NorthCarolina Industrial Facilities andPollution ControlFinancing Authority-to Finance-the Project and Approval of theProjectAt 1000 am, the Chairman of the Board of Commissioners for the County of Johnstonthe Board announced that the Board would proceed to hold a public hearing and would hearanyone who wished to be heard on the proposed issuance by the Johnston County IndustrialFacilities and Pollution Control Financing Authority the Authority or by The North CarolinaIndustrial Facilities and Pollution Control Financing Authority the NC Authority of not exceeding 1,500,000 aggregate principal amount of its qualified small issue industrial revenuebonds to pay all of a portion of the cost of the acquisition of land and an approximately 11,000square foot building located on Noble Street, Selma, Johnston County, North Carolina, and theacquisition and installation therein of equipment all to be used by the Company in manufacturingdried protein substances used in agriculture livestock foods and pet foods the Project The Project is to be owned and operated by Atlantic Coast Protein Corporation, an Iowacorporation the Company and is to be located wholly within Johnston CountyThe Chairman stated that the Authority had adopted a resolution expressing itsintention to issue qualified small issue industrial revenue bonds and authorizing the executionand delivery of a memorandum of agreement pertaining to the financing of the Project for theCompany The resolution provides that if the Company deems it to be economically desirable, theCompany may request that such bonds be issued by the NC Authority The Chairman then submittedcopies of the resolution and the memorandum of agreement to the BoardThe Deputy Clerk to the Board presented an affidavit showing publication in a newspaperof general circulation in Johnston County on a date at least 14 days prior hereto of notice ofthe public hearing The Chairman directed that the affidavit of publication be attached to thisextract of minutes as Exhibit AThe Chairman requested that the Deputy Clerk to the Board inquire in and around theCommissioners Chambers to determine whether there were any persons who wished to speak at thepublic hearing The names and addresses of the persons who were present and who offered commentson the proposed issuance of the qualified small issue industrial revenue bonds to finance theProject are as followsA list of persons who offered comments or delivered written testimony, and a summary ofsuch comments and testimony are appended as Exhibit BAfter the Board has heard all persons who had requested to be hear, Commissioner NormanC Denning moved that the public hearing be closed The motion was seconded by CommissionerJerry F Wood and was unanimously adoptedThe Chairman stated that under the Internal Revenue Code of 1986, as amended, the Boardmust approve the issuance of the Authoritys qualified small issue industrial revenue bonds, orthe NC Authoritys qualified small issue industrial revenue bonds, if the interest thereon isnot to be includable in the gross income of the owners thereof for purposes of federal incometaxation123July 1, 1991 of Commissioners for the County of Johnston the Board hascreated a political subdivision and body corporate and politic of the State of North Carolinaknown as The Johnston County Industrial Facilities and Pollution Control Financing Authoritythe Authority ; andWMEAS, the Authority is authorized under the Industrial and Pollution ControlFacilities Financing Act, Chapter 159C of the General Statutes of North Carolina, as amendedthe Act , to issue industrial revenue bonds for the purpose, among others, of paying all orany part of the cost of any industrial or pollution control project for industry; to acquire,construct, improve and equip any such project; and to make and execute financing agreements,security documents and other contracts and instruments necessary or convenient in the exerciseof such powers; andW EREAS, the Authority has determined to issue not exceeding 1,500,000 aggregateprincipal amount of its qualified small issue industrial revenue bonds to pay all or a portionof the cost of the acquisition of land and an approximately 11,000 square foot building locatedon Noble Street, Selma, Johnston County, North Carolina, and the acquisition and installationtherein of equipment all to be used by the Company in manufacturing dried protein substancesused in agriculture livestock foods and pet foots the Project , which Project is to be ownedand operated by Atlantic Coast Protein Corporation, an Iowa corporation the Company ; andW WREAS, the Authority intends to file an application for approval of the Project withthe Secretary of the Departmient of Economic and Community Development the Department , asrequired by the Act; andMEMEAS, the Department has, by regulation, provided that no application for approvalof a proposed project by the