Upon presentation of bill by Robert C Browning, Consulting Engineer, Raleigh,N C, who stated that the rewiring of the courthouse annex Thornton Building wasover 50 completed, Commissioner R G Gurley moved that R C Browning, ConsultingEngineer, Raleigh, NC, be paid 20040,representing clans and s ecifications fornew electrical wiring for the Thornton Building in the amount of 179110 andinspection of construction to dais on the above project in the amount of 2100Commissioner Floyd GPrice, Sr, seconded the motion, which was carried5 Commissioner R G Gurley introduced the following resolution and moved thatit be adoptedResolution Designating the Boundaries of the Bentonville Fire DistrictiWhereas at a regular meeting of the Board of County Commissioners of JohnstonCounty, convened and held on November 7, 1960, the matter of fixing and declaringthe boundaries of the Bentonville Fire District was duly presented to the Board;and it appearing to the Board that the Bentonville Fire Department has complied withthe provisions of resohttion provding for the establishment of fire districts inJohnston County, which was duly adopted by the Board of County Commissioners onOctober 3, 1955; has met the minimum requirement for personnel and equipmentrequired by said resolution, and is receiving financial assistance from the County,and the Bentonville Fire District having been fixed and established by metes andbounds, and duly submitted to the County Board of Commissioners for approval;Now, therefore, be it resolved that the boundaries of the Bentonville FireDistrict to be served by permitted to place sign on courthouse grounds in recognition ofcontributions made to the T B Association7 The complaint of E W McCullers relative to suit for non - payment of taxesfor the ,years 1956 and 1957 on 32 acres in Clayton Township, which Mr McCullersstated was sold to H G Carpenter prior to 1953 was referred to Rhetta Martin,Tax Attorney, for adjustment8 The request of Needham Munden to out hardwood on the County Home propertyapproximately 100 yards from his home was referred to C W Tarlton, County Agri -cultural Agent, for disposition9 Mir Dayton Poole, representing the General Services Agency Inc in Clayton andMr Fred Benton, Assistant Manager, Travelers Indemnity Company, presented a planfor providing a blanket bond for all employees of the County, excepting electiveofficers and those required by statute to furnish bonds at an additional premiumcost of 28597 in lieu of the cost of 27500 the County is paying for the presentcoverage of employees In addition, the employees would be covered up to an amountof 10,000 each including faithful performance of duty and would automaticallycover all cases of changes in employees10 After discussion, W H Britt and W G Massey were appointed to contact thecurrent agencies representing the various bonding companies relative to the aboveproposal and present the Board with their recommendations at their next regularmeeting11 The complaint of W B Stanley, R #2, Four Oaks, N C in connection with ecertain road in Ingrams Township was referred to the State Highway Commission forinvestigation12 Plans for the renovation of the Wellons office in the Thornton Building weredferred until the next regular meeting13 The request of Sarah Ann Butts for additional office space formerly occupiedby the State Highway Patrol was deferred until the next regular meeting14 Wilson Jigas Broadwell, Civil Defense Director, gave a verbal report of hisactivities of the Civil Defense program, and upon his request the Board of CountyCommissioners proclaimed December 7, 1960 as Civil Defense Day15 Commissioner R G Gurley moved that Rayford G Oliver be reappointed Chair-man of the Board of Trustees of the Johnston Memorial Hospital and that Dr R EEarp and Jesse Austin be reappointed me -nbers of the Board of Trustees of JohnstonMemorial Hospital for a term of six years, expiring October 1966Commissioner J D Bailey seconded the motion, which was unanimously carried16 Commissioner J D Bailey moved that the bond of Charles 0 Woodall, DeputySheriff, in the amount of 200000 with the National Surety Company be approvedCommissioner R G Gurley seconded the motion, which was unanimously carried17 The following legal opinion was submitted by T W Bruton, Attorney General,in response to been referred to this office by Mr R Eugene Brown,Director of Public AssistanceIn your letter you state the followingThe Johnston County Board of Commissioners has requested that I obtainan Attorney Generals opinion