reconvened in special session onJanuary 13, 1964, at 1100 A M, in the Commissioners Room of the Courthouse, withthe following members presentH M Johnson, Chairman, J D Bailey, Frank B Holding, Norman C Denning, andJesse H Austin, JrAbsent NoneThe following business was transacted1 Commissioner Frank B Holding moved that the following resolution be adoptedWHEREAS, the bond order hereinafter described has taken effect and the Board ofCommissioners desires to make provision for the issuance of 530,000 of the bonds tobe issued pursuant to said bond order; NOW, THEREFORE,BE IT RESOLVED by the Board of Commissioners of the County of Johnston as follows,1 The County shall issue its bonds at this time of the aggregate principalamount of 530,000 pursuant to and in accordance with the bond order entitled BondOrder authorizing the issuance of 975,000 Public Hospital Bonds of the County ofJohnston , adopted by the Board of Commissioners of the County on July 2, 19622 Acting pursuant to Section 153 -80 of the County Finance Act the Board ofCommissioners has ascertained and hereby determines that the existing building describedin said bond order the alteration of which is to be financed by the issuance of thebonds is of either fireproof construction or non - fireproof construction as defined insaid Section 153 -80, and that the life of the improvement described in said bond orderis thirty years, computed from June 1, 19633 The bonds shall be designated Public Hospital Bonds, Series A and shall beof the denomination of 1,000 each of 5,000 each as shall be determined by the Boardof Commissioners, shall be numbered from 1 upwards in the order of their maturity, andshall be payable in annual installments on June 1, in each year as follows, viz40,000 in each of the years 1965 and 1966, 20,000 in each of the year 1967 to 1971,inclusive, 25,000 in the year 1972, 50,000 in each of the years 1973 to 1978, inclusive,and 25,000 in the year 19794 The bonds shall be dated December 1, 1963, and shall bear interest from theirdate at a rate which shall be hereafter determined and which shall not exceed six percentum 6 per annum Such interest shall be payable semi annually on June 1 andDecember 1- 5 The bonds shall be coupon bonds, registrable as to principal only, and shallbe signed by the Chairman and Clerk of the Board of Commissioners of the County Thecorporate seal of the County shall be affixed to each of the bonds Each of the interestcoupons to be attached to the bonds shall be authenticated by the facsimile signatureof said Clerk Both principal of and interest on the bonds shall be payable at theprincipal office of the Manufacturers Hanover Trust Company, in the Borough of Manhattan,City and State of New York, or, at the option of the holder, at theoffice of the First -Citizens Bank Trust Company, in the City of Raleigh, North Carolina, in any coin orcurrency of the United States of America which at the time of payment is legal Norman C Denning seconded the motion and the motion was adopted,those voting for the resolution were Messrs J D Bailey, Frank B Holding, Norman CDenning, and Jesse H Austin, Jr and no one voting against it2 ConstablesA group of Constables composed of W F Parrish, Hubert B Edgerton, Willard AWallace, Leo Barbour, James Purvis and Roy Norris from Selma, Beulah, Smithfield,Wilsons Mills, Ingrams and Clayton Townships, respectively, protested the appointmentof Special Deputies by the BoardMr Parrish and Mr Edgerton vociferously complained of the appointment of MrClinton Pully and Mr Charlie Allen as special Deputies and were adamant in the appoint-ment of Mr Hales They each stated that it was not fair to the public or to the dulyelected Constables and would cause the County to lose fees as the Special Deputieswould, in a great many cases, do the work that Deputy Sheriffs were supposed to doMr Wallace substantially agreed with Messrs Parrish and Edgerton but offeredno objection to the appointment of Mr Allen, and further that the bank who employedMr Hales needed his services as Special DeputyThe Boards position was clarified by several of the Commissioners who statedthat the appointments were made in good faith upon the recommendation of the SheriffSheriff Oliver was contacted relative to the complaints and stated that Mr Allensservices were needed and that the appointment of Special Deputies would in no wiseimpede the effeciency of his deputiesIt was the concensus that the work of the Special Deputies should be restrictedto the townships in which they reside The matter was deferred pending furtherinvestigation and action by the Board at its next regular meeting3 Johnston County Bar Associa ion L?? ram Spacearry ana ay and?ames ATJelons,J°r , representing