312November 2, 1992The Johnston County Board of Commissioners met in regular session Monday, November 2,1992, at 10 oclockam in the Commissioners Room, Johnston County Courthouse Annex, Smithfield, there were any corrections to the minutes of the October 5 and 14,1992 board meetingsThere being no corrections, the Chairman declared the minutes approved as presented2 Department of Transportation Petition to Abandon Maintenance on SR 1246Ross Halley, Maintenance Engineer with DOT, discussed with the Board a request from Mrs Viola Raynorto abandon SR 1246 He explained if the Board approves the petition, DOT would abandon maintenance of the road;however, in his opinion, Mrs Raynor wants the road entirely closed He noted there is a cemetery located at the endof the road which may require accessFollowing further discussion, the Board deferred action on this matter until the December meeting to allow MrHalley and Commissioner Frank B Holding a chance to talk further with Ms Raynor3 Department of Transportation UpdateRoss Halley informed the Board DOT is in the process of taking a visual traffic count of unpaved roads in thecounty The updated count should be completed by December and will be used to revise the states priority list forpaving unpaved roads4 Public Hearing Rezoning RequestsAdvertised October 16, 23, 1992 - The Smithfield HeraldNotices posted at locations on October 23, 1992, and certified letters mailed to adjoining property owners onOctober 19, 1992The Chairman opened the public hearing and invited anyone who wished to address the Board on the followingrezoning requestsA CASE# 46 Petition to rezone 10 acres located north of the intersection of SR 2371 and SR 1002,with frontage on SR 1002 in Boon Hill Township from ARR40 to Hem Industrial Special UseDistrict Applicant Barrus Construction CompanyThis Case was originally presented to the Board of Commissioners at their October 5, 1992 meeting and wassent back to the Planning Board with the suggestion that the property be considered for a special use districtJeff Coutu, County Planning Director, advised the Board that Barrus Construction Company has submitteda new petition requesting the property be rezoned heavy industrial special use district He stated the Planning Boardrecommended approval of this rezoningGordan Woodruff Attorney for Barrus, informed the Board his client feels that the special use district zoningrenewable on a yearly basis, will give them the opportunity to show their intent to comply with all regulations He urgedthe Board to approved the new petition313In response to a question from Commissioner John M Booker concerning the environmental concerns ofthe neighbors,Mr Woodruff responded the EPA has very stringent regulations, and Barrus intends to conduct an environmentally safebusiness He noted the necessity of renewing the permit on a yearly basis gives everyone involved an added assuranceof complianceKathryn Wells, who lives near the site, spoke again in opposition to the rezoning She voiced several concernsincluding the possibility of Barrus subleasing the property to another asphalt plant, and the question of how soon alandscape buffer will be in placeMarion Loftin, representing Barrus Construction Company, responded that Barrus does not plan to subleasethe property; however, they would not object to that stipulation being added to the permit Concerning the buffer oftrees, Mr Loftin stated Barrus plans to begin immediately to plant trees in the 20 feet area along the property line onthe Princeton side to shield the view of Community Assistance a CommunityDevelopment Block Grant Application - Economic DevelopmentMichael de Sherbinin, Director of Economic Development, explained that 14 million in CommunityDevelopment Block Grants are available for the State of NC to demonstrate creative housing opportunitiesfor low and moderate income families Johnston County is considering applying for one of the grantsIt was noted a second required public hearing has been scheduled for November 9,1992 at 800 amThere being no further comments, the Chairman closed the public hearing18 Authorization to Apply for Home Investment Partnership ProgramAnne Eason, HAPP Director, and Lula Sanders, Administrator of the Countys Red Hill CDBGproject, requested authorization for the Community Development Program to apply for a 350,000 grant torehabilitate 15 homes for low to very low income families in the CountyMs Sanders explained the community assistance funds would be used in conjunction with the CDBGproject but would rehabilitate single family houses scattered throughout the county The grant money can notbe used for administrative purposes, and Johnston County HAPP is asking the Commissioners to authorizeHAPP to pay the related administrative cost from their administrative reserveFollowing discussion, Commissioner Frank B Holding moved the Board authorize the CommunityDevelopment office to make application for a 350,000 grant under the HOME Investment PartnershipProgram, and further authorized the HAPP agency to pay related administrative expenses if the grant isawardedCommissioner Jerry F Wood seconded the motion which carried by unanimous vote19 Report Framers Home AdministrationBilly Hales gave a brief report on the FmHA activities over the past year He stated the agency loanedmoney for single family and multi - family housing, made guaranteed and insured farm loans, and provided onebusiness loan and an industrial grant in Johnston County during the 1992 fiscal year He asked theCommissioners to direct any needs they recognize in the County to Farmers Home AdministrationThe Board thanked Mr Hales for the report20 Wastewater Reauest I -40 NC 42Bob Hollister and Lew Starling,Attorney, met with the Board concerning Mr Hollisters request forcommercial wastewater at Old Drug Store Mr Starling asked the Board to determine at what point the sewerline becomes public between Clayton and the I40 -42 Industrial Park He also asked who would determine theallowable charge if users are required to pay a tap -on fee to the I4042 Developers who originally paid for thelineCommissioner Frank B Holding pointed out the I -4042 Developers paid for getting sewer to the areawith the agreement that they would be allowed to charge tap -on fees to help recoup their investment Hequestioned whether the line would accommodate enough capacity for the entire areaMr Starling responded that the Town of Clayton has indicated to his client that there is sufficientcapacity for his property319Michael de Sherbinin, Economic Development Director, explained the interceptor line to the pumpstation is located on I -4042 Developers property and is private He stated, as he understands the agreement,in order to tie into the force main line along Hwy 42 back to Clayton, any person would have to obtaincapacity, if available, from the town of Clayton and get permission from the County Commissioners Any tap -on fee would then go back to I -4042 Developers to help recoup their initial investmentLinwood Jones representing I -4042 Developers responded this would be allowed only if Clayton hasmore capacity than needed to serve their commercial park and its projected tenants He stated since they paidfor the entire sewer line, they are asking other users to pay some pro -rata share of the money they expendedBob Hollister told the Board his only objective is to get sewer service to his property and is willing tolook at whatever options might be availableFollowing further discussion, Chairman Norman C Denning asked the County Manager to arrangea meeting with all parties involved, including Tim Broome, Engineer, to attempt to find a solution to thissituation21 Recreation Grants and Budget Amendment ApprovedUpon a motion by Commissioner Frank B Holding, seconded by Commissioner John M Booker andcarried by unanimous vote, the following
