January 19, 19601 2Fit widthl+leeting of Board of Commissioners for the County of JohnstonJanuary 19, 1960The Board of Commissioners of Johnston County reconvened in special sessionon January 19, 1960, in the Auditors Office, at 730 P M, with the followingmembers P resentH i Johnson, Chairman, J D Bailey, R G Gurley, Frank B Holding, andFloyd C Price, SrAbsent NoneThe following business was transacted1 Mr R W Dawson, District Engineer, State Highway Commission, presentedthe 1959 -60 Secondary Road Plan for Johnston County of the North Carolina StateHighway Commission He reported briefly on each of the thirteen 13 projects,requesting that the road plan be approved or disapprovedCommissioner Floyd C Price, Sr moved that the Johnston County SecondaryRoad Plan for 1959 -60 as presented by R W Dawson, amounting in allocated fundsto 247,000 and covering thirteen 13 projects, amounting to 1995 miles of pavedroads, with a reserve fund of 520,e45 be approvedComrrdssioner J D Bailey seconded the motion, which was unanimously carried2 With the assistance of Daniel G Matthews, C P A, the report on examinationof accounts as of May 7, 1959 of H V Rose, Clerk of the Superior Court was review,ad with special attention being given to the following itemsa An item of 149577, which has been carried on the books for manyyears as an amount due from Z L LeMay, former Clerk,in settle-ment of his accounts at the expiration of his term of officeb The distribution of unallocated collections from the followingsourcesSuperior Court - CriminalSuperior Court - CivilRecorders Court CriminalRecorders Court CivilSpecial Proceedings0 24106532b680101902099773628863502TOTAL 7048324c The uncollected balances in the bills of costs which have been out-standing for a long period of time and which are as followsSuperior Court - Criminal 5215Recorders Court Criminal 31 1208TOTAL 3695423In the above cases, there is an undistributed balance of 21,43164d Cash bond deposits as shown on page 147 of the audit amounting to0295200 which have been forfeited and should be distributedaccording to lawA discussion followed concerning the aforementioned items and several avenuesof approach to the problems were suggested Mr Matthews recommended that the dis-position of unallocated funds could either be distributed on an individual basis,which would require clerical assistance, or by an act of the General Assemblydistributing the funds on a larcentage basisThe question also arose as to the procedure to follow in the collection ofoutstanding court costs, which are shown in Item CAs a result of the discussion, the following orders were adopted3 In view of cash bond deposits dating from 11 -24 -1944 to 4 -3 -57 in the Clerkof the Superior Court office, as appears in the audit of Daniel G Matthews ofthe accounts of H V Rose, Clerk of the Superior Court as of May 7, 1959, andwhich was brought to the attention of the Board by Daniel G Matthews, CommissionerR G Gurley moved that W H Britt, Auditor, bring these bonds totalling 295200to the attention of honorable Archie Taylor, Solicitor of the District, and requestthat he proceed to declare these bonds forfeited and that Mrs Nora p Southerland,Clerk of the Superior Court, be directed to pay these forfeitures to the schoolfundCommissioner J D Bailey seconded the motion, which was carried4 Commissioner J D Bailey moved that W H Britt, Auditor, b€ authorized anddirected to employ a person to work under his supervision and pay a salary commen-surate with salaries paid courthouse employees for the purpose cf clearing, con-37 8January 19, 1960 Cont aeluding and distributing unallocated funds of the various court cases, which werespecifically mentioned in the audit of Daniel G Matthews of the accounts of H VRose, Clerk of the Superior Court as of 1Iay 7, 1959 and appear on page 3 commentsof the report, with the understanding that W H Britt consult with Mr Matthewsrelative to procedure and accounting and provided that it meets with the approval `of Nora P Southerland, Clerk of the Superior CourtCommissioner Frank B Holding seconded the motion, which was carried5 WH Britt, Auditor, presented audit of the Town of Clayton for the year ending;June 3 0, 1959, which disclosed that the Town of Clayton was due Johnston County400183 from the funds collected by the Town of Clayton District Court fFCommissioner J D Bailey moved that W H Britt, Auditor, be authorized and I;directed to notify the Town of Clayton to pay into the County the following amount400183 representing fines and forfeited bonds and being the amount represented inthe audit as due Johnston County by July 1, 1960Commissioner Frank B Holding seconded the motion, which was carried6 Commissioner R G Gurley moved that J L George, County Attorney, be author-ized and directed to request the District Courts of the County to provide W HBritt, Auditor, a report of their annual audit which the law provides; and furtherto request that they pay into the county such funds as belong to the countyCommissioner Frank B Holding seconded the motion, which was carried7 Ordered that J L George, County Attorney, be requested to secure legal opin-ion from the Attorney General and Alex McMahon, Secretary and Counsellor of theNorth Carolina Association of County ComtTissioners for the collection of outstandingbalances due on bills of costs of the various courts reported in the audit of DanielG Matthews of H V Rose, Clerk of the Superior Court, as of May 7, 1959, which isspecifically mentioned on page 3 under general comments8 Daniel G Matthews submitted a report on examination of the Johnston CountyFire Departments for the year ended June 30, 1959, which was ordered filed withW G Massey, Clerk9 Commissioner Frank B Holding moved that the amount in order of the Board datedJanuary 4, 1960 authorizing Nora P Southerland, Clerk of the Superior Court, toinsure her employees under a blanket bond of 05,00000 be amended by striking outthe word 500000 and inserting in lieu thereof 610,00000Commissioner J D Bailey seconded the motion, which was adopted10 Daniel G Matthews commented briefly on the report he had prepared on accountsof the Justices of the Peace of Johnston County for the period ending June 30, 1959, -stating that, in his opinion, that several of the Justices of the Peace were notkeeping good recordsThere being no further business, the meeting was adjournedC irmanClerkG
