OF RELATINGTO TAX COLLECTIONWHEREAS, the governing body of Johnston County has found and determined that it is inthe public interest and for the public benefit to provide for the collection by Johnston Countyof ad valorem taxes levied by the town; andWIGS, the County Commissioners believe that Johnston County has the means to providefor the collection of the ad valorem taxes levied by the town; andW EMW, the County Commissioners have examined and approve of a contract whichprovides for said County collection of town ad valorem taxes and details the legal relationshipand duties of the Statutes, Chapter 160A, Article 20, Part 1, whereby theCounty shall collect the ad valorem taxes duly and lawfully ordained and levied by the governingbody of the Town2 Methods and Procedures The methods and procedures which shall be followed by theCounty and the Town to implement this undertaking shall be as followsa On or before the 1st day of July, each year, the governing body of the Town shallduly appoint the Tax Collector of Johnston County as the Tax Collector of the Town for the termhereinafter specified Said appointee is hereinafter referred to as the Tax Collectorb The Tax Collector shall perform on behalf of the Town those duties specified inNCGS Section 105 -350c The County shall provide the Tax Collector during the term of this Agreement suchassistants and employees as are necessary for said Tax Collector to accomplish his duties tocollect the taxes of the Townd Except as expressly provided herein, the governing body of the County shall havethe sole and absolute authority to make any and all elections, determinations and decisions forthe Town that the governing body of the Town is authorized to make pursuant to Articles 21, 26,27 and 28 of Chapter 105 of the North Carolina General Statutes and shall perform all actionspertaining to, or ancillary to, tax collection which are required by said governing body bySubchapter II of Chapter 105, NCGS, to include1 accounting rules ofthe County, except that the following special procedures shall apply to the extent that they arenot inconsistent with said General Statutes1 Separate bonds shall be given by the Tax Collector, one in his capacity as theCounty Tax Collector and one in his capacity as the Town Tax Collector Separate bondsshall also be given by such of said Tax Collectors Assistants and Clerks as may bedesignated by each of the taxing units so that said persons may be held to properlyaccount to and settle with each taxing unit as provided by law Each taxing unit shallapprove those bonds given for its protection and shall pay the premium requiredtherefore2 Records maintained by the Tax Collector shall show separately the amount collectedon behalf of each taxing unit, and such records shall be available at any time3 Only one tax bill shall be mailed by the Tax Collector to a taxpayer within thepurview of this Agreement, whether that taxpayer owes taxes to either of the taxingunits or to both In the event of a partial payment, the amount of such payment shallbe credited to each taxing unit pro rata in the proportion to each units share of thetotal amount of taxes owed4 The County shall remit to the Town any and all sums, to include principal,penalties, interest, etc, collected under this Agreement on behalf of the Town for thei551current and previous tax years, except that the County shall retain any compensationdue from the Town as more specifically provided herein5 The County shall be compensated by the Town to the sum of 20 or as amended bymutual agreement of both parties of all ad valorem related funds collected on behalfof the town6 Penalties and interest collected, proceeds recovered from tax foreclosures andsales pursuant thereto, and discounts, settlements, or compromises allowed shall beapportioned between the County and the Town in proportion to each taxing units shareof the principal amount which was the basis of said collection, recoveries, orallowances7 The Town may, at its own expense, provide for a audit of the records relating totaxes owed the Town and collected on its behalf by the Tax Collector8 The Tax Collector shall remit to the Town Treasurer all taxes, penalties, andinterest due the Town collected by him whenever the amount due the Town exceeds OneThousand Dollars 1,000 but in no event more frequently than once per day subject tothe reimbursement provision of this Agreement9 Unlisted property placed upon the tax scroll of the County shall, if taxable by theTown, likewise be placed upon the tax scroll of the Town10 The town shall advise the County as to whether a taxpayer resides in the townlimits and should be assessed town taxes The town shall be responsible to periodicallycheck taxpayers records and assist the County tax office in correcting records Nolater than May 111 The town shall be responsible for determining if a refund is due any taxpayer uponappeal The County Tax Administrator shall assist in this by making recommendation inaccord with NC General Statute 105 -380 and 381 The County shall not be required torefund any fees charged to invoice and or collect taxes for the town12 All taxes becoming delinquent after the effective date of this Agreement shall bethe sole responsibility of the County All taxes owed to the Town prior to theeffective date shall be the sole responsibility of the Town The County will use thesame diligence and effort to collect taxes owed to the Town as it does to collect taxesowed to the County If a delinquent tax bill is due to both the County and the Town,foreclosure and other enforcement actions shall be in the name of both The cost of anylegal action shall be borne by each taxing unit in proportion to its share of the totaltax bill delinquent3 Duration This Agreement shall endure so long as the parties hereto exist and havethe power to make and maintain such an agreement, unless this Agreement is sooner terminated ashereinafter provided This agreement may be terminated by either Governmental Body effective atmidnight on June 30 of any given year provided written notice is given no later than March 1 ofthe same year4 Appointmentsa The appointment of the County Tax Collector as the Tax collector of the Town shallbe made by the governing body of the Town in accordance with the provisions of NCGS Section105 -349 The County Board of Commissioners by resolution shall approve such appointment Theappointment and its approval and acknowledge thereof will be entered into the minutes of thegoverning bodies of the parties heretob Appointments of all assistants, consultants, attorneys, or employees provided bythe County to implement this undertaking shall be made by the appropriate County officials andshall not be subject to the approval of the Townc The participation of the office of the Tax Collector of Johnston County in thisundertaking, except as otherwise provided by law or this Agreement, shall be under thesupervision of the Board of Commissioners of Johnston County and the County Manager, whichofficials shall have exclusive authority as provided by law to regulate and control theadministration of said officed The jurisdiction, authority, rights, privileges, and immunities including coverageunder the Worlunens Compensation Act which the officers, agents, and employees of the Countyenjoy within the territory of the County shall also be enjoyed by them within the Town when theyare acting pursuant to this Agreement and within the scope of their authority or in the courseof their
