Report for the fiscal year ending June 30, 1990 Mr Neighbors reviewed the financialreport with the Commissioners and offered to answer any questionsIn response to a question from Commissioner Frank B Holding as to the reason theCounty telephone operation was set up as a separate fund, it was explained this was done inorder to receive reimbursements from state and federal grants and also to build a reserve forfuture maintenance and expansion Commissioner Holding asked Mr Neighbors to provide the Boardwith comparative cost information on the telephone system over the past four yearsMr Neighbors offered to meet with the Commissioners at any time to go over the reportin further detail if the Board so desired He said overall, it was a very good report8 Drug Awareness PresentationJudy Creech, representing the Primary Prevention Program, Johnston County Mental HealthCenter, and Debbie Brewington of the Student Assistance Program, Board of Education, reported onthe success of Red Ribbon Week, October 20 -28th They noted over 15,000 red ribbons weredistributed during the week to promote drug awareness and they presented the Commissioners withsignatures of approximately 11,000 Johnston County school children who signed up to support adrug free America9 ADvointments AanrovedCommissioner Frank B Holding moved that Grover Dees, Selma; Kenneth Aycock, Kenly;Robert A Busby, Smithfield; bodies of all cities, counties, and towns acting individually, orcollectively, to require any special - purpose unit of government or privatedeveloper of a major development project to submit detailed statementsreflecting the environmental impact of such a project North CarolinaEnvironmental Policy Act, NCEPA, NC Gen Stat 113A -1 et seq, morespecifically, NC Gen Stat 113 -A -8; andVTOFAS, the North Carolina Administrative code contains provisionsinterpreting the authority of local goverrunents pursuant to NC Gen Stat113A -8 and the role of state government with respect to this authority NCACTitle 1, Chapter 25, 0100; andW902FASS, Section 0802 See Title 1, Chapter 25, North CarolinaAdministrative Code specifically provides that [i]n processing applicationsfor state permits, state agencies shall consider any information generated bythe local government pursuant to the Codes provisions; andVIiH REAS, the management of hazardous waste is an issue of particularconcern to the citizens of Johnston County as well as the citizens throughoutthe state of North Carolina; andWRFRFAS, a number of hazardous waste facilities currently exist inJohnston County and the potential exists for an increase number of hazardouswaste facilities, both public and privately operated; and652December 3, 1990 ContinuedVMFMAS, it is a matter of great interest and importance to the JohnstonCounty and its citizens to have access to information relating to environmentalimpact of hazardous waste facilities in a timely manner;NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of JohnstonCounty, North CarolinaSECTION 1 PURPOSEPursuant to the North Carolina Environmental Policy Act, the JohnstonCounty Board of Commissioners adopts this ordinance establishing a county policyto encourage the wise and safe use of the Countys natural resources; toencourage public and governmental awareness of the environment, particularlyconcerning hazardous waste management; and to require full disclosure by alloperators of hazardous waste facility component operators regarding theenvironmental impact of their activities The intent of this ordinance is toprovide a mechanism for full disclosure of anticipated impacts of hazardouswaste management facilities and to make such information available to thecitizens of Johnston County in a timely manner It is the intent of thisordinance to provide such information at such an appropriate time and in suchmanner so as to enable the information so generated to have a reason andmeaningful impact into all aspects of the operation of any hazardous wastemanagement facility More specifically, it is the intent of this ordinance torequire the preparation and evaluation of environmental impact statements EISfor any and all hazardous waste management facilities, or components thereof21 Hazardous Waste Facilities211 This ordinance shall apply to all hazardous waste managementfacilities including, but not necessarily limited to, anyhazardous waste incinerator, solvent recovery facility, landfill,long -term storage or other hazardous waste disposal facility andshall include all hazardous waste facilities as defined by130B -2b 1 and all hazardous waste management units as definedby 10 NCAC 10F0002 and 40 CFR 2601063, as well as allcomponents thereof212 This ordinance shall apply to all haardous waste managementfacilities whether the operator is a private person or agovernment entity22 ExemptionsThis ordinance shall not apply to any hazardous waste management facilitywhich occupies a total area of two acres or lessSECTION 3 ASSESSMENT RDQUIRIIv1E US31 Environmental Assessments311 Any person required under- this ordinance to submit anenvironmental impact statement may first submit an environmentalassessment EA The environmental assessment shall consist of adocument supplied to the County to address questions ofenvironmental concerns to the County and shall be completed by theoperator of the facility The County may, upon review of the EA,choose to relieve an operator of its obligation to draft an EIS bydelivering to the operator of the facility and finding of nosignificant impact FONSI312 The Submittal of an EAfacility of any obligationswritten notification of aCounty32 Review of Environmental Assessmentin no way relieves an operator of ait may have to file an EIS except uponfinding of no significant impact by the321 The environmental assessment may be submitted prior to thesubmittal of an environmental impact statement322 The County shall review the EA for completeness within five 5calendar days of the date of submittal If the EA is found to beincomplete, it will be returned to the applicant with notificationof its deficiencies323 If accepted as complete, the EA will be reviewed by the County andwill be distributed to appropriate departments or agencies withinthe County for review and commentI `I653December 3, 1990 Continued324 Final action on the EA shall occur within fourteen 14 days fromthe date of acceptance or such longer time as agreed upon inwriting If the EA reveals no significant environmental impacts,the County shall issue a finding of no significant impact FONSIIf significant impacts are identified, then the County shall sonotify the operator of the facility and require that an EIS beprepared325 The filing of a EA with the County shall not relieve a person fromany required deadline set out in this ordinance for the submittalof an EIS except upon receipt of a FONSI by the CountySECTION 4 ENVIRONvMAL IMPACT STATEMENT41 Environmental Impact Statement Requirement411 An environmental impact statement EIS shall be submitted to theCounty for every facility which shall be placed in the Countyafter the effective date of this ordinance412 