the Johnston CountyBar Association, again petitioned the Board for space on the third floor of thecourthouse for library purposes184January 13, 1964 Cont_After a discussion, motion was made, seconded and carried that the Bar Associationbe granted the privilege of choosing which room in the courthouse located on thethird floor of the northwest corner for library purposes and that the Commissionerswould retain room not selected by the Bar for public use, with the Commissionersretaining the right to furnish this room4 West Johnston Fire DepartmentUpon the request of E T Evans, and upon the recommendation of Norman C Denning,Fire Commissioner, Commissioner J D Bailey moved that the West Johnston Fire Depart-ment be paid 10000 per month, effective February 1, 1964, as said Fire Departmenthad complied with the provisions contained in resolution adopted by the Board attheir regular meeting on October 3, 1955Commissioner Jesse H Austin, Jr seconded the motion, which was carried5 Drainage Problem - Lenwood CollierW R Britt, County Attorney, presented drainage problem on behalf of LenwoodCollier, Smithfield, N CCommissioner Frank B Holding moved that W G Massey, Clerk, notify Mr J ILynch, District Engineer, of complaint submitted by Mr Britt and request that heinvestigate problem of Mr Collier and offer him all assistance possibleCommissioner J D Bailey seconded the motion, which was carried6 Archer Lodge Fire DepartmentThe request of the Archer Lodge Fire Department, proposing a special districttax for the benefit of the Fire Department, was referred to W R Britt, CountyAttorney, for study and that he report his findings to the Board at a future meeting7 Sale of Timber County Home PropertyIn response to a request of the Board, C W Tarlton, County Agent, reported thatin his opinion that he would not sell any gum timber from the County Home property atthis time, recommending that the services of the State Forester be utilized in workingup plan for the disposal of marketable gum or pine timberAccepting recommendation of Mr Tarlton, WG Massey, Clerk, was directed tonotify Mr Z B Byrd, Jr that the Board was not interested in selling the gum timberfrom the County Home property at this time8 Purchase of Mattresses for JailW H Britt, Auditor, submitted samples of mattress covers to the Board, statingthat mattresses could be purchased at a price of 950 each, plus 400 for the coversCommissioner Frank B Holding moved that W H Britt proceed to purchase from theLions Club Industries for the Blind, Inc, Durham, N C 36 mattresses and covers ata cost of 1350 each, total 4600, for the use of the county jailCommissioner J D Bailey seconded the motion, which was carried9 AuditorW H Britt, Auditor, posed the question of payment of bill for the transferringof radios in the Deputy Sheriffs automobiles, stating that no funds were budgetedfor this purposeCommissioner Frank B Holding moved that W H Britt, Auditor, be authorized anddirected to pay 7000 for the transferring of radios in twoautomobiles belonging to the Deputy SheriffsCommissionercJ D Bailey seconded the motion, which was carried10 Tax SupervisorSubsequent to a report by W H Britt, Tax Supervisor, that he had discovereda discrepancy in the inventory listing of the firms of Dixie Block Company, FourOaks, Roberts t Nellons, Smithfield and Talton, Inc, Smithfield, Commissioner J DBailey moved that approval be given to W H Britt, Tax Supervisor, in complying withGeneral Statutes 105 -331 providing for the proper inventory listing of firms andcorporations and that each firm mentioned above be notified of the action taken byMr BrittCommissioner Jesse H Austin, Jr seconded the motion, which was carried11 Failure to List TaxesAfter hearing a report from W H Britt, Tax Supervisor, as to the procedure hehad followed in notifying by mail citizens of the county failing to list their taxes,Commissioner J D Bailey moved that W H Britt proceed to indict, according to law,said citizens failing to list their taxesCommissioner Norman C Denning seconded the motion, which was carried5 Loan to Thanksgiving Fire DepartmentUpon the recommendation of Norman C Denning, Fire Commissioner, Commissioner J DBailey introduced the following resolution and moved that it be adoptedWhereas, the Thanksgiving Fire Department has met the necessary requirements foreligibility of a loan from the County, as provided by resolution pertaining to FireDepartments adopted by the Board on October 3, 1955,Now therefore, be it resolved that a loan of 100000 be made to the ThanksgivingFire Department, with the provision that the said 100000 be deducted from the monthlyal 8O of the Thanksgiving Fire Department when it qualifies for monthly payments ofUU per
