transacted1 The Clerk reported to the Board that the bond order entitled Bond Orderauthorizing the issuance of 11250000 School Bonds of the County of Johnston ,which had been introduced on September 5, 1961, had been published in The SmithfieldHerald on September 20, 1961, with notice that the Board of Commissioners wouldhold a public hearing thereon on October 2, 1961, at 11 oclock, in the forenoon,at the regular meeting room of the Board of Commissioners at the Courthouse, inSmithfield, North CarolinaR G Gurley moved that the Board proceed to hold a public hearing on the bondorder The motion was seconded by Frank B Holding and was unanimously adoptedAt 11 oclock A M, the Chairman announced that the Board would hear anycitizenror taxpayer who desired to be heard with respect to the bond order Atthe direction of the Chairman the Clerk read the bond order and the published noticeof hearingAfter the Board had heard all persons who requested to be heard, R G Gurleymoved that the public hearing be closed The motion was seconded by Frank B Hold-ing and was unanimously adoptedCommissioner R G Gurley moved that the following resolution be adoptedWHEREAS, the bond order entitled Bond order authorizing the issuance of01,250,000 School Bonds of the County of Johnston introduced at the meeting ofthe Board of Commissioners held on September 5, 1961, had been duly published withnotice of hearing thereon and the Board of Commissioners has, at the time and placespecified in such notice of hearing, heard any and all citizens and taxpayers whodesired to protest against the issuance of the bonds, and such hearing has beenclosed; andWHEREAS, the County Auditor has, by direction of the Board of Commissioners,filed in the officecC the Clerk of the Board of Commissioners a statement of debtincurred or to be incurred for school purpose under bond orders either introducedor passed, complying with the provisions of the County Finance Act, and such state-ment so filed shows that the net indebtedness of the County is 329 of the assessedvaluation of property in said County as last fixed for County taxation; NOW, THERE-FORE,BE IT RESOLVED by the Board of Commissioners of the County of Johnston asfollows1 The bond order entitled Bond order authorizing the issuance of 1,250,000School Bonds of the County of Johnston , introduced at the meeting of the Board ofCommissioners held on September 5, 19611 is hereby adopted without change or amend-ment2 The Clerk of the Board of Commissioners is hereby directed to cause acopy of said bond order to be published with the statement as to its adoption pre-scribed by The County Finance Act in The Smithfield Herald, a newspaper publishedin Smithfield in said County, and such publication shall be made in the mannerprescribed by The County Finance ActThe motion having been duly seconded by Commissioner Frank B Holding, it wasunanimously adoptedCommissioner R G Gurley moved that the following resolution be adopted;WHEREAS, the Board of Commissioners adopted on October 2, 1961, the bond orderentitled Bond Order authorising the issuance of 1,250,0J0 School Bonds of theCounty of Johnston authorizing the issuance of 1,2500,000 School Building Bondsand the indebtedness to be incurred by the issuance of such bonds and the tax to belevied for the payment of such bonds, and said bond order should be submitted to thevoters of the County of Johnston for their approval or disapproval in order tocomply with the Constitution and Laws of North Carolina; NOW, THEREFORE,531October 2, 1961 contRtBE IT RESOLVED by the Board of Commissioners of the County of Johnston asfollows1 The question whether the qualified voters of the County of Johnston shallapprove rove 1 the indebtedness to be incurred by the issuance of thePP or disapprovebonds of the County of Johnston authorized by said band order, and 2 the levy of atax for the payment thereof, and 3 said bond order shall be submitted to thequalified voters of the County of Johnston at a special election to be held in saidCounty on November 7, 19612 The Clerk of the Board of Commissioners is hereby authorized and directedto publish a notice of said election which shall be in substantially the followingformCOUNTY OF JOHNSTON, NORTH CAROLINANOTICE OF SPECIAL ELECTIONNOTICE IS HEREBY GIVEN that a special election will be held in the County ofJohnston, North Carolina, on November 7, 1961, for the purpose of submitting to thequalified voters of said County the question whether they shall approve or disapprove1° the indebtedness to be incurred by the issuance of bonds of said County of themaximum principal amount of 1,250,000, and 2 the levy of a tax for the paymentof such bonds, and3 the bond order entitled Bond Order authorizing the issuanceof 1,250,000 School Bonds of the County of Johnston adopted by the Board ofCommissioners on October 2, 1961, to authorize the issuance of said bonds and thelevy of such tax The bonds are authorized to finance the cost of constructingin the Johnston County School Administrative Unit, several new buildings to be usedas school houses, school garages, physical education and vocational