In regard to OAA recipients paying taxeson property on which the County has a lien This question has arisenseveral times when the Commissioners were confused when the problem ofwhether to foreclose when taxes had not been paid when the county hasa lien on the property of an OAA client425November 7, 1960 ContThe policy in regard to including taxes andupkeep in a public assistance budget wasexplained to the Commissioners However,they would like to know from the AttorneyGeneral whether or not a recipient would beexpected to pay the taxes in view of thelien or not,We advise that a recipient of old age assistance is legally responsible forthe payment of taxes on his property as any other propertyowner In cases wherethe recipient fails or refuses to pay the taxes assessed against his property,the county may foreclose on the property to enforce its lien for unpaid taxesWe have previously expressed the view that a lien for ad valorem taxes takespriority over the lien for old age assistance Therefore, in cases where therecipients property is sold to enforce the lien for ad valorem taxes, thetax lien and costs of the proceeding should be paid first out of the proceeds ofthe sale and the balance, if any, should be applied toward the satisfaction ofthe old age assistance lien, assuming that there are no other liens of record whichwould be superior to the old secondedby Mr Cecil Brown, that the Juros Grand Jurors compensation be increased toeight 800 Dollars per day, effective immediatelyA vote was taken and the vote was unanimous for the increasea Ralph CanadayForeman23 Ordered that the courthouse be closed on November 8, 1960 and on November 11,1960 in observance of Election Day and Armistice Dayrespectively24 In answer to a letter of Nrs Virginia V Bunn, Court Reporter, requestingpayment for the scheduled week of court beginning May 16,1960, W G Massey, Clerkwas directed to advise Mrs Bunn that the Commissioners after due Investigationfound that Mrs Bunn was notified Wednesday preceeding Monday, May 16,1960 thatthe court would not be held that week and further that her statement was notapproved by the Presiding Judge and that in view of these circumstances the Boardfelt disinclined to authorize payment of her billI25 W G Massey, Clerk, was authorized and directed to investigate statementof the Orthopedic Service Company of Raleigh in the amount of 4500, representingshort leg brace furnished Isaac DeWitt inmate of the Johnston County Jail onNovember 9, 1959, and report his findings to the Board at their next regularmeeting26 The offer and request of Mrs Lucy Rhodes Duncan to present to the County aportrait of the late H V Rose, who served as Clerk of the Superior Court ofJohnston County from 1926 -1959 to be placed n the Johnston Stanley and G RBritt, Deputy Tax Collectors, were filed28 The following resolution was adoptedRESOLUTIONWHEREAS, the North Carolina Association of County Commissioners, in recognitions,of the dynamic efforts and tangible effects of the program of Governor Luther HHodges in inviting and promotion industry in the State of North Carolina, adopteda resolution at their annual meeting in Morehead City, requesting that Governordesignate an Industry Appreciation Week and celebrated during the fall of theyear, andWHEREAS, Governor Luther H Hodges has designated and proclaimed the weekof November 28- December 3, 1960, as Industry Appreciation Week in North Carolina;NOW, THEREFORE, the Board of County Commissioners of Johnston County joinGovernor Hodges in proclaiming the week of November 28- December 3, 1960- as INDUSTRY ?APPRFCIATION WEEK IN JOHNSTON COUNTY, and takes this meens of expressing to theindividuals, firms and corporations who have either organized or located in ourCounty their deep appreciation for the fine worthwhile contribution they have madeto the economic and social life of our County, and urge the citizens of the variouscommunities to continue to cooperate, foster, encourage and promote the industriallife of our economy in order that Johnston County can continue to lead in providinga balanced economy for its citizens29 In response to a request of Mr J It Gardner, of Smithfield, N C, relativeto a drainage problem on his property located on the outskirts of Kenly, W GMassey, Clerk, was directed to request the State Highway Commission to give consid-eration to the drainage problem confronting Mr Gardner and render him everypossible assistance, in order for him to make certain improvements on same30 The following reports were filed with the
