, met with the Board seeking ` funds to repair the old one -room schoolhouse located on the college campusThe old school, once known as Barnes Crossroads School, was donated to theCounty and moved to the college campus during the Nations Bicentennial celebration in 1975by efforts of Mr M A Happy Morgan and the Johnston County Bicentennial CommissionMrs Morgan stated the old school house has been vandalized and needs repairs Thecollege has agreed to maintain the building once it is repaired Ms McCullers said therestoration is in keeping with a major beautification project now taking place on campusThe County Manager reported to the Board of a break -in that occurred over theweek -end and expressed a growing concern about vandalism at the school He said he andDr Tart have talked about security on campus and will be meeting to talk further about theproblemAfter discussion, Commissioner Howard Benton moved the County appropriate up to750 from the County Contingency Fund for repairs to the old school house located on theJohnston Community College campusCommissioner Frank B Holding seconded the motion which carried by unanimous vote13 School Bond Issue - 1,88118 Social Services - Additional Positions ApprovedFour additional positions requested by the Department of Social Services werediscussed with I the Board by the County Manager as follows three Income MaintenanceCaseworker Is and an Administrative Assistant He explained these positions have beenapproved by the Social Services Board; and further, that existing funds would be used formatch and no additional appropriation will be requested from the County this year Inaddition, three current positions are be abolishedCommissioner John M Booker, who is also Chairman of the Social Services Board,explained the need for these positions 1 the Administrative Assistant is needed to maintainthe personnel system and to establish a personnel system that will meet all requirements ofState Personnel 2 the Income Maintenance Caseworkers are needed to process the hugevolume of applications for Medicaid and AFDCAfter Much discussion, Commissioner James W Cash moved that the followingpositions be ap roved for the Department of Social Services 1 an Administrative Assistant;and 2 three Income Maintenance Caseworker IsCommissioner John M Booker seconded the motion which carried by unanimous voteCommissionerHoldingstated for the recordtoreflectthat Commissioner John MBooker is to becommendedon the excellent jobheis doingas Chairman of the SocialServices Boardend for the time he has spent duringtheinterimperiod between directors19 Rescue Squad Study Committee A-In an ffort to deal with increasing problems which are being experienced by thecounty rescue rquads, the Chairman made the following appointments to a Study CommitteeAl Gaskill, President, Johnston County Rescue Squad Association; Dewayne West, EmergencyManagement Director; Vince DiFranco, Johnston Memorial Hospital; Richard Self, CountyManager and Co missioner John M BookerThe Chairman asked that this committee have a progress report within 60 days20 Natural Gas for Courthouse HeatingCommissioner Howard Benton suggested to the County Manager that he look into thefeasibility of converting the courthouse heating system from oil to natural gas He saysnatural gas is 15 to 20 percent less that oil or electricity It is hoped that natural gas willbe extended into the Selma and Smithfield area in the near future324October 3, 1988 Continued_ 1121 Wastewater Treatment - Late Payment Charge PolicyThe County Manager explained to the Board that the County invoices themunicipalities and sludge haulers on a monthly basis by the 10th of the month for previousmonths service, with payment due by the 25th based on the contracts with the towns Aschedule of late payment of invoices for wastewater treatment services was presented to theBoard for review In discussion it was explained that June is the worse month and has adirect impact on the Countys cash flow A late payment penalty was recommended forpayments received after 12 noon on the 25th of the month following serviceAfter further discussion, Commissioner Howard Benton moved the following policy beadopted on wastewater treatment services effective December 1, 1988Invoices will be mailed on or before the 10th of each month If theinvoice has not been received by the 12th of the month, it is theresponsibility of the customer to contact the County Finance OfficePayment is due in the County Finance Office no later than 1200 noonon the 25th of the month The County assumes no responsibility for the USPostal ServiceInvoice payment received after 1200 noon on the 25th of the monthwill be assessed a 5 late penaltyCommissioner James W Cash seconded the motion which carried by unanimous vote22 Solid Waste - Compaction Equipment DiscussedThe County Manager presented a detailed cost analysis of the Countys green boxcollection system; the distance to the landfill, number of loads per month, cost of compactionequipment, cost to operate County equipment and the cost to contract with a privatecompany He explained that compactor sites are not cheaper, but more efficient It wouldcut transportation expenses in hauling garbage from the sites to the landfill, but thecompaction sites would require full time attendantsThe Board seemed to favor compaction sites, however, asked the County Manager tocomplete a more detailed comprehensive cost analysis for reviewCommissioner James W Cash mentioned to the Board there is a need for a permanentsite on the Clayton side of Cleveland School and some type of system is needed in theCorinth Holders areaWarren Grimes, owner of Trash Collection Service, Inc, spoke briefly with the Boardstating that he would be glad to work with the county on compaction sitesEXECUTIVE SESSIONUpon a motion by Commissioner James W Cash, duly seconded by CommissionerHoward Benton and carried, the Board recessed regular session to meet in Executive Sessionfor the following purposes GS 143 -
