October 5, 1992The Johnston County Board of Commissioners met in regular session Monday, October 5, 1992, at 10 oclock amin the Commissioners Room, Johnston County Courthouse Annex, Smithfield, North Carolina, with the following memberspresentNorman C Denning, Chairman, Frank B Holding, Vice Chairman, James W Cash, John M Booker, DVM, andJerry F Wood, DDSAbsent NoneAlso Present Richard B Self, County Manager, Joyce H Ennis, Clerk to the Board, and W R Britt, CountyAttorneyThe Chairman called the meeting to order and the following business was transacted1 MinutesThe Chairman asked if there were any corrections to the minutes of the September 8, and 11, 1992 board meetingsThere being no corrections, the Chairman declared the minutes approved as presented2 Recognition of Bill Sharpe, Candidate for NC SenateChairman Norman C Denning recognized Bill Sharpe, Candidate for the NC Senate representing a portion ofJohnston CountyMr Sharpe spoke briefly saying if elected he would object to the state sending mandates to local governmentswithout the necessary funding3 Recognition of County CommissionersDr Tom Houlihan, Superintendent of Schools, formally announced that the Johnston County Board of Educationhas nominated the Board of Commissioners for the North Carolina School Board Associations prestigious award for localgovernment leadersDr Houlihan gave a brief report on the state of the Johnston County school system and plans for the immediatefuture He pointed out the Board of Education has received several grants which will help in making further improvements4 Board of Education Surplus Property Offered the CountyDr Houlihan informed the Commissioners the Board of Education, in accordance with GS 115C -518, has offeredthe County two pieces of property recently declared surplus Harrison School property in Selma, and a residence on theformer Coy Powell property at SR 1010 and SR 1525 in Cleveland TownshipCounty Accepts Harrison School and Donates to Town of Selma - Rejects Residence in ClevelandTownshipUpon a motion by Commissioner Jerry F Wood, seconded by Commissioner Frank B Holding and carried byunanimous vote, the Board accepted the Harrison School property from the Board of Education in accordance with G S115C -518Upon a motion by Commission Frank B Holding, seconded by Commissioner James W Cash and carried byunanimous vote, the Board voted to reject the School Boards offer of a residence on the former Coy Powell property inCleveland TownshipUpon a motion by Commissioner Jerry F Wood, seconded by Commissioner Frank B Holding and carried byunanimous vote, the Board donated the Harrison School property to the Town of Selma with the stipulation that theJohnston County Head Start Program and the Mental Health Developmental Day Care Program be allowed to remain atthe facility for a period of time at no additional cost except payment of utilities5 Hospital Audit Contract ApprovedCommissioner James W Cash moved the Board approve the hospitals annual audit contract with Deloitte Touche, including expanded services to cover Home Health and the McGees Crossroads operation in the amount of22,350, plus out -of- pocket expenses and supplemental proceduresCommissioner John M Booker seconded the motion which carried by unanimous vote3036 Department of Transportation Addition to SystemThe Board reviewed petitions presented by the North Carolina Department of Transportation requesting thefollowing roads be added to the State Secondary System for maintenance Dogwood Drive, Dogwood Estates in BeulahTownship, and Charlie Lane, Cottonwood Subdivision II, Clayton TownshipFollowing review, Commissioner Frank B Holding moved that NC Department of Transportation be requestedto add Dogwood Drive and Charlie Lane to the State Maintained SystemCommissioner James W Cash seconded the motion which carried by unanimous vote7 Public Hearing Rezoning RequestsAdvertised September 22, 29, 1992 - The Smithfield HeraldNotices posted at locations on September 25, 1992, and certified letters mailed to adjoining property owners onSeptember 23, 1992The Chairman opened the public hearing and invited anyone who wished to address the Board on the followingrezoning requestsA CASE #45 Petition to rezone a 682 acre parcel, located in Pleasant Grove Township on SR 1532,approximately 2030 feet south of the intersection with SR 1537 from ARR40 to General BusinessPetitioner Nancy CanadyJeff Coutu, Planning Director, pointed out the