-- - -- - - - - -- - - -- - -- - - - - -- December_ 3,_ 1962 - -- tCont - - - --Dr John R BenderDr, Ben W DawseyDr Lenox D BakerDr Jasper C JacksonDr Oscar S GoodwinDr Glenn L HooperDr D T RedfearnOn the motion of Dr Dawsey, which was duly seconded by Mr Jackson, the followingresolutions were passed creating the West Smithfield Sanitary District in JohnstonCounty, North Carolina, all in accordance with the provisions of Chapter 130, Article 12,General Statutes of North Carolina 1957 and 1959 cumulative supplementBE IT RESOLVED That the North Carolina State Board of Health, upon giving dueconsideration to the proposal to create the West Smithfield Sanitary District, JohnstonCounty, North Carolina, finds the following facts in relation thereto, to -witA That the petition, containing the names of over fifty -one per cent51 of the resident freeholders requesting the creation of saidsanitary district as prescribed by law, was filed with the Board ofCommissioners of Johnston County, North Carolina, and duly approvedby said BoardB The State Board of Health was duly notified through the Chairman ofthe Board of Commissioners of Johnston County; therefore, the StateHealth Director of the State of North Carolina and the Chairman ofthe Board of Commissioners of Johnston County, mutually set the dateand place for the public hearing to be held on November 5, 1962 at230 PM in the Sharon Baptist Church located within the boundarylines of the proposed sanitary district0 Notice of the joint public hearing was duly given by posting a noticeon the bulletin board at the Johnston County Courthouse and publishingfor four 4 successive weeks in The Smithfield Herald, a newspaperpublished in Smithfield, North Carolina, and having general circulationwithin the territory to be included in the proposed sanitary districtD That a joint public hearing was held by the Board of Commissionersof Johnston County, and representatives of the North Carolina StateBoard of Health, to -wit Mr X J Stevenson, Regional Engineer,and Mr D L Fox, Assistant Regional Engineer, Sanitary EngineeringDivision, upon the question of creating the Nest Smithfield SanitaryDistrict, Johnston County; the joint public hearing haying been heldin accordance with the publication of said notice on Monday, the 5thday of November, 1962, at 230 P M in the Sharon Baptist Churchlocated within the boundaries of the proposed sanitary districtE That at the said joint public hearing no opposition to the creationof the sanitary district was encountered Therefore, the Board ofCommissioners of Johnston County, and the representatives of theState Board of Health agreed that the creation of the Wrest SmithfieldSanitary District, should be approved The Board of Commissionersadopted a resolution to that effect Therefore, the representativesof the State Board of Health stated that they would recommend to theState Board of Health at their next regular meeting that the proposedWest Smithfield Sanitary District be approved and createdTHEREFORE, BE IT RESOLVED FURTHER, that in the opinion of the State Board of Healthof the State of North Carolina, the territory described in said petition should becreated as a sanitary district, and it is for the beat interest of the residents andinhabitants of the said district for the purpose of preserving and promoting the publichealth that the said sanitary district be created, and that same be and is hereby creat-ed and established as a sanitary district, all in accordance with and pursuant toprovisions of Chapter 130, Article 12, General Statutes of North Carolina 1957 and 1959cumulative supplementThe said district as described in the said petition and resolution heretofmrepassed-is hereby described and set out as follows to -witBEGINNING at a point at the mouth of Poplar Branch where said PoplarBranch enters Neuse River, it being on the lands of Bill Strickland;and the line runs in a southerly and westerly direction as the westand north bank of Neuse River passing under the bridge of U SHighway 70 and continuing to a point on the north bank of Neuse River,a corner between the lands of C 0 Heavner, Frank Holding, and thelands of Dr Ed Boyette, it also being a corner in the division ofthe J W Stephenson land between Ielllah Rook Stephenson and her sister,Mrs Herman Talton; and the line runs as the dividing line between theHeavner- Holding property and Dr Ed Boyette North 15 degrees 21 minutesEast 1000 feet to a corner; thence across the lands of Dr Ed BoyetteNorth 78 degrees 39 minutes West 2726 feet to a stake on the bank ofSwift Creek; thence along the east bend of Swift Creek in a northerlydirection to an iron stake a corner between the lands of Dr EdBoyette and Jesse Whitley; thence as Jesse Whitleys line and the?2_— -
