Johnston County Board of EducationAt a meeting of the Board of County Commissioners of Johnston County, held on the7 day of October, 1963, the following members were present, the same being a quorumof said board Messrs H M Johnson, Chairman, Jesse H Austin, Jr, Norman C Denning, J D Bailey and Frank B HoldingThe following resolution was offered by Mr J D Bailey and seconded by MrNorman C DenningResolved by the Board of County Commissioners of Johnston County1 That for properly maintaining a six months school term in District No -Township, School, County, as required by Article IX, Section 3, of theConstitution of the State of North Carolina, it is necessary that certain improvementsbe made therein of the following character2 That in order to provide said improvements it is necessary that the sum ofForty Thousand Dollars 40,00000 be obtained by borrowing the same to be used bythe County Board of Education of Johnston County for said purpose3 That the Board of County Commissioners of Johnston County does hereby approveof and authorize the application for, and procurement of a loan for said purpose fromthe State Literary Fund of the State of North Carolina, established and operated underj III, C S 5683 -5687, the same being Article 24, Chapter 136, Public Laws 1923, andChapter 115, Public Laws, 1937, and 1955 Session Laws, Ch 1372, Art 11, and said Boarddoes hereby authorize and direct that all necessary steps be taken to procure saidloan under the terms of said statutes, and the rules and regulations of the StateBoard of Education governing the making of loans from said fund, and the Chairman andClerk to this Board are hereby authorized, empowered and directed for and on behalfof this Board to join with the County Board of Education of Johnston County in makingthe necessary application therefor, and to take such action under this resolutionand under said statutes, rules and regulations as may be necessary for said purposeThe county accountant is hereby authorized and directed to make application to TheLocal Government Commission for approval of the issuance of such notes4 That the Board of Commissioners of Johnston County hereby agrees to levy,at the appropriate tax levying period in each and every year, upon all taxable propertyin said county, ad valorem taxes at a rate sufficient to meet the interest and principalpayments on such part of the loan requested herein as may be approved by the StateBoard of Education, and thereby provide the funds necessary each and every year tomeet the repay the interest and principal payments due on such approved loan, under theterms of the statute by authority of which the said loan is made, and in accordancewith the rules and regulations of the State Board of Education governing such loans,as found in Book 10, pp 340 and 368, of the minutes of the said State Board of EducationThe resolution was duly adopted by the following voteThose voting in the affirmative were J D Bailey, condemnedthe mattresses in the jails -Commissioner Frank B Holding moved that W H Williford and Jesse H Austin, Jr,acting in a supervisory capacity, be authorized and directed to purchase approximately36 mattresses for the jailCommissioner Norman C Denning seconded the motion, which was carried5 Welfare DepartmentCommissioner J D Bailey moved that the Board concur in the action of theWelfare Board in adjusting the salary of Mrs Edith Park, who succeeded Bruce D Palmeras Acting Director of the Welfare Department on September 20, 1963Further moved that Mrs Edith Park, Acting Director of the Local Welfare Depart-ment, be raised three grades above her present salary range, amounting to a monthlysalary of 54300, effective September 20, 1963 and continue as long as she assumesthe responsibilities of Acting Director of the Welfare DepartmentCommissioner Norman C Denning seconded the motion, which was carried6 Mental Health ProgramUpon the recommendation of Dr Robert D Phillips, Commissioner Frank B Holdingmoved that 5000 be appropriated from the contingent fund and transferred tc theMental Health account for the purpose of defraying miscellaneous operational Clerk, beauthorized and directed to investigate county buildings insured under the Public andInstitutional Policy Plan and make a quarterly report of the same to the NorthCarolina Fire Rating Bureau preservaties and cleaning materials4 The price herein named contemplates the work to be done during regular workinghours on regular working days of the trades involved except as specified below Onall emergency calls, the Purchaser is to pay in addition to the contract price, thetravel time and travel expenses of the mechanic to and from the job If overtime worknot included in this contract is requested by the Purchaser covering examinations, oremergency call back service, the Corporation will absorb the hours worked at singletime rates, and the Purchaser will compensate the Corporation for overtime bonus hoursonly at the Corporations usual overtime rate5 It is understood, in consideration of our performance of the service enumeratedherein at the price stated, that nothing in this agreement shall be construed to meanthat the Corporation assumes any liability on account of accidents to persons or propertyexcept those directly due to negligent acts of the Corporation or its employes, and thatthe Purchaserb own responsibility for accidents to persons or properties while ridingon or being on or about the aforesaid equipment referred to, is in no way affected bythis agreement The Corporation shall not be held responsible or liable for any loss,damage, detention, or delay caused by accidents, labor troubles, strikes, lockouts,fire, flood, acts of civil or military authorities, or by insurrection or riot, or byany other cause which is unavoidable or beyond its control, or in-any event for con -sequential damages No work, service or liability on the part of the Corporation,other than that specifically mentioned herein, is included or intended This contractshall constitute the entire agreement for the service described, and all prior represen-tations whether written or verbal are merged herein6 This service will be furnished from October 1, 1963 at the price herein named,and will continue until terminated as provided herein Either party may terminate thisagreement either at the end of the first one year- from October 1, 1963, or at the endof any subsequent year by giving the other party ninety 90 days prior written notice7 The price of this service as herein stated shall be THIRTY -EIGHT AND 501100Dollars 350 per month, payable monthly upon presentation of invoiceThe purchaser shall pay as an addition to the price herein quoted the amount of anytax based on sales made hereunder, imposed by any law enacted after the date of thosproposal The foregoing price shall be adjusted yearly by the percentage of increaseor decrease in the straight time hourly rate for elevator examiners in the localitywhere the equipment is inspected on the yearly adjustment date as compared with thestraight time hourly rate for elevator examiners on the 24th day of September, 1963For the purpose of this agreement and subsequent adjustments, the straight timehourly rate for elevator examiners, shall equal the actual hourly rate paid to theelevator examiners plus the fringe benefits granted in lieu of, or in addition to,hourly rate increases Fringe benefits imclude, but are not limited to, pensions,vacations, paid holidays, group life insurance, sickness and accident insurance, andhospitalization insuranceThe adjustment in price resulting from the foregoing price adjustment provisionshall not increase the contract price to more than the maximum price permitted by anyapplicable, legally issued government regulation in force on the date that the adjust-ment becomes effectiveThese adjustments shall be made as of the first day of October 1964 and as of thefirst day of October of each year thereafter8 This proposal shall become a valid contract only when accepted by the Purchaser,,and subsequently, when approved by an authorized representative of the Corporation Noagent or employe shall have the authority to waive any clause of this proposal9 The Corporation reserves the right to discontinue this service at any time,without
