following business was transacted1 Surplus Food Commodity ProgramMr Jay P Davis, Director of Commodity Distribution Program, State Department ofAgriculture, Mr W W Franklin and Mrs Edith Park, Welfare Director, outlined thesurplus food commodity program to the members of the Board, which is given in detailby the Commodity Distribution Book, dated 3- 1--63, and which is on file with W G MasseyClerkThe offer of Commissioner Frank B Holding to furnish warehouse space in warehouselocated on Highway # 301, south of Smithfield, for the storage and distribution ofsurplus food was acceptedFollowing a discussion of the program, in which pertinent data and procedure wasbrought out, the following motions were adoptedCommissioner Frank B Holding moved that the County enter into program with theNorth Carolina Department of Agriculture for the distribution of surplus food commodit-ies furnished by the U S Department of Agriculture for a period of three monthsfrom this date, providing for at least three distributions of the foodFurther moved that H M Johnson, Chairman, be authorized and directed to executeon behalf of the County the following Agreement and Application for U S Departmentof Agriculture Donated Commodities with the North Carolina Department of AgricultureNorth Carolina Department of AgricultureCommodity Distribution ProgramRaleigh, N CAgreement and Application for U S Department ofAgriculture Donated CommoditiesWe, the below named County Board of County Commissioners, hereby make applicationto the North Carolina Department of Agriculture hereinafter referred to as NCDA forcommodities donated by the United States Department of Agriculture hereinafter referredto as USDA , and said Board of County Commissioners hereby enters into the followingAgreementName Johnston County Board of CommissionersStreet AddressCity Smithfield, North CarolinaNorth CarolinaJohnston CountyThis Agreement, made and entered into on this the 11 day of January, 1965, by andbetween the County of Johnston, through its Board of County Commissioners, and theNorth Carolina Department of AgricultureWITNESSETHThat for and in consideration of being supplied with certain commodities donatedby the USDA, the above named Board of County Commissioners, being the authority havingsupervision and control over the Commodity Distribution Program covenants and agreeswith the NCDA to supervise the transportation, handling, warehousing, and distributionof all donated commodities received in such a manner as will insure compliance with theterms and conditions of this Agreement, supplemental instructions issued by the NCDAand USDA and the provisions of the Commodity Distribution handbook, said handbook beingattached hereto and made a part hereofThe above named Board of County Commissioners further agrees to the followingterms and conditions1 Commodities will be requested and accepted only in such quantities as canbe fully utilized at rates not to exceed those established by the UCDA2• Commodities received under this Agreement will be distributed solely tothose persons certified as eligible by the local County Welfare Departmentand will not be otherwise disposed of without prior written approval of theNCDA Under no circumstances will the USDA commodities be sold or tradedIm3, p p p Board of Commission-ers Facilities materials and personnel in storage or the facilities or the warehouses used in thehandling and storage of commodities4 No charge will be made, nor donations accepted from recipients of donatedfoods5 Records pertaining to the distribution of foods shall be kept for a periodof not less than three years, and reports furnished to the NCDA as requiredThe NCDA andor the USDA are authorized to inspect such books and recordsat any reasonable time and place to insure compliance with the aboveconditions,6 Either agency may terminate this agreement by giving thirty dayst notice inwriting to the other party The NCDA may cancel this agreement immediatelyupon receipt of evidence that the terms and conditions thereof have not beenfully complied with Subject to such notice of termination or cancellationof the agreement, the County Board of Commissioners agrees to comply withthe instructions of the NCDA, either to a distribute all remaininginventories of foods donated by the USDAin accordance with the provisionsof this agreement or b return such inventories to the NCDA, to transmitsuch reports as are required by the NCDA to record final disposition of suchinventoriesIN TESTIMONY WHEREOF, the parties hereunto have executed this Agreement in dup-licate original, one of which is retained by each of the parties, the day and yearfirst above writtenOn behalf of the Johnston County Board of Commissioners by its with Sheriff Rayford Oliver, it was determined that Mr Oliverwould cooperate in the program by furnishing deputies and prison labor to assist theSupervisor in the distribution of the surplus food3 Appointment of SupervisorCommissioner Frank BHolding moved that Mr Harper Godwin, Tax Collector, berequested to furnish or designate Russell Britt, Field Tax Collector, as CommoditySupervisor to act as Agent of the Board in administering the county distributionprogramCommissioner Norman C Denning seconded the motion, which was carried4 Adoption Scale No 2Commissioner Norman C Denning moved that the county adapt Scale No 2 known asincome exclusion scale for the purpose of determining eligibility of households forfoods assistanceCommissioner Frank B Holding seconded the motion, which was carried50 Employment Personnel Welfare DepartmentCommissioner Frank B Holding moved that Mrs Edith Park, Director Welfar-eDepartment, be authorized and directed to employ sufficient personnel, which, in hergood judgment and prudence, she deems inecessary n determining the need of all personsapplying for food assistanceCommissioner Norman C Denning seconded the motion, which was carried6 Commissioner Norman C Denning introduced the following resolution and moved thatit be adoptedResolutionaJanuary 11, 1965 ContWhereas, it is reported that the bid of Lonnie Allen to purchase 9 acre inCleveland Township in the amount of 1450 00 has been raised by a 10 deposit bid,And whereas, the resale of this property meets with the general approval of theinterested citizens in Cleveland Township,Now therefore, it is ordered that motion adopted by the Board at its regularmeeting on January 4, 1965 conveying said property to Lonnie Allen be rescinded, andthat W R Britt, County Attorney, be authorized and directed to readvertise said9 acre in Cleveland Township, and that said resale be reported to the Board ofCounty Commissioners at their next regular meeting in February for
