January 12, 19591 4Fit width9-59Meeting of Board of Commissioners for the County of JohnstonJanuary 12, 1959The Board of County Commissioners of Johnston County reconvened in specialsession on January 12, 1959, at 1100 AM, in the Grand Jury Room, for the purposeof proposing legislation for enactment by the 1959 North Carolina General Assembly,with the following members presentH M Johnson, Chairman, R G Gurley, J D Bailey, Floyd C Price, Sr,and Frank B HoldingAbsent NoneThe following business was transacted1 W H Britt, Auditor, reported that he had discussed with Mr Delma Johnsonthe matter of paying rent for the use of the county farm property, and that MrJohnson stated that he would be willing to pay 8000 for the partial use of theproperty for the year 1958Commissioner Frank B Holding moved that the Auditor be authorized and directedto accept 8000 from Delmer Johnson as payment in full of the use of the barns atthe county home farmCommissioner J D Bailey seconded the motion, which was unanimously adopted2 a W H Britt, Auditor, proposed that the Negro Farm Agent, County Agent,and the Home Demonstration Agent accounts be deleted from the General Fund and setup for special tax purposes thereby giving more flexibility to the General Fundbudget, which is limited by law to a 20¢ levyIn answer to questions by the members of the Board, it was pointed out thatthis would necessarily mean an increase in the tax rateb J L George, County Attorney, by prior instructions from the Board pro-posed that legislation be enacted whereby the county could call for a referendum,issue bonds and or provide necessary machinery for the county to erect an agricul-tural buildingIt was the concensus of those present that such legislation be drafted3 Commissioner J D Bailey moved that J L George, County Attorney, and W HBritt, Auditor, confer with the Attorney Generals office and draft legislationfor presention to the Legislators of Johnston County for their approval and enact-ment by the 1959 General Assembly whereby the Farm Agent, County Agent and HomeDemonstration Agent be removed from the General Fund and set up as a specialpurpose tax; and an enabling act authorizing the county to hold a referendum, issuebonds, etc or otherwise to raise funds for the purpose of purchasing land for theerection of a building to be known as an agricultural building and provide for thehousing of other county departments4- Wilson Jiggs Broadwell, Civil Defense Director, reported that as ofJanuary 1, 1959 that the Civil Defense Budget, with the exception of the amountappropriated for the purchase of government surplus property, would be matchedby the Federal Government on a 100 to 100 basis and that for the period ending6 -30 -1959 or 12 year the county would be entitled to receive 486750, providedthis amount was spent for Civil Defense Administrative and personnel expensesand stated that the Civil Defense program would not have to be established on afull time basis to receive matching funds5 Commissioner R G Gurley introduced the following resolution and moved thatit be adoptedResolution Designating the Boundaries of the Pi -Le Fire DistrictWhereas at a special meeting of the Board of County Comnissioners of JohnstonCounty, convened and held on Monday, January l2, 1959, the matter of fixing anddeclaring the boundaries of the PI -LE Fire District was duly presented to theBoard; and it appearing to the Board that the Pine Level Volunteer Fire Departmenthas complied with the provisions of resolution providing for the establishmentof fire districts in Johnston County, which was duly adopted by the Board of CountyCommissioners on October 3, 1955; has met the minimum requirement for personel andequipment required by said resolution, and is receiving financial assistance fromthe County, and the PI -LE Fire District Area having been fixed and established bymetes and bounds, and duly submitted to the County Board of Commissioners forapproval;Now, therefore, be it resolved that the boundaries of the PI -LE Fire DistrictArea to be served by the pine Level Volunteer Fire Department be officially designedand fixed as follows;MJanuary 12, 1959 CantPI -LE FIRE DISTRICTBOUNDARIESBeginning at a point on the Pittman Road three miles north of thePine Level, N C at Intersection of Interstate Hi hway # 45; thence in aneasterly direction to a point on the Micro Road 04 miles east of the BagleyRoad Junction; thence South to Creech Branch on the Bagley Road 04 miles eastfrom the Micro Road; thence Southeast to the Little Creeck Road at the junctionof the Hinnant Road, thence in an easterly direction to the Rains X Road, 01mile east of the Little Creek Road; thence southeast to a point on the Loop Road,44 miles east of the intersection of the Barden Road; thence South to a pointon the Evans Road 05 miles east of the Barden and Evans Road Crossing; thenceSouth to Highway # 70A, to the Bull Road Crossing; thence south to the HephzibahBaptist Church on Highway # 70; thence southwest on the Braswell Road 03 milessouth of Highway # 70; thence in a southwesterly direction to Massey Branch onthe Stevens Chapel Road; thence southwest to the intersection of Bawdy Branch onthe Creechs Mill Road; thence west to a point on the Mill Pond Road 06 milessouth of Highw # 70; thence northwest to the junction of the Fire Tower Roadon Highway # 70ay ; thence along said Fire Tower Road to Peedin Branch; thencenorthwest to the Overhead Bridge, Junction of U S # 70A and Interstate # 95;thence northeast along said Interstate # 95 to the point of beginningCommissioner Frank B Holding seconded the motion, which was unanimouslyadopted6 On a motion made by Floyd C Price, Sr, seconded by Frank B Holding, it wasmoved that the State Highway Commission be requested to hard-surface that certainroad in Pine Level Township, described as follows and designated as Project No 1on the attached mapBeginning at the J C Futrell farm, runs thence to the Lula Barrowfarm, and is known as the Futrell road, being a distance of 12 milesPetition and map enclosed with this order For reference see A FFutrell, Pine Level7 Commissioner Frank B Holding introduced a letter from Charles Thomas Toler,Bentonville Township, Princeton, N 0 Route # 1, and signed by approximately 35citizens of Bentonville Township, requesting that the Old Mill Creek road orsometimes called the Stevens dirt road, located 1 mile northeast of Coy Mill andapproximately two miles south of New Richardson Bridge and designated as ProjectNo 2 on the attached map be built up and paved and that the canal that runseast and west alongside this road be dredged;