The EIS shall be submitted to the County by the person who will bedesignated as the operator of the facility or any state agencyresponsible for the siting of a facility42 When Environmental Impact Statement is Required421 When the operator of a hazardous waste facility is a privateperson and the facility cannot otherwise be considered a facilityoperated by a governmental unit, the environmental impactstatement shall be submitted to the County no later than ninety90 days after the date of the submittal by the operator of anypermits regarding the subject facility to the North CarolinaDepartment of Environment, Health and Natural Resources422 Any facility which shall be operated by a governmental unit orwhose construction is mandated by state, local or federal law orregional agreement, shall be due within ninety 90 days afterinitial selection of the site423 With regard to a facility, or component thereof, which is beingsited pursuant to the provisions of NCGS 130B -1 et se q, theEIS shall be required no later than ninety 90 days after theselection of any site within the County as a suitable site asdefined by NCGS 130B -11 An EIS must be submitted prior to theselection of any site in Johnston County as a preferred site, asdefined by NC Gen Stat 130B -1143 Review of Environmental Impact Statement431 The County shall review the EIS for completeness within five 5working days of submittal If the statement is found to beincomplete, it will be returned to the applicant with notificationof its deficiencies432 Upon acceptance by the County, the environmental impact statementshall be distributed to all appropriate departments and agenciesof the County for review and comment A notice shall be placed ina newspaper of general circulation stating that the EIS will beavailable for public review at the commanding department for aperiod of at least fifteen 15 days433 Upon completeness of the advertised fifteen -day review period andupon receipt of comments from all applicable state and federalparties, all comments will be compiled and summarized by theplanning staff434 The EIS along with all comments received during the review periodshall be presented for public hearing The hearing shall takeplace no later than thirty 30 days after the close of the publicreview period or upon receipts of comments, whichever is later435 The Board of Commissioners shall receive the EIS and all commentsas information only No action shall be taken regarding the EISuntil after it has been presented to the Board of CommissionersSECTION 5 TECHNICAL REQUIREMIENTS FOR AN EIS51 PurposeThe primary purpose of a EIS is to serve as a decision-making tool to ensurethat the purposes and policies defined in the North Carolina Environmental654December 3, 1990 ContinuedPolicy Act of 1971 NCGS 113A are given full consideration in theongoing programs and actions of state and local government It shouldprovide a full and fair discussion of significant environmental impacts andshould inform decision- makers and the public of the reasonable alternativeswhich would avoid or minimize adverse impacts or enhance the quality of theenvironment52 RequirementsPreparers should use a format for EISs which would encourage good analysisand clear presentation of all alternatives, including the proposed activity,while minimizing length and complexity These documents should not exceed 50pages and should include site location maps521 Format and Contenta Cover Sheet A Single cover sheet including the followinginformation;1 designation of the document as a draft, supplementary orfinal statement;2 title of the proposed activity that is the subject of thestatement;3 list of any involved cooperating entities;4 name, address, and telephone number of the person who cansupply further informationb Summary An adequate and accurate summary of the statementstressing the major conclusions, areas of controversy, andissues to be resolved The summary shall also list allfederal, state, and local permits, licenses, certifications,and other approvals which must be obtained in implementing theproposal If there is any uncertainty about whether any one ofthese is necessary, it should be so indicatedc Purpose and Need The underlying purpose and need for theproposed activityd Alternatives including proposed activity Based uponinformation and analysis presented in the following sectionson the affected environment and environmental consequences, itshould present the environmental impacts of the alternativesincluding the proposed activity in comparative form To theextent possible the comparison of alternatives should quantifyhow the purpose and need would be satisfied by eachalternative and the proposed activity It should also1 Explore and evaluate all reasonable alternatives;2 discuss the reasons for the elimination of alternativesfrom detailed study;3 include appropriate mitigation measures not alreadyincluded in the alternatives; and4 describe the environment of the areas to be affected andthe environment to be created by the alternatives underconsideration The description should be on longer than isnecessary to understand the effects of the alternatives5 describe environmental consequences, such asa direct effects and significance;b indirect effects and significance;c possible conflicts between the proposed activitiesand the objectives of federal, state, and local plans,policies and controls for the affected area6 List the names and qualifications of the persons who wereprimarily responsible for preparing the EIS7 If an appendix is included in an EIS, it should meet thefollowing requirementsa consist of materials substantiating any analysisfundamental to the principal document, as distinct frommaterial of lesser County shallbe entitled to an injunction or other appropriate equitable remedy torestrain any violation of this ordinance or to require compliance with anyprovision of this ordinanceSECTION 7 DEFINITIONSAs used in this ordinance, unless the context indicates otherwise1 EA - an Environmental Assessment2 EIS - Environmental Impact Statement3 FONSI - A Finding of No Significant Environmental Impact4 Completed EA - an Environmental Assessment that has been acceptedby the County Planning Department as technically acceptable for purposesof this ordinance5 Completed EIS - an Environmental Impact Statement that has beenaccepted by the County Planning Department as technically acceptable forthe purpose of being transmitted to the State Clearinghouse or for beingreviewed for adequacy by the County Planning Department6 County - Johnston County7 County Planning Department or Planning Department means theJohnston County Planning Department8 Environmental Document - an EA, EIS or FONSI, or all of them9 Special- purpose Unit of Government - includes any special districtor public authority10 State agency - includes every department, agency, institution,public authority, board, commission, bureau, division, council, memberof Council of State, or officer of the State government of the State ofNorth CarolinaSECTION 8 EFFECTIVE DATEThis ordinance shall be in full force and
