March 16, 1992The Johnston County Board of Commissioners resumed regular session Monday, March 16, 1992, at 7oclock pm in the Commissioners Room, Johnston County Courthouse Annex, Smithfield, North Carolina, withthe following members presentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, James W Cash, John M Booker,DVM, and Jerry F Wood, DDSAbsent NoneAlso Present Richard B Self, County Manager, Joyce H Ennis, Clerk to the Board, and W R Britt,County AttorneyThe Chairman called the meeting to order and the following business was transacted1 Rezoning and Special Use Permit RequestsPublic Hearings on these cases were held March 3, 1992 - Reference Minute Book 19, pages 201 and 202A REZONING CASE #024 - Petition to rezone a one acre parcel in Clayton Township on SR 1555approximately 500 feet north of the intersection with SR 1557 from ARR -40 to Hwy BusinessSpecial Use District Petitioner Rick MeadowsJeff Coutu, Planning Director, stated the Planning Board recommended approval of this rezoning requestUpon a motion by Commissioner James W Cash, seconded by Commissioner Frank B Holding and carriedby unanimous vote, the Board approved rezoning request, Case #024, for Rick Meadows for one acre parcel inClayton Township on SR 1555 from ARR -40 to Hwy Business Special Use DistrictB SPECIAL USE CASE #024 - Request for Permit to locate an automobile repair garage on SR1555 approximately 500 feet north of the intersection with SR 1557 in Clayton TownshipPetitioner Rick MeadowsJeff Coutu explained the Planning Board recommended approval, subject to the following conditions beingmade a permanent part of the permit1 The residence must remain a residence2 A solid 6 fence must be constructed on three sides of the property3 A 5 landscaped buffer must be established on the perimeter of the property4 No business or auto sales shall be conducted in front of the existing residenceCommissioner James W Cash moved the Board approve a Special Use Permit Case #024 for RickMeadows to locate an automobile repair garage on SR 1555 in Clayton Township, subject to the four conditionsstated above being made a permanent part of the permitCommissioner Frank B Holding seconded the motion which carried by unanimous voteC SPECIAL USE CASE #023 Request for a Cellular Radio Transmission Facility in Banner Township onSR 1105 near the intersection with Hwy 50 Petitioner Centel Cellular Company of Chicago, IllinoisJeff Coutu informed the Board the Planning Board recommended denial of this requestQuinn Parker with Centel, stated he met with the property owner closest to the site and offered to make somechanges in the actual location of the tower; however, he was unable to satisfy other property owners in the areaFor this reason, Centel has decided to WITHDRAW their request for this site and are currently consideringanother location211Johnny IveX stated he and several others were present to oppose Centel erecting a tower in theirneighborhoodJeff Coutu explained Centel has submitted a petition requesting a special use permit for another site Thispetition will be addressed at the March 24, 1992 Planning Board Meeting and heard by the Board ofCommissioners at their April 6th session2 Rescue Association Request for AssistanceDonald R Holland, President of the Johnston County Rescue Association, spoke with the Board about theproblems the local squads are having with daytime staffing He explained most members work away from thecommunity and it is difficult to find volunteers who can respond during the daytime hours He presented severalplans to raise the additional funds needed to provide permanent, daytime staff for squads in the CountyCommissioner Frank B Holding noted the Board will soon be working on the budget for FY 1992 -93, andwould take these needs into considerationCommissioner John M Booker stated the problems facing rescue squads in the County have reached a pointwhere they have to be addressed, and a solution will take the combined efforts of the Board and the squads Thenine squads have always been supported by the County and operated by volunteers; however the time has comewhen volunteer help is not always available and paid help has to be considered He noted that when using taxmoney to provide staff, whether from fees or taxes levied in districts, the County has to look at all the factorsincluding the level of direct county involvementChairman Denning and the entire Board voiced their appreciation for the service the rescue squads providethe citizens of Johnston County, and assured those present the Board would work with them to find a satisfactorysolution3 Citizen Complaint - Maylon McLambMaylon McLamb, businessman from the Benson area, addressed the Board concerning his association withthe County Inspections DepartmentIn April, 1991, Mr McLamb obtained a building permit to construct a storage clean -up shop building with noplumbing Since that time, inspectors have visited the site on several occasions and have advised Mr McLambhe is out of compliance He needs a change of use permit because he is using the building as an office auto paintand car garage He has also extended the building over existing septic lines which makes him out of compliancewith the State Environmental Law The Inspections Department has informed Mr Mclamb that he needs to makeseveral changes in order to comply with State regulationsMr McLamb stated he is ready to comply with whatever regulations are required to meet the State buildingcode and satisfy the County Inspections Department, Environmental Health, and OSHAThe Board instructed County Manager, Richard Self, to meet with Mr McLamb and C P Thompson,Director of Johnston County Inspections, as soon as possible to try to work out a satisfactory solution to MrMcLambs situation4 Budget Amendment Approved Environmental HealthUpon a motion by Commissioner Frank B Holding, seconded by Commissioner Jerry F Wood and carriedby unanimous vote, the Board approved the following budget amendmentExpenditure Increase - Environmental Health10 -5910 -7400 Capital Outlay 1,4720010 -5910 -1410 Training 3000010- 5910 -1110 Postage 75000Total 2,52200Revenue Increase10- 3518 -82 DEH NR 2,52200212EXECUTIVE SESSIONUpon a motion by Commissioner James W Cash, seconded by Commissioner Jerry F Wood and carriedby unanimous vote, the Board recessed regular session to meet in executive session for the purpose of discussingland acquisition and potential litigationREGULAR SESSIONUpon a motion by Commissioner Frank B Holding, seconded by Commissioner John M Booker andcarried by unanimous vote, the Board adjourned executive session and resumed regular session5 Cancellation of GIS Contract with UltimapDue to unsatisfactory product performance, Commissioner Jerry F Wood moved the Board authorizethe County to cancel their Geographic Information System contract with Ultimap, Corp and award contract toother low bidder, Genasys CorpCommissioner James W Cash seconded the motion which carried by unanimous voteUpon a motion by Commissioner John M Booker, seconded by Commissioner James W Cash and carriedby unanimous vote, the Board adjournedNorman C Denning, ChairmanJoyce H Ennis, ClerkDetailsAnnotationsEntry PropertiesModified11192013 22136 PMCreated5142003 102742 AMTemplateMinutesFieldsMinutes - TypeRecessedMinutes - Date3161992Book19
