W Cash and carried by unanimous vote, the Board set a public hearing for 1115 am,April 1, 1991, to hear further requests for renaming rural roads in Johnston County TheBoard specified that requests petitions must be submitted to the Planning Office by March 18,1991, in order to be heard at the April public hearing5 Rezoning Requests - - -- #010 - -- Clayton - Township,- Intersection of US 70 and SR_ 1570;Office - Institutional - to -- Light -- Industrial; - Norwood- Thompson; -ApplicantCounty Planning Director, Jeff Coutu, reported that after further consideration, thePlanning Board has recommended that rezoning request #010 by Norwood Thompson for nine9 acres at the intersection of US 70 and SR 1570 from 0 -I to I -1, be approved, based oncompatibility with the Johnston County land Use PlanUpon a motion by Commissioner James W Cash, seconded by Commissioner Jerry FWood and carried by unanimous vote, the Board approved rezoning request #010 from NorwoodThompson as recommended by the Johnston County Planning Board6 City of - Wilson - Expansion -- of - Buckhorn - ReservoirWilson Acting City Manager, Charles Pittman, and City Engineer and Director ofPublic Works, Bill Bartlett, met with the Board concerning plans to expand Wilsons Buckhorn jReservoir in order to meet the citys future water needs Mr Pittman explained the proposedexpansion would include flooding approximately 400 acres in Johnston County and requestedthe Board adopt a resolution authorizing the City of Wilson to acquire this land by Icondemnation It was explained that Johnston is one of a few counties in NC that hasspecial State legislation which prohibits other local governments from acquiring or condemningproperty within Johnston County without permission from the Johnston County Board ofCommissioners31March 4, 1991 ContinuedMr Bartlett noted this acreage does not involve any homes and is mostly wet landsIt was pointed out the expanded reservoir would create a large body of water that shouldprovide the entire area with recreational advantages, within the limitations of State and EPAregulationsCommissioner John M Booker asked if the proposed increased water supply wouldservice towns other than the city of Wilson, noting the town of Kenly is partially in WilsonCountyMr Pittman responded that at the present time there are no plans for serving townsother than Wilson; however, this would probably be a future considerationChairman Norman C Denning commented on the loss of property tax revenue forJohnston County and questioned the actual tax value involved Mr Pittman offered to assistthe Johnston County Tax Department in identifying the exact acreage and corresponding taxvaluesFollowing discussion, the Board agreed to consider this request further at the nextregular meeting on April 1st7 Johnston Memorial Hospital — Financing- of New -Equipment Resolution AdoptedMelvin Edwards, Chairman of the Johnston Memorial Hospital Board of Trustees, andLeland Farnell, Hospital President, appeared before the Board requesting permission for thehospital to negotiate with lending institutions on financing up to 11 million to purchaseneeded equipmentCommissioner James W Cash, who also serves on the Hospital Board of Trustees,indicated the new equipment is needed to provide better care for Johnston County citizensand would generate additional revenue for the hospitalUpon a motion by Commissioner James WWood and carried by unanimous vote, the followingRESOLUTION OF THE BOARDJOHNSTON COUNTY, NCWHEREAS, Johnston Memorial Hospital is athe Hospital ; andCash, seconded by Commissioner Jerry Fresolution was adoptedOF COMMISSIONERSIRTH CAROLINApublic hospital owned by Johnston CountyWHEREAS, the Hospital has informed the Board of County Commissioners that itintends to purchase the equipment listed on Schedule A attached hereto, for a total cost notin excess of 1,100,000; andWHEREAS, the Hospital has determined that the equipment is needed in the operationof the Hospital and that the cost is reasonable; andWHEREAS, the Hospital proposes to finance the purchase price of the equipment overa period of approximately five years at a tax exempt interest rate, pursuant to alease purchase or an installment contract with a local lending institution; andWHEREAS, pursuant to such contract, the lender will advance the funds to purchasethe equipment and the hospital will repay the funds, together with interest, out of patientrevenues; andWHEREAS, the obligation to repay the funds will be secured solely by a securityinterest in the equipment and the revenues of and taxing power of the County will not beencumbered for the repayment of the funds; andWHEREAS, the Hospital has requested the authorization of the County to enter intothis financing transaction; andWHEREAS the County is willing to authorize the Hospital to enter into this financingtransaction, subject to the conditions that all statutory requirements relating to this type offinancing be followed and that the County shall have the right to review and approve theform, terms and conditions of the financing transactionNOW, THEREFORE, the Board of Commissioners of Johnston County hereby resolves asfollows1The Board of Commissioners of the County of Johnston hereby approves, in concept,the method of financing the purchase of the equipment proposed by Johnston Memorial32March 4, 1991 ContinuedHospital and authorizes the Board and officers of the Hospital to negotiate the terms andconditions of the proposed financing transaction with local lending institutions in order toachieve the most favorable