Request Approval for Certificate of Need TransferCounty Manager, Richard Self, informed the Board Britthaven, Inc has requestedapproval of their application for Certificate of Need transfer from Autumn Care of Selma toBritthaven of SmithfieldThe Board postponed action until additional information could be obtained from SelmaTown Council concerning their communitys response to this request3 Proclamation - National DARE DayUpon a motion by Comnissioner Frank B Holding, seconded by Commissioner John M Bookerand carried by unanimous vote, the following proclamation was adoptedWODesignating September 13, 1990 asNational DARE DayWHEREAS DARE Drug Abuse Resistance Education is a semester -longprogram that teaches young people ways to resist peer pressure to experimentwith drugs and alcohol;11REAS DARE targets young people when they are most vulnerable totremendous peer pressure and teaches the skills to make positive decisions andresist pressure to engage in negative behaviors;WHEREAS more than 100,000 classrooms in 49 states as well as Departmentof Defense Dependent Schools and schools in American Samoa, Canada, Australiaand New Zealand conduct the DARE program;WHEREAS over 20 million students have been reached through DARE;WHEREAS the DARE program is taught by veteran police officers withdirect experience in cases involving criminal activities and ruined lives causedby substance abuse;WHEREAS each police officer who teaches the DARE program completesan 80 -hour training course that included instruction in teaching techniques,officer- school relationships, development of self - Corinth Holders Fire DepartmentIn response to a request from the Corinth Holders Volunteer Fire Department,Commissioner Frank B Holding moved that Secondary Road Construction funds in the amount of1,750 be allocated for the paving of the driveway at Corinth Holders new fire station locatedoff NC Highway 39Commissioner Jerry F Wood seconded the motion which carried by unanimous vote9 Department of Transportation MaintenanceChairman Norman C Denning commented he hashad complaints about the high grass alongthe roads and highways in the County, and asked Ross Hailey, DOT Maintenance Engineer, to checkon roadside mowing10 SR 1905 Request to be Reinstated to State Maintained SystemGaddis Lee, property owner and developer, met with the Board concerning reinstatementof state maintenance on the 45 of a mile of SR 1905 Part B which was abandoned several yearsago He explained the road, although it still lacks five residents, has been brought up tostandards as required by NC Department of Transportation, and he requested DOT resumemaintenance responsibilitiesFollowing discussion, Commissioner Frank B Holding moved the Board respectfullyrequest the NC Department of Transportation to reinstate maintenance on SR 1905 B, due tothe fact the road was never taken off the State Maintained System and has now been brought up tostate standardsCommissioner James W Cash seconded the motion which carried by unanimous vote11 Fire Department Request Fire TaxRay Earp, Chief of Thanksgiving Volunteer Fire Department, met with the Board torequest the County assess a fire tax on residents in Thanksgiving fire districtCounty Manager, Richard Self, informed, the Board that Selma and Bethany FireDepartments, along with Pine Level last month, have made similar requests Of the sixdepartments in the County without a fire tax, only Clayton has not yet made a requestAction was postponed to allow Clayton time to respond12 Recreation Grants AnDrovedUpon a motion by Commissioner James W Cash, seconded by Commissioner Frank B Holdingand carried by unanimous vote, the following recreation grants were approvedTown of Benson Parks Recreation Department, 2,000; Cooper Athletic Booster Club,2,000; Clayton Civitan Club, 2,000; Johnston County Civil Air Patrol Composite Squadron,2,00013 Ordinance - Fee Established for Hazardous Waste Clean Up OperationsUpon a motion by Commissioner Jerry F Wood, seconded by Commissioner James W Cash andcarried by unanimous vote, the Board adopted the following ordinance7 ID 0 to DOAuthorization NC GS 153A -101, 153A -102 and 153A -121Section 1 Purpose and IntentThe duties of Emergency Management Agencies, Fire Department, EMS andRescue Squads shall include controlling and eliminating hazardousmaterial emergencies in Johnston County The FMA, Fire Departments, EMS,and Rescue Squads have the authority to summarily remove, abate or6164, 1990 Continuedremedy hazardous material emergencies in Johnston County that aredangerous or prejudicial to the public health and or public safety Theexpense of the action shall be paid by the persons in defaultSection 2 Chargesa FMS - Guyand Winston Roads, Clayton TownshipJeff Coutu reported the Johnston County Planning Board recommended approval of thisrequestDan Dailey, Manager of Red and White Grocery, proposing to locate on the property, metagain with the Board asking approval of the rezoningUpon a motion by Commissioner James W Cash, seconded by Commissioner Jerry F Wood andcarried by unanimous vote, the Board approved the rezoning from AR R -40 to Commercial Businessfor Case #007, Joseph Joye, 637 acres, Clayton Township, as recommended