Meeting of the Johnston County Board of CommissionersJuly 5, 1989The Johnston County Board of Commissioners met in regular session Wednesday, July5, 1989, at 10 oclock am in the Commissioners Room, Johnston County Courthouse Annex, ISmithfield, North Carolina, with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, Jerry F Wood,DDS, James W Cash, and John M Booker, DVMMembers Absent NoneAlso present Richard B Self, County Manager, Eleanor N Creech, Clerk to theBoard, and W R Britt, County AttorneyThe Chairman called the meeting to order and the following business was transacted1 Road Petition - Add to State SystemThe Board received a petition requesting that Swift Creek Drive, Swift CreekSubdivision, Cleveland Township, be added to the State Secondary Road System formaintenanceJ 0 Ethridge, District Engineer, DOT, presented the Secondary Road AdditionInvestigation Report for the Boards review with remarks and recommendations regarding themaintenance and upkeep of this roadFollowing review and upon motion by Commissioner James W Cash, duly seconded byCommissioner Frank B Holding and carried by unanimous vote, it was moved DOT berequested to add Swift Creek Drive, Swift Creek Subdivision, Cleveland Township, to theState Secondary Road System for maintenance2 Secondary Road 1905 - MaintenanceGattis Lee, developer and property owner, met with the Board requesting the Stateto reinstate maintenance on 45 of a mile on State Road 1905 Part B which the Stateabandoned several years ago Mr Lee explained he plans to develop land on a portion of theroad J 0 Ethridge, District Engineer, informed the Board that Mr Lee had contacted JackMurdock, State Secondary Road Officer, and Mr Murdock explained the State Rules andRegulations on what would have to be done before this road can be reinstated formaintenance; property owners will have to bring this portion of SR 1905 Part B to minimumState standards with at least five 5 homesJ C Rhodes, Assistant District Engineer, advised that SR 1905 will require majorconstruction to bring it back up to State standardsFollowing discussion, Commissioner Frank B Holding moved the DOT be requested toreinstate maintenance on 45 of a mile on SR 1905 Part B which was abandoned severalyears agoCommissioner James W Cash seconded the motion which carried by unanimous vote3 Water Supply Revolving Loan - Four Oaks to Benson Water LineThe County Manager informed the Board the County has, with the assistance ofSenator Leo Daughtry, been able to obtain a loan in the amount of 209,347 from the watersupply revolving loan fund for the Benson to South Johnston segment of the water line onHighway 301 Senator Daughtry, present at this meeting, said he hopes he can get additionalfunding for the Four Oaks to Benson water line in the 1989 -1990 funding period The Boardwas advised that an application has already been submitted for the first round of funding tobe announced in the fall of 1989Commissioner Frank B Holding asked Senator Daughtry if the County could go aheadand start construction without jeopardizing additional clean water money being awarded forthis project Senator Daughtry said he would check on this matter The Board expressedconcern over the pressing need for a water line to connect Four Oaks and Benson; toprovide a potable water supply to South Johnston High School7i iAfter discussion, Commissioner Jerry F Wood moved the County accept the 209,347State Clean Water Loan to assist with the Construction of the water line from Four Oaks toBenson, and further that the County Manager be authorized to execute the necessarydocuments to secure these fundsCommissioner Frank B Holding seconded the motion which carried by unanimous vote445July 5, 1989 Continued NOTE The County Manager was instructed to have the engineers proceed withengineering services on the Four Oaks to Benson Water Line4 Schools - Property Offered to CountyPursuant to GS 115C -518 , the Board of Education offered to the County the OldPrincipals Home at Wilsons Mills Elementary SchoolFollowing discussion, Commissioner John M Booker moved the County decline theoffer from the Board of Education to take possession of the Old Principals Home at WilsonsMills Elementary SchoolCommissioner Jerry F Wood seconded the motion which carried by unanimous vote5 Recreation Grants ApprovedUpon a motion by Commissioner Jerry F Wood, duly seconded by Commissioner JamesW Cash and carried by unanimous vote, the following recreation grants were approvedSmithfield -Selma Middleiaost2?,s 2,000; Triangle Land Conservancy, 2,0006 Cable TV - CMA - Consent of AssignmentCMA asked the Board by letter for approval of Consent to Assignment and Pledgeand Consent to Assignment, in order to obtain additional financing on their cable system inJohnston CountyThere was no one present representing CMA to explain this request, therefore, theBoard deferred action at this time7 Cable TV - Channel MasterTerry Herlihy of Channel Master Cable TV, met with the Board requesting the Countyplace a one year moratorium on approval of any more cable TV franchises for rural areas ofJohnston County where Channel Master has been awarded franchises for building cable MrHerlihy respectfully asked the Board to give Channel Master the opportunity and the time toprovide cable service to the areas they have franchised He emphasized they have startedconstruction on 1010 near Swift Creek and expect to proceed as quickly as possible in thisimmediate area, and also in other rural areas of the CountyThe Board took this request under advisementFriendship Cable TV of NC had requested to meet with the Board to seek afranchise in the unincorporated areas west