transacted1 Rhetta Martin, Tax Attorney, advised the Board that she had received an inquiryfrom Johnnie Hamilton, of Raleigh, concerning the purchase of two lots in Clayton,formerly owned by J R Moore, with taxes in the amount of 05576 due against saidlotsCommissioner J D Bailey moved that she offer the aforementioned two lots toMr Hamilton at a price of 2oo00Commissioner Floyd C Price, Sr seconded the motion, which was adopted2 L P Creech, Veterans Service Officer, was requested to supply W H Britt,Auditor, an inventory of county equipment that remained in his vacated officeslocated next to the Thornton Building3 W R Britt, Attorney, introduced Mr Sam Tarlton, official, and Mr N B 1Bragg, site specialist of the Department of Archives and History in Raleigh MrTarlton, acting as spokesman for the Department, requested thatthe Board recommendto the State Highway Commission the abandonment of a section of that certain roadwhich leads from Mill Creek and goes by the Harper House in Bentonville Townshipand the relocation of this road at approximately 600 feet east of the present intersection or crossroads, stating that the members of the Mill Creek Church and otherBentonville citizens had approved this relocation He cited the plans for theBentonville battleground showing the location of the proposed museum and proposedplans for parking and picnic areas and the restoration of the road to its originalform in 1865, stating that the property would be used extensively by school childrenand elderly people, and that if the present road was used it would prove to be ahazard to their safety Plans were made where the tenant house belonging to JakeDunn would be served from the proposed relocated road and stated that the matterhad been discussed with Mr DunnMr Bragg joined Mr Tarlton in stating that he had discussed the matter withthe Highway Commission and stated they took a dim view of paving a road that is ahazard to school children and that the relocated road would stand a better chanceof being pavedMr Jake Dunn, who was present when the request was made by Mr Tarlton,stated to the Board that he would contend for the road to retain its present locat-ion, and that the proposed relocation would involve his property as well as incon-venienoe those living near the Sampson County line He cited that several petitionshad been filed with the State Highway Commission to pave this certain road and urgedthat the Commissioners not to recommend abandonment and relocation of the road,asking that they make a self case of the propositionAfter a discussion, W G Massey, Clerk, was directed to request the HighwayCommission to make a recommendation concerning the abandonment and relocation ofthe proposed road4 M W Knott, of Clayton, reported that he had qualified for electrical inspect-or of Johnston County and was ready to assume his duties He was advised by the Board to commence immediately upon his duties and render prompt service5 Wilson Jiggs Broadwell, Civil Defense Director, gave a verbal report of theactivities of the Civil Defense program6 WA Creech, Attorney, accompanied by Mrs Bert Beasley, Chairman JohnstonCounty Historical Society, requested that the Board furnish the Society with a room,preferably in the courthouse, for the storing and safekeeping of historical dataand heirlooms now in the possession of the Society He was advised that this req-uest would be given consideration7 At 300 P M Chairman H M Johnson proceeded to open bids for the air -con-ditioning of the Johnston County courtroom The following bids were of Alt 1 as setout in Specifications and Contract Documents as prepared by Robert C Browning,Consulting Engineer, of Raleigh, N C, be awarded to Berger Jones, Inc of Wilsonat a contract price of 964700, with the understanding that the work be completedby June 1, 1960, and that the county be allowed to pay for the work by July 1, 1960Commissioner Frank B Holding seconded the motion, which was carried8 Lulu A Jolliff submitted a written report of cases processed by the JohnstonCounty Welfare Board covering a period from December 15, 1959 through January 19609 After a discussion with Mr Browning, Consulting Engineer, in connection withinstallation of a new electrical service for the courthouse, Commissioner Frank BHolding moved that Mr Browning be requested to present plans and specificationsfor electrical service to the courthouse, which would be designed to take care ofthe present congested current load, plus the contemplated air - conditioning unitwith provision for additional capacity for future needs of the courthouse, at therate of 4 of bid price for plans and specifications, plus an additional amount of1j for inspection Further moved that he make recommendation for service entranceto the Thornton BuildingCommissioner J D Baileysecohded the motion, which was carried10 At the request of the Board, Judge W IGodwin discussed with them the uncoll-ected bills of costs of the Recorders Court amounting to 31,41208, which wassubmitted in the audit of Dan G Matthews, in his audit of the Clerk of the SuperiorCourts office, and which cases J L George reported that the Attorney General hadruled were under the jurisdiction of the Johnston County Recorders Court JudgeGodwin stated that the court had made various attempts to collect these costs, butthat it seemed difficult to do He agreed to the suggestion of the Board that