tax exempt interest rate and terms and conditions in connection2That the final terms and conditions of the financing, and all documents relating tothe transaction, shall be presented to the Board of County Commissioners for approval, andthe Hospital shall carefully observe all statutory requirements relating to the transaction3Thatit is understood that neither the revenues northe taxing powerof the Countyof Johnstonshall be pledged or encumbered to securethe obligations ofthe Hospitalpursuant tothis financing transaction, and that only revenues of the Hospitalshall be usedto repay thefunds advanced by the local lending institutionin connection withthe financingtransactionThis resolution is adopted by the Board of County Commissioners of Johnston Countythis 4th day of March, 19918 Clayton Library Contract of Affiliation with the Public Library of Johnston Countyand ,- SmithfieldJoyce Mitchell, Director of the Public Library of Johnston County and Smithfield metwith the Board requesting the Countys approval to enter into a ten year contract ofaffiliation with Hocutt- Ellington Memorial Library in Clayton Mrs Mitchell explained that dueto restricted budget allocations, the NC State Library discontinued services to independentmunicipal libraries in July, 1990 Although the Clayton library and other municipal libraries inthe County have always been unofficially affiliated with the the Public Library, thisarrangement needs to be formalized in order for State Library services to be restoredUpon a motion by Commissioner Jerry F Wood, seconded by Commissioner John MBooker and carried by unanimous vote, the Board approved the following contract ofaffiliationLIBRARY CONTRACTThis contract, made and entered into this 4th day of March, 1991, byand between the Public Library of Johnston County and Smithfield herein theCounty Library and the Hocutt- Ellington Memorial Library Herein theHEM Library WITNESSETHWHEREAS, the County Library operates under the Chapter 153A,article 14 GA 153A -261 through GS 153A -271 to give library service to theresidents of Johnston County and the Municipality of Smithfield; andWHEREAS, the HEM Library operates to give library service to theresidents of Clayton and wishes to become affiliated with the County Libraryto have the benefit of additional services which the County Library canprovide11 THEREFORE, IT IS MUTUALLY AGREED THATThe County Library will furnish to the HEM Library the servicesset forth herein and in Appendix I, and any future amendments as agreed toby both partiesThe HEM Library will remain under the control of the Municipalityof Clayton and its Library Board of Trustees, and will continue as the agencyresponsible for providing library services for the residents of ClaytonThe HEM Library will be known as the Hocutt - Ellington MemorialLibrary, an affiliate of the Public Library of Johnston County and SmithfieldThe HEM Library will employ and supervise personnel of theHEM Library, whose salaries, retirement, social security and any otheremployee benefits will be paid with funds appropriated by the Municipality ofClayton or otherwise contributed to the HEM LibraryThe officials of the Municipality of Clayton will agree to sign theannual Maintenance of Effort Report and Declaration as required by the NCDepartment of Cultural Resources, Division of State Library, and as signed bythe officials of Johnston County and the Municipality of SmithfieldThe HEM Library will maintain the building and the grounds of theHEM Library, including major repairs or emergency repairs Any and allequipment and real property furnished by the Municipality of Clayton shallremain the property of the Municipality of Claytoniif133The HEM Library will provide for telephone service on the premisesfor the use by library staffThe HEM Library will be open for service a minimum of forty 40 hours per weekThe HEM Library will provide to the County Library the followingA copy of the HEM Librarys bylaws; monthly fiscal and statistical reports;two 2 copies of the annual audit by December 30 of the fiscal year followingthe audit year; and a copy of the new fiscal year budget by July 30 of thenew fiscal yearThe County Library will loan books, periodicals, and other librarymaterials to the HEM Library in such quantities as the Director of theCounty Library may determine, such materials to supplement materials alreadyowned or subsequently acquired by the HEM Library Materials loaned tothe HEM Library by the County Library will remain the property of theCounty Library Materials owned by the HEM Library may be loaned to theCounty Library or its units upon special request; such materials will remainthe property of the HEM LibraryThe County Library and the HEM Library agree to enter into thiscontract through a period ending June 30, 1991 Thereafter, in accordancewith the requirements of the NC Department of Cultural Resources, Divisionof State Library, it is agreed by the County Library and the HEM Librarythat the term of this agreement shall be for a period of ten 10 yearsbeginning July 1, 1991, with each party reserving the right to terminate theagreement after the ten 10 year period, upon giving written notice six 6 months prior to the date of termination The County Library and the HEMLibrary, upon giving six 6 months written notice, may extend this contractfor an additional ten 10 year periodBy this contract the HEM Library has agreed to certain termsrequired by the NC Department of Cultural Resources, Division of StateLibrary Nevertheless, both parties understand that apart from