of Benson along Highway 50 to McGees Crossroadsand certain uncabled areas west of Highway 210 in Elevation, Cleveland, and Pleasant GroveTownships They did not appear at this meeting8 Subdivisions ApprovedUpon the recommendation of the County Planning Board, the following subdivisionswere considered for approvalA Holland Hills, Marshall Associates, Owner; SR 2159 SR 2162; Beulah Township,22 lots; Restrictions Landscaped entrance sign; motion by Commissioner James W Cash,seconded by Commissioner Jerry F Wood and carried by unanimous vote; plat executed byChairman B Summerbrooke - Section III, Donald Lee, Owner; SR 1571, Clayton Township; 7lots; motion by Commissioner John M Booker, seconded by Commissioner Frank B Holdingand carried by unanimous vote; plat executed by Chairman C Cleveland Manor, DR Wells,Owner; SR 1516, Cleveland Township; 17 lots; Restrictions Landscaped Entrance Sign; Motionby Commissioner Jerry F Wood, seconded by Commissioner James W Cash and carried byunanimous vote; plat executed by Chairman9 Public Hearing - Zoning Ordinance and Zonina Maas10 Central Johnston County Regional Wastewater Treatment Facility - EngineeringAgreementCommissioner Jerry F Wood moved the Chairman be authorized to execute theEngineering Agreement between Johnston County and Ragsdale Consultants, PA , and thatUpon a motion by Commissioner James WCash,duly secondedby Commissioner FrankB Holding andcarried by unanimous vote, the Boardset a PublicHearing for Monday,August 7, 1989,at 1015 am , to provide thepublican opportunityto address the Boardand review theCounty Zoning Ordinance andZoningMaps for thetownships of Wilders,Clayton, Cleveland and Pleasant Grove, as wellas theI -40 InterstateCorridor 1500 feet oneither side of theinterstate center line 10 Central Johnston County Regional Wastewater Treatment Facility - EngineeringAgreementCommissioner Jerry F Wood moved the Chairman be authorized to execute theEngineering Agreement between Johnston County and Ragsdale Consultants, PA , and that? r rJuly 5, 1989 Continuedthe engineers be authorized to proceed to furnish professional engineering services inconnection with additions to the Central Johnston County Regional Wastewater TreatmentFacility The project shall include the addition of two 60 -foot diameter secondary clarifierswith associated site work and appurtenances, including a sludge return pump station andrelocation of an existing earthen dikeCommissioner James W Cash seconded the motion which carried by unanimous votell Child Support Enforcement Agency Contract of Employment - Agency AttorneyCommissioner John M Booker moved the County Manager be authorized to execute acontract of employment between the Johnston County Commissioners and WA Holland, Jr, torepresent the Johnston County Child Support Enforcement Agency, to be available, uponreasonable notice, for consultation, legal advise and for representation as requested by theChild Support Enforcement Agency in all legal matters at an hourly rate of 6000 per hourCommissioner Frank B Holding seconded the motion which carried by unanimous vote12 Advertisement for Bids - Dog Warden TruckCommissioner John M Booker moved the County Manager be authorized to seek bidson a new pick -up truck for the County Dog WardenCommissioner James W Cash seconded the motion which carried by unanimous vote Note The Dog Wardens old truck will be transferred to the County Landfill 13 Container SiteCommissioner Frank B Holding briefly discussed with the Board container sites in theCounty with regard to the trash that had accumulated over the July 4th holidayIn further discussion, Commissioner John M Booker emphasized that compaction sitesare needed The sites will be manned, will be clean and the public will know when the sitesare openCommissioner Holding asked the County Manager to specifically define what the scales xwill accomplish for the solid waste program In brief discussion, the County Manager said thescales will supply data on the volume of solid waste carried to the landfill which would helpto establish more accurate user fees14 Landfill - TimberThe County Manager was authorized to work with Ken Bateman, Agriculture ExtensionAgent, on cutting off timber at the County Landfill site15 Commissioners Visit Old JailThe Board of Commissioners visited the old jail facility to determine what needs tobe done in order to prepare the old jail as a satellite facility The County Managerreported a maximum use of space for the old facility, after renovation, will be forapproximately 60 inmatesBill Fripp, Architect, upon request, had inspected the jail to make recommendationsfor renovations16 Demolition of District County BuildinUpon a motion by Commissioner Frank B Holding, duly seconded by CommissionerJerry F Wood and carried by unanimous vote, the Board authorized the County Manager toadvertise for bids for the demolition of the District Court Building, Courthouse Square; bidspecifications to include specific instruction to remove all footings17 Recreation Grant - ApprovedUpon a motion by Commissioner Jerry F Wood, seconded by Commissioner Frank BHolding and carried by unanimous vote, the Board approved a Recreation Grant in the amountof 2,000 for the Benson Area Chamber of Commerce18 New Courthouse - HousekeepingThe Board of Commissioners instructed the County Manager to discontinue thetemporary cleaning agreement and employ a housekeeping staff to clean the new Courthouse447July 5, 1989 ContinuedBuildingUpon a motion by Commissioner John M Booker, duly seconded by CommissionerFrank B Holding and carried by unanimous vote, the Board adjournedEleanor N Creech, ClerkNorman C Denning, Chairman