hework on 25 cases and report back to the Board on the progress he had made11 Upon the recommendation of W H Britt, Tax Supervisor, Commissioner Frank BHolding moved that the period of listing taxes be extended through February 6, 1960Commissioner R G Gurley seconded the motion, which was carried12 Ordered that the Johnston County Board of Education be allocated the suite ofrooms on northwest corner of the third floor of the courthouse, formerly occupiedby the Welfare Department, and that the room on the second floor adjoining theTreasurers office be allocated to the use of the Johnston County Treasurer13 Ordered that W H Britt, Auditor, be authorized and directed to designate tworooms on the second floor of the Thornton Building for use and oupaney by theNorth Carolina Department of Revenue and one room on the second floor for the useand occupancy of the Johnston County T B AssociationFurther ordered that room on the third floor of the east side of the courthouse,formerly occupied by the Johnston County T B Association, be allocated to theJohnston County Historical Society, and that the room adjoining occupied by theNorth Carolina State Department of Revenue be assigned to W H Britt, Auditor, forhis use14 It was brought to the attention of the Board that E J Wellons, Attorney, haddiscussed with a member of the Board a possibility of retaining his offices in theThornton Building, with the understanding that he would sell to the County`his,lotadjoining the Gaskin BuildingAfter a discussion of this matter, Chairman H M Johnson appointed Commission-ers Frank B Holding, R G Gurley and J D Bailey as a committee to negotiatewith Mr Wellons concerning the retention of the offices he is now occupying on arental basis and the sale of his lot to the County15• Upon the recommendation of Sheriff B A Henry, Commissioner R G Gurley movedthat water pump confiscated by the Sheriffs Department and now in the custody ofSheriff B A Henry be lent to the Archer -Lodge Rural Fire Department, provided thatit meets with the approval of the Johnston County Board of EducationCommissioner Floyd C Price, Sr seconded the motion, which was unanimouslyadopted16 Commissioner R G Gurley moved that resolution adopted by the Board of CountyCommissioners of Johnston County at a regular meeting of the Board on October 3,1955, which provides for the establishment of fire fighting organizations and dis-376February 1,,1960 Conttricts in the county be amended by adding to paragraph K of Section 4a of saidresolution the following clause; Except those departments which are located withinan incorporated town Commissioner J D Bailey seconded the motion, which was, unanimously adopted17 Commissioner Floyd C Price, Sr introduced the following resolution and movedits adoptionRES OLUTI ONWhereas, the 1959 General Assembly enacted into law Chapter 668, which actprovides for supervision of ADC grants in certain cases, andWhereas, the Federal Government has notified the State Board of Public Welfarethat if this law is used Federal funds will be cut off and,Whereas, Attorney General Malcolm B Seawall has challenged the federal rulingand is in the process of attempting to have it changed,Now therefore, be it resolved that the Board of County Commissioners of JohnstonCounty do hereby endorse the enactment into law of Chapter 668, Session laws of1959, and commend the integrity and efforts of Malcolm B Seawall, Attorney Generalof North Carolina, in attempting to secure recognition of this law by the Federalauthorities so that proper expenditures of ADC funds can be iisured, andBe it further resolved that he be requested to take whatever steps he deemsnecessary to effect the procedures as outlined in the aforementioned actCommissioner J D Bailey seconded the motion, which was unanimously adopted18 In order to enable the members of the Brogden Rural Fire Department, Inc toparticipate in the pension fund as provided by law, Commissioner R G Gurley movedthat H M Johnson, Chairman, Board of County Commissioners of Johnston County, beauthorized and directed to sign for and on behalf of the Board of County Commission-ers of Johnston County the following certification of the Brogden Rural Fire Depart-ment, Inc as of January 30, 1960CERTIFICATION OF THE FIRE DEPARTMENTBY ITS GOVERNING BODYWHEREAS, G S 118 -23 requires certification to the North Carolina Commissionerof Insurance as to firemen and fire departments in compliance with minimum condit-ions precedent to the eligibility of firemen and volunteer firemen for benefitsunder the North Carolina Firamens Pension Fund Act, the undersigned certifies tothe North Carolina Commissioner of Insurance that1 Brogden Rural Fire District, R#2, Smithfield, North Carolina, is a politicalsubdivision of this State having a bona fide fire department which operates fireapparatus and equipment of the value of five thousand dollars 5,00000 or more,and said fire department holds drills and meetings not less than four hours monthly;2 The persons named on the attached roster are regular andor volunteerfiremen of the fire department described in 1 above, and said firemen attend atleast thirty -six hours of all drills and meetings of said fire department in eachcalendar year3 This certification was duly approved and adopted by the governing bodyof Johnston County, North Carolina, at a meeting held on the 1 day of February,1960, and the