education build-ings, teacherages and lunchrooms and other school plant facilities and to enlarge,by the erection of additions, several existing buildings located in such unit andused for such purposes, and to acquire land, furnishings and equipment necessaryfor such new or reconstructed or enlarged buildingsThe ballots to be used at said election shall contain the words For the bondorder authorizing 1,250,000 bonds to finance the cost of constructing, reconstruct-ing and enlarging, to the Johnston County School Administrative Unit, several build-ings used and to be used as school houses, school garages, physical education andvocational education buildings, teacherages and lunchrooms, and other school plantfacilities and of acquiring the land, furnishings and equipment necessary therefor,and a tax therefor and the words Against the bond order authorizing 1,2509000bonds to finance the cost of constructing, reconstructing and enlarging, in theJohnston County School Administrative Unit, several buildings used and to be usedas school houses, school garages, physical education and vocational education build-ings, teacherages and lunchrooms, and other school plant facilities and of acquiringthe land, furnishings and equipment necessary therefor, and a tax therefor, withsquares opposite the affirmative and negative forms in one of which squares thevoter may make a mark X to indicate his choiceIn the event that a majority of the qualified voters shall vote to approve theincurring of such indebtedness and the levy of such tax, said bonds shall be issuedand a tax shall be levied for the payment of such bondsThe polls for the election will open at the hour of 630 oclock A M and willclost at the hour of 630 oclock P M, Eastern Standard Time The election willbe held at the same polling places at which the last election was held in JohnstonCounty for the election of ire tubers of the General AssemblyThe registration books shall be opened for the registration of voters at 900oclock A M, on Saturday, October 14, 1961, and shall be closed at sunset on Sat -urday, October 28, 1961 On each day Sundays excepted during such period, theRegistrar for each election precinct in the County will keep his book open betweenthe hours of 900 Oclock, A M, and sunset for the registration of voters in suchelection precinct On each Saturday during such period each Registrar will attendat the polling place in his election precinct between the hours of 900 oclock AMand sunsetfor the registration of votersBy order of the Board of Commissioners of the County to the State HighwayCommission4 Fletcher Futrell, of Pine Level, N C requested assistance in the paving ofRoads 2325 and 2326 in Pine Level Township Request was referred to the State High-way Commission5 H F Palmer, Negro Agricultural Agent, introduced Onuoha Ache MBA, Agricultir alOfficer in the Ministry of Agriculture, of Enugu, Nigeria; and Melville FrancisHarris, Sr, Deputy Register of Extension for the Province Department of Agricultureand Commerce, of Monrovia, Liberia A brief exchange of ideas ensued between themembers of the Board and the visitors with all parties gaining insight into theproblems and responsibilities confronting each The visitors were extended a cordialInvitation to enjoy the facilities of the county and revisit our county when theopportunity presented itself6 Commissioner Frank B Holding moved that the resignation of Clifton L Woodlief,Assistant Agricultural Agent, be accepted, effective October 14, 1961Commissioner Floyd G Price, Sr seconded the motion, which was carried7 The request of Jesse L Parrish, of R #3, Selma, N C, asking for financialassistance was referred to the Johnston County Welfare Department8 Upon the request of L P Creech, Veterans Service Officer, Commissioner FrankB Holding moved that 2400 be appropriated from the contingent fund and transferredto the clerical fund of the Veterans Service Department for the purpose of paying02400 for clerical services rendered in that departmentCommissioner J D Bailey seconded the motion, which was carried9 The following bids for the installation of self- service elevator in the moved that the bid of WestinghouseAlectric Corporation, Elevator Division, low bidder in the amount of 22,213 00,be accepted, subject to the final approval of Harry McGee, Architect and W RBritt, County Attorney Those voting in favor of the motion were CommissionersR G Gurley, Frank B Holding and J D Bailey Voting Naye Commissioner Floyd CPrice, Sr11 Harry McGee, Architect, exhibited floor plans of the proposed AgriculturalBuilding, stating that formal specifications and plans would be available in two orthree weeks12 William B Wellons, Attorney, protested the unsatisfactory condition of the fair conditioner in the courtroom, which was recently installed by Berger- Jones, Incof Wilson, under the supervision of Robert C Browning, Consulting EngineerMr Wellons reported that due to the noise the air conditioner made that it wasimpossible for the court to function properly while it was running As a result ofthis formal complaint, W, G Massey was directed to write Mr Browning