June 5, 1989The Johnston County Board of Commissioners met in regular session Monday, June 5,1989, at 10 oclock am in the Commissioners Room, Johnston County Courthouse Annex,Smithfield, North Carolina, with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, James W Cash, DrJerry F Wood, and John M Booker, DVMMembers Absent NoneAlso Present Richard B Self, County Manager, Eleanor N Creech, Clerk to theBoard and W R Britt, County AttorneyThe Chairman called the meeting to order and the following business was transacted1 MinutesThe Chairman asked if there were any corrections to the minutes of May 1, 1989,board meeting There being no corrections, the Chairman declared the minutes standapproved2 Resolution - Raymond Gardner GurleyUpon a motion by Commissioner James W Cash, seconded by Commissioner John MBooker and carried by unanimous vote, the Board adopted the following resolution in memoryof Reverend Raymond Gardner Gurley, former County CommissionerRESOLUTIONWHEREAS, the people of Johnston County are greatly grieved by the death of theReverend Raymond Gardner Gurley, bringing to an end a life of seventy -three years filledwith kindness and devotion; andWHEREAS, Raymond Gardner Gurley served the people of Johnston County as aCounty Commissioner from December 1950, until December 1962, depicting twelve years ofdedication to the best interest of the County as he worked for the betterment of its economicand cultural development; andWHEREAS, he earned the respect, admiration and high regard of all those with whomhe came into contact, and the love and affection of all who were proud to call him friendand brother; andWHEREAS, as a Minister he devoted many years of his life performing faithfulservices by helping others in times of need and hardships; he supports Mr Peeles opinionrr407June 5, 1989 ContinuedMr Peele and Mr Pearce emphasized that industries are taking the initiative to bein compliance, and in their opinion, fees should not be assessed to companies that are takingthe initiative to be responsible They expressed there are other ways to be reimbursed byassessing those responsible for accidents caused by hazardous materials Mr Peele concludedby requesting the Board consider their decision carefully as he would hate for CoastalChemical to relocate in another countyC Otis Collier, Terminal Manager, Gulf Oil Corporation, and LEPC Committee member,spoke in opposition to the assessment of 500 per tanker load 5,500 gallons or greater thatoriginates in Johnston County, to be collected by the fixed facility where the load originatesand collected by the County Tax Collector as collecting agent He says this will create aburden for the County and extra paper work for the terminal, and further emphasized thatthe audit tracking would be burdensome and expensive for the CountyD Rudolph Jones, McGees Crossroads - Farmer and Pesticide Farm Supply Dealeragreed with the theory of the ordinances, but not with an additional tax on individuals,saying that businessmen pay quite a bit of taxes to the General Fund now and he can notsee taxing and assessing people in order to hire someone to do a job that you already havepeople to do Mr Jones continued by saying that in his area of the County there areapproximately 50 less farmers than eight years ago, so it seems to him the Johnston countyFarm Agents can assist people in filling out the necessary paper work required by theFederal Government However, Mr Jones feels the County needs to stay in compliance withthe Superfund ActE Dewayne West - Emergency Management Services Director stated one of his mainconcerns is to try to cover the cost of the program if the County is going to handle theseregulations as described by the Federal Government; for example, if an individual comes intothe EMS office and demands to know what chemicals pesticides his neighbor is using, theCounty is required to be able to furnish that information, the County will have to havefunds from somewhere, whether by fees or taxes The Federal Government has passed theselaws and regulations, but provided nothing to enforce them with; the County does not havethe equipment or personnel to administer the SARA regulations Mr West continued that allcounties in the State are looking at a fee structure Johnston County does not have aclean -up crew, so the LEPC Committee is looking at a contract on an annual basis forservices if needed which will mean a retainer fee of approximately 5,000 to 10,000 a yearplus clean -up feesMr West explained the assessment fee structure of who would be charged under theLEPCs recommended ordinance He