the partiesagreement to these terms as independent contractors, neither party herebyacquires any right of control, supervision or direction over the physicalfacilities, employees, or operation of the other The HEM Library willindemnify the County Library from any loss by virtue of any liability arisingfrom a transaction, act, omission or occurrence at the HEM Library facilityor in the operation of the HEM Library; and the County Library willlikewise indemnify the HEM Library from loss due to any liability arisingfrom the operation of the County Library or its facility Neither party by thisagreement agrees to waive any governmental immunity except to the extentinsured And in fact both parties attach, as a part of this agreement, copiesof automobile liability policy with liability and employee errand protection limitsof 1,000,000 by the County Library and 2,000,000 by the HEM LibraryAs to a premises liability policy, the parties attach copies of policy withliability limits of 2,000,000 on the HEM Library facility, and 4,055,000 onthe County Library facility Each party will agree to continue to provideinsurance, as referenced in the two preceding sentences, and evidence of itsannual renewal during the term of this contractThis contract may be amended upon unanimous approval of all theparties signing this agreementIN WITNESS THEREOF, the County Library, the HEM Library, theMunicipalities of Clayton and Smithfield, and the County of Johnston havecaused hearing scheduledfor April 1st11 Abandonment from State - Maintained SR System • - A -- Portion of SR 1503County Manager, Richard Self, informed the Board that in order to relocate a fenceat the Johnston County Landfill, a portion of SR 1503 needs to be abandoned from the statemaintained secondary road systemCommissioner John M Booker moved the necessary resolution be adopted andforwarded to NC Department of Transportation requesting maintenance of 4 mile of SR 1503be abandoned, leaving 7 mile remaining on the State SystemCommissioner Frank B Holding seconded the motion which carried by unanimous vote12 Cleveland Community Citizens GroupDebra Mobley and others from the Cleveland Community were in attendance andrequested to be placed on the Commissioners April 1st agenda to discuss concerns of theircommunityAttorney George Mast, Cleveland area resident, explained that the community is veryconcerned about the critical need for a new school at ClevelandFaye Johnson and John Dildy also spoke briefly about the overcrowded and hazardousconditions at the existing Cleveland SchoolChairman Denning assured those present that citizens from Cleveland Community arealways welcome; however, he stressed the Board of Commissioners do not determine whereschool dollars are spent He invited the group to return on April 1st at 2 oclock pm13 201 Waste Water Facilities Plan ResolutionThe Board discussed the proposed expansion of the Johnston County CentralWastewater Treatment Plant and the necessary requirements for applying for state low - interestloans for financing the projectTim Broome with McKim and Creed was present and offered to answer questionsconcerning the amendment to the 201 Facilities Plan for the project, noting a Public Hearinghas been scheduled for April 1st at 1100 amFollowing further discussion and upon motion by Commissioner Jerry F Wood,seconded by Commissioner John M Booker and carried by unanimous vote, the followingresolution was adoptedRESOLUTIONWHEREAS, The Federal Clean Water Act Amendments of 1987 and the NorthCarolina Clean Water Revolving Loan and Grant Act of 1987 haveauthorized the making of loans to aid eligible units of governmentin financing the cost of construction of waste water treatmentworks and or waste water collection systems; andWHEREAS, The County of Johnston has need for and intends to construct awaste water treatment project described as an expansion of theexisting 4 million gallons per day to 45 million gallons per dayfacility; andWHEREAS, The County of Johnston intends to request State loan assistance forthe project36March 4, 1991 ContinuedNOW THEREFORE BE IT RESOLVED by the Board of Commissioners of JohnstonCountyTHAT Johnston County will arrange financing for all remaining cost ofthe project, if approved for a State loan award;THAT Johnston County will adopt and place into effect on or beforecompletion of the project a schedule of fees and charges which willprovide adequate funds for proper operation and maintenance of theproject on completion of construction thereof;THAT Norman C Denning, Chairman, and successors so titled, ishereby authorized to execute and file an application on behalf ofJohnston County with the State of North Carolina for a loan to aid inthe construction of the project described above;THAT Norman C Denning, Chairman, and successors so titled, ishereby authorized and directed to furnish such information as theappropriate State agency may request in connection with suchapplication or project to make the assurances as contained above;and to the InterstateMr Starling maintained the signs are directional signs, not billboards, and should beallowed to remain He stated they were erected in good faith after receiving a permit from37March 4, 1991 Continuedthe Johnston County Planning office, and remarked the only advertising message on the signshas been removed He stated his client did not realize a permit from NC DOT was neededHe asked the County to consider issuing Mr Hollister a variance allowing him to keep thesigns in placeJeff Ccutu, County Planning Director, explained his