property on a map and noted the adjacent zoning He stated thecurrent use of the property is non - conforming on a non - conforming lot The Planning Board recommended denial of therequestMichael Parker, resident of Shadow Lake Subdivision which is located next to the property, voiced strongopposition to the rezoning He cited the following reasons for his opposition hazards of vermin, odors, and pollution;detraction of appearance of the subdivision; therefore, the property can not be reconsidered for this type of rezoning for 12 monthsB CASE# 46 Petition to rezone 10 acres located north of the intersection of SR 2371 and SR 1002, withfrontage on SR 1002 in Boon Hill Township from ARR 40 to Heavy Industrial Applicant BarrusConstruction CompanyC CASE #47 Petition to rezone approximately 73 acres in Meadow Township at the intersection of SR1118 and SR 1113 from ARR 40 to Heavy Industrial Applicants Mr Mrs Charles DenningChairman Norman C Denning asked that the Board send these two requests, both of which deal with sites forBarrus Construction Companys portable asphalt plants, back to the Planning Board with the suggestion they be consideredfor special use district designation on a year -to -year basis The Board concurred with the Chairmans requestDISCUSSION ON CASE 446, BOON HILL TOWNSHIPKathleen Wells, resident of Princeton, voiced opposition to another asphalt plant being allowed in Princeton Shepresented a petition with signatures of fifty families opposing the rezoningJames Best, lifetime resident near the proposed Princeton site, stated the existing asphalt plants near his home havecreated enough problems and asked the Board not to make matters worse by allowing another facility He mentioned thehigh level of noise, poor air quality, heavy traffic from trucks and tankers, and effect on ground water as major concernsEdward Wells, pointed out the plant would not employ people from Johnston County He voiced concern thatBitumen from the existing asphalt plants is found in the water in nearby ditches304Dr Sherrill Glover, and Dr Donnie Jones also voiced opposition to more industry in Princetons residential areaGordon Woodruff Attorney for Barrus Construction on the Boon Hill site, responded the land was purchasedbefore countywide zoning and abuts another asphalt plant and quarry He stated the portable plant would only be inoperation at the site when road construction was being done in the area He assured those present that all permits are inorder and all environmental and health standards have been upheldDISCUSSION ON CASE 447, MEADOW TOWNSHIPBob Griffith, Attorney representing a group of residents in Meadow Township against a portable asphalt planton the Denning Property, stated his clients are still opposed, even ifthe rezoning is a special use designation If the propertyis temporarily allowed to be used for an asphalt plant, he questioned whether it would ever be suitable for anything otherthan heavy industry He stated the area is residential and should remain residentialRand Jam, Joyce Draughon, Ms Mrs Clarence McLamb, Maxine Jones, Patty Barefoot, Steve Parker, andRicky Raynor also voiced opposition to the rezoning Several reasons were cited for their opposition residential area notconducive to industry, air pollution which causes health problems, reduction of their land values, excessive traffic onunpaved roads already in poor condition, and damage to general quality of life of nearby residentsCharles Denning, property owner who proposes to lease to Barrus Construction, responded that Barrus haspromised that when they are through with the nearby road construction they will leave the property in the same conditionthey found it He also stated Barrus has agreed their trucks will use an alternate route that will not go past any homesThere being no further comments, the Chairman closed the public hearing8 Rezoning Requests Sent Back to Planning BoardUpon a motion by Commissioner Frank B Holding, seconded by Commissioner Jerry F Wood and carried byunanimous vote, the Board referred rezoning cases 446 and 447 back to the Planning Board to be considered for specialuse districts on a year -to -year basis9 Rezoning Cases Held OverUpon a motion by Commissioner Frank B Holding, seconded by Commissioner Jerry F Wood and carried byunanimous vote, the Board deferred action for 30 additional days on the following rezoning petitions1 CASE 438 - Beulah Township, Petitioner BB T2 CASE 441 - Smithfield