The Johnston County Board of Commissioners met in special session Wednesday,November 28, 1990, at 7 oclock pm at the Clayton Fire Department, Barbour Street,Clayton, North Carolina, with the following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, James W Cash andJerry F Wood, DDSAbsent John M Booker, DVMAlso Present Richard B Self, County Manager, Eleanor N Creech, Clerk to theBoard, Joyce H Ennis, Deputy Clerk and Dewayne West, Director of Emergency ManagementThe Chairman called the meeting to order and opened the Public Hearing concerningthe designation of a fire taxing district for the service area known as Claytex Fire Districtif afI4{November 28, 1990 ContinuedPublic HearingAdvertised The Smithfield Herald - November 16, 1990Clayton News -Star - November 20, 1990Attendance Approximately 20 peopleChairman Norman C Denning recognized Fire Chief Larry Castleberry and stated thepurpose of the Public Hearing is to obtain citizen input concerning a fire tax in the ClaytexService District located outside the town of Clayton and served by the Clayton FireDepartmentThe Chairman called on Dewayne West, Johnston County Fire Marshall and Director ofEmergency Management to review the requirements of a service district and the authorizationunder NC General StatutesMr West outlined the criteria which fire departments must meet and state regulationsfor ISO ratings He explained the lower the rating the fire department receives, the greaterthe benefit to homeowners and commercial business within the district, relative to insurancepremiums He emphasized the added revenue from a district tax could enhance the quality offire service by providing additional and more up -to -date equipmentChairman Denning asked if anyone wished to address the BoardCommentsLarry Castleberry, Clayton Fire Chief, pointed out that Claytex has been anapproved fire district for many years and residents are already receiving insurance benefitsCosts for operating the department have been realized from the County appropriation, theState and Town of Clayton, as well as private donations and fund - raisers; a service districttax for fire protection would better distribute the operating cost among those receiving theservice He noted, on an average, the department receives more rural calls than city callsCommissioner James W Cash, resident of Claytex Fire District, remarked he has beenreceiving the service without contributing, except by donation, and welcomes the district taxas an opportunity to better support the fire departmentFireman John Tuttle emphasized the department needs the added revenue from thedistrict tax to replace some outdated equipmentIn response to a question from Fireman Ronald Barbour, Dewayne West noted that ifthe fire tax rate was set at 8¢100 valuation, the cost for property valued at 75,000 wouldbe 60 yearFire Chief Castleberry responded that he does not anticipate the department needingmore than a 5¢ fire tax and possibly lessChairman Denning explained the actual rate would be determined yearly by threeappointed commissioners who would be residents from the Claytex district, outside the townlimits He noted the law allows the fire tax rate to be set up to 15¢100 valuation, however,the Board and the Fire Association have agreed to limit the rate in Johnston County to notmore than 8o100 valuationThere being no further comments, Chairman Denning thanked everyone for attendingand closed the Public HearingUpon a motion made and duly seconded, the Board adjournedorman C Denning, ChairmanJ ce Ennis, Deputy ClerkDetailsAnnotationsEntry PropertiesModified11192013 30501 PMCreated3312003 84852 AMTemplateMinutesFieldsMinutes - TypeSpecialMinutes - Date11281990Book18
