Holding moved the Board concur with the Board of Educations request to apply for400,000 from the State Public School Capital Fund for use on the Selma Middle School TMH additionCommissioner Jerry F Wood seconded the motion which carried by unanimous vote3 Resolution of Acceptance and Project Ordinance EDA Grant for Water and Sewer FacilitiesCommissioner Jerry F Wood moved the Board accept an EDA Public Works Grant in the amount of 1,635,000to extend water sewer facilities and construct a skill training center at the old Cleveland School site on SR 1010 in ClevelandTownship Commissioner Wood further moved that McKim Creed Engineers be authorized to proceed with engineeringand advertisement for bids, and that the Chairman and County Manager be authorized to sign the necessary Commissioners Annual Conference which will be held August 13-16,1992,in Charlotte, NCCommissioner Frank B Holding seconded the motion which carried by unanimous vote8 Selma Fire Tax Rate AdjustedAt the request of the Town of Selma, Commissioner Jerry F Wood moved the Selma Fire Tax rate for 1992 -93be amended to 6 cents per 100 valuation instead of the 8 cent rate originally requestedCommissioner Frank B Holding seconded the motion which carried by unanimous vote9 Relocation of GravesCounty Manager, Richard B Self, informed the Board Harold Wayne Cross has requested the Boards consentto remove twelve graves from his property on Highway 3 9 north of Selma so that he can develop the land He explainedthat according to Mr Cross Attorney, Robert V Lucas, all statutory requirements have been complied with, and MrCross plans to proceed with relocating the graves to established cemeteries in accordance with the directions forremoval of graves as set forth in NC General Statutes 65 -13Upon a motion by Commissioner Jerry F Wood, seconded by Commissioner John M Booker and carried byunanimous vote, the Board voted their consent for disinterment, removal, and reinterment of graves located on propertyowned by Harold Wayne Cross located on Hwy 39 north of Selma, in compliance with NC General Statute 65 -1310 Public Hearing Amendment to Zoning Ordinance - Section 19Advertised The Smithfield HeraldThe Chairman opened the Public Hearing and invited anyone who wished to address the Board on a proposedamendment to Section 19 of the Johnston County Zoning Ordinance Maps to recognize those subdivisions which havepublic water supplies or community water systemsJeff Coutu, County Planning Director, spoke of the need to amend the ordinance to put eight subdivisions onthe Zoning maps as Residential 20 zoning He explained these subdivisions have been approved by the Planning Boardfor 20,000 sqft lotsRecognizing citizens present from the Wilsons Mills community, the Chairman asked Mr Coutu to give abrief history of the subdivision, Triangle Estates, located in Wilsons Mills that would be affected by this amendmentMr Coutu explained in December, 1991, the Planning Board reviewed and approved a subdivision plat for a27 acre tract of land, zoned ARR40, in Wilsons Mills He noted that by law, the Planning Board or Planning Staff isnot allowed to ask the developer what he plans to put on the lots It appeared to be a subdivision and the plat wasapproved for 20,000 sqft lots In January, citizens from the neighborhood contacted the Planning Office stating thatmobile homes were being placed in Triangle Estates Subdivision The Planning staff talked with the developer and wasassured by letter that their intention was to sell the lots individually, which is customary with subdivisionsIn February, citizens from Wilsons Mills attended the Planning Board meeting and complained the subdivisionwas being used as a mobile home park The Planning Board heard the complaint; however, after conferring with legalcouncil, decided the developers had vested rights since the subdivision plat was duly approvedMargaret Morgan Kash, attorney retained by a group of citizens from Wilsons Mills, addressed the Board onbehalf of her clients She questioned the Planning Boards practice of approving ARR40 zoned property as subdivisionplats for 20,000 sqft lots if the property had public water or a community water system She noted that ARR40zoning allows for 40,000 sqft lots, and to divide the property into smaller lots should require rezoning She stated0416,3411the developer has already placed twelve mobile homes on the property, six of which appear to be rented on a weeklybasis, and if allowed to continue, can place 51 mobile homes in the subdivision She maintained that the developer nowappears to be developing a mobile home park instead of a subdivision and, in her opinion, such a situation completelygoes against the purpose of zoning She further pointed out that in the Zoning Ordinance, R -20 zoning does not includemobile homes as a permitted useMs Kash informed the Board the citizens she represents would agree to the twelve mobile homes alreadyplaced if they could have assurance that no more mobile homes would be allowed on 20,000 sqft lots in TriangleEstates SubdivisionKenneth Jones, from the Wilsons Mills Community, stated 51 mobile homes on 27 acres would create unduepopulation concentration, the prevention of which is listed as one of the purposes of zoning in the Johnston CountyZoning OrdinanceDonna Creech, Chairman of the Board of Directors of Wilsons Mills Christian Church, stated she is concernedwith the quality of life in the community She asked the Board to require the developer to divide the property into40,000 sqft lots in accordance with the ARR -40 zoningTony Southerland who lives and operates a business in the area stated the developer is not selling the lots andoperating the property as a subdivision He asked the Commissioners not to allow the developer to ruin the communitythe