tax stamps inadvertently purchased fromthe Johnston County Register of Deeds and placed on a deed involved in a foreclosuretransaction ,625October 1, 1990 ContinuedIn accordance with GS 105- 22828, the seller, Federal National Mortgage Association,as a federal agency, was exempt from the taxUpon a motion by Commissioner Jerry F Wood, seconded by Commissioner James WCash and carried by unanimous vote, the Board authorized refund to the law firm of Brown,Kirby and Bunch, on behalf of Federal National Mortgage Association, in the amount of11250, collected by the Johnston County Register of Deeds in excise stamp tax7 Oak Tree Park Water Improvements RequestIn reference to water sewer lines committed by the Board on February 6, 1990, to aproposed industry at Oak Tree Corporate Park, Selma Township, the County Manager informedthe Board that cost estimates have been revised upward from 59,543 to a range of 147,000to 186,000 He explained that in order to provide adequate fire flow protection for theprospective industry, SMB , North America, a 12 water main is now recommended instead ofthe original 8 lineTim Broome, President of Ragsdale Consultants, was present and outlined two possibleroutes for laying the line He noted the less expensive route would run cross - country andwould involve acquiring easements, while the other would be installed along highwayright -of -way and would provide water supply to adjacent marketable industrial sitesSelma Manager, Jim Caldwell, explained that SMB plans to break ground on October20, 1990, and hopes to open in April, 1991Commissioner recommendations at the November Board meeting10 Appeal of Property Value - Williams Oil CompanyThe County Manager informed the Board that A Tab Williams, Jr, Williams OilCompany, has asked the County to reduce the value on property owned by the oil companyparcel ID# 01F09055B, 417 acres located at I -40 intersection with Benson RoadFollowing discussion, the Board deferred action on this matterH Proclamation - Lupus Awareness Month - OctoberUpon a motion by Commissioner John M Booker, seconded by Commissioner Frank BHolding and carried by unanimous vote, the following proclamation was adoptedLUPUS AWARENESS MONTHWHEREAS, Systemic Lupus Erythematosus affects one in every twothousand Americans; and over 16,000 new cases are diagnosed each year; andWHEREAS, Lupus is more common than Leukemia, Muscular Dystrophyand Cerebral Palsy; that it affects both men and women, young and old; andWHEREAS, Lupus is a chronic inflammatory disease which causes thebodys immune system to produce Audit - ComplaintRoss Lampe, President of Guy C Lee Mfg Co, met with the Board questioning theaudits currently being done by Tax Management Association, a firm contracting with theCounty to audit business personal property listings on a percentage of discovery fee basisIn a written memo to the Board, Mr Lampe stated he believes the audit constitutesprogressive taxation and is not taxing by uniform ruleMr Lampes attorney, James Wellons, was present and spoke on the essential elementof equality in taxation, noting only businesses with large tax liability are being audited Heand Mr Lampe asked that the Board apply the same rules for all Johnston CountybusinessesMr John White, representative from Tax Management Associates, spoke on thelegality of audit agreements between counties, and private auditing concerns He read a letterwritten to Gaston County Attorney, Charles Moore, dated July 10, 1988, from the StateAttorney Generals Office, which addressed this question The letter stated that such anagreement is squarely authorized by GS 105 -299 and constitutes a valid exercise of thecountys contractual powers Mr White stressed his company seeks ,uniformity and equalityand maintains a high degree of professionalism He explained that small companies are auditedfrom within the County Tax office and businesses with tax listings of 100,000 and above arepicked at random for audit by his companyCounty Manager, Richard Self, pointed out that large listings of 100,000 and over,tend to be multi- county firms and the County Tax office lacks the staff and expertise tohandle audits of this kind He stressed that Tax Management Associates are not appraisersand are not involved in any way with tax collectionC627October 1, 1990 ContinuedWHEREAS, the Johnston County Board of Commissioners desires to concur withthe Johnston County Airport Authoritys request to construct ahangar at the Airport; andWHEREAS, the Johnston County Airport Authority desires to finance theconstruction of the necessary facility by installment contract with afinancial institution, andWHEREAS, the local Government Commission of the North Carolina Departmentof the State Treasurer requires that the Johnston County AirportAuthority make certain findings before the Commission can grantapproval to the Authoritys application for approval of thisparticular installment contract as authorized under the NorthCarolina General Statutes;NOW THEREFORE BE IT RESOLVED that the Board of Commissioners of JohnstonCounty concur with the proposal from the Johnston County Airport Authorityas follows1 The proposed project is the construction of a 46,000 square foothangar The proposed method of financing is a 15 -year installmentcontract between the Authority and a financial institution, for the fullamount of the construction and the associated water lines2 The construction of the hangar is necessary and expedient for theAuthority due to the steady and rapid growth of the industrieslocated at the airport 3 The proposed construction cost of the hangar is 1,927,098 whichincludes design, construction, water lines, fire sprinkler system, firehydrants, sewer, and a contingency The Authority will give a deedof trust on the specific site property to the financial institution tocollaterize the installment purchase contract The tenants shall furnishinsurance guaranteeing ten years of payments with an option torenew It is expressly understood that should the lease not berenewed at the end of ten years that five years still remain on theinstallment obligation between the Authority and the financialinstitution4 No taxing obligation on the part of Johnston County is pledged orinferred in any manner to this project5 The County Attorney has rendered an opinion that the constructionof the hangar is authorized by law, and is a purpose for whichfunds may be expended pursuant to the Constitution and the laws ofNorth Carolina at this time The opinion is expressly subject to thefinal determination by the North Carolina Supreme