Meeting of the Johnston County Board of CommissionersDecember 22, 1989The Johnston County Board of Commissioners met in Special Called Sessionon Friday, December 22, 1989, at 900 am in the Commissioners Room, JohnstonCounty Courthouse Annex, Smithfield, North Carolina, with the following memberspresentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, James WCash, John M Booker, DVM, and Jerry F Wood, DDSMembers Absent NoneAlso Present Richard B Self, County Manager, Joyce H Ennis, DeputyClerk to the Board, and W R Britt, County AttorneyThe Chairman called the meeting to order and the following business wastransacted1 Public Hearing - GS 160A -20 - Lease Purchase FinancingAdvertised December 8, 1989 Time 900 amChairman Norman C Denning opened the Public Hearing and asked if anyonewished to address the Board on the County entering into contracts authorizedunder GS 160A -20 involving the lease purchase of real propertyRichard Self, County Manager, explained the County is consideringentering into lease purchase contracts under GS 160A -20 for four projects 1ASCS Office Building, 2 Social Services Building Addition, 3 Water Sewerlines from Clayton to proposed industrial site on Highway 42 and I -40, 4 Waterline from Four Oaks to BensonThere being no one present who wished to address the Board, the Chairmandeclared the Public Hearing closedDiscussionOn behalf of those present, Commissioner Frank B Holding explained thatthe two buildings will be self liquidating over a period of a few years; ASCSBuilding 100 and the Social Services Addition 63 He further commented thewater sewer line from Clayton to the proposed industrial site on Hwy 42I -40will be built contingent upon the industry locating at the proposed siteCommissioner John M Booker noted the proposed resolution will permit theCounty to participate in this type of financing if they choose to do so; it ispermissive, not obligatory3 Resolution - Lease Purchase Financing Under GS 160A -20Upon a motion by Commissioner Frank B Holding, duly seconded byCommissioner James W Cash and carried by unanimous vote, the followingresolution was adoptedRESOLUTIONWHEREAS the Board of Commissioners of Johnston County hasdetermined that a public need exists for facilities and for utilitylines; andWHEREAS a Public Hearing has been held by the Board ofCommissioners to obtain public input into this need; andWHEREAS the County has been notified by the State of NorthCarolina that the Social Services Building has to be expanded orrisk losing State and Federal Funding; that the Federal Governmentneeds immediate space for ASCS to continue the service in JohnstonCounty in close physical proximity to the FHA, Soil Conservationand Agriculture Extension services; that the available water supplyat South Johnston High School is becoming a critical need, and aback -up water supply for the county -wide water system is needed;and infrastructure is needed immediately for a 25,000,000 industryin the County; andWHEREAS the sums to fall due under the contracts are notexcessive for the purposes stated above; and500December 22, 1989 ContinuedWHEREAS the County Attorney has rendered an opinion that theproposed undertaking is authorized by law and is a purpose forwhich public funds may be expended pursuant to the Constitution and flaws of North CarolinaNOW THEREFORE BE IT RESOLVED that the method of financing ispreferable to other forms of financing due to the urgent need andthe lack of any form of opposition exhibited at the public hearing;that the unappropriated fund balance is not currently available forthis endeavor; that the two -third rule would not be advantageous tothe county nor provide adequate funding due to the small amount ofbonded debt payment; and that this method of financing is prudent;that the leases available for the ASCS building will cover allexpenditures; that the reimbursement from the State for DSS willcover almost two- thirds of the cost; that a water problem exists atSouth Johnston High School, and that a back -up water supply for thecounty -wide system is needed;