citizens of Wilsons Mills have worked hard to buildLinda Uzzle asked the Board to hear the citizens of Wilsons Mills and put a stop to the developers apparentplan for a mobile home park on property divided for a subdivisionPauline Sanders and Joseph Wilder also opposed the developer making a mobile home park out of asubdivision, and asked the Board for their helpOsie Wood, whose elderly mother lives in the area, was concerned for the safety of the neighborhood Shepointed out that 15 driveways currently enter the highway in approximately 4 mile area just beyond a dangerous curvein the roadReverend Billy Lawson, pastor of Wilsons Mills Baptist Church, also voiced concern for the safety of thecommunityRepresentative Billy Creech, NC House of Representatives, added his concern for the quality of life in WilsonsMills and the rest of Johnston County if a developer is allowed to make a mobile home park out of a subdivision Henoted the developer is not providing affordable housing, but rather expensive housing for what the occupant is gettingHe stated he believes in property owners rights; however, not when those rights hurt everyone else Wilsons Mills hasworked hard in racial harmony to upgrade the entire community, and the citizens want to keep the integrity of thecommunity intact He asked the Board to require the developer to comply with the intended rules for subdivisionsCommissioner John M Booker referred to the Countys Mobile Home Ordinance He asked Mr Coutu if, inhis opinion and the opinion of his staff, the property is now being developed as a mobile home park Mr Couturesponded that this would appear to be the caseThe Board discussed the situation and what the County needs to do to prevent developers from usingsubdivisions to circumvent the Mobile Home Ordinance Chairman Denning told those present that zoning is new tothe County, and naturally problems will arise that need to be corrected He assured everyone that the Board wouldinvestigate the situation and act in the best interest for the Community of Wilsons Mills and Johnston CountyThere being no further comments, the Chairman closed the Public Hearing11 Restraining Order Triangle Estates SubdivisionCommissioner John M Booker moved the Board instruct Attorney WA Holland to have a restraining orderplaced on Triangle Estates located in Wilsons Mills to restrict the developers of the subdivision from placing anyadditional mobile homes on the property until further noticeCommissioner Jerry F Wood seconded the motion which carried by unanimous vote12 Call for a Public Hearing on Amending Subdivision OrdinanceUpon a motion by Commissioner John M Booker, seconded A Petition to rezone 1918 acres on State Road 1918 in Smithfield Township from Mto Residential -20 Petitioner Sue Warrick - Whipporwill SubdivisionJeff Coutu stated the Planning Board recommended approval of this petition He pointed out the proposedsubdivision on a mapDan Warrick, whose wife owns the property, informed the board they plan to divide the tract into approximately27 lots, each at least 20,000 sq ft He assured those present that no mobile homes would be placed on the lotsChip Hewett, Attorney representing a group of residents who live near the proposed subdivision, opposed therezoning stating the R -20 zoning would allow doubling of lots which would overcrowd the property and change thecharacter of the community His clients live downhill from the property and feel there as Marshall RoadThere was no original petition to name SR 2558 Fisher Road The Planning Board recommended approvalB SR 1914 - Currently Browns Farm Road Petition to rename Bear Farm RoadMr Coutu renamedThunder Road at June 1, 1992 Board meeting, leaving SR 1235 unnamed The Planning Board has suggested the nameShort Road for SR 1235 which is 1 mile in length Another suggestion has been Billboard RoadE SR 1571 Portion - Small Loop - Currently named Peele Road Emergency ServicesRequest this Portion be Renamed South Peele RoadIt was explained that SR 1571 intersects SR 1563 Little Creek Church Road at three separate locationsEmergency Services has requested the smaller loop west of SR 1563 be renamed South Peele to avoidconfusionThe Board asked Commissioner Cash to talk with the people who live on this section of Peele Roadto get their suggestions if the road is to be renamedF SR 1526 Portions- Currently Named Josephine Road Emergency Services RequestPortions of the Road wasconsidered for renaming following the June 1, 1992, Public Hearing held by the Board Mr Godwin explained that thereis confusion because some of the signs on the road have Old Stancil Road, and some have Stancil Road He asked thatthe portion of SR 2158, east of Hwy 222, be renamed Godwin RoadChairman Denning assured Mr Godwin the Board would look into the matter of the signs He noted beforethe road name could be reconsidered, it would have to be readvertised16 Youth Task Force - Recommendations for CBA FundingDeborah Brewington, Chairperson, presented the Youth Task Forces following recommendations for 1992 -93funding of Community Based Alternative Funds for Johnston CountyA Home Based Delinquency Prevention Program Requested Funding 34,174; Recommended Funding- 56,500 Administered by Johnston County Department of Social Services - Contact Person Earl Marett,Director Funding includes 32,000 for beds at Lee Countys Hillcrest Home Estimated number of youth tobe served is 25Justification l Program is an alternative type program and the availability of residential care beds for Johnstoncounty juveniles may preventreduce the number of placements at training schools and provide care for otheryouth at -risk of becoming involved with the court 2 This program provides intervention with court involvedjuveniles and their families and with other juveniles at risk of