Court ruling on aWayne County case now before the Court6 Because of the expenditure nature of this project, and the relativesmall nature of the total project cost, the proposed installmentcontract is preferable to alternative financing mechanisms as followsa Current appropriations in the Authoritys operating budget areinadequate to fund this projectb Currently, fund balance available for appropriation is notsufficient to fund this projectc The proposed financing is preferable to bonds because the costof crisis situation fortheir agency She pointed out that an increase in Home Care nursing salaries is needed toattract and keep qualified help, and noted the program generates sufficient revenue toincrease salaries without effecting county tax dollarsOn behalf of the Home Health nursing staff, Mrs Earp made the following requests1 Increase the hiring rate for new Home Care nurses by 20 effective immediatelyThis would raise the hiring rate from 23,256 to 27,4322 Increase the rate of salary compensation to all existing Home Care nursing staffby 20 effective immediately3 Direct County Administration to carefully monitor the revenues and expenses ofthe Home Care Division to ensure fiscal responsibility, but also instruct CountyAdministration to allow the Home Care Division the flexibility it requires to meetmarket demands and to remain a competitive and viable agency in JohnstonCountyOther nursing staff were present in support of these requestsJanice Lofton, Data Program Coordinator, spoke on behalf of non - nursing staff askingfor equal recognition and consideration for increased compensation She noted the workloadfor non - nursing personnel has increased proportionately, if not more, than nursing staff,and emphasized the following 1 no job reclassification for non - nursing staff; 2 difficultyin filling vacancies with qualified persons; 3 shortage of, and in some cases deletion of,non - nursing positions; 4 no specific salary increases other than annual cost of living; and5 nursing personnels 21 step increase less than one year ago with no consideration fornon - nursing staff She concluded that to recognize and compensate only one group decreasesmorale and motivation of other staffOther non - nursing Health Department personnel added their supportChairman Norman C Denning, who also serves as Chairman of the Johnston CountyBoard of Health, reported that a salary committee, appointed by the Health Board, studiedthe request and recommended a Z step increase in nursing salaries at this time, andsuggested a more thorough salary study prior to next years budget632October 1 , 1990 ContinuedCommissioner John M Booker questioned the wisdom of increasing salaries, other thanat budget time He reminded the Board of low morale and general complaints from otheremployees when salaries for a specific group were raised mid -yearCommissioner Frank B Holding reopened the question of Hospice and asked why theservice was deleted from the Home Health DivisionIt was explained, at the time it was under the Health Department, the program didnot qualify for medicare and medicaid reimbursements and was financially depleting Home Carefunds In separating Hospice from Home Health, it was hoped the program would operateindependently, draw more funds from outside donations, and become certified to serveMedicare and Medicaid patients In order for Hospice to be certified, there are severalrequirements including 1 a full time nurse, 2 an executive director, 3 a physicianactively involved, and 4 an agreement with a local hospital concerning beds for Hospiceclients In the past, Hospice was unable to reach an agreement with Johnston MemorialHospitalOthal Minshew informed the Board his committee talked with the new administrator atJohnston Memorial and were told the hospital would now be willing to work with the programThe Board agreed to meet again on Tuesday, October 23, 1990, at 7 oclock pm tofurther address these issues They asked the County Manager to gather information fromother counties concerning nursing salaries and how Hospice programs are administered, andmake the data available for their study prior to the meeting Those present were invited toprovide input through the County ManagerRalph Dunn asked the Board why the next meeting couldnt be held at an earlierdate and a decision madeThe Board stressed the importance of taking the time to be well informed in order tomake a responsible decision on matters that directly effect many citizens of Johnston CountyThey noted that both the questions of Home Health nursing and a successful Hospice programrequire careful and serious consideration30 Mileage Reimbursement to County EmployeesDue to the increase in cost of gasoline, Commissioner Frank B Holding moved thatmileage reimbursement to County employees be raised from 24mile to 255mileCommissioner Jerry F Wood seconded the motion which carried by unanimous vote31 Propane Gas Tank - Request to Place on Countv PropertThe County Manager informed the Board that Attorney James W Narron hasrequested permission to place a propane gas tank on County property in order to provideservice to his buildingFollowing discussion, the Board agreed to allow Mr Narron to use the space, free ofcharge, with the understanding the agreement is on a month -to -month basis until such timeas the County has need of the site32 Oak Tree Park Water Improvement ProjectIn reference to earlier discussion concerning additional water lines needed to serveindustry at Oak Tree Corporate Park, Selma Township, Commissioner Jerry F Wood moved theBoard approve the installation of a 12 water supply main from the Gulf Oil Terminal, alongBuffalo Road and Noble Street to the entrance of the Park Commissioner Wood further movedthat the Town of Selma be asked to participate in the 39,000 additional costWith the consent of Commissioner Wood, Commissioner Frank B Holding amended themotion to include authorizing Commissioner Wood to negotiate with the Town of Selma in thismatterCommissioner James W Cash seconded the motion which carried by unanimous vote33 Recreation Grant ApprovedUpon a motion by Commissioner James W Cash, seconded by Commissioner Frank BHolding Booker brought to the Boards attention that there is someconfusion among citizens on what can and can not be disposed of at the Countys solid wastecompaction sites He suggested an additional container might be placed at the sites to takehousehold items that can not be compactedThe Board asked Commissioner Booker to work with Commissioner Cash and the SolidWaste Task Force on this matterUpon a
