Meeting of the Johnston Countv Board of CommissionersSeptember 21, 1990The Johnston County Board of Commissioners met in Special Called Session on Friday,September 21, 1990, at 900 am in the Commissioners Room, Johnston County Courthouse Annex,Smithfield, North Carolina, with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, James W Cash, John MBooker, DVM, and Jerry F Wood, DDSAbsent NoneAlso Present Richard B Self, County Manager, Joyce H Ennis, Deputy Clerk to theBoard, and William R Britt, County AttorneyThe meeting was moved to the Johnston County Superior Courtroom due to the large numberin attendanceThe Chairman called the meeting to order and the following business was transactedChairman Denning explained this meeting was called for the purpose of addressing theStates decision to test a site for locating a hazardous waste incinerator in western JohnstonCounty1 Resolution in Opposition to a Hazardous Waste Incinerator and Disposal Site in JobnstonCountyUpon a motion by Commissioner James W Cash, seconded by Commissioner Frank B Holdingand carried by unanimous vote, the following resolution was adoptedRF50LUTIONOPPOSITION TO THE SITING OF A HAZARDOUS WASTE INCINERATORAND DISPOSAL SITE IN JOHNSTON COUNTYThe State of North Carolina is performing geotechnical evaluations on atract of land located on US Highway 70 in Johnston County; andThe State of North Carolina is contemplating locating a hazardous wasteincinerator and disposal site on this tract of land; andWd ERW, within Johnston County, over 6,000 citizens reside within 10,000 feetof this proposed site; and over 16,657 citizens reside within 25,000feet of this proposed site in Wake and Johnston Counties as well asover 58 subdivisions; andVMREAS, the Town of Clayton is within approximately 10,000 feet of thisproposed site; and that Clayton Township is the fastest growingtownship in Johnston County with a growth rate of almost 500; andWVf4W_AS, the safety of Johnston County is adversely impacted due to 1 the solesource of the Johnston County water system being within 6,200 feet ofthis site; 2 the site is adjacent to coastal evacuation route; 3the site is adjacent to the Sharon - Harris Nuclear Facility evacuationroute; and 4 the fire and rescue facilities in the area areinadequately equipped for a facility of this nature; andlAliIDtEAS, the site is located on a primary gateway into Johnston County and willhave an adverse psychological impact on all future visitations byprospective industries which enter Johnston County via US Highway 70;andthat the facility would cause great concern to the pharmaceuticalindustries which have developed along US Highway 70; that futureexpansions of this economic component would be in jeopardy; andW EREAS, All future industrial projects which require a PSD permit will have tomodel in the effects of their proposed air emissions with that of ahazardous waste incinerator forcing Johnston County into an airattainment status similar to large metropolitan areas; andWHUWAS, the facility would have a tremendous adverse affect on all propertyvalues in the area, which will deflate the tax revenues of JohnstonCounty and create an undue hardship on all the citizens of the County;and622September 21, 1990 ContinuedWiEREAS, the entire State will feel the loss of the test station currently onthe siteNOW THEREFORE BE IT RESOLVED that the Board of Commissioners of Johnston Countyadamantly OPPOSES consideration of this property as the location of a hazardouswaste incinerator and hazardous waste burial siteBE IT FURTHER RESOLVED that the citizens of Johnston County are encouraged tocontact state legislators, the Governor of North Carolina and take all lawfulactions to assist in the removal of this site from consideration for a hazardouswaste incinerator and disposal siteAdopted Unanimously this 21st day of September, 1990CommentsLenore Cooper, Clayton resident who lives near the site being considered, stated shewas opposed to a hazardous waste incinerator being located near her home, citing health relatedproblemsDr William H Johnson, Assistant Director of The Agricultural Research Service,College of Agriculture and Life Sciences, North Carolina State University, spoke concerning thedetrimental effect of losing the agricultural research center presently located on the site Henoted the Central Crops Research Station is a key center due to its proximity to the University,and the many scientists conducting short -term and long -term field research on various crops Hestated the faculty and administration feel that replacing the crops research station with ahazardous waste incinerator would be a severe blow to the Universitys program, which would takeyears to overcome and replace, and would have a tremendous impact on farmers and agriculturethroughout the state He presented a list of active projects at the siteRay Hunt, Clayton resident, informed the Board the community has circulated a petitionand plans to stage demonstrations at the site He thanked the Board for passing the resolutionand asked for any suggestions for organizing lawful citizen opposition He voiced concern thatthe Countys reputation would suffer, and consequently Johnston County would lose out on ,potential industry and growth He also pointed out the danger of accidents