Township, Petitioner Sue Warrick10 Resolution - Johnston Community College Awareness DayUpon a motion by Commissioner Frank B Holding, seconded by Commissioner John M Booker and carried byunanimous vote, the Board adopted the following resolutionResolutionJohnston Community College Awareness DayWHEREAS, Johnston Community College has served Johnston County and surrounding counties since its charterin 1969; andWHEREAS, Johnston Community College has the highest graduation rate of any college in the North CarolinaCommunity College System; andWHEREAS, Johnston Community College, through its vocational and technical training, has allowed citizensformerly without skills to become skilled and employed; andWHEREAS, Johnston Community College has individually tailored training programs for local businesses andindustries so that they can have a more productive work force; andWHEREAS, Johnston Community College has trained thousands of local personnel in fire service, rescue serviceand law enforcement; andWHEREAS, Johnston Community College has the college transfer program which allows students to enteruniversities as juniors after saving a considerable amount of money on tuition and room and board; andWHEREAS, Johnston Community College has continuing education courses to prepare adults to take state examsin various occupations such as insurance, real estate, plumbing, and electrical wiring; and re- certification courses forteachers305NOW, THEREFORE, BE IT RESOLVED by the Johnston County Board of Commissioners that Wednesday,October 28, 1992, be declared Johnston Community College Awareness DayAdopted this 5th day of October, 199211 Ambulance Billing Rescue SquadsDewayne West, Emergency Management Services Director, reported the County began billing on October 1st forthe County rescue squads He stated the process appears to be working very well with full cooperation of the rescue squadsinvolved He noted Smithfield Rescue Squad which is totally supported by town taxes is not participating at this timeIn response to a question from Commissioner John M Booker, Mr West stated Smithfield Rescue responds toan estimated 750 rural residents He noted, should the Town of Smithfield decide to participate, revenue from membershipsand insurance billings could amount to as much as 60,000 per year for the Smithfield Squad12 Ambulance Franchises Request ChangesDewayne West informed the Board two ambulance providers have requested a change in their franchise NovaMedical Transport from Basic Life Support Level to Advanced Life Support Level, and Four Oaks Rescue Squad fromEMT - Defibrillator Level to EMT -I -V LevelHe noted the EMS Advisory Commission has recommended the request from Nova Medical Transport be deniedas they are not an emergency transport unit, they are not based in Johnston County and do not use Johnston County certifiedpersonnel The Commission recommended the request from Four Oaks Rescue be approvedIt was pointed out any action amending a franchise must be voted on by the Board at two regular meetingsFirst Votes on Franchise AmendmentsUpon a motion by Commissioner John M Booker, seconded by Commissioner Frank B Holding and carried byunanimous vote, the Board approved Four Oaks Rescue Squads request to be upgraded from EMT - Defibrillator Level toEMT -I -V Level for more advanced field treatmentAt the recommendation of the Emergency Medical Services Advisory Commission, Commissioner Frank BHolding moved the Board deny Nova Medical Transports request to have their franchise level changed from BLT to AILSCommissioner John M Booker seconded the motion which carried by unanimous vote13 Corinth Holder Revised Fire Insurance DistrictUpon a motion by Commissioner Jerry F Wood, seconded by Commissioner James W Cash and carried byunanimous vote, the Board approved the following revised insurance district boundaries and map for Corinth Holder whichincorporates the recently approved expanded service areaCorinth - Holder Insurance Service DistrictCombined 5 mile district and expanded service districtBeginning at a point 1 at the intersection of NC 96 and the Wake County line; thence in a northeasterly direction to apoint 2 on SR 1727 at the Johnston -Wake County line; thence in a northeasterly direction to a point 3 on NC 39 at theJohnston Wake County line; thence in a northeasterly direction along the Johnston -Wake County line to a point 4 on NC264 -A where it intersects with the Wake County