Department will be officially received until the governing body ofthe county from which the application is made has, by resolution after having held a publichearing, approved the issue of qualified small issue industrial revenue bonds and approved theproposed project and a certified copy of such resolution has been provided to the Department;andWH MEAS, pursuant to the North Carolina Industrial and Pollution Control FacilitiesPool Program Financing Act, Chapter 159D of the General Statutes of North Carolina the INCAct , certain counties of the State of North Carolina have created the North CarolinaIndustrial Facilities and Pollution Control Financing Authority the INC Authority to issueobligations to finance projects such as the Project, and Johnston County is or expects to becomea member of the NC Authority;VkHREAS, if the Company so determines that the issuance by the NC Authority of itsqualified small issue industrial revenue bonds is in the best economic interest of the Company,such bonds may be issued by the NC Authority;{MUMAS, the Project will be located wholly within Johnston County,WiRlEAS, the Board, pursuant to public notice duly given, has held a public enacted the North Carolina Industrialand Pollution Control Facilities Pool Program Financing Act, chapter 159D of the North CarolinaGeneral Statutes, as amended the Act which provides for the creation of a politicalsubdivision and body corporate of the State of North Carolina called The North CarolinaIndustrial Facilities and Pollution Control Financing Authority the Authority and empowersthe Director, Jim Caldwell,Manager of Selma, and Tim Broome, Engineer, met with the Board concerning plans for sewerservice along 70 -A between Selma and Wilsons MillsMr de Sherbinin explained an application has been submitted for an EDA grant to expandthe Utilicon project in addition to the CDBG grant already approved for water and sewer Herecommended the Board consider several engineering options, delaying any decision until theCounty hears from the EDA grant in late AugustTim Broome outlined the following three options1 A small pump station at Utilicon with a force main down Hwy 70 -A east to existingsewer service; would serve Utilicon only Cost 76,000 CDBG funds available2 Gravity sewer line down Hwy 70 -A to expand project to serve Utilicon, Hesco, andTransformer Sales Service by CommissionerFrank B Holding, seconded by Commissioner James W Cash and carried by unanimous vote, theBoard adopted the following resolutionRFSOLUTION AUTHORIZING E 0ION OF AN ANWALCONTRIBUTIONS CONTRACTMEMEAS, the Johnston County Housing Assistance Payments Program hereincalled the PHA proposes to enter into an Annual contributions Contractherein called the Contract with the United States of America, Department ofHousing and Urban Development herein called the Government NOW, THEREFORE, BE IT RESOLVED by the PHA as followsSection 1 The Contract, numbered Contract No A- 3554 -E, is herebyapproved and accepted both as to form and substance and the County Manager ishereby authorized and directed to execute said Contract in triplicate on behalfof the PHA, and the Clerk to the Board is hereby authorized and directed toimpress and attest the official seal of the PHA on each such counterpart and toforward said executed counterparts to the Government together with such otherdocuments evidencing the approval and authorizing the execution thereof as maybe required by the GovernmentSection 2 The Program Director is hereby authorized to file with theGovernment from time to time, as monies are required, requisitions together withthe necessary supporting document, for payment under the ContractSection 3 This Resolution shall take effect immediately14 HAPP - Authorization to Apply for Additional UnitsAnne Eason, HAPP Director, informed the Board funding is available through HUD for morerental assistance housing certificates She requested authorization to apply for 50 additionalunits for Johnston CountyCommissioner James W Cash moved that Anne Eason, HAPP Director, be authorized to applyfor 50 additional rental assistance housing units for Johnston CountyCommissioner John M Booker seconded the motion which carried by unanimous vote15 Control of Alcoholic Beverages and Controlled Substances on County PropertyCounty Manager, Richard Self, informed the Board the Smithfield Police Department hasrequested the Board adopt an ordinance controlling the consumption and display of alcoholicbeverages and controlled substances on County propertyCommissioner Frank B Holding moved that the County Attorney be instructed to draft anordinance prohibiting the consumption and display of alcohol and controlled substances on Countyproperty Commissioner Holding further moved that until such time the ordinance is prepared andadopted, the Smithfield Police Department be authorized to enforce the Town of Smithfieldsalcohol and drug use