involving vehicleshauling chemicals and other hazardous wasteGeorge Clark, Superintendent of the NCSU Central Crops Research Station, informed theBoard he was notified late Monday 917 that the site was being considered, and drilling beganWednesday morning 919 He stated the University wants to keep the community informed, andoffered to answer any questionsRepresentative Barney Paul Woodard, NC House of Representatives, stated he is opposedto a hazardous waste incinerator and disposal in Johnston County and offered his support to thecitizens in desisting any plan the State might have to build one in the CountyBetty, Hunt comnented on the difficulty of citizens meeting during the day, and askedthe Board to consider holding any future meetings at night so that everyone, including schoolstudents, could participateChairman Denning explained the Board only learned of this situation late Monday Henoted a 48 hour notice is required for a special called meeting, and the Board wished to passthis resolution in opposition as soon as legally possible He assured those present that theCommissioners would hold night meetings on this issue if necessaryPatricia Tilley asked if the County has any additional plans of opposition, or iffurther resistance will be left up to citizens groupsChairman Denning offered the Countys assistance through the County Managers Office,and County Attorney, as well as individual Board members He asked the County Manager tocommunicate with other counties that have had similar situations, and make any helpfulinformation available to the citizensCommissioner Frank R Holding commented that it seems inconceivable that this site isbeing considered, saying in his opinion, it is only because the State owns the land He notedany effort to build an incinerator on the site would not happen quickly, and citizens, and theCounty alike, would have time to attempt to stop itPam Sutterfield questioned if industries planning to locate in the area, have beennotified so they can help in opposition efforts She stressed the need for Johnston County andWake County citizens to work together on this problem21,1990 ContinuedWake County Requested to Oppose Site for Hazardous Waste Incinerator and DisposalCommissioner Frank B Holding moved the Wake County Board of Commissioners be asked togo on record opposing a hazardous waste incinerator and disposal being located on State propertyin Johnston County at the Wake County lineCommissioner James W Cash seconded the motion which carried by unanimous voteComments ContinuedJody Dupree of WHPY Radio in Clayton, and John McFadyen, Smithfield resident, alsospoke in opposition to a hazardous waste incinerator being located anywhere in Johnston CountyDavid Geiger questioned the long -term and short -term effects an incinerator might have,noting especially the impact on growth in the areaReferring to the highly populated community, Eddie Jones, Clayton, stated he spoke withthe Hazardous Waste Commission and was told that area population is not considered in choosing asite for an incineratorRay Hunt responded that large scale negative public opinion would be noticed and wouldhave an affectRobert Hyatt, Manager of Clayton, explained the town is concerned about the economicand environmental repercussions, stressing special concern with the water supply He reportedthe Clayton Town Council will meet Monday, September 24, 1990, at 6 oclock pm to address thisissue, and welcomed and encouraged citizens to attendCommissioner Frank B Holding commented he expects to see tremendous opposition fromboth Johnston County and Wake County, and assured those present the Board of Commissioners woulddo everything legally possible to see that a hazardous waste incinerator is not located inJohnston CountyChairman Norman C Denning stated, We would go to court if necessary He asked theCounty Manager to keep the Board informed concerning this issue and added the Commissionerswould hold another meeting if necessary2 Resolution ZSmith Reynolds Foundation - Opportunities for Families FundUpon a motion by Commissioner Frank B Holding, seconded by Commissioner James W Cashand carried by unanimous vote, the following resolution was adoptedRESOLUTIONOPPORT[AVITIES ?FpOR FAMILIES FCMWHEREAS, Z Smith Reynolds Foundation has made available grants for county -widedemonstration programs to move indigent families from dependency toself - sufficiency; andGff1EAS, Only North Carolina County Governments are eligible to apply for, andreceive these grants; andWHEREAS, Fifteen counties will receive 20,000 planning grants; five of thesecounties will be eligible for 1,000,000 each to implement the plans;andWHEREAS, Through the efforts of the County, the public and private sectors havejoined in to prepare this proposal; andWiEREAS, The Johnston County Rural Health Research Center has provided technicalassistance in the grant application process and will be a continuingasset to the eventual implementationNOW HERE BE IT RESOLVED that the Johnston County Board of Commissionersapprove and support Johnston Countys submission of a grant to the Z SmithReynolds Foundation to assist the indigent in Johnston CountyAdopted unanimously this 21st day of September, 1990Upon a motion by Commissioner John M Booker, seconded by Commissioner James F