by the Johnston CountyPlanning Board18 Districting - Election of County ConmissionersIn response to recent interest expressed by citizens of Johnston County concerning themethod of electing the Johnston County Board of Commissioners, and at the request of the presentBoard, Raleigh Attorney, Michael Crowell, of the law firm of Tharrington, Smith Hargrove,introduced a resolution calling for a referendum to alter the structure of the Board AttorneyCrowell briefly outlined the proposed plan which would increase the number of Board members fromfive to seven and would establish seven residency districts to determine eligibility ofcandidates, who would be voted on countywide for staggered terms He displayed a County mapdivided into the proposed districts, explaining that State law provides for county commissionersto offer the voters a specific plan with specific district lines, and if the resolution isadopted, the referendum would be held in conjunction with the general election on November 6,1990Chairman Denning welcomed comments from those presentLouise Sewell, Smithfield, voiced concern about minority representation She noted theblack population is disbursed throughout the County and expressed regret that districting willnot appreciably affect minority chances for election to the Board She questioned theadvisability of countywide voting for each board memberCommissioner Frank B Holding explained the plan would assure every area would haverepresentation, but make all commissioners accountable to the entire CountyPhil Matthews, resident of Cleveland Township, commented on single member districtrepresentation with only one or two members voted on at- large He suggested the Board postponeaction and appoint a committee to study the various options availableSeptember 4, 1990 ContinuedMichael Rabil, Smithfield, asked if 1980 census figures were used in drawing thedistrictsAttorney Crowell explained that residency districts do not require equal population;however, data on the number of registered voters was usedMr Rabil responded he favored countywide vote for board members as this would givecitizens more voting power He commended the Board for presenting this planJames George offered an alternate proposal which included the following enlarged boardof seven; non - partisan elections; staggered terms; commissioners limited to three consecutiveterms; commissioners subject to recall, and grandfather clause to protect incumbentsAttorney Crowell clarified that some of these issues are outside the authority of theCounty Commissioners and would require legislationCommissioner Frank B Holding pointed out the resolution would give voters in JohnstonCounty the choiceRalph Dunn expressed his belief the proposed plan basically represents what the publicwants, noting revisions could be made at a later date He favored the referendum be held asproposedCommissioner John M Booker commented he feels comfortable with the present Boardstructure; however, is convinced the general public wants some type of districting to give eacharea representation He voiced support for countywide voting to ensure commissioners alwaysconsider the entire Countys best interest and are accountable to all the voters Continuing, hestated he feels the citizens are better served when they have the opportunity to vote on a planrather than have the legislature make changes, and since more people exercise their vote in ageneral election, he favored offering the referendwn on November 6thCommissioner James W Cash added his support, but recognized everyone may not agree onthe proposed district boundary lines He noted it is regrettable the County does not have adistrict made up predominately of minority votersCommissioners Jerry F Wood voiced his support and concurred that countywide voting isimportant to ensure commissioners equally represent the entire CountyUpon a motion by Com issioner Frank B Holding seconded by Commissioner Jerry F Woodand carried by unanimous vote, the Board adopted the follow resolutionRESOLUTION CALLING REF EMXM TO ALTERTHE STRUCTURE OF THE BOARDSeptember 4, 1990WHEREAS, the Johnston County Board of Commissioners presently consistsof five commissioners elected by all the voters of the county; andWHEREAS, although the county has been well served by the presentelection method, it does not assure representation of all areas of the county;andWHEREAS, numerous citizens have expressed an interest in changing themethod of election to provide for representation of each area; andWHEREAS, the General Statutes of North Carolina authorize the Board ofCommissioners to call a referendum on such a change; andWHEREAS, the Board believes that the voters of Johnston County should begiven an opportunity to decide whether the election method should be altered;andUPS, to call a referendum the Board must propose a specific electionplan;NOW, qHER_FFOM, BE IT RESOLVED by the Johnston County Board ofCommissioners that1 Upon approval at the referendum called by this resolution, the Boardof Commissioners shall be expanded to seven members beginning withthe 1992 electionw14fIiI?619September 4, 1990 Continued2 Commissioners shall reside in and represent the following districtsDistrict 