department issued the permitunderstanding the signs would be on -site identification signs He indicated the issue involvesthe interpretation of the term, identification sign, and noted that according to the LocalGovernment Commission the question to the JohnstonCounty Board of Adjustment16 Child Support Agency - Request for Additional PositionJim Henderson, Director of Johnston County Child Support Enforcement Agency, metwith the Board requesting an additional child support agent for his department MrHenderson explained the added personnel is needed because of increased case loads and newrequirements created by recent Welfare Reform Legislation He stressed the new positionwould generate increased collections and would be completely paid for by revenues from hisdepartmentUpon a motion by Commissioner Jerry F Wood, seconded by Commissioner John MBooker and carried by unanimous vote the Board approved a new Child Agent I position forthe Child Support Enforcement Agency, and authorized the appropriate budget amendmentfrom funds generated by this agency17 Tax Administration Request- for Change in Billing -- Tax- NoticesJohn Stott, Tax Administrator, discussed with the Board the possibility of convertingto a postcard format for sending future tax notices He explained that using postcard billsinstead of the present mailer system would save the County considerable money in postage;1991 estimated savings would amount to approximately 8,000Upon a motion by Commissioner James W Cash, seconded by Commissioner Jerry FWood and carried by unanimous vote, the Board authorized the County Tax Department toconvert to postage bill tax notices effective with 1991 billings18 Board of Equalization and - Review - Date SetThe Board set the date of April 1, 1991, at 230 pm for the Commissioners to sit asa Board of Equalization and Review19 Severe Weather Awareness -- Week _ - -- ProclamationDewayne West, Director of Emergency Management Services, informed the Board thatMarch 4 through March 10, 1991, is Severe Weather Awareness Week in North Carolina Hereported that planned activities include tornado drills in all schools and a county -wide fullscale disaster exercise on Saturday, March 9th involving fire, rescue, law enforcement andother service and medical organizations He invited the Board to take part in the exercisenoting they would play an integral part in emergency management coordination in the case ofan actual disaster in the CountyMr West presented a proclamation asking the Board to officially adopt SevereWeather Awareness Week in Johnston CountyUpon a motion by Commissioner Jerry F Wood, seconded by Commissioner James WCash and carried by unanimous vote, the Board adopted the following ProclamationSEVERE WEATHER AWARENESS WEEKNorth Carolina has endured more than its share of severe weather inrecent years Many of our residents have suffered injuries and the loss ofhomes and businesses as a result of hurricanes, tornadoes and other naturaldisasters In the 1980s, tornadoes alone killed at least fifty residents of ourstateFew major severe weather events were reported in North Carolina lastyear, but there is no way to predict what 1991 will-bring Education remainsour most effective tool in protecting ourselves against severe weatherOne way to learn about weather protection is by participating inSevere Weather Awareness Week activities These activities are public hearingshave now been held in all six of the Countys fire service districts that do not have a fireprotection tax He noted there was little opposition expressed at any of the public hearingsand recommended approval of taxes for these districtsFollowing discussion, Commissioner Jerry F Wood moved the Board approve the levyof fire protection taxes for the following rural fire service districts Shoeheel, Claytex,Pi -Le, Selma, Smithfield, and Thanksgiving; individual rates to be determined later and setby the Board for the 1991 -92 budgetCommissioner James W Cash seconded the motion which carried by unanimous vote22 Fire Commissioners -to -be appointedThe Board announced they will appoint district commissioners to the six newlyapproved fire taxing districts at the April regular Board meeting They instructed EMSDirector, Dewayne West, to coordinate with the fire departments and the tax office inidentifying residents in each district23 Storm Water Run Off Permits • Group Application- through NCACC and League ofCounty Manager, Richard Self, informed the Board that, in accordance with recentEPA regulations, several county operations, including the County landfill, WW TreatmentPlant, Airport, and others, as well as the Board of Education, are now required to apply forstate permits to discharge stormwater He explained that permits can be applied for as singleunit applications in which each individual site would have to be tested at considerable cost,or as group applications in which only 10 of the sites applying would be testedThe N C Association of County Commissioners and the League of Municipalities aresponsoring statewide group applications to produce significant cost savings to counties andcities Group applications are submitted in two parts with Part One requiring each facility tosubmit a 150 fee and complete an application questionnaire Mr Self further explained thatin order for County facilities to participate in the group application, the Board would need toadopt a resolution of participationUpon a motion by Commissioner JamesWood and carried by unanimous vote, theauthorized the necessary budget amendmentapplication feesW Cash,