line; thence in an easterly direction along the County line to a point 22 on SR 1720 at theWake County line; thence in an easterly direction along the Wake County line to the beginning point 1 on NC 9614 Ambulance Contributions ApprovedAt the recommendation of the Rescue Squad Association, Commissioner Frank B Holding moved the Boardallocate the 1992 -93 budgeted ambulance appropriation as followsSmithfield Rescue Squad 20,000Clayton Rescue Squad 20,000Commissioner John M Booker seconded the motion which carried by unanimous vote15 Town of Pine Level - Request County Buy Water and Sewer LinesPhil Pittman, Mayor from the Town of Pine Level, and Dick Braswell, developer, met with the Board to discussthe towns request that the County purchase water and sewer lines owned by Mr Braswell located along SR 2309 fromthe city limits of Pine Level to Hwy 70Mr Pittman stated, in his opinion, public interest would be better served if the water and sewer lines were in thehands of the County considering the possibility of growth in the areaMr Braswell reported he built the 8 lines located within 100 of Hwy 70 in 1984 and 1985 He offered the waterline to the County for 90,000, and the sewer line for 60,000The Board agreed to take the request under advisementEXECUTIVE SESSIONUpon a motion by Commissioner James W Cash, seconded by Commissioner Jerry F Wood and carried byunanimous vote, the Board recessed regular session to meet in executive session for the purpose of discussing acquisitionof real property and to consult with an attorney on a matter of possible litigationREGULAR SESSION RESUMEDUpon a motion by Commissioner John M Booker, seconded by Commissioner Frank B Holding and carried byunanimous vote, the Board adjourned executive session and resumed regular session16 County Surplus Vehicle Offered Town of PrincetonUpon a motion by Commissioner Frank B Holding, seconded by Commissioner John M Booker and carried byunanimous vote, the agreed to sell a surplus deputy vehicle, mid to late 1980s model, to the Town of Princeton for 150017 Real Estate Exchange of Property - Glennie Rea CorporationCounty Attorney, W R Britt, explained the County owns six 25 lots in Selma that have been appraised by theCounty Tax Office at an estimated value of 1500 Glennie Rea Corporation who owns the adjacent lots has shown aninterest in purchasing the property Mr Britt further explained the County, in connection with the construction of sewerlines from Clayton to the I -4042 interchange, needs certain property owned by Glennie Rea Corporation in ClaytonTownship which has also been valued at approximately 1500 With proper publication of notice, NC General Statutes153A -176 and 160A -271 allow for exchange of property of equal value Mr Britt stated the property was published in TheSmithfield Herald on September 18, 1992Upon a motion by Commissioner Jerry F Wood, seconded by Commissioner James W Cash and carried byunanimous vote, the Board approved the exchange of property with Glennie Rea Corporation as set forth by the CountyAttorney, and authorized the Chairman to sign the necessary documents18 Public Hearing Set Cable TV FranchiseUpon a motion by Commissioner Frank B Holding, seconded by Commissioner Jerry F Wood and carried byunanimous vote, the Board called for a public hearing on November 2,1992, at 11 oclock amto hear public comment ona petition from Deacon Cable, Inc of Raleigh for a cable TV Franchise in Johnston County30719 Policy Established for Considering Petitions for Road Name ChangesThe Board discussed the need to establish a policy on how often petitions for road name changes will beconsidered It was pointed out this would be helpful to the Countys Communications Department in their endeavor toestablish accurate E -911 addressing information Three petitions sent from the Planning Board were for roads which theBoard acted on in recent monthsFollowing further discussion, Commissioner Frank B Holding moved the three petitions for road name changesbe held until May, 1993, for further consideration and that the Board only consider petitions for road name changes oncea year at their regular May meetingCommissioner Jerry F Wood seconded the motion which carried by unanimous vote20 Recreation Grants ApprovedUpon a motion by Commissioner Frank B Holding, seconded by Commissioner John M Booker and carried byunanimous vote, the Board approved the following recreation grantsArcher Lodge Community Center, 2,000;