1 - Wilsons Mills and Pine Level Townships and the portionof Smithfield To ship in North Smithfield precinctDistrict 7 - Clayton Township3 One commissioner shall represent each of the seven districts Aperson must reside in a district to be eligible to be a candidate torepresent that district, but all seven offices shall be voted upon byall eligible voters of the county in both the primary and generalelection4 In 1992 and every four years thereafter commissioners shall beelected from Districts 1, 2, 4, and 6 In 1994 and every four yearsthereafter commissioners shall be elected from Districts 3, 5 and 75 Pursuant to N0 5 153A -60, a referendum on adoption of thisalteration in structure of the Board of Commissioners shall beheld on Tuesday, November 6, 1990, at the same time as the generalelection The ballot for this referendum shall be separate from anyother ballot in the election The ballot shall allow each voter tovote YES or NO on the following proposition Shall the structureof the Johnston County Board of Commissioners be altered to increasethe number of commissioners from five to seven and to requirecandidates for each of those seven seats to reside in and representparticular districts, while still allowing all voters of the countyto vote on all seven commissioners 6 If a majority of the votes cast in the referendum are YES, thealteration shall take effect as provided in this resolution If amajority of the votes cast are NO, this resolution and the electionplan described in it are void7 This resolution shall be published in full and shall be filed andindexed in the county ordinance bookADOPTED this 4th day of September, 1990NOTE Item 2, District 5 Resolution amended in item 24 of these minutes to reflectchange in name from West to South Smithfield Precinct19 Board Endorsement of Districting PlanUpon a motion by Commissioner Frank B Holding, duly seconded by Commissioner James WCash and carried by unanimous vote, Board members endorsed the preceding proposed plan to alterthe structure and method of electing the Board of County Commissioners for Johnston County20 County Mapping - Landmark GISCounty Manager, Richard Self, asked the Board for direction concerning payment toLandmark GIS for the Johnston County Mapping Project He reported Landmark was to have finishedthe project by April 1, 1990, which included 18 months extension, and the check plot maps arestill only 40 completed Payment has been suspended since December 1, 1989, and Landmark hasrequested the County release paymentFollowing discussion and upon a motion by Commissioner Jerry F Wood, seconded byCommissioner John MBooker and carried by unanimous vote, the Board directed the County Managerto continue withholding payment to Westinghouse Landmark, GIS, until the County Mapping Projectis 100 complete620September 4, 1990 Continued21 EPA Proposed Regulations on Solid Waste Landfills and IncineratorsThe County Manager reported that NACo has notified counties that the EnvironmentalProtection Agency EPA has proposed regulations that would make 25 recycling a condition formunicipal waste incinerator permits, and are considering a proposal that would tie recycling tolandfill permits NACo has requested that county governments notify congress of their oppositionto such regulationsUpon a motion by Commissioner James W Cash, seconded by Commissioner Jerry F Wood andcarried by unanimous vote, the Board instructed the County Manager to inform congressionalrepresentatives of Johnston Countys opposition to EPA regulations tying recycling toincinerator and landfill permits22 Neuse River Development Authority AppointmentsCommissioner James W Cash moved that MW Mokie Stancil be appointed to the NeuseRiver Development Authority, representing community organization, for a two year term to expireSeptember, 1990 Commissioner Cash further moved the Board recommend to Neuse River COG theappointment of Scott Evans, Smithfield, and Bud Andrews, Smithfield, to the Authority torepresent area banking Commissioner John M Booker seconded the motion which carried by the following voteYeas James W Cash, John M Booker, Jerry F Wood, Norman C DenningNae NoneAbstaining Frank B Holding23 Town of Princeton - Request for Funds for Recreation ParkIn response to a request from the Town of Princeton, Commissioner Frank B Holdingmoved the County approve a grant in the amount of 21,500 to offset the remaining cost ofrebuilding Princeton Recreation Park, and that the appropriate budget amendment be made from thecontingency fundCommissioner John M Booker seconded themotion which carried by unanimous vote24 Districting Resolution AmendedIt was called to the Boards attention that the Johnston County Board of Elections, onAugust 28, 1990, changed the name of the Smithfield precinct previously known as WestSmithfield to South SmithfieldConsidering this information, Commissioner John M Booker moved the resolution titledRESOLUTION CALLING REFERENDUM TO ALTER THE STRUCTURE OF THE BOARD, adopted earlier this date,be corrected in Item 2, under District 5, to read, South and East Smithfield precinctsCommissioner Jerry F Wood seconded the motion which carried by unanimous voteNOTE Reference Item #18, Resolution -