and requestthat he take immediate steps to remedy this problem13 Dr Robert D Phillips, County Health Director, made a verbal report of theactivities and program being outlined by his department, requesting funds be madeavailable for payment to George Edward Jackson recently employed as a Sanatarianin the Health Department533October 2, 1961 ContFCommissioner R G Gurley moved that 280000 be appropriated from the adjust- E`ment fund of the Health Department and transferred to the salary clerical accountfor the purpose of paying to George Edward Jackson, Sanatarian, 28000 per month,effective September 1, 1961Commissioner Frank B Holding seconded the motion, which was carried14 Wilson Diggs Broadwell made a verbal report on the activities of the CivilDefense Program and also brought to the attention of the Board the increased int-erest in the building by the citizens of the county bomb shelters In response tohis request, he was advised that it did not appear at thiO time that the countywould be able to include in the Agricultural Building space for a bomb shelter15 W H Britt, Auditor, presented the members of the Board, on behalf of DanielG Matthews, certified Public Accountant, a report of the examination of accountsof the Clerk of the Superior Courts office as of June 1, 1961 A copy was leftwith each member for their study16 L P Creech, Veterans Service Officer, discussed with the Board the problemof assisting citizens of the county in filling out Class Q Allottments and request-ed financial assistance to aid in this work, stating that his office would continuethis service if funds were made availableCommissioner J D Bailey moved that 10400 be appropriated from the contin-gent fund for the purpose of enabling L P Creech, Veterans Service Officer, atthe rate of 800 per day for each week, to #employ clercial help based on a three imonths periodCommissioner Floyd C Price, Sr seconded the motion, which was carried17 The statement of William Moore Weber, Architect, Raleigh, N C, in the amountof 37251, representing submission of plans and specifications for heating and airconditioning work of the Johnston County Health Center based on the rate of 45x 8278,00o low bid, submitted by the Holloway Air Conditioners of Four Oaks, waspresentedThe Board took the position that the estimate by Mr Weber was so far out ofline with the bid received that the bill for services received was too high, andthat W G Massey, Clerk, be directed to advise him to that effect18 Commissioner J D Bailey moved that William Moore Weber, Architect, be paid20250 from the adjustment fund of the Health Center, based on the rate of 46x 450000, original estimate of Mr Weber for the air conditioning of the HealthCenterCommissioner R G Gurley seconded the motion, which was carried19 W R Britt, County Attorney, gave a report on the progress being made by himand W H Britt, Auditor, in the plans and specifications for the revaluation ofthe County W H Britt, Auditor, reported that he had been able to define themapping areas with the assistance of William Ragsdale, the towns of Four Oaks,Smithfield, Selma, and Clayton, advised the Board that he, with the assistance ofthe County Attorney, would have available complete plans and specifications forthe Board by October 10, 196120 W R Britt, County Attorney, discussed plans for making available to theMoccasin Creek Water Shed Authority a loan of 0500000 promised by the County forthe payment of initial work for the establishment of this project, advising theBoard that this fund should come from non tax revenue of the general fund Headvised the Board that he would continue to investigate the source from which thesefunds should come and report to the Board at their next meeting21 W R Britt, County Attorney, stated that some of the used automobile dealerswere questioning the validity of resolution adopted by the County on August 4, 1958applying to used automobile car dealers and also reported progress being made byMr Upchurch in the collection of taxes in Clayton through garnishee proceedingsHe was requested to secure from the Attorney General a ruling as to the validityof the resolution adopted by the Board in reference to imposing a 30000 depositby used automobile car dealers where it was questionable whether they were operat-ing on full time or seasonable22 The daily reports of G R Britt and C D Stanley, Deputy Tax Collectors,were ordere filed23 The road petition of Delma Adams, Four Oaks, N C, R #3 was filed and referredto the State Highway Commission24 Agreements of the Strickland Cross Roads Fire Department, Inc and the Thanks-giving Fire Department, Inc as executed by said fire departments in compliancewith resolutions and recommendations of the rural fire protection committee and theJohnston County Fire Commission to the Johnston County Board of Commissioners asadopted by the Board on October 5, 1955 were presented for approval534October 2, 1961 ContitCommissioner J D Bailey moved that the Strickland Cross Roads Fire Depart-ruent, Inc and Thanksgiving Fire Department, Inc according to the proposal asexecuted between the said Departments