mentioned that farmers are exempt if hazardous materialsare used in routine agricultural operations or a fertilizer held for sale by a retailer to theultimate consumer There seemed to be some misunderstanding about some of the fees, whowould be charged and when; the Board suggested that Mr West attempt to answer thesequestionsCommissioner James W Cash asked about assessment fees for Natural Gas CompaniesMr West responded they will be assessed on a per cubic foot basisThe Board briefly discussed the amount of revenue on a yearly basis to administerthe program; a figure of approximately 50,000 a year for administrative cost not addressingfees to provide for clean-upsMrSelf, County Manager,explained the laws are already here, theexisting lawsare being modified One concern isthat businesses, as well as the County andState, may beWest said the County is in compliance, except beingfaced withexcessive fines if theseregulations are not met These ordinancesare a way ofaddressingthe problems and a waythe County and businesses can stay in compliance; it isas they have a large terminal, to see what they areof great concern to the Countydoingand how theyare funding the programMrWest invited and welcomed any input that anyone might haveon how theseregulationscan be dealt with, theordinances and proposed assessment fees He says everyState andCounty is going to beinvolved; Johnston County is not uniqueto a fundingproblem Itsnot a matter of if the County is going to do this, but howCommissioner James W Cash asked about assessment fees for Natural Gas CompaniesMr West responded they will be assessed on a per cubic foot basisThe Board briefly discussed the amount of revenue on a yearly basis to administerthe program; a figure of approximately 50,000 a year for administrative cost not addressingfees to provide for clean-upsCommissionerHolding suggestedthat maybe the oil terminals have some resources tohelpthe County getin compliance MrWest said the County is in compliance, except beingableto furnish information on a timelybasis to the public Commissioner Holding asked theEMSDirector to lookat Guilford County,as they have a large terminal, to see what they aredoingand how theyare funding the programMr West responded the other counties are in? ? s0June 5, 1989 Continuedthe same situation as Johnston; there are no models to go by California - the only stateknown about - has a weighted value per chemical, a very complicated fee structure and notpractical to NCMr West, in further discussion, remarked the problem is not with the terminal, asthey have a very good operation, it is with the carriers; thats where the spills areThe Board expressed concern on how to handle these situations and concerns for thefarmers, however, realizing that something has to be done, they asked the LEPC Committeeto get more information on what other counties plan to do in order to comply The Chairmanstated they need more time and more information on these proposed fee ordinancesDewayne West, EMS Director, referenced the Clean -up and Cost Recovery Ordinanceand recommended, unless some opposition, the Board consider the adoption of this ordinanceHe called the Boards attention to Section 2, item C Fire ServiceTo include but not limited to; fire supression, wash -down, rescue,stand -by, or other actions necessary to neutralize the hazard Charges shallbe prescribed annually in the county budget for the fiscal yearJohnston County facilities coming under this ordinance are to beexempt of all EMA clean -up fees for the first twenty 20 hours of servicesrendered annuallyHe related the committee has no problem with this sectionThis ordinance does not establish a fee, just a cost for recovery of clean -up costsThere being no further response from the audience, the Chairman declared the PublicHearing closedNo action was taken at this time pending further study and consideration8 Public Hearing - 1989 -1990 Secondary Road Construction ProgramAdvertised and posted by the North Carolina Department of TransportationChairman Denning opened the Public Hearing on the 1989 -1990 Secondary RoadConstruction Programs and asked if anyone wished to be heardC A Gardner, Jr, Division Engineer, J 0 Ethridge, District Engineer, NorthCarolina Department of Transportation, Division of Highways, and Elwood Goodson,Member -At- Large, North Carolina Board of Transportation, appeared before the Board ofCommissioners and presented 1989 -1990 Secondary Road Construction Programs for JohnstonCountyA Elwood Goodson, DOT Member -At -Large spoke with the Board about the SecondaryRoad Construction Programs and