January 5, 19591 4Fit width255Meeting of Board of Commissioners for the County of JohnstonJanuary 5, 1959The Board of County Commissioners of Johnston County met in regular sessionat 11 00 A M, January 5, 1959, in the Commissioners Room, with the followingmembers presentH M Johnson, Chairman, J D Bailey, Floyd C Price, Sr, R G Gurley,and Frank B HoldingAbsent NoneThe following business was transacted1 Messrs A A Corbett, E J Wellons, E G Hobbs, R A Spence, L F Wood,H E Canaday and J R Pool, local attorneys, and representing the Johnston Countybar Association, requested that R E Batton be appointed Assistant Solicitor ofthe Superior Court to assist Mr Archie Taylor, Solicitor for the District Court,in the prosecution of the criminal docketIt was brought out that the Bar Association had gone on record as endorsingMr Batton, and that Mr Taylor had by letter recommended the appointment of MrBattonPractically all of the members of the group stressed the importance of theposition, and asked that the Assistant Solicitors salary be made adequate A ACorbett stated that not less than 30000 per month be paidMr H V Rose, Clerk Superior Court, and others present pointed out that ifthe Assistant Solicitor gave the position adequate attention that he would be ableto save the county money in witness fees and also expedite the trial of casesE J Wellons asked that the Board act on the appointment, and stated that he wouldbe the first to recommend that Mr Batton be replaced if he failed to discharge hisduties in an eficient mannerCommissioner Floyd C Price, Sr moved that upon the recommendations made thatMr Batton be appointed As the motion was not seconded, he withdrew his motion byrequest, in order that the appointment could be given further considerationHowever, Mr Price stated that no action should be taken without studying the furtherrecommendations that might come from the Bar AssociationBy mutual consent, action was deferred-until the next meeting of the Board2 Wilson Jiggs Broadwell, Civil Defense Director, in his verbal report advisedthe Board that federal funds are now available for employing a full time directorand administrative personnel on a matching fund basis and suggested that the Boardenter into such a program as it might be necessary for securing government surplusproperty He atated that he would notify them later of this aspect He alsostressed the need for budgeting funds for a communication system3 Whereas, it has been determined by informUtion presented by Rhetta Martin,Tax Attorney, 1W R Britt and Pope Lyon, Local Attorneys, that I Earl Westbrook,C CCox and Paul L Allen and wife are the present owners of 166 34 acres of theJohn Benton lands in Bentonville Township by virtue of deeds from C L Denningconveying 84 acres and Norwood Smith conveying 82 34 acres,And whereas, there appears of record in F R # 4, page 207, Tax Collectorsoffice, an entry showing payment in full of a one - seventh undivided interest ofJ B Rose assessed on said lands foreclosed in the name of J H Hill heirs -J B Rose, and an order passed by the Board of County Commissioners conveying toC L Denning the interest of the county in said lands as will appear in Commission-ers Minute Book marked 1939, page 166Therefore, on motion by Commissioner J D Bailey, it was moved that quit-claim deed be made to I Earl Westbrook, conveying interest in a portion of 84 acres,C C Cox, conveying a portion of 64 acres, and Paul L Allen and wife, Mildred SAllen, conveying 62 34 acres, making a total of 166 34 acres for the purpose ofcorrecting defect in their titles by virtue of the failure of C L Denning torecord his deed from the county in conformance with order passed by the Board in19424 Upon the recommendation of H V Rose, Clerk Superior Court,the followingmotion was adoptedOn a motion made by Ccmmissioner J D Bailey, seconded by Commissioner Frank BHolding, it was moved that Mrs Lola S Davis, 123 Halifax Street, Raleigh, NorthCarolina be paid 4800 for room and meals of Ellen L Young for a period of tbeeweeks , who was being cared for by said Lola S Davis by virtue of instructionsfrom the Solicitor of the Superior Court5 Upon representation by Sheriff B A Henry and James R Boggan, representingMotorola Communications and Electronics Inc that the county would save 350 permonth by eliminating telephone wire from Sheriffs of -Vice to the local policestation and 800 per month on service contract upon entering into an agreement3SEAJanuary 5, 1959 Contfor the servicing and repair of the Sheriffs radio units with the Motorola Corp,the following motion was adopted;On a motion made by Commissioner R G Gurley, seconded by Commissioner J DBailey, it was moved that the Motorola Communications and Electronics Inc beauthorized to bring up to factory specifications the seven two -way radio units,one base station of the Sheriffs Department at a cost not to exceed 22500 andfurther that the county execute a service contract with the aforementioned corpor-ation at a cost of 47650 per month, beginning February 1, 1959 to July 1, 1959and continuing thereafter provided arrangements work out satisfactory, subject,however, to cancellation by county at any time upon thirty days written noticeto the corporation6 Commissioner R G Gurley moved that the Blackmans Crossroads Volunteer FireDepartment be paid 10000 per month beginning November 1, 1959 in a coordance withprovisions outlined in resolution adopted by the Board on 10 -3 -1955, providingfor the establishment of volunteer fire department in the countyCommissioner J D Bat ley seconded the motion, which was unanimously adopted7• After a discussion with Sheriff B A Shenry relative to the duties and needfor a court officer of the newly organized Johnston County Recorders Court, asof December 1, 1958, the following motion was adopted;0n a motion by Commissioner J D Bailey, seconded by Commissioner Floyd CPrice, Sr, it was moved that Bill Smith, Johnston County Recorders Court Officer,be paid 5000 for services rendered the month of December 1958 and that he continueto serve in the capacity as court officer for the Johnston County Recorders courtuntil notified otherwise by the Board8 E J Corbett, Jr and P D Strickland, Zebulon, N C Rt #1, requested thatthe Corinth Holder Fire District be defined by metes and bounds in order fbr theresidents of that area to secure cheaper insurance rates; and presented a map anda description of the proposed Corinth Holder Rural Fire DistrictCommissioner R G Gurley moved that the following resolution beadoptedcResolution Designating the Boundaries of the Corinth Holder Rural Fire DistrictWhereas at a regular meeting of the Board of County Commissioners of JohnstonCounty, convened and held on Monday, January 5, 1959, the matter of fixing anddeclaring the boundaries of the Corinth Holder Rural Fire District was duly present-ed to the Board; and it appearing to the Board that the Corinth Holder VolunteerFire Department has complied with the provisions of resolution providing for theestablishment of fire districts in Johnston County, which was duly adopted by theBoard of County Commissioners on October 3,1955; has met the minimum requirementfor personnel and equipment required by said resolution, and is receiving financialassistance from the County, and the Corinth Holder Rural Fire District Area havingbeen fixed and established by metes and bounds, and duly submitted to the CountyBoard of Commissioners for approval;Now, therefore, be it resolved that the boundaries of the Corinth Holder RuralFire District Area to be served by the Corinth Holder Volunteer Fire Department beofficially designated and fixed as follows;CORINTH HOLDERS FIR F DISTRICTDecember 17, 1958BOUNDRIESBeginning at a point 1 on Highway #