how the programs will be affected by the Highway TrustFund Package should it pass the Senate He stated if the bill passes, the four lane fromRaleigh to Morehead City will be improved, as well as 248 miles of unpaved secondary roadsin Johnston County by the year 2001B C A Gardner, Division Engineer, DOT explained the two programs submitted byDOT the first program of 1,154,920, the traditional program; and the second program of2,517,937, the Highway Trust Fund Package Mr Gardner stated the Transportation Boarddecided to go ahead and present the programs so they could proceed with surveys whileawaiting a decision on pending legislation of the Highway Trust Fund Package He continued,the Transportation Board decided this year to separate the subdivision residential prioritiesfrom the rural road priorities, DOT will be addressing roads off both priority lists He toldthe Board there are 31 unpaved subdivision roads in the County totalling 716 miles Thereason for the two priorities is so the Board will have a way to address unpaved subdivisionroads, as the 716 miles of subdivision roads represents 337 homes or 48 homes per mile, ascompared to 208 homes or 20 homes per mile on rural roadsIn reviewing the second program of 2,517,937, Mr Gardner reminded the Board thisprogram is designed to pave all but a few of the unpaved miles in Johnston County in thenext 12 yearsChairman Denning asked if anyone else wished to be heardIkJune 5, 1989 ContinuedC Thad Howell spoke with the Board regarding discontinued maintenance by DOT onSR 2175 He says this creates a problem because there is a fire hydrant that serves fiveresidents and a public utility near the end of this road and access is neededThe Board of Commissioners, as requested by Clovis Boykin, Jr, sole propertyowner and upon recommendation of DOT, abandoned this road from the State MaintainedSystemIn discussion, the Board advised Mr Howell they would contact Mr Boykin to see ifthis matter can be resolvedD Helen Reinhart - SR 1745 - Ms Reinhart complimented the State on maintenanceof this road for the past year saying they have had very good maintenance She expressedconcern, however, about an article in the newspaper regarding funds being appropriated forpaving of a road SR 1102 Ms Reinhart was of the opinion this road had been placed inpriority # 1 above other roads It was explained that SR UO2 was priority # 1 on the1988 -1989 Secondary Road Construction Program, however, the DOT had been unable to secureall right -of -ways until May, 1989 SR 1745 is now priority #43The Board was questioned by a citizen about the priority of SR #1548; in checkingthe list, it is # 10In conclusion, Mr Gardner and Mr Goodson emphasized that should the HighwayTrust Fund Package pass, paving should be speeded up three -fold, with a guarantee ofapproximately 85 of the fund money Mr Goodson urged the Commissioners to speak tomembers of the General Assembly favoring the billThere being no further response from the audience, the Chairman declared the PublicHearing closedAfter reviewing and discussing the proposed programs, Commissioner Frank BHolding moved that the following resolution be adoptedRESOLUTIONWHEREAS, THE BOARD OF COMMISSIONERS OF JOHNSTON COUNTY has received fromthe Department of Transportation two 1989 -1990 Secondary Road Construction Programs,Program A Total 1,154,920 and Program B Total 2,517,937, as presented by OwenEthridge [ Which of these programs will become effective will be determined by pendinglegislation before the North Carolina General Assembly; Garnishment Costs AiDiDealJohnnie Stott, Tax Administrator, reported that Mary Beth Slabaugh had contactedthe Tax office appealing the payment of interest of 1311 and cost of a garnishment servicefee of 1000 for the year 1986 She has stated that she mailed the tax listing form inJanuary, 1986, and listed the vehicle and her lending institution paid her taxes The TaxAdministrator told the Board that according to their records, the vehicle was not listed, theyhad not received a tax listing in the mail and the Tax Office billed from the permanent realestate listing In recent follow -up on delinquent taxes, Ms Slabaughs employer was issued agarnishment for collection of delinquent tax Ms Slabaughs opinion was that she may beliable for the tax on the vehicle, however, does not think she should have to pay theinterest and cost The Tax Administrator added that records show that taxes in the pasthave been promptly paid, however, Ms Slabaugh was properly notified prior to garnishmentNo action was taken on this request at this